shawn chitnis is live at guerneville where it is flooding. we know that the river overflows every year. what the are residents dealing with this morning? >> reporter: they certainly know first hand what it is like to deal with that and have been telling us about that. i will step out of the way so you can get a sense of what they are dealing with in this neighborhood. as we made our way up from 101 to get from guerneville we saw decent conditions. not much ponding. now into town we see the impact of the flooding that's affected the folks who live here, some who are in trailers in the area trying to get out and take whatever belongings they have and reach the red cross and seek shelter there for now as they wait to see how much this can potentially recede in the hours ahead. we want to show you some of the conditions we have been able to capture around guerneville with other residents dealing with this. we know that the water in this location as well as others is getting up to the knees of those who live here and also up to the tires of cars l

we are hoping to get an update and them later in the morning. >>> all right, shawn chitnis, thank you. time now for a look at this morning's other top stories. the man accused of killing tech executive bob lee is due back in court today for an important hearing. lawyers for nima momeni want to have his trial moved out of the san francisco. they told the judge the jury pool has been tainted by published photographs of nima momeni inside the jail cell. momeni is charged with the murder in the stabbing death of cash app founder bob lee last april. the trial will start mid-march and he has pleaded not guilty. >>> a new speed bump for robo taxis. san francisco is suing the california public utilities commission for granting both cruise and waymo permits to expand service. the lawsuit is asking the cpuc to reconsider its decision and whether it was compliant with the law. this legal action will not impact cruise as the dmv already pulled the company's permits last year after one of its cars hit a pedestrian. however, it could have a major impact on waymo. which is still operating for profit

reed, back to you. >> shawn chitnis thank you so much. of this loss that has meant the officers hurt by the killing of one of their own still had to get up and do their jobs every day and late into the night. to that end, we can tell you they have made four arrests some connected to t shooting and some connected to the burglary that brought officer le to the scene in the first place. so three caught and cuffed in alameda county. here they are from left to right. allen star brown, charged with murder and other felonies also. mark sanders, the man police say fired the fatal bullets right there in the middle and sebron russell charged in the burglary portion of the marijuana dispensary burglary. our news team is also learned this morning of a fourth arrest down in southern california. that one is connected to the robbery. so we know officer le helped represent a voice between police and his community. and so because of that, we want to mike his services available to you at home. to everybody. officer le's services start at 10:00 a.m. and we

shawn chitnis has more on the upcoming vigil and the latest on the murder case. he joins us now, good morning, shawn. >> reporter: gianna, good morning. and that is right. there will be a vigil for the officer later this morning. it is being organized by a group of organizations in chinatown including the oakland chinatown chamber foundation. and that vigil will of course remember officer tuan le. he is the 54th opd officer killed in the line of duty. it happened week ago today. this happened hours after he had been shot after responding to burglaries t a marijuana business. his family and dozens of others were in court yesterday. markageers accused of firing the shots that killed the officer. he was silent during the brief court aexperience and so was allen brown and sebron russell accused of participating in the burglaries. sanders the main suspect has a prior manslaughter conviction and he and russell have been in trouble together before. both were charged in a 2021 burglary in contra costa county. sanders was convicted. and we also want to point out the east

and shawn chitnis is live this morning where services to pay tribute to a man who was really a bridgegin a little later this morning. shawn? >> reporter: reed, good morning. and that's right. we know that the family had the chance to privately remember him and for more than a week now, this whole community has tried to say good-bye. this might be that final opportunity with that public memorial set to begin later this morning. now this of course all started late last year at the end of the month when officer tuan le was working undercover. he was responding to a burglary at a cannabis business. that's when he was shot and then later died from those injuries. he's being remembered though as a devoted husband who cared deeply about his community. someone with a big smile who was known for his kindness and the positive change he brought to others around him. born in vietnam he moved to oakland in 2001. he graduated from the police academy in 2020. but before that, officer le was a member of a program for young people based in oakland chinatown called the asian youth services committee. a

shawn chitnis is live near the scene. this was last night in the news cycle a little bit after 7:00. what's the update? >> reporter: good morning. we are at the airport. we can see one of the coastguard helicopters that may have been part of this search. we understand it did start around 7:00 in the evening when they were first getting the calls and trying to figure out what was happening here. this was because someone spotted a two engine plane two miles from the airport. we can see in the video that there was a search team looking for the plane in the water with challenging conditions because of tides and it was dark at the hour. they did locate the plane about an hour in but were trying to find anyone on board. emergency response teams were on site on the ground to assist nihar they could. the initial call said a small two propeller plane flying erratically and those reporting said they thought they heard the engine sputter out before losing sight of the plane. we still don't know who was on the plane and how many peop

shawn chitnis is at the montgomery station talking with writers about the changes. >> b.a.r.t. started testing this late last year in west oakland. take a look over here and you can see with the classic look is. this is what you have seen a most b.a.r.t. stations for quite some time. the new gate will be more than 7 feet tall. ink about the fact that i am 6 feet tall. that is another foot above me. it is how they hope to have the people not jump over. take a look at a map that shows you all of the different locations that will be receiving gates in the months ahead. that includes stations in richmond, antioch, sfo and oakland's fruitvale station. here in the city, there four stops including montgomery, powell, civic center . b.a.r.t. says this won't be able to stop all variations but the new gates will stop most of it. the difference will be a drop in maintenance cost for the agency while keeping stations cleaner and increasing revenue. riders have shared that they have seen people sneak through the gates many times, getting very close to the point of it being uncomfortable so

shawn chitnis has the latest. >> reporter: we are near ross' cove in san mateo county which is the closestart where search and rescue teams were able to recover part of the wreckage from last night's crash. the search for survivors continued at 5:00 a.m. but had to be called off at 10:00 because of rising tides. search and rescue teams stopped looking for survivors last night around midnight. conditions were considered too dangerous. we know calls came in about the crash around 7:00 sunday night. plane was spotted about an hour later, and we know that the plane was seen upside down in the water. this morning the search and rescue teams working on the ground were able to bring some of the debris before stopping their search on foot late in the morning. the water helped push part of the wreckage closer to shore and initial call said a small two propeller plane was flying erratically sunday night, those calling into 911 said they thought they heard the engine sputter before losing sight of the plane. as of this morning, this is still considered active search and rescue but we have few details

jessica burch is tracking the rain of the first let's go to shawn chitnis in guerneville where people in sycamore court are dealing with knee deep water. >> reporter: clean up began this morning as folks were trying to figure out how much damage they were facing in this neighborhood in guerneville. behind phaze there is still plenty water that's surrounded homes, cars, other belongings that make up the neighborhood. the water coming up to folks at their knees as they were walking from one place to the other trying to find whatever belongings they could salvage, what didn't get damaged from the flooding. even a refrigerator floating by. we know that the water came to at least the tire line of some cars, higher in other places. we spoke to some families that knew their home flooded and that's why they were trying to take whatever they could before they were seeking shelter. others left last night as sheriffs office and fire department were knocking asking people to evacuate and coming back this morning to see the damage, worried their homes may have been lost only to learn that just bar

shawn chitnis has the latest. >> reporter: it is the start of the work week for many people and things are looking normal here at the orinda bart station with a full parking lot just a day after that derailment. we are only a half-mile away from where that happened. crews had to work overnight to make sure they could offer normal service on the yellow line. having those trains running just before 5:00 a.m. but the investigation continues into what exactly happened. we did get a new update from b.a.r.t. this morning and have a better understanding of what they were dealing with yesterday. they tell us that the second car in an eight car train came off the track at a section of rails where trains can move from one track to another. usually, the operations control center can move those tracks remotely but was not able to do that yesterday. while that can happen, it is one of the investigation . the focus will be on the derailment itself. passengers yesterday said that the train came to an abrupt stop, they heard pops and then saw smoke and flames shooting up from the train. today, we chec

shawn chitnis is live near the scene at the half moon bay airport. shawn, good morning. what are you seeing? >> reporter: nicole, good morning. it is the hope with the sun up in the daylight , to help crews they may be able to make some more progress in trying to find out if there was anyone on board and how they may be able to locate those folks with the sun coming up. this helicopter behind me as part of the u.s. coast card and it has been here most of the morning. let's look at the scene last night when these calls were coming in, just after 7:00 p.m. that is when we know that soon after someone spotted this two engine plane, two miles away from where we are in half moon bay airport. a search team was looking for the plane in the water last night with challenging conditions because of the tides and it was dark at night. located the plane about an hour into the search but they are trying to find if anyone was on board -- anyone who was on board. emergency response teams are on site to assist in the search from the ground. according to the san mateo sheriff's office the

shawn chitnis joins us from montgomery, one of the stations about to get the newgate. >> reporter: b.a.r.t. is ready to expand the newgate's too many more locations. they started testing it last year in oakland. you will see what the classic look is and this is what you have seen at most stations for quite some time. the newgate will be more than 7 feet tall. if you think about the fact that i am 6 feet tall, that is another quote above me. it is one way they hope to try to prevent more people from being able to jump over and skip paying the fair. take a look at this map that shows you the different locations. that includes stations in richmond, antioch, sfo and oakland . here in the city, there four stops including montgomery, powell, civic center the 24th street station. b.a.r.t. says it will be able to stop all evasions but the new gates will help to stop most of it. the difference will be a drop in maintenance costs for the agency will keeping stations cleaner and increasing revenue. riders have shared that they have seen people sneak through the gates many times, getting very close to

and our shawn chitnis is live from sfo this morning with details on the improvement project. and good morning to you shawn, what's the latest? >> reporter: hey nicole, good morning. we're here inside terminal 3 not used to seeing it so empty and usually when we're here that's because it is so busy. but as you mentioned we're already seeing some cancellations and delays. and based on what is happening and what will be occurring over next several months, that may be more and more typical. the goal of this project is to improve how planes exit the runway and this should also help them when they're landing. making it easier and safer. but it is going to affect how you fly out of this airport for the next few months, the prowreck is going to realign two taxiways. crews will have to reconstruct two taxiways so they don't intersect and they will improve the safety of this as well as bring the runways to the latest standards. but from now through april sfoanticipates that one-third of its flights will be delayed 30 to 60 minutes. for may and june is still being calculated. so here's

shawn chitnis is the latest on the repairs. as we try to get him, we will check back in with him.let's move on. >>> we are back to normal in this part of downtown san francisco. traffic is able to move in all directions. crews were able to open up the intersection after having to work on that sinkhole last night. folks in the area were not aware there were issues coming out the door this morning. take a look at the video we have . you can see water spewing out from the first pipe. the fire department first learned about the sinkhole just before 7:00 on tuesday evening. so far we don't know if the break caused the sinkhole or was the result of it. the intersection was closed while crews patched it up and a cable car was hit behind it. one man on a motorcycle, fell off his bike because of the sinkhole . he had minor injuries and was treated at a hospital and released an hour later. the fire department said this is an important reminder for people to slow down in the rain. they say people often turn to quickly and especially in heavier rains we see more pedestrians getting injured. >

shawn chitnis has the latest on the supervisors vote from san francisco. >> reporter: the cease-fireesolution was with the rules committee yesterday and there were three members from the board of supervisors that make up the committee. they decided to move it forward to the full board of supervisors today but we got a preview of the debate and discussion we will likely see later in the day. yesterday at city hall, there were some members who wanted to show that emotion and passion that comes with this issue as a group of local healthcare workers staged a 'die-in' and they say they want to highlight the medical workers killed and medical infrastructure destroyed in gaza, by israel's military. according to the world health organization, there have been nearly 600 attacks on healthcare facilities in gaza and the west bank since october 7th . public comment lasted for a half hours including one woman who said that more than 100 members of her family have been killed in gaza. >> we are witnessing atrocities we have never seen before , live streamed on social media. is a doctor i'm here to

shawn chitnis is live in orinda this morning to talk about the incident and the response from passengers. are you seeing a lot of people out? >> reporter: in the 9:00 a.m. our we are truly seeing what feels like a normal start to the day with a full parking lot and that is part of the experience people want as they return to work from the holiday. we know they were busy working over the night to make sure they could have the normal service of the yellow line before 5:00 a.m. those arriving today should not have to notice anything even though we are only half a mile away from where the derailment happened. as for the investigation, it continues this morning, a day after all this happened. no clear understanding of what happened yet but we have more information this morning, knowing this was the second car of an eight car train that came off the tracks in a section of the rail where trains can move from one truck to the other. the operations control center can usually move the tracks remotely but was not able to do so yesterday and while that is not unusual it is part of the investigation.

our shawn chitnis was there. >> it was an incredible show of support for officer tuan le here at 3 crosses church in castro valley. one final chance to say goodbye to a loved one, community member and fellow officer. the morning began with a procession that started in oakland and then made its way here to castro valley. we were able to watch as members of law enforcement and much of the oakland police department made their way off the freeway and into the church parking lot. opd officers got information, waiting for one of their own, standing silent in the cold as the rain poured on them for more than an hour. inside a memorial service that brought together leaders from around northern california, including attorney general rob bonta, spoke with -- oakland mayor sheng thao and others in the bay area. we heard from his family during the service this morning. >> i will miss him coming to the door at family gatherings i miss him at the table. i miss his warmth and cheerfulness. rest easy. we will always love you. >> officer le graduated from the police academy in 2020, serving as a police off

our shawn chitnis is live in orinda with more on the incident and the response from passengers.g. i'm sure it was a very scary situation for people on b.a.r.t.. >> reporter: gianna, good morning. certainly the details paint a picture that was very scary for the passengers and now this morning, as we're waiting for folks to arrive here at the orinda b.a.r.t. station, we're sure that's still a concern that they have this morning. but the good news coming just about an hour ago before the commute begins that they are able to have normal service for that stretch here. now this is just about a mile away from where that derailment happened about half a mile and the cause is still under investigation. but b.a.r.t. says operations control center is usually able to move those tracks remotely and yesterday they were not able to do so. so take a look at the aftermath of the antioch bound b.a.r.t. train derails on new year's day. passengers say the train came to an abrupt stop, they heard pops and then saw smoke and flames shooting up from the train, forcing them to scramble to safety. >> w
