marcus said his verizon phone stopped working. he filed an insurance claim. verizon sent him a replacement plus a box to return the old one. he said he did in this tracking email that reads proof of delivery, tells us that they got it. marcus says verizon sent an alert saying it will charge more than $700 for failing to return that phone that they got. a representative confirmed his old phone was delivered. that representative sent an email guaranteeing there would be no charge on his bill. guess what? the charge still appeared. he protested even with this email here. verizon then said he sent in the wrong phone. we contacted verizon and within two days, credited the money. they apologize for any inconvenience this may have caused in hope to have the opportunity to continue earning marcus his loyalty. marcus is a smart cookie. he insisted on getting things in writing. that is important to do. even if you are on the phone with a company. demand the email their promises and confirmation and stay on the phone until those emails arrived.>> i will hold. still hold

good morning to you, laura and marcus.hat is because law enforcement is still looking for a third suspect in connection with this murder, and they have recently increased the reward. but there are the two suspects who are in custody, who will go on trial in a couple of hours from now. their trial will start at 9:00 in oakland. mitchell and hale have been charged in the murder of kevin nishida. nishida was a retired police officer, having worked for the san jose and hayward police departments. he was guarding a tv news crew when he was shot thanksgiving week of 2021. nishida died in the hospital three days later. mitchell is accused of pulling the trigger, while hale is accused of being an accomplice. nishida's widow is pushing for the recall of alameda district attorney pamela price. she said she feels the men accused of her husband's murder are not being prosecuted aggressively enough. back to the third suspect i mentioned earlier, his name is laron gilbert, still at large. there's a $40,000 reward for information leading

i'm marcus washington. >> i'm kris sanchez. laura garcia is off. our microclimate weather alert team coverage starts right now. here is the reason why. we have crews posted around the bay area covering this wet weather and the impact. mike inouye tracking a big problem spot in the east bay, which rain is no doubt making more complicated. first we go with cinthia pimentel. you are seeing a lot of rain where? >> we've seen it over the last couple hours for that morning commute. now some spots -- i'll zoom it in -- some spots have started to let up a little bit from parts of san francisco into parts of san mateo county, but it's picking up in the east bay and south bay. one place it's not let up all morning is marin county. we have that coastal flood advisory, too, so higher than normal tide mixed in with a lot of rainfall could be a concern for some trouble, especially where areas are prone to flooding. san rafael, mill valley getting in on the action, down through parts of the east bay. your commute over the bay bridge, down through hayward, the dub

. >> i'm marcus washington. we're going to get to mike in just a bit because what's happening in your department is because of what's happening in this department. >> we're going to see more patches of fog drifting around in different areas, so we are seeing this as a result of the high humidity and it's really chilly out there as the temperature comes down to what we call the dew point, and humidity goes to 100% and basically we have a cloud on the ground. we're going to see areas shaded in gray included in that quarter mile visibility or less until about 10:00 this morning. you can see the den fog advisory in effect for the delta and down into the east bay, into fremont as well. it's coming through the tri-valley into the peninsula, as well as the coastline, and then into san jose, to the south county. so basically a lot of our low-lying areas included in that. then we are going to eventually see a change in the weather pattern that will bring in some rain heading into next week. i'll be talking more about tha

i'm marcus washington. >> and i'm kira klapper. we're going to get right to that breaking news out of oakland, where a large police investigation is unfolding near ninth and embarcadero. >> "today in the bay"'s thom jensen is there, just arriving to the scene. talk to us about what you've learned. >> reporter: well, we're still trying to get more information. this is breaking right now. initially we had heard that there were shots fired in this area, that possibly an officer was down. we have not gotten confirmation that an officer was injured. i want to be cautious about saying that. but we did hear that initially. we do know that sometime in the 4:00 hour -- we're basically fifth and embarcadero, somewhere ninth and embarcadero this occurred. we got video from the scene a short time ago that was closer to where this happened. there was a white toyota pickup truck that had bullet holes and windows shattered. it looked like police evidence markings placed around in the street, around what appear to be shell casings. like i said, we
