convicted murderer scott peterson, appearing virtually in a redwood city courtroom today as part of his bid for a new trial, peterson was convicted 20 years ago for the murders of his pregnant wife, laci, and their unborn son. at issue is how a 15 inch piece of duct tape that was found on laci's pants will be tested, and whether anyone else's dna shows up. the hearing was focused on which lab will handle that dna testing. >> what i'm being asked to evaluate is whether the district attorney has made a reasonable effort to communicate with the laboratory to provide what exists, not what should ideally exist if they had done the job the way you would have preferred, they did. >> now, peterson's attorneys from the los angeles innocence project argue this piece of evidence could contain dna that may point to another suspect. the judge says that she will wait until monday to pick the dna lab in question. well, that duct tape is the only piece of evidence out of 14 items that the judge allowed to be retested, and our legal analyst, michael cardozo, weighed in on that earlier today on the four.
