and the foreign secretary have raised them waythe egyptian government. upholding the human rights contained within the constitution, is essential to building a still prosperous and domic egypt. joins us live now, what are you watching for in terms of the way a second trial might be managed? >> to be very clear the legal basis of this case is very weak. i think it is nonexistence. and in a normal context it would be thrown out for lack of legal evidence. the political dimension as well as very strong and i think what they are looking at in the retrial is the political side of this the dynamics the political dynamics domestically or regionally, were really

effect the outcome of the retrial. so this is to be very clear. >> omar, a difficult question to answer, but do you think we could be looking at a swift retrial, or are we looking at potentially protracted legal proceeding here. >> again based on the political more or less dynamics we can see a prolonged one, if we have a political stand still or if we have a very swift one if the there is a release in the political stalemate. i think part of the problem as well as of course it's about -- it's a crisis of the freedom of speech in egypt as a whole. and that crisis is -- if you are an independent journalist, if you are reporting on what's actually happening on the ground, if you are reporting the realities the social, political

realities and those realities defy the narrative of the status quo, defy the narrative of the regime, then you can be subjected to what mohamed and peter have been going through. >> yes. >> and this applied to them, and applied to many other. >> that's right, because we have been talking about a potential resolution in this case. but we must not forget the plight of the hundreds of thousands of other egyptians who have been imprisoned on political charges omar, who hope is there for them. >> it's very difficult at the moment. the pal lance of power is on the side of the regime. there seems to be more events and developments that happened that would put anyone who would do this on the international criminal court list.

a date has not been set and it is not clear how long a retrial will take. mourners have layed flowers at the site where 36 people were killed in a spam pead. chinese police say they are still investigating what caused the crowd to panic. north korea's leader is proposing high level talks with the south. he made the offer during his traditional new years speech, but he also said they couldn't take place while south korea carries out military drills with the u.s. a court hasrd oared a retrial for three al jazeera staff. here is a reminder of that case. the three journalist were arrested on december 29th. after a trial, they were sentenced to june, peter and mohamed to seven years, baha was given ten years. in october authorities in cairo announce add judicial review with a hearing of the case on january 1st.
