donald trump is counting on is that he might be able to take this to the supreme court and of course that is where he has judge amy kone barrett who was 6 appointed and confirmed there just in recent weeks so this is all part of the strategy now at the same time this strategy this legal strategy cost money so what we've seen already isn't even being sent out to supporters of donald trump saying that they have launched a legal fund particularly wisconsin in order to try and fight back now according to the white house press secretary and also adviser to the trunk campaign kelly mcenaney what the concern is is that in democrat controlled states or in democrat controlled cities where some of this recounting is taking or counting rather is taking place the feeling is particularly in states like pennsylvania in philadelphia there has been a history of corruption in the past also in detroit and so what they're asking for they say is transparency something that they say has not been afforded to them but

has described many of these actions as baseless and stupid as he puts it pointing out for example that the move to suspend the vote in michigan would actually or suspend the count would actually count against donald trump because joe biden is leaving there so by suspending the count joe biden becomes the victor but there is one case in which some traction has been granted the trump campaign petition the supreme court to allow the campaign to be intervene as a petitioner in a case involving the pennsylvania secretary of state now this is a case that was held and the 1st pennsylvania supreme court decided on before the election took place it went to the supreme court the supreme court said because of the narrowness of time it would not allow the motion by the republican committee in pennsylvania so it pushed it back to the court and allowed to the counting of votes

after election day to go ahead but 3 of the justices on the supreme court at that point said it's something they may have to revisit and indeed now the trump campaign has petitioned the supreme court the supreme court has now sent a letter to the pennsylvania secretary of state instructing her to respond to the trump campaign's requirement to be added as a successful petitioner by 10 pm tomorrow night now whether this is significant or not we'll see basically it would open up that case again in the pennsylvania supreme court should the tram campaign succeed. in its attempt to be put on as a petitioner so it could indeed go back to the supreme court at some stage however and this must be stressed there is a legal position here so which is very very important in this and was mentioned in the original supreme court decision and that's called reliance interest basically that is a legal concept that the supreme court is very very hot on and has used on

a number of occasions which basically anybody who takes an action that they believe to be legally acting on information that they believe to be eagle illegal cannot be punished for that so in the case where a voter has in his or her best interests and in his or her belief that they are acting legally because they received certain information they cannot be punished in other words those votes got to be counted according to the supreme court dictum so this is all illegal but joe biden has responded to the same self in quite a tactical way he's leaving all of these fights to his lawyers to the various democratic lawyers that have been put on what he himself says let's just count the vote let's just get on with this pushing away any thought of legal action indeed a very complicated situation unfolding there in pennsylvania for the moment mike thanks very much well let's go over to miami now and to gallagher joins me now to

discuss really the state north of florida and that's georgia where there's also a controversy there as well as the vote count continues. we began wednesday morning trumpet about a 300000 lead over biden over the past few hours joe biden the former vice president has been eating into that late so it's now less than a percentage point between these 2 candidates but what's key here is they are counting mail in ballots but they are counting 1000000 ballots from the suburbs of atlanta which lean democratic if you look at all those of the counties around the ones that have yet been counted the overwhelming be gone for the democratic candidates so there is a chance here that the biden campaign could take georgia now that is something i don't think anyone in fact had for a vice presidential nominee a democratic presidential nominee has not won that state since 1992 and that was

bill clinton the trump campaign's lawyers have already launched legal action saying that one of their observers saw 53000000 ballots handed in after the 7 pm deadline 53 that just shows you how desperate the trump campaign is getting they did not factor into anything going on over the past couple days that they would lose a state like georgia that has been so red for so many years so if joe biden wins the state of georgia that is 16 electoral college vote which puts him way over 270 and he may not even need it if he wins a state like nevada it would just be ice cream on top of the take on top of the cake so 5 that is pretty significant watching very closely officials in the state of georgia saying in the next few hours they should finish counting those final ballots what about 100000 mark maybe 130000 but that eating into that all the time . for the moment turn to go together in miami thanks so much. know there have been

seems to be happening in the state why is there this dispute right now. well in the midst of this heated rhetoric the vote count is continuing in the convention center behind me and as more and more ballots are counted the lead by president chomp is getting narrower and narrower with about 88 percent of the votes counted he is now ahead by less than $200000.00 votes and that's leaving vice president joe biden within striking distance here in pennsylvania as you mentioned the president is attempting to shut down the vote counting here in pennsylvania he's filed suit to that effect claiming that there's an attempt to disenfranchise voters here claiming that rudy giuliani claiming his attorney claiming that these ballots are coming from mars and possibly from dead people although they're citing no evidence to back that up he's asking in the legal team is asking that the

angeles let's get more on this from melanie sloan joins me live on skype from washington d.c. she's a former federal prosecutor and lawyer with expertise in government ethics good to have you with us mislaid and live on al-jazeera kind just begin really with how do you react to these potential legal cases being brought by president trump's legal team in trying to get the courts to stop postal vote counting. well it's a pretty much a last ditch effort and it's not even that serious i mean the main lawyer the president has on this is rudy giuliani this is a g.o.p. that has many sophisticated lawyers some of the best lawyers around have been busy suppressing votes for decades and here they have nobody really except for rudy giuliani who's big allegation is that some of the ballots come from mars so that litigation just isn't really serious at this point and i don't think the biden team is taking it very seriously they aren't making any really good cases they want to

argue in some places that they shouldn't count votes anymore and in other states they want to say oh you're not counting enough votes and so they have very inconsistent messaging as well for international audience will be quite confused by this whole scenario of votes being counted. with a certain postmark on them i.e. november the 3rd in other countries to say it's not over until the fat lady sings all the votes have to be counted why is this so contentious in the united states about a cutoff point. well the republicans have made it a very contentious issue one of the most interesting things is we're talking about ballots in michigan wisconsin and pennsylvania and republicans pushed to have state legislatures say that the ballots had to all the accepted they had to be in by november 3rd election day but they could be counted after that and the reason the president why did this is now the president is coming in and arguing really we

should just count any vote that was counted by election day rather than all the ballots that already came in and all of those early ballots all the mail in ballots were largely by democrats because the president spent much of the summer and fall telling his voters that the voting by mail wasn't a good idea and so all of these votes that are still to be counted that are still in process are largely democratic and that's why the president is so eager to shut those those numbers down out he knows that when those ballots are counted it is very likely that biden will have an insurmountable lead in pennsylvania by some projections are about 100000 votes if that's a sign already that's the scenario then what is the what is the protocol in terms of legal challenges for example if the if the trump company gets no joy from states' courts come the. jump jump over them and go straight to the supreme court i mean is there

a route to getting legal to getting his voice basically heard at the highest level or will it be cost within each respective states that he's tried making a challenge in. it's likely to be caution each state in order to get to the supreme court i think we'd have to be talking about a very only one state and we'd have to be talking about a number of votes that would make all of the difference and in this case we're not looking at that because we're looking at several different states it looks like biden will get the $270.00 electoral votes and then stop it so it will not be that close so i don't think mr trump has any pashley to the supreme court melanie sloan obviously the night dare i say it is still young lots of twists and turns thank you very much feel insights joining us from washington d.c. .
