katie phang, lisa rubin, and laura jarrett. katie, from your spot in the courtroom what do you think of stormy daniels? how did she do from actually seeing her live as opposed to reading it cold? >> she did a spectacular job. stormy daniels testimony did not come across as rehearsed. whether you liked her or not because of the sincerity it didn't seem she rehearsed or practiced her testimony. preparing with lawyers is totally different, but she prepared for that, and she did a great job, and i think shoe knew even though i call it a detour -- not a sideshow but a detour. the case took a detour to explore what happens between her and donald trump, because you had to create the foundation why that payment was made by michael cohen and how it got to the level of the business records being falsified, but you needed to have that dialogue, and what's really important is everyone likes to say this is paper case but it is about humanity in some way, people's courage, involvement with others, extra marital affairs, hush money payments.

laura jarrett is nbc's senior legal correspondent. she has been following this one very closely for months now, and it would seem highly likely that the high court finally hands down this decision today. so refresh our memories, walk us through the former president's best arguments and the government's best arguments. his best argument is that the presidency itself, not him, not his case, but the office of the presidency itself, has to have some immunity or it just can't function. you can't have the president looking over your shoulder thinking he's going to get prosecuted for things that he's doing as president. and on the surface of it, that makes a lot of sense. but the federal government's position, jack smith, the special counsel, is saying that may all be well and good, but what he's been accused of here has nothing to do with the office of the presidency. it has to do with him trying to win an election in the government's position by fraud, by lies. and so, because everything he was doing was about trying to win the election, w

let's turn to nbc's senior legal correspondent, laura jarrett, who's with us now.away from opening statements? any surprises? >> the biggest surprise is now they're saying, even if he did pull the trigger, essentially, opening the door to the fact that they know the prosecution has evidence that he did pull it. they have a witness, day may have video, they might have other evidence. they're sort of laying the groundwork for that, with the jury -- >> the defense is. >> the defense is. but for more than two and a half years, he's been swearing up and down that he never pulled the trigger. he gave an interview to abc right after saying he never pulled the trigger. i think there's some credibility issues there. that that's what the prosecution wants to get out of it. >> one of the things the prosecutors said was that the actor should treat the gun, every gun, like it's loaded with a live round. i would assume. how is that going to land with the jury? >> i think for some of the jurors, especially ones who have familiarity with guns, the idea that you don't point a gun a

let's bring in senior legal correspondent, laura jarrett. tell us about this decision. it was one of these kind of hail mary passes that the lawyers made. and this judge ruled for them, and the case is gone for now. >> yeah, savannah. his legal team did not expect to win this. this is the case that posed the greatest legal peril to the former president. even though it wasn't scheduled for trial, they wanted to do anything they could to get it tossed out. the basic reasoning from the judge here is because jack smith was not nominated by the president and confirmed by the senate like any other u.s. attorney across the country, therefore his appointment is invalid. if his appointment is invalid, everything he did has to be thrown out, the entire indictment has to go away. doesn't mean another u.s. attorney couldn't bring the same case. but for now, this case is wiped out. >> and the justice department has the opportunity to appeal or, for example, probably could bring the case through the normal processes, not the special counsel. how might that play out? as a practical ma
