it is an similarities of cultures across the. time we take you will bring you the news and current affairs that matter to you. this is al-jazeera. the robin you're watching the al-jazeera news our life my headquarters here in doha are coming up in the next 60 minutes president drugs impeachment trial shifts to questions from senators as democrats push to hear from a key witness drops former security adviser john bolton. truth above all is on our side and that's why we're still in the fight that's why we're still in the ballpark. as palestinian protesters denounce donald trump's middle east plan
2:01 am
president mahmoud abbas says he'll travel to new york to address the u.n. . meanwhile with israel in the midst of an election campaign we look at the domestic reaction to trump's proposals. the whole world needs to be on alert the whole world needs to take action and be ready. for the warning from the world health organization urging all countries to take action to combat the corona virus outbreak. welcome to the news of the impeachment trial of u.s. president donald trump has entered a new phase with the start of 2 days of senators questions but that's already being overshadowed by the fallout from an upcoming book by the former national security adviser john bolton which could implicate the president. now leite excerpts from
2:02 am
the book appear to support accusations of abuse of power at the center of the president's trial the white house has moved to block the book's publication saying it contains significant amounts of classified information however on capitol hill democrats and republicans that it has to allow bolton to testify and if you have any question about it at all you need to hear from his former national security advisor don't wait for the book don't wait to march 17th when it is in black and white to find out the answer to your question was it all the motive some of the motive or none of the motive and we think as i mentioned the case is overwhelmingly clear without john bolton but if you have any question about it. you can to race all doubt. the hijack castro's been following events for us from capitol hill did washington d.c.
2:03 am
of course we have to then ask what is the sort of latest offense being offered by trump's lawyers. well so it appears that there's been an update to this defense maybe and in anticipation of the fallout you know from bolton's revelations in his book for he to become a witness and this new defense that was laid out by alan dershowitz the president's attorney goes something like this and it's a bit philosophical but it goes that if the president believes that it was also in the national interest for his own reelection which of course is in his personal interest and those 2 motives are mixed and thus the president should be the new from this impeachment process so there was already much discussion about that legal theory with senators speaking with reporters immediately after democrats calling it absurd and bizarre but moderate republicans who have been asking specific questions about what was the president's motives and what if the motive was mix
2:04 am
what if he was intent on helping ukraine combat corruption and at and that at the same time thought you know getting these investigations into joe biden would be helpful for his own reelection campaign and they asked about mixed motives to which the president's attorneys said that even if there was the possibility of the president having the nation's interest in mind even a bit of that mode of being due to the national interest that he should be acquitted and of course the focus really is on friday and the real chunks is over the pietschmann trial chile happening i mean what's your general assessment up to know. well everyone is has their eyes on the list for moderate republican senators who would essentially be the swing vote on whether or not to end this trial on friday. likely with an acquittal given the political dynamics of
2:05 am
republicans controlling the chamber or the other scenario voting on friday to open the trial to additional witnesses and of course that's where john bolton is back in the picture he's the former national security advisor to trump and the democrats have said that he has compelling information on the president's motives so it would take for 4 republicans to side with democrats to extend the trial to witnesses and the answer on whether or not they will do that will come on friday wolf and i will leave it that of course follows through the night had to construct force in washington d.c. welcome to all the debate surrounding john bolton's forthcoming book. the latest revelation a letter that has been made public as of today put forward by the white house to john bolton's attorneys and something making the argument that the book that he is planning to release next month that it cannot be released because it would put
2:06 am
national security at risk the letter saying that this was caused exceptionally grave harm to national security that the conversations between the u.s. president his former national security advisor are classified at the top secret level so essentially what the effort is is to try and avoid what we already know has been leaked in the form of the book that john bolton all but confirms that the president abused his presidential powers for political purposes by leveraging the office says that withholding military aid in order to pick up an investigation on political rival former vice president joe biden so this effort to try and stop the book is also an effort to try and stop the testimony on capitol hill that we know many democratic senators are pressing very hard to have made public the president's also discrediting the testimony he tweeted very early today that reacting to this
2:07 am
bolton bombshell as it's called that he fired the former national security adviser because it would be world war 6 by now that when he did then the for the president says that john bolton immediately went out and wrote a nasty and untrue book so essentially the president has sort of put forward this attack on many fronts whether it be setting executive privilege that the former national security adviser can't testify whether it be national security whether it be in the courts or even just discrediting the testimony before it's even heard. when bruce fein is the former u.s. associate deputy attorney general and joins me now from washington d.c. could have you on the program again mr fein i mean come on national security council or even the white house stop legally this book and the formal security grounds. well it's quite questionable in a famous case called snap versus the united states the united states supreme court held that if publication went forward without the security review that the united
2:08 am
states government could recover all the profits but in that case the book itself was published there is a very very strong presumption against what's called prior restraint trying to prevent publication of a book or a speech before it's disseminated to the public after the fact is a different matter where they want to punish somebody but here as well there is a unique element to the likelihood that mr mr bolton will be called as a witness remember mitch mcconnell and the majority leader of the senate said yesterday he doesn't have the votes to prevent additional witnesses and mr bolton would be number one on that list that even the republicans as well as democrats would want and i do not think that there would be any legal foundation for a court to tell a witness to refrain from testifying before a senate impeachment trial the united states supreme court has made it clear the processes by which impeachment is heard by the house in the senate is exclusively
2:09 am
their responsibility and courts are not to intercede because so we could have the situation where even if the book is not published mr bolton is testifying to the same events before the senate so what is the protocol was to find when you were within the close confines of the presidency the white house and you want to write about your experiences through your own lifetime hypothetically because people like michael wolff james could be bobbled what would have all published books all this sort of issue all the scenario of the white house. surely you must get clearance of some sort before you've put pen to paper. well what is required and i had to sign one when i was in the government is you submit in a contract to pre-publication review of your manuscript before it's published but still the courts have held the executive doesn't have willy nilly authority to declassify information that really is more political or discloses lawlessness than
2:10 am
otherwise and when cases have gone to court where the author of a book has challenge the cia or the security established for improperly trying to redact information they've generally speaking prevailed remember the standards for classification are very very wobbly and vague and the abuse is rampant with regard to bob woodward for example he's written countless books there's classified information on virtually every page which is true of his book about the trump administration called fear and yet there was never attempt to go to court what also undermines the trump administration is that if they did permit ambassador sanyal in to testify about communication with the president and never and vote classification as a reason for for censorship or suppression so it looks as though it's a political rather than a national security issue that troubles the white house of course that is the next few days will live with the witnesses can be called to the trial not so easy to win
2:11 am
win situation for john bolton whether he appears. it is absolutely when when the book sales of are going to go right through the roof because of all this unbelievable free publicity if you will so it's going to call more rather than less attention to the disclosures and he's probably smiling right now sweet revenge from being handled this in such an abusive way by the president was fine always good to get your insights and your opinion on all these sorts of issues thanks very much for your time from washington d.c. thank thank you. now the palestinians are putting pressure on the u.n. to take action against the u.s. president's plan for the middle east palestinian president mahmoud abbas will speak at the security council in the next 2 weeks the palestinian envoy to the u.n. says he's hoping the 15 member group will back a draft resolution on the issue or diplomatic editor james bays has more from the

of classified information. the palestinians are putting pressure on the united nations to take action against trumps a plan for the middle east palestinian president mahmoud abbas will speak at the security council within the next 2 weeks. the world health organization will be to get on thursday to decide whether the coronavirus outbreak constitutes an international emergency it's urging all countries to be ready and take action against the virus that has left more than 160 people dead in china. let's get more now on what our top stories the fallout from president trump's middle east peace plan and this latest effort by the u.s. follows decades of conflict and mistrust and actually abroad takes a look at how we got here. when we look at president trump's proposed plan it's important to remember how palestinian territory has vanished over the past century and if we wind back to before the british mandate for palestine in 1917 this was
2:33 am
the map just 3 percent of the population were jews but over the next 50 years of british rule jewish immigration increased and when the mandate expired and 948 the state of israel was created and its military expelled at least 750000 palestinians from their homeland then during the 1967 war israel expanded its territory into the west bank including east jerusalem and the gaza strip occupying all of historic palestine in the 1990 s. under the oslo accords palestinians were given some powers of self rule but remained under israeli military occupation since then hundreds of thousands of israelis have moved into settlements built on that occupied land which is against international law and this is how a future palestinian state could look under trump's proposed plan israeli territory would separate the 2 main palestinian centers of gaza and the occupied west bank
2:34 am
though they'd be a tunnel between them but all of these israeli settlements inside palestinian territory would be recognized by the u.s. and while the plan would create a capital for the palestinians it's not east jerusalem it's in the eastern outskirts cut off from the old city and the mosque compound by a concrete separation wall and israeli checkpoints trump says jerusalem will be israel's undivided capital groups like amnesty international have rejected the plan saying it would exacerbate tensions and endorse israel's half century of occupation . the 60 general of the palestinian national initiative political party he says palestinians are united in their opposition to tribes still resist it at every level. this plan of course it can be unilaterally implemented by israel which israel is doing already but that doesn't mean there is a need it doesn't mean that without a palestinian up over this means nothing it means that an occupying power supported
