. >> let's talk about michael cohen.admitted to lying under oath. he's talked about that. he says it's a small thing in a big case but is it necessarily in the eyes of the jury, and we have seen him before. we have seen him on tv. we know he testified in a civil case. what kind of witness is he going to be, and how difficult might he be for the prosecution? >> so, you know, i think it's always complicated when you have a witness who admits to lying. any defense lawyer is going to say, okay, first off, you admit you are a liar, and you're under oath. are you saying you were lying then or you're lying now. prosecutors are well trained of how to prepare witnesses of how to get them ready for the stand and i think michael cohen will be a good witness. the question will be is the jury going to see him as someone who is biassed, someone who has an ax to grind against a former bus or someone who now sees the truth and wants to be honest and forth telling. that's going to be the job of the jury to decisive between the two option

so michael cohen paid her money. michael cohen then later said after events unfolded as they did that donald trump told him to make that payment and that donald trump would pay him back. there was a payment made back to michael cohen after donald trump took office. the interesting thing i find about this upcoming trial, whenever it does get set is the access hood tape isn't going to be admitted into evidence. why is that? >> so interesting. judge merchan is playing it right down the middle. i think it was a wise choice on his part. he ruled it can't come in audio or visually, however they can talk about it on the stand. in trials like this, the ultimate question is probative versus prejudicial. he ruled that type of inflammatory language was more prejudicial than probative, meaning it's overly inflammatory. you can elicit the bare facts of it without actually playing the tape for the jurors would could poison their minds against the defendant unreasonably and not just taking it as sort of face value. i think what's i

"washington post" says merchan told blanche the latest dispute read quote, a pattern where i read certain information, and then i hear your interpretation of that and it's different than mine. far from misconduct involving potential

cohen michael cohen? is it really key in this case, the allegations here are that trunk paid hush money to former adult film star stormy daniels ahead of the 2016 election to stay quiet about their alleged affair. now, sara there's nothing wrong with paying someone to be quiet about a personal relationship with allegation here is that this money was paid help his chances in the 2016 election, and then he is charged with falsifying business records and tried to cover up why he was paying michael cohen back. now, in terms of this new evidence, trump's lawyers argue that it helps their client and they need at least it's 90 days to review it. but the district attorney insists that there's only a small portion of it that's actually relevant to this case. and if it helps anyone, it helps them. so sarah, today, we don't expect this case will be dismissed, but we do expect the judge will give us some clarity on when this trial will go so forward. >> there is also the deadline today for the bond payment of $464 mi

as it pertains to michael cohen, this has to do with the federal investigation into michael cohen and campaign finance violations, campaign finance violations he pleaded guilty to in connection with those hush money payments. what happened is approximately a year ago from january through march of last year, the manhattan d.a.'s office said hey, we have discovery requirements. we have to give donald trump's attorneys a whole slew of documents, including documents, u.s. attorney's office, which you may have that may be helpful to the defense. that's something we have to do. they requested a number of different things. subsequently, donald trump's attorneys in january of this year asked for is and received a subpoena for more information from the u.s. attorney's office. as a result of that subpoena, a ton more documents were handed over, 170,000 plus pages. folks last week had a lot of questions, why is the southern district of new york, the prosecutors why are they handing this over now? the manhattan d.a.'s office said they requested this information. more details in the filing. accord

and let's not forget that michael cohen went to jail, in part for those very payments. so why shouldn't trump, who is listed as individual 1 in the indictment of michael cohen? today, on what was originally scheduled to be the first day of the trial, trump's lawyers failed in their attempts to convince the judge to further delay it or even dismiss it. judge juan marchon was described as uncharacteristically furious as he called out trump's lawyers for accusing the manhattan's d.a. office of prosecutorial misconduct but providing nothing to back up the claim. before making his ruling, he added, quote, it's odd that we're even here and that we've taken this time. trump has said he would be appealing that decision, but the judge appeal or not, he expects to see trump in court next month for trial. and while trump may finally have to face accountability for some of his actions, he is still catching breaks. as today's ruling was under way, a new york appeals court judge handed him a pretty hefty one, reducing the bond for his civil fraud verdict and buying him more time. he

>> michael cohen is a core witness for the prosecution. he's not a witness without his own problems. he has been convicted of federal crimes. that will be lots for the defense to make hay of. he's a lynchpin of their case. stormy daniels are the lynchpins of their case. there is also david packer, the ceo of american media which is the publisher of the national enquirer. they are a big part of this case. it is alleged the national enquirer purchased stories from donald trump's alleged paramours and they had the women sign ndas allegedly so the stories would never see the light of day so donald trump's chances would be optimized. again, there are other witnesses that the prosecution could go to. allen weisselberg is also available and donald trump has not said anything about him. he's likely to be a witness for the defense. there's a lot the prosecution could do with him as well. i don't think this scuttles the prosecution's case entirely, but the prospect of getting rid of michael cohen and stormy daniels is a big, big deal. >> dave, let's
