. >> lisa rubin is a former litigator, known msnbc legal analyst.es colbert prosecuted civil cases on behalf of -- the government. he's now a civil rights defense attorney. they both join me now, free to have you here. first, give me your first read on the central idea of this argument. you have to impeach and convict first argument as it appeared today, which i was not anticipating to be as central as it was. >> it's not the first line argument. the argument that they are making on presidential immunity starts with the overarching he's immune from everything because of the structure of the constitution and separation of powers principles. this was their second line. the impeachment judgment clause of article one of the constitution, which is really intended to be a limit on the senate, and essentially what it says is if you impeach and convict someone, the penalties you can impose on them are disqualification from holding office and removal from office and nothing further. but nevertheless, nothing should prevent that person from also being liable

joining us now, msnbc legal analyst lisa rubin. you were in the courtroom.what happened exactly this morning? >> reporter: so jose, there was a pause of about 20 to 30 minutes this morning after the schedule's start time of the trial, which is 9:30. when the judge took the stand, we learned why. there are two reasons, one, the jurors sitting in seat 3 of 9 reported feeling ill on his way to court this morning. he said he was nauseous and hot, and to take precautions he was advised to stay home and take a covid test. that's when the judge also learned that alina habba, the former president's lawyer also was not feeling well and on top of that had had a covid exposure of her own. she had dinner approximately three days ago with her parents who have tested positive since. obviously she also spent time with her co-counsel, michael ma day owe. on learning all of those things, although robbie kaplan did want to go forward, and they can go forward. you only need a jury of six in a civil trial. they have nine jurors. despite that, judge kaplan thought the better thi
