is need for international investigators. >> thank you for joining us on al jazeera. we just heard the views of many that the only way to properly investigate these sorts of crimes and issues is through the icc. do you think its inevitable now that the palestinians will at least try to take this to the icc? >> you well, it's not clear that the palestinians will go to the icc regarding last year's attack on gaza. they're moving forward on the file of israeli settlements there. but i do agree that international mechanisms to hold israel accountable are really the only avenues of justice for palestinians to seek. it's clear that israel will not hold itself accountable for war

crimes committed against the palestinian people. >> in that interview they did say they were trying to present two files. one on the settlement and one on war crimes in gaza. you're speaking to us from the u.s. we know that the u.s. does not want the palestinians to take israel to the icc and that also certainly congress would reflect that aid could be withheld from the palestinians if they do go ahead and try to do that. that is the current u.s. laws to punish the palestinians if they present a case to the icc. but there are other mechanisms as well in addition to the icc. one is this commission of inquiry, which is going to be submitted to the human rights council and look at israel's activities and actions in gaza last summer. that's another avenue to pursue.

the problem with the obama administration is that it has wrongly cued to this viewpoint that israel is capable of examine and adjudicating its actions and holding itself accountable on its own. that's not been won out by the facts of the egregious case and unwillingness of israel to look seriously into the allegations that a war crime was committed here by the deliberate targeting of these children, who were playing soccer on the beach for three hours before they were killed. >> israel disputes that they say that the children were killed, that it was an accident. they were targeting a hamas compound next or near to where the children were playing. going back to the prospects of the palestinians going to the icc, do you think that would act as a deterrent to israel? >> it may serve as a deterrent

to future israeli aggression, but the reality is that israel is talking about the inevitability of another war against palestinians in the gaza strip, and with each ensuing war against palestinians in the gaza strip the intensity only progresses. so while it may theoretically serve as a deterrent from the testimony that's come out from israeli troops who participated in the attack last year, it was very clear that there was no distinction made by israeli soldiers between civilian and military targets. and that the intensification of the attacks on the people of gaza may only increase in the future despite palestinian ability to going to the icc now. >> josh rubn ener, thank you. >> the u.s. president has been
