>> reporter: well, today word spread fast among those protesters that this drill would be leaving the port this morning. they arrived very early 4:00, 5:00 this morning, they tried to stop this polar pioneer from leaving the port. they were all detaind and detained and find. he sent a letter to president obama and state and city officials and asked there be an investigation and halting to this effort. i can tell you that these protesters told me that they were aware all along that this probably wouldn't be successful but hopefully to send a message to society about our reliance on oil and environmental issues in alaska. all around feel profound sense

of sadness. >> it's really sad. i mean i was in tears out there. it just, you know, there's a mixed feeling. it's like you know we're in these little kayaks, obviously we're not going to stop this hue humongous rig with four tug boats. but i couldn't stand by. >> here's some next steps. part of an investigation where they are staying a look if there were any permit violations of this drill being docked here in seattle. there's also another drill that is also being docked in everett. and many of those protestors are headed in that direction in an effort to stop that rig from leaving. shell sent us a message at a overall they are happy with what happened. they have never seen so many protesters out they appreciate the right for them to be out here and protest at this time.

now that investigation on those permit violations we won't know more about that until the end of july but at this time that drill is headed along the puget sound up to alaska. >> you mentioned the reaction from shell they want it both ways, it seems on one hand, show some respect for the protesters but the oil rig is headed towards where it's supposed to go. >> reporter: i'm sorry i did not hear you. but i think your question really spoke to some of the questions to shell about this oil rig and some of the things that they will be doing in alaska. we do know that just over the last few days they received two very important permits one that would allow them to safely drain some of the material there in alaska. and so right now they are focused their efforts on making sure that they have all of the rest of the permits in place to begin their efforts there. >> tanya mowsly reporting live

sudan's president was able to leave the country. omar al bashir is wanted at the time international criminal court for alleged crimes against humanity in darfur. be bashir was told he would get immunity for attending this conference. so is this a battle between the high escort and the government? >> reporter: well, it certainly is the case regarding his immunity, based on an agreement between the south african government and the african union around immunity for heads of state. linked to its approach to the international criminal court. now he it has left south africa in a very difficult position in that it didn't respect the order set out by the high court. bashir was still able to leave the country and has seven days to respond to questions around that and ultimately this will lead to further questions around

how south africa government respect the courts in the country and what kind of precedent has been set so far. >> does it also set a precedent in terms of how the powers of the international criminal court or perhaps the lack of its powers? >> reporter: well we have known for some time the sentiments of the african countries to the icc. how it has dealt with allegations of crime that african countries have been focused on unjustly. they would rather set up a court to deal with those allegation themselves. they say the icc has no value and ultimately we are looking at some sort of resolution from the african union and looking for consensus from its members to do that. >> romina what has been the

south african government's reaction to bashir's departure? >> it's been interesting it took them most of the day to come out and officially confirm that bashir had indeed left the country. and this was after several hours that heafter a report that he had left via an air base. prior to the summit al bashir would be in the country and he was immune from prosecution as well as arrest. so the south african government defending itself saying all is in order. however al bashir being in the country does lead one to the question why that was allowed if south africa was confident of
