critics argue is particularly dangerous because many would say that this is a process that is working but i can tell you that trump supporters feel that that is not the case and we've seen those expressions in areas like arizona as well as around the country where they feel that there has been trickery in the process so this is where we are in the united states right now the u.s. president is about to weigh in and of course we did hear from the former vice president joe biden that he believes the system is working now we will hear what the concerns are by donald trump now we should point out with regard to these lawsuits what many at legal and sort of electorial experts have been saying is that some of these lawsuits have been a little bit thin in nature for example one of the lawsuits filed in georgia really only affected about 53 votes. which many would argue could be ultimately in consequential to the overall impact of

a state result but at the same time as we've seen these margins are becoming so razor thin that donald trump is saying he is going to challenge every single one where there is a concern he is focused on winning the white house says and this is what we are expecting to hear from the president ultimately when he speaks sometime after the bottom of the hour kimberly. how much support does he actually have from within the party from other republicans about the moves that he's been making to hold some of these vote counts as well as the neagle action he's been taking does he have the full support of the republican party. it's interesting you bring that up because. donald trump's son donald trump jr was very critical of some members of the republican party for not being more public in supporting the president and this is where you have to remember these people are politicians they're looking at what's best for them in the longevity of their own political career is donald trump is not

a politician so he goes there as we like to say he'll speak out when others won't but some of these more professional politicians are trying to think of their longevity beyond donald trump and i suspect that's why you're hearing some silence less support for the president at the same time there have been of some vocal supporters but this is a fragile time and many of the members of the republican party know it they're thinking about their long term jeopardy in the u.s. senate for example in the house of representatives where we should point out there have been already republican victories and this is a story that has been a little bit overshadowed not only did we see the republicans well they don't have a majority in the house picking up some seats they also it appears are going to maintain control of the u.s. senate and that in and of itself is significant for example mitch mcconnell the republican leader that will become the majority leader we suspect had more than $100000000.00 in opposition ads being poured against his campaign and still he won

a democrat and a lawyer he joins us on skype from washington d.c. many thanks for speaking to us and i was there which i think it really do any of these lawsuits have legs for example in michigan the lawsuits already been dismissed and that's the case i believe also in georgia so can these lawsuits lead anywhere. and i think it's the case that he's lost cases that he's brought in pennsylvania in arizona to look he remember in his whole career donald trump has seen that going to court was his way to get the better of any transaction because he had resources that contractors and others who worked for him didn't have this is different. this is not something where he can just pull his way through the process the legal process also the law is not on his side so far and you alluded to this these lawsuits don't really have seem to have much merit there aren't facts to

support them they don't seem to be written by particularly sophisticated lawyers and we kind of know the people leading his legal charge are not the best lawyers on election law in this country that people like rudy giuliani who really are more mouthpieces than they are effective election lawyers so that gives you some reason to think not sure that donald trump is taking it as seriously as maybe the media is taking it it also seems a little inconsistent in terms of the legal positions trump is taking in different states for example in some states he says that they should keep counting and some say states he says they shouldn't count why is it so inconsistent and he's got his his forces out in the streets saying count the vote in some state and stop the vote stop the count and others. i guess they would tell you if the circumstances are different it was odd he put out a tweet earlier today that said stop the count at

a time where the counting really had been stopped in every state he would have lost because he was behind in the states where he wanted the vote counting to stop it's odd would just make you wonder is is it that he's become just slightly unhinged faced with the prospect of losing and nobody can rein him in because otherwise you think there would be a rigor to what the president of united states is doing with the stakes so high but we're not really seeing evidence of that ok so whether these legal challenges do have legs are not they are able to create delays to guessing some kind of final result is that not the case. well again each state has deadlines that they have to meet for their results to be certified and i don't think the secretary of state the ultimate the authority is over the sort of occasion process are going to look at the mere fact that donald trump has submitted a complaint

a lawsuit in their in their state courts and say oh that's a reason to hold up if anything i think their attitude is like we know both under state law and frankly under the constitution of the united states that we have to meet certain deadlines and we're going to meet it the only reason that the vote counts was stopped by the supreme court when it was bush versus gore in 2000 is again there were certain deadlines in the supreme court we think because there were 5 republican appointed justices decided we won't be able to meet these deadlines if we keep counting the ballots in florida so we're going to call it to a halt i don't think it's going to work that way this year. there has been a lot of speculation at least before the election that donald trump was packing the supreme court in his favor in light of a situation like this if any of these cases do you somehow managed to get to the supreme court what would that lead to some kind of problem. well
