mr. teague. yeah. thank you. i wanted to touch on that point. exactly which is to me, after hearing everything and considering it, and there seems to be, you know, i think, consensus on a roof deck, but a reduced roof deck to minimize the impact as much as possible, because that takes care of the open space requirement. i see the introduction of a rear stair as a net negative because, again, it's going to reduce that area and it's going to create a very tight space where that ground floor adu that's the sum of the only access it has. and so it creates real challenges that we've seen in other projects where you have open space accessible by multiple units, but it's directly right out the front window or back window of units and bedrooms, etc, so to me, the addition of the stair, obviously if there was an internal stair, it wouldn't trigger a variance if it was an external stair, it would. i don't think i would support the external stair, and i would be, i think i would be comfortable from a variance perspective with, a scenario that you just refe

thank you, mr. teague. as always, i, um, have a very narrow question, which is regarding the, uh, alleged or proposed change of use that occurred several years ago. um, i just want to get your opinion on that. get your, uh, the planning department's position on whether that change of use was, uh, was applied correctly, legally, and all of that, i it it seems that you've endorsed the permit holders brief, which i understand. i just want to hear it specifically. sure. and that's a fair question because i think the appellant raised, you know, slightly different question, which is you know, these lots got valid permits to change the use of vehicle storage. and then they kind of raised the question , were they actually used as vehicle storage or were they used as a different use. um, now that's the part i don't know the answer to that 100, because i don't believe i've looked at that specific question. um, if there was a concern that a any particular property is being used as a use that's not permitted, that's mo

mr. teague thank you. i just wanted to clarify one of the issues that was raised by the project sponsor about the rear yard and the open space, because it is a little nuanced. he's correct that for common open space in a rear yard or a roof deck, if you're going to have a space be used by more than one unit, the minimum dimensions are 15 by 15. and it is true if they put a stair down to that rear yard for the upper unit, both of those units would have access to it and it would be, in practice, common open space, but technically under the code, because that second unit that's being added on the ground floor is a state adu. it's not required to have any open space. and so we have interpreted that in the past where under the planning code, it's not common. open space is still just it has to meet the minimum private dimensions for that upper unit. having said that, and i expressed this at the last hearing, this is a small lot. so small yard. it's a small adu that really, some of its primary access to kind of,

um i know mr. teague is not here, but i did hear from, uh, someone i didn't get to watch it that the board of appeals voted unanimously to continue remote hearings. so i think that's really interesting. and i hope that it, um, it's not a dead letter item with this commission because i think there's still value to it. i mean, i know personally a couple of people, elders like myself, who, uh, can't come and can't figure out how to, uh, to get the doctor's note to, to talk week in, week out from, uh, from the secretary and i think they're an important voice to hear. so the handout that mr. ionin just gave you, uh, is about section 317, democracy, and it's two pages. and it's, um, based on, to me looking at everything for the past ten years, i think the values in year two are make sense. and i think it makes sense because of the constraints reduction ordinance. that's trying to protect the priority equity geographies. and i think there's still issues that could happen there in those neighborhoods where
