1:38 pm
oh, is this race is absolutely close. for the first time in the history of the election, there are new voting processes in place, that will increase voter turnout. >> talk about this, liz. >> meaning -- yes, yeah. >> talk about it, the number of ways colorado is making it really easy for people to vote this time around. >> right. absolutely. it is the opposite of what is happening in other states are people are making it harder to vote, in colorado it is easier to vote this year, every registered voter was mailed an absentee ballot, three weeks ago. dew next tuesday, there is early in person voting locations, there are
1:39 pm
election day in person voting locations. and, there is same day registration, which means just because you aren't registered to vote today doesn't mean you won't be able to show up next tuesday and register to vote. yo will see an increase that is going to be astronomical. and normally, higher turnout favors democrats. so i actually think these new laws in the end will -- >> but, liz, is the base out there energized. >> oh, yes. absolutely. because actually, a bill excuse me a ballot measure that represent i gardner has sponsored three times now, it is back on the ballot, it is losing again, and it is absolutely motivated one, particularly, unmarried younger women, those exact same voters who tend to sit out midterm

elections, in fact, a lot of people think the personhood bill in 2010, saved upon bennett from the crazy roe lewis of 2010. and that again, is because it is driving out those younger women, who tend to stay home in midterms but who vote democrat when they show up. getting some traction there, what about jobs. what about healthcare. >> that's a really interesting question, in all honesty, at this point, with a week to go, i think this is about the only u.s. senate race ha is really focused on this these issues of women's help. is it about election case funding or perhaps is it about the foreign policy issues.

very extremist record on birth control,s specially now that he is is coming out and saying no, i am for birth control, well, no he has a ten year record in the house about making it easier to have birth control. this is being driven by the person with the ballot measure, which is on the ballot and is going to go down. >> colorado has a large latino voter base. how is it playing out in this election cycle? they have not moved forward with more comprehensive action on immigration. >> i think it hurts all democrats chancens that the president wasn't able to move that legislation. i think it is going to be very difficult, the the democratic nominee to move forward because we haven't been able to get
1:42 pm
any type of reasonable immigration reform passed. i think it is going to be one of the biggest issues but i think it is hurting democrats this year as the latino population looks at all of the candidates and says you all keep promising this. >> promising. >> and keep not delivering. >> and nothing. >> exactly. >> terrific. >> and nothing. >> joining us from washington, thank you. >> you know the choices that voters make next tuesday will have a huge impact on federal courts the party that controls the senate has enormous power, and sway over judicial nominations. and as grid lock has intensified so has the long jam in the federal court system. more on this story. >> tony, first, the good news, they have made some brock, in finally filling vacancies on the court of appeal, but delays continue in the work

force of the federal judiciary system. the trial courts where most cases begin. >> judge john jones was nominated to the district court in february 2002. he was confirmed six months later. we were up 300 cases per judge. >> in texas, retired federal judge who was confirmed in four months and 1994, never expected it would take years to appoint his replacement. >> i think we have two senators the one president, and they don't necessarily see eye to eye on these matters.
1:44 pm
over supreme court nominations hike this one for nominee alana. i don't think what that label means. >> but nomination fights did not always extend junk jones says times have changed. >> in my experience, this were very few controversial district court nominees. i think the -- i can't give you an average time for confirmations but i don't think that there was anything that compared to what it became after that. and then a vote of the full senate. at every step, a delay can be real confirmation. >> historically,
1:45 pm
appointments have not been particularly fought. >> is there a watershed year when you notice the uptick in federal trial court vacancy interests. >> usually the first year that a president takes off, there's a uptick in vacancies and that happened in 2009, when president obama took off, just as it happened for president bush what was so unusual, is that number didn't go down for five years that number actually increased and stays above 60 vacancies. >> last year, senate majority leader initiated the so called nuclear option, allowing a simple majority of 21 instead of 60 to confirm appointees. excluding supreme court nominees. #u republican senator denounced the move. >> the domic control
1:46 pm
senate confirmed more judges but there is still more than 60 court vacancies, 60% of them in states with two domic senators 32% in states where there's a democrat and a republican, and 43% in states where there are two republicans senators. >> unfortunately, we have seen politics come ahead of the interest of the courts in those statements. are lost in the a government every year, because they lack in the court system, resolution doesn't come and people just sort of sit there, and spinning their wheels. ultimately they impact everyone waiting for their cases.
1:47 pm
>> we shouldn't have these many vacancies. these are allocated funding full boat district judgeships. and they out to be filled. and the appellate seats out to be filled and i think we need to take a step back, and look at it's effect on real people who want access to the courts. >> judge ferguson and jones agree, both parties must find a way to make the judiciary work. toni. >> randall, how is this backlog effects the work that the judges are actually do. >> well, the judges say that everything is taking a lot more time, for example judge jones said the motion that may be handled is taking up to a year.
