analysis on capitol hill 1st of all we have hi joe castro and will be speaking in just a few moments to a white house correspondent kimberly how could i be what did you make of that. well we heard the arguments again repeatedly and again and again for why democrats think that trump should be removed from office now of course this is just the formalities at this point certainly there's no danger of this vote failing in fact it was already adopted by a voice vote as you just heard democrats control the lower chamber of the house of representatives it's what led the impeachment inquiry and now it's just a matter of delivering those articles of impeachment which are really the political charging documents if you will that lay out what trump is accused of they will be handed delivered by these impeachment managers who will walk with those documents across the capitol later this evening about

a 2 minute walk or so ceremonial procession and then hand deliver those documents to the senate which is what will touch off on this final and most. important part of this impeachment of president donald trump which is when this these $100.00 u.s. senators will be sworn in that perhaps as early as tomorrow to become the jurors and they will decide whether or not president trump remains in office as you know republicans have the majority in the senate and it takes a 2 thirds majority in order to convict and remove the president from office. very high bar so it would take 20 republicans to defect from trump in order to remove him but democrats say they're certainly going to try their best to present a compelling case if not for the jurors who are the senators at least for the

american people and you saw that also in the selection which we just heard announced earlier today of who these 7 impeachment managers will be these are the individuals who are democratic congress people there from the house and they will be the prosecutors they will argue the case against you for their senate colleagues the 2 who will be leading that charge that effort no surprise there the chairman who we've already heard making these arguments in the impeachment inquiry the other 5 democrats they were selected to really show a consolidation politically behind the democrats' efforts you are seeing 3 members of the progressive caucus or seeing a freshman congressman who represents a swing district was one of the pivotal voices who said he would support launching the inquiry that kind of pushed the moderates to take this effort they are the ones

who will be making the case now on american television screens when this trial begins mitch mcconnell who is the top republican in the senate from now on he will be the one calling the shots and he has told his members that in short order they will receive instructions on exactly when and what these next steps will be. pensioned speech see how st a kevin mccarthy. what's the the republican deal with this whole issue why do they think that this is all a political political issue a lot of the issue of justice. well republicans say that this has been a partisan effort by democrats to essentially throw anything they can at president trump since the day he was elected in order to try to remove him from office they say that this impeachment concerning the ukraine allegations are just an extension

of the charges against. accusations facing him in dealing with russian influence in the 2016 election and the mall humans clause in which democrats accused him of gaining privately from his office they say all of that is evidence that democrats simply don't like trump don't like his policies and are searching for a way to remove him from office and democrats have countered that simply not the case that's why they try to keep this impeachment charges narrowly focused on ukraine and on what they see as the administration's efforts to impede the investigation into the ukrainian charges but what we are seeing here really is a battle for what americans opinions will be coming out of this trial like i said at the beginning that this the likelihood of removal from office for trial if you just look at the numbers it's 20 republicans who would have to defect and we don't

has sort of taken over a life of its own as you point out all cameras fixated on it around the world so the president's effort to try and control the media narrative has been unsuccessful but that doesn't mean that his supporters in the house of representatives you just heard representative dunn collins there speaking on his behalf that has not stopped or what we're really seeing right now in the house of representatives is the members last ditch effort to try and shape the senate trial now there is the comfort of knowing for republicans that it is a body of the senate that is dominated by republicans but still it is this question of witnesses and that's what we heard the sort of final flexing of muscle by the houses. representatives controlled by democrats trying to say that they want a fair trial they want well they're saying that what they mean is they want witnesses to be called but again you heard there the republicans saying this is nothing more than the urgency of trying to prevent the president from being

reelected in fact the white house in a statement stephanie grisham saying the naming of these managers does not change a single thing president trump has done nothing wrong he looks forward to having the due process rights in the senate the speaker pelosi and the house democrats denied to him and expects to be fully exonerated what they mean there is those house managers are like the prosecutors in this trial and exonerated essentially mean the president would not be removed from office right now the numbers are in his favor you would need a 2 thirds majority in the senate to remove the president from office it's unlikely that 2 thirds with republicans controlling that body that will happen but still as you point out at the start of this conversation the president trying to control the media narrative with that signing ceremony for the 1st phase one of a trade deal with china he was also tweeting in the midst of all of this and here's what the president had to say just a couple of hours before we were watching what was happening in the house of

representatives in fact he was saying here we go again another conjured up by the do nothing democrats all of this work was supposed to be done by the house not the senate it's a bit of an unintelligible tweak quite frankly none of us are really sure what it means but it does mean though is the president's trying to inject his voice trying to influence this process we could expect he'll do a lot of that when this trial in the senate kicks off there is going to ask you more won't will be the white house strategy one of this trial does kickoff in the senate. i'm so glad you asked that question because now i can tell you there's a call going on right now with members of the trumpet registration for members of the media i don't know specifically who they are but they're saying exactly that that it will be strategy no one strategy adrian that we know is taking place right now in coordination between republicans in the senate and the white house is this issue of witnesses and reciprocity that's the word we're hearing

a lot of democrats saying we want witnesses who have this evidence to come out republican saying yeah we did too we want to call hunter biden the son of former vice president joe biden why is he relevant while the crux of all of this this impeachment inquiry is the president views his political powers to dig up dirt aren't repugnant ever credit rival joe biden the former vice president republicans are saying we need to call the vice former vice president's son because it's highly unusual that his son was sitting on the board of the ukraine energy company where former vice president joe biden was overseeing ukraine policy they're trying to get their dirt if you will one less opportunity of course both sides saying this is all for the case of objectivity a fair trial but there's no question the allegations are this is a political process i think it's safe to assume it's political on both sides a white house correspondent kimberly how could reporting live from washington d.c. kimberly many thanks indeed bruce fein is a former united states associate deputy attorney general he helped to draft the

articles of impeachment against president bill clinton and joins us now live from washington to have you with us once again. where do we start here. well as dreadful political theater reminds me of a. aphorism of samuel johnson that patriotism is the last refuge of a scoundrel and i've been around a long time and the idea that these members are driven by anything but politics is ridiculous nancy pelosi stood up and praised the constitution to the heavens i was scheduled in 2007 to testify at a hearing before the judiciary committee on impeachment was then chaired by john conyers the illegal wars and surveillance of mr bush and mr cheney. said impeachment is off the table she went to the chairman said you're being fired if you continue forward in the whole effort was cancelled because miss pelosi thought if you went forward on impeachment enforce the constitution it would imperil the likelihood the democrats would capture the. white house in 2008 on both sides of

the aisles the major constitutional violations that truly are impeachable offenses they are both completely complicit depending upon whether their guy or their woman was in the white house illegal wars illegal surveillance revoking trees without the consent of congress making appointments without confirmation of congress spending money that's not been appropriated by congress the wall raising revenues by imposing tariffs not enacted by congress totally flouting the oversight power refusing to give tax returns that are required by federal statute these are the things that have created an imperial presidency and none of them are even touched on by the impeachment articles that will be sent over later today they're going after the capillaries because the real juggler that is needed to take our constitution off of life support they're both complicit both the democrats and republicans if you took the republican statements today and went back to 2000 i mean 198-1999 when bill clinton was impeached now is involved they are making the

same arguments that the democrats are making the democrats which were defending mr clinton are making the same arguments that were being made in defense of mr clinton so they do echo chambers of each other because they're all driven just. partisan politics the constitution means nothing to them other than it's a makeweight to try to cover their partisanship and something that isn't so flagrantly i think denigrating of our american system just for a brief you said you said that the constitution and life support is it. yes it is own life support we have a president now who goes to war on his own he can assassinate on his own he says openly openly without challenge under article 2 the president can do anything i want that statement alone would justify impeachment and he has an attorney general says that's true the president can do anything congress can't question any decision to go to war to kill it's off the table you can have a right to ask why there was a killing in fact if you ask you're unpatriotic that's

justice of the united states john roberts will be the presiding officer and under existing rules the presiding officer would make an initial rulings on relevancy of evidence admissibility of evidence subject to overruling by the whole senate so i believe that if the republicans tried to call hunter biden as a defense witness to the charge that there was a deal with mr zelinsky that he would get his money if he was opening and vesta geishas against the opponents. trying to help from there would be denied is not relevant to the particular charge but anyway that's how this system would operate under existing rules but remember the senate can change the rules at any time by simple majority vote if we expect as mr mcconnell the majority leader has said that they have the ability to pass his resolution creating the rules what we can anticipate is next week there will be opening arguments made by the house managers

this is we evidence this is why these are people offenses they will be opposition that will be presented by mr trump and his defense counsel then there will be questions written questions that will be asked by the senators that will be either to the managers they may or may not call witnesses that i expect will last 4 or 5 days under existing rules from monday through saturday the senate is required to sit all day until the impeachment trial ends i would expect maybe a week of the trial at that point under the mcconnell rules then the senate would decide do we need more documents do we need more witnesses my view is that the republicans believe the american people will be so bored of this because we've not heard anything new and i think it's not unusual if you would comment have you heard anything new today when you heard miss pelosi go on ad infinitum it's all the same thing it will be boring and they'll expect we just need to get this over and then the last wild card we have i think that if we look at the precedent mr nixon under

that's a mistake. yes i do think it's a mistake i believe the overall narrative that the rouse is presenting to the senate namely the president made a phone call to mr lynskey it was clear in the phone call that he was suggesting he wasn't going to be riding the hundreds of millions in military aid unless mr zelinsky open publicly investigations against a political rival for the 2020 campaign now that narrative doesn't need to be proved it's a very simple one you don't need trial lawyers to prove it's a water runs downhill or you breathe oxygen in order to have respiration you need in this case in my judgment those who are steeped in constitutional law the history of the country the nixon impeachment why it's important to hold the president accountable to the rule of law what it would mean going forward if president trump is able to get away from this wrongdoing which requires a far greater depth than

a trial lawyer and is down in the weeds we don't need to be down in the weeds the fact is that all this new evidence that miss pelosi says has come forth in the last days or a week before the articles have been sent to the senate there's nothing new in them i mean what are we going to say john bolton's already said he didn't want to get involved in a drug deal by being involved in this deal with a quid pro quo the money goes to ukraine in exchange for the opening of the investigation it's what the lawyers call cumulative evidence were already there you're just pounding dirt at this point so i believe that the the trial is going to be very very bad for the democrats and they don't think that they have the team the 7 members of the team who are equipped to raise it to a level to alert the american people why our constitution is in jeopardy not only for these reasons but for other reasons and that it's critical that we remove a president even though it doesn't result in

be arguing the case against president trump in the senate they will walk from one side of the u.s. capitol where the u.s. house of representatives chambers are found they will be accompanying the printed articles of impeachment housed within and below this and they will walk across the capitol to the senate doors and deliver those articles to the senate that will crossed a threshold in american history it will be only the 3rd time that this will have happened to a u.s. president to be impeached and to face his destiny in the senate that is where those $100.00 u.s. senators will be sworn in in short order it could happen as early as tomorrow it may not happen until next week and they will become the jurors who will be ultimately decide the president's fate whether or not he remains in office and if as you've heard from our guess from versifying you know it's 2 thirds of the senate

would have to vote to convict trying to remove him from office the numbers statistics we are simply such a high threshold to meet that no one is really considering. that to be a likely outcome however with this open question of whether or not senators would agree to allow new witnesses in new evidence to be considered how damning could it be we simply don't know at this point we've seen the drips and drabs of what new evidence is out there we've heard the offer from john bolton the former national security advisor to trump and says he has information to share he wants to share it if he is subpoenaed by the senate and exactly what he'll say that really it's still an unknown exactly what other documents might be out there those are open questions as i said to have said to kimberly a the white house in the world at the world is watching at the moment is there any sense that there of occasion but that is that a buzz about about about capitol hill at the moment the that that something big is

is on the way today. well recent polling shows that the vast majority of americans are paying attention to this you know with iran having really sucked away all the oxygen from this political headline in the beginning of the new year there was some talk that perhaps president trump was making political moves and you heard bruce fein just say that it would be not surprising that he does because hast presidents who face impeachment have done similar things launching a military strike just as this is a very negative and peach mint news is happening concerning the president and so of course iran took away all of these other impeachment headlines in the beginning of the year but now it's interesting you see the president signing the trade deal with china and as kimberly said from the white house that's receiving very little attention here among the u.s. public everyone is paying attention to what's happening on capitol hill which will
