overstepped his authority when he unilaterally declared the senate was in recess and appointed three members to the national labor relations board. libby casey, good afternoon. why is this case so important? >> we'll watch for the decision made by the supreme court late july when they round out their term and at the heart of this case is whether or not a president in this case, president obama can make appointments when the congress is out of town. the white house says if the congress is gone the president can move forward and not only nominate people to serve on boards to serve as judges but also can go ahead and install them. senate republicans have a very different interpretation. they say if the senate's out of town doesn't necessarily mean it's on an official recess. recesses technically only happen twice a year, in between sessions. senate republicans are pushing back and saying those

appointments were out of bounds. after oral arguments, one of the senators mike lee of utah a lawyer by training addressed reporters in front of the supreme court. he says the days of horse and buggy are gone. it's no longer necessary for the president to make appointments so quickly. >> it has been altered to some degree by virtue of the modern reality, that the senate can be brought back into session at really a moment's notice within 48 hours or so it can be brought back in. but again it's -- a lot of it is a procedural question. it relates to whether or not the senate has acknowledged that it is not in session. >> the republicans say it's up to them to declare that they are not in session. a very different argument stephanie saying 14 presidents have made necessary appointments

over the years. this is part of what the president needs to do when the senate is out of town. >> is the balance of power really what is at stake here? >> absolutely is a question of where the authority lies. in the executive branch in the white house or in the legislative branch in the senate. and the solicitor general argued today that a key component of the white house's ability, the president's ability to put into office who he deems appropriate, is being able to use these recess breaks as a time to put folks in. it comes down to politics though stephanie because senate republicans have been accused of obstructionism, of block even basic nominees that the president has put forth. that's why the white house has said it needs this able to go ahead and act even if the senate won't comply. on the other hand republicans the key group here in the senate say that it's up to the senate to decide if they're in session or not and that they don't want the president extending his power when they are not in town.

but of course the senate is the one that sets the schedule, stephanie. they go into a pro forma session, the fact is do they actually need to be here in person or about a technicality. >> it is a fascinating case, libby casey, thanks. residents in some parts of west virginia can open their taps again. the state is liftings water restrictions for designated areas, thursday's chemical spill left 300,000 people without tap water. governor earl tomblin made the announcement after the contamination levels had fallen. >> the do not use order has been lifted in some areas. >> jonathan has the word from

the area. >> use their tap water zone by zone, they really don't want the system to be overrun so they're notifying customers when they can use their water again. now we do know the process involves them flushing out their pipes for about 20 minutes. the governor told us today the government has been testing over 200 samples and they now pleat federal standards. the company responsible for the chemical spill, freedom industries, investigators want to know how it land from the storage containers and wanted to know mowg it took to notify the authorities. >> jonathan martin, reporting from west virginia. the moral monday protestless are spreading to georgia. the demonstrations are in response to what some call extreme right wing demonstrators are scheduled to gather during these pñññññ?ç
