separate still this is just a measure of what we're going to be seeing from the trump campaign for some time and that is a series of legal challenges that donald trump is hoping will allow him to reclaim the lead and take away the possibility of the presidency from joe biden now donald trump is also tweeting as we he often does when we don't even front the cameras and what he's been saying is really challenging this notion that joe biden is to become the president elect in fact although joe biden has not actually claimed he has won this election donald trump feels that he is making those assertions and he says on twitter that he could make that claim to in fact has made that claim so double talk taking issue with a lot of the sort of narrative that seems to be getting momentum in the united states that joe biden house what he needs to get that magic number in order to become president elect and this seems to be

joe biden will be speaking regardless of whether or not there is a major projection issued in coming hours but i think the way to leave it is on this is that once his convoy comes into the convention center on the road right next to me here then we'll know that he will be making a speech within the coming hours but i just want to pick up on the supreme court action that has just occurred the supreme court instructing the secretary of state in pennsylvania to separate the votes that were handed in after the close of the polls not to clarify this what actually happened is that the secretary of state did instruct election counters to separate these votes however the count can use now the republicans had brought the urgent interdict in the supreme court demanding as well that the count be stopped well the supreme court did not do that all the supreme court has done is essentially sent

thursday 24 hours ago and then she said we definitely have them by friday of course that hasn't happened just yet so really we're just sitting here waiting for the votes to come in with 100000 still out there about 100000 it's looking less and less likely that we're going to have that answer that we wanted on friday likely going into the biden calculation i think everyone expected the vote would be in but now it doesn't look like that's going to happen i also want to pick up on something that both kimberly and mike talked about with the supreme court case and the fact that those votes were already pushed put aside we're not. votes that could actually change anything now what we're hearing is the numbers between 3 and 4000 and again we're talking if you look at let's say the math holds up joe biden continues to get the percentage he's been getting from these mail in ballots in these democratic places the lowest numbers in the 60 high sixty's to 80 percent so if you look at

former vice president joe biden so what that means is georgia is heading towards a recount and there are 2 dates we need to keep in mind here november the 13th of november the 20th that's when the votes are certified by election officials and then state officials but this is really a state that should have even been playing a role in this election because it's been solidly republican for decades it's been since 1992 when democratic nominee bill clinton won there and ever since then it's been just a very red state so there is a reflection or a think of changing demographics and if we look at election day on tuesday which feels like a very long time ago trump 370000 or thereabouts vote lead over biden but are those mail in ballots came in from those democratic neighborhoods mostly around atlanta or in savannah that that lead was eaten away and sold your biden is now in the lead by $4000.00 but as one alexion official says that margin is less than the

population of a small high school in georgia so what officials are saying there now is that there will be a recount the dates i gave you are the days to watch but another thing to watch or 2 senatorial races in the state of georgia which are so tight they'll be run off as well in january now why they're important because they may decide who controls the senate for the next 4 years obviously the republicans if they lose the presidency want to keep hold of congress and those 2 races will be watched. very very closely because they were so once again razor thin so the counting is still continuing in georgia despite the fact we now know almost certainly there will be a recount and we have to watch for those dates november the 13th and november the 20th the votes may come in before then but this is a task these people have been working 24 hours a day ever since tuesday to go through all that again it is difficult but that's

mean i feel like especially here in d.c. you know it's been peaceful protests and i think this is a great energy to come down here and and check it out but yeah i'm not surprised and it's been so peaceful and nice and it's been a really. beautiful weather so the big question though was if biden is declared the winner come january 20th what if trump makes good on his promise about not accepting defeat what if he refuses to leave the white house are you concerned about that yeah well i watched a lot of bill maher and he's always been very vocal about the fact that he's not going to leave you know that is a concern but i really have faith in the system and i think that democracy is going to prevail here and i think that i think his republican supporters you know if biden wins and he gets every vote counted and he is the victor i think they're going to support democracy and i think they're going. to leave and i think we are going to have eventually a peaceful transfer of power and i'm really excited to see that happen thank you so much and after sharing your thoughts and of course here just as across the country

lawyer brian darling he's a former senior communications director and star legal counsel for the republican senator rand paul he joins us from the in maryland so the president still remaining very defiant launching many of these legal challenges in various states some of which have already been dismissed we have another one being dismissed today in nevada. do any of his lawsuits have legs. well time will tell i think what's happening now is they're organizing their legal strategy i mean we're still in the middle of the count i mean these counts are still going on they haven't been completed there's a good chance that we know in georgia they're going to have a recount there may be other states where there are recounts so some of these allegations will not be litigated for a few weeks and you know one of the most important aspects of this is restoring confidence in the american people that the american people have in the electoral

process and are a good deal or republicans are looking at what's going on and in pennsylvania skeptically and so any investigation that's done that comes out either way will help restore confidence and in our electoral process and it's important that these lawsuits are taken seriously and if they have no merit they should be dismissed but if they do have merit let's have that out in the open and let the american people see how it all plays out well today we had for. a report with the republicans trying to raise up to $60000000.00 to fund north states what do you think this is all about. well look at what's going on and pennsylvania there's a case said went right up to the supreme court considering and looking at the issue of whether ballots that arrive after election day are valid or not and that's something that the courts should look at and in other states that is allowed not

every state allows ballots that are mailed on election day or before election day to be counted if they come after election day and i can tell you from personal experience in my state of massachusetts when i tried to vote in 2004 i mailed my ballot and got there one day late it was postmarked on election day it was not counted so it's not unusual for states to have a look at those ballots and only count the ballots that come in on election day and the big question is is there a federal will the federal courts take a hard look at that since 2nd guess the states that have made this decision there's been controversy in pennsylvania whether the courts or the legislature made that decision correctly and it's all going to be litigated in the courts which is great because that's where it needs to be litigated not in the media not with the talking heads like me or democrats trying to hash it out and declare somebody a victor now because we we as we know we have a long way to go feel the election still being counted we may have recounts and

we're going to have litigation so there's a long way to go before this is resolved in a way that just restores confidence that the american people can say that the election was fair and free it's interesting you say that this is about restoring faith in the democratic process and do you really believe that's what president trump is doing with the narrative he is and using. well the president is a fighter and he's digging in and fighting as hard as he can and i may not 100 percent agree with many of the arguments he's making you know declaring himself the victor and saying that he won all the legally cast votes we don't know i mean i don't know if that's true or not and i suspect that when this process is all played out many of the states are just going to say that there was a very close election and present trump lost but i do think it's a president's right to fight this he has a perfect the right as a president as a candidate for office to go into the courts litigate these matters and if they're
