congress and the crowd who was out here tens of thousands of people are chanting fight for trump so we've heard people talk out here about how the election was stolen stop because steele is one of the signs that are out here it's just spoke to that and he's urging people to continue to fight for him in this post election period when he has been defeated not yet certified by the congress he says he hopes that mike pence his vice president will do the right thing that is because pants will oversee that part of the certification procedure on capitol hill. it's clear that the president doesn't know whether mike pence is going to try to oppose the certification and in the words of send it back to the states something the constitution doesn't call for nevertheless this is what we are

a 2. step process it wasn't there's been literally no evidence of fraud even in the lawsuits the term campaign has filed because you can't lie to a judge they haven't actually alleged that there was widespread fraud all of the lawsuits have been thrown out all of the allegations that the president is making are just simply conspiracy theories that have been sort of floating around on right wing media clear that the president is trying to send a message to republicans that this is his republican party and they want to stay in the office then they should do his bidding we're going to see if it's going to work it seems unlikely we are seeing really tight security here we've seen videos on twitter of senators coming into the building trying to get on planes getting harassed and heckled so they are feeling some pressure but really with so far we've only seen 12 senate republicans and more than 100 house republicans say that they're going to do salans the results in certain states if they don't get an emergency audit now the president again in another false mike pence has the authority to send this certification back to the states there's nothing in the

a historian emirates this of the united states senate is joining us from bethesda that's in maryland over in the u.s. thanks very much for sticking around and listening to what donald trump had to say i mean i do want to obviously talk to you about these certification process. mr donald but 1st just some reaction to what the president had to say a moment ago when he was slamming the republicans calling them weak saying that we will never concede the election when it comes to his party and the republican party what do you think the message is that he's trying to convey to them right before the certification process and and are they a divided party well yes they are down. with the president so many of them said this is an unusual circumstance the party is actually very united so this is the 1st big republican party in congress.

so he's he's succeeding in trying to sow division that. well it's very strange usually presidents are trying to unite this case he's trying to divide us just yesterday voters in georgia went out to vote and voted for the democrats so we're now going to be facing probably a 5050 senate with the democrats back in the majority so this is a bit sort of a very unusual circumstance in which a president to some degree has worked against his own party expecting them to be loyal to ok well let's look at the certification process i mean this really is meant to be a ceremonial procedure in the official end of the election let's talk about how it's usually played out and then we'll drill down into what's happening this particular process. you know so it's usually a very cut and dry procedure that everything has been worked out to advance in the past i've served committees with lawyers from the house of the senate who have read

through all of the electoral ballots to make sure that everything is just exactly perfect that there's nothing that anyone can object to sometimes the states states that the stakes when they send in the material when state got the wrong dates that you know if you're a shim so they got it all straight down so that the job of the post president that is simply to read aloud how each of the states voted and eventually then to declare someone is the winner of the ceremonies a so dull that for the most part many senate is did but the going and there were some years when they because there are going to be a lot of empty seats they voted steph that the senate said march of that with the senators and sit in the senator's seat so the least there would be bodies that the audience when they counted out the count that would be a problem this year it's certainly not going to be a dull event and here's the thing i mean you were just mentioning the vice president and just a few moments ago while trump was speaking at that rally he had a message for the vice president and he said that he has the right to reject the

results effectively and he wants mike pence to send it back to the states now we know that constitutionally pence cannot do this on one hand he doesn't want to remain loyal to trumpet on the other hand he has to follow the law in the constitution does he not so what do you expect to happen what will he do. well the job of the vice president is very limited this case he's the president of the senate it's a very he's the only member of the u.s. government used part of 2 branches he's vice president of the executive branch but he's president of the senate and so the electoral ballots are actually sent to him as these presidents of the senate they're collected by the secretary of the senate put it open boxes that are carried by the pages across the capitol to the house chamber they're opened up that they were to lose and for both the house of the senate for both parties who will check to make sure that these ballots are correct and these are the ballots that was certified by the states they have been disputes
