u.s. government says more than eighteen hundred migrants children have been released from immigration detention centers and more than fourteen hundred of them have been reunited with their parents in unspent comes just hours ahead of a court ordered deadline has more from mcallen texas. the u.s. government has indicated it will not meet the court imposed deadline to return all children that had been separated from their parents at the border some seven hundred children have been in eligible for reunification and according to government attorneys they fall into groups or parents have red flags in their criminal history or work discharged into the interior of the country and then lost track of by the government or the most concerning and predominant group more than four. one hundred cases of parents being deported from the country while leaving

their child behind the government claims that no one has been deported without the opportunity to ask to bring their child with them but that assertion is being fiercely contested by immigration attorneys who cite clients after client that claim they were removed from the country under protest knowing they were being forced to leave their children behind going forward there will be a status hearing on friday where the government will work with the american civil liberties union to come up with a plan of how to reach these four hundred some parents who have been deported asked them if they want their children back and develop a new plan and how to reunify them live roscoe's a former deputy assistant attorney general in charge of immigration at the u.s. department of justice and he's joining us now on skype from washington d.c. we appreciate your time so i want to ask you first of all if i may about the over seven hundred kids that have not yet been returned because their parents have been

deemed unfit by the immigration service now in many countries dealing a parent on food is a long drawn out process that involves psychiatric testing on social workers are you surprised by the speed at which the immigration service has made the deliberation. absolutely i mean the only basis that they used to say that the parent is unfit is that they were committed if they were convicted of a crime and. i mean there's plenty of parents who were convicted of crimes we don't lose custody over their children and it just goes to the nature of the crime and you know whether the person's been rehabilitated or not but what the government is trying to say as a proxy is we don't have the tying to do all of that we're not going to reunite the ball parents and children where irene has been convicted of a crime we will keep the parent or keep the child in the custody of health and human services and try to find a different guardian for that what is the legal status of those kids who are kept with them with social services pending being found

a legal guardian so those children do not have any illegal immigration status but they're not permitted to be deported unless and until their removal hearing is conduct that but children have special rights where they can apply for something called special immigrant juveniles which is if they've been a band of abuse or neglect that by their parent they can actually painted a lawful permanent resident status in the united states and so oddly enough if the government creates those that you agent or the government itself the parent who abandon abuse or neglect of the. child may end up being able to get a lawful permanent resident green card in the united states even though the parent one of the board in the u.s. government has been working very hard in order to try to get beat this deadline or and get as many kids as possible reunited with their their parents ahead of that is there any substance to the suggestion that it is using this argument of unfit

parents to perhaps cover up for the fact that it has simply lost track of some of those parents and can't find them i mean here is the point. three months ago this had never been done in the history of the united states separation of the parents of the children and so there were not statistical recordkeeping database. there were not technological. wristbands for any of that nothing exists but what had to happen is the government had to recreate everything by end and try to figure out who was separated where people went and when some course it is inevitable that there will be parents and children who will never be reunited again and that is the prize how much of this is done not so much to the trumpet ministration although it obviously carries responsibility for putting the process into place but also the frankly the beautiful clunking us of immigration service the border patrols and the social workers i'm trying to bring all of those services together and that would
