both. parties in the case made their arguments in terms of what sentence should have been handed down the lawyers for michael cohen argued that he deserved no jail time because he had offered information against the most powerful person in the country of course the president of the united states donald trump and faced threats and intimidation not knowing if the special counsel's investigation would even proceed or go forward he had agreed to cooperate under all of that the special counsel had representatives here who argued that he had provided credible information about core issues in their investigation into russian interference into the two thousand and sixteen election but they also said that this is a serious crime and that a message needed to be sent especially considering the national importance around the crimes that had been committed so the judge in the and decided to give

are a couple of the implications one could be political the other could be legal in terms of the political implications certainly the president has tried to distance himself from michael cohen but the problem is that these court documents in the admission of michael cohen is in fact that he did pay this money to these two women that the president is less shy of affair had affairs with the so-called hush money and michael cohen has said that it was donald trump that directed him to do so so that is certainly problematic the the other issue that's problematic in all of this is the fact that in the statements provided in court the attorney for the special prosecutor robert muller who's conducting the probe into whether or not there was collusion between the trunk campaign and russia in twenty sixteen he says that michael cohen provided credible valuable information regarding links between donald trump's campaign and a foreign government presumably

a russian government so this could be a problem for the president because michael cohen is not going to be going to to serve his prison sentence until march sixth that means that he's sitting at home potentially stewing about the outcome of this case and could continue to be a bounty of information for the special prosecutor because it was also said in court that in fact michael cohen had been at times selective in his cooperation so he's already admitted he lied to congress about the extent of discussions during the campaign with regard to whether or not there would be a trump tower moscow being built now the question is whether or not there was collusion this is something that in fact the special prosecutor will be zeroing in on and now it appears he does have a cooperative witness michael cohen in terms of his effort to prosecute that case and now president trump as far as we know has not reacted to yet although this just happened within the last hour but given what he said about michael coen in the

posties probably not going to be shy about what he thinks about all this. yeah i'm looking at my twitter feed right now so far nothing coming from the president that's usually how we hear from him first but you're right donald trump certainly disparaged michael cohen when many of these court documents the recommendations for the sentencing guidelines were put forward in made public although heavily redacted last friday don't trouble the time over twitter said that the court filings totally cleared the president thank you but that's not how many people read those court documents sarah sanders the press secretary late last week also saying that nothing new with the court filings that has sort of surfaced with regard to michael cohen he repeatedly lied he's no hero but you have to remember in all of this that michael cohen still working with the special counsel robert muller we also have michael flynn the former national security adviser also working with the special

prosecutor we know from these court filings he has met with them nineteen times what does this mean this means that we are continuing to await robert mueller report it will be presented to the justice department we know that he is poised to deliver the key findings but now maybe by a little bit more time in order to do so but at the same time what this means is that with these revelations with these disclosures from these two people from donald trump's inner circle this presents not only a political problem for donald trump especially as we have the democrats taking over the house of representatives in january but also potentially a legal problem as well all right for the moment kimberly how could life force there in washington thanks can be a cliff stein is a professor of law at the university of pennsylvania law school she joins us now from philadelphia thanks very much for being with us so your reaction first of all to the sentence that was handed down to michael clones three years that's not as high as prosecutors want to. well that's right in

fact the federal sentencing guidelines gave the range of fifty one to sixty three months so he could have had a higher sentence prosecutors were asking more in the range of forty one months and he got thirty six months instead of plus two months for the crime of lying to congress which was unsworn testimony and so not perjury but nevertheless a significant crime now the two months that he got for lying to congress he will serve concurrently with the thirty six months so it won't add any extra prison time for him and that really reflects the fact that muller was willing to sign off based on his cooperation with muller in the russia probe to a concurrent sentence now from the moment that these stories first came out about

michael cohen in the legal trouble that he was facing of rule this he was kind of referred to as as a fixer and the person who. metaphorically speaking knows well the border bodies buried is there a sense that he hasn't. given given as much as i let on as much as he knows right now that there is that he's the one he still has more to reveal. that's right and prosecutors from the southern district of new york were disappointed with his level of cooperation they said his cooperation was selective and in particular he did not. he was not as forthcoming on the financial crimes as he was on other matters he was relatively more cooperative with robert muller and i think that we can expect to see possibly an accelerated pace of cooperation now given that

he has been sentenced to federal prison time where there is no minimum that he has to serve from those thirty six months he may be able to further reduce his sentence by cooperating more fully and given that he has now been explicitly called out by the judge him by the new york prosecutors for failing to cooperate more extensively it would be very much in his interest to increase the pace of his cooperation so so where do things go from here then and how how worried should president trump be. i think you should be very worried one of the things that came out loud and clear from michael cohen's remarks today in court is that he deeply regrets having followed the president with what he called blind loyalty he was inclined to blame a lot of what he did and losing his moral compass by having

a sense that he had to help cover up the president's misdeeds and that is a lesson to others working with the president and close to the president who may similarly feel that they have to put loyal to loyalty to the president over doing the right thing both morally and legally and so i think that this may help give some momentum to others who are contemplating cooperation when you couple that with the fact that you can contrast michael cohen's case with michael flynn on the one hand who will serve likely no jail time and paul man a fort on the other who has been. completely false in this who operation and in fact not cooperating at all who will serve likely very significant jail time unless he is pardoned that gives reason to suppose that future
