7:02 pm
outside the white house for us but we'll start with heidi joe castrol who's on capitol. who. should we be looking out for as these proceedings get under way. while democrats how are are using 2 options at their disposal and both of them we expect to be launched today in a moment's time we're expecting the house to gavel back into session and 1st we will see a resolution introduced that would ask vice president mike pence as well as trump's cabinet to invoke the 25th amendment which can be used to remove a president from office when he is incapable of exercising his duty that is a resolution likely to fail under unanimous consent today could come up again tomorrow in floor vote however president vice president pence has said he's opposed to calling for trump to be removed from office so that is a likely to be
7:03 pm
a dead end that gets us to the 2nd option the democrats are likely to introduce this morning as well which is the article of impeachment it is drafted in simple terms charging the president with inciting insurrection in violence against the u.s. government it says that this is a pattern building on the telephone call he had with george's secretary of state trying to find enough votes to overturn the election results now we know that at least $210.00 democrats in the house have already signed on to this article that's approaching critical mass for its passage which would make president only the 1st president in u.s. history to be impeached twice however all of this is unfolding for a fast deadline of course we know trump is leaving office in just days time that means he will not be tried before he leaves office so the question is what's the whole point if he has to come back to be tried in the senate once biden is in
7:04 pm
office will democrats say it's important to hold him accountable to seal that it has a spinal punctuation point in. story of his presidency in history also if he were to be convicted under this impeachment he would be barred from holding office in the future and how do you see the democrats. how much support is there from republicans for these moves. well you're seeing a growing handful of republicans who have voiced support for the 25th amendment or called for president trump's resignation pat toomey a senator from the republican party has said that trump has devolved into a path of madness since losing the presidential election and we're seeing a very different tone from the time that trump was impeached about a years ago for his call with ukraine at that time you saw no republicans leave
7:05 pm
their ranks in defending the president well now you're seeing reports of even his legal team jumping ship or husing to return to his defenders if he were dragged back here for another senate impeachment trial and namely those few republicans who have stepped forward to defend the president even now all their main defense has been to call for unity for the country as the reason to not impeach him a 2nd time but few if not any are actually defending his actions in inciting the violence that we saw last week. with their own thank you. reaction from the white house we can join fish or. we could see the live shot just makes you those proceedings the efforts to remove donald trump from the white house are now. we. the president reacting to all of this. of course we don't know i mean in the old days
7:06 pm
just 4 days ago if we wanted to know what the president was thinking you grab your phone your check his twitter feed and say all right ok so that's what he's thinking of course kicked off the platform on friday we're told that he might make remarks he's due to hold a medal of freedom ceremony in the next hour or so here at the white house for jim jordan who is a republican congressman from ohio big supporter of donald trump man who appeared over the weekend suggesting that there should be no proceedings to remove the president from office so we're told by the white house that the president is considering making remarks there that would be unusually sail 2 of these events over the last 10 days or so and hasn't made remarks to any of them in fact there's been nor independent media it's just been the white house that have taken the pictures and then released them does go from think he's about to get kicked out of office well he doesn't think that mike pence is going to invoke the 25th for a number of reasons one it would take too long and donald trump could just send
7:07 pm
a letter saying i don't agree and that starts the whole process of having to get a panel of independent experts just slows the whole thing down does he think he's going to. run into problems with impeachment with the house he thinks that that's an issue but he doesn't think they'll get anything to the senate and the senate able to hold a trial before we get to the 20th of january so he reckons he's probably pretty safe until then of course the difficulty he's got is that they could still carry out impeachment hearings after he leaves office that would impact him in the way that losing 80000000 twitter followers has impacted him he realizes that if he is impeached by the house not only will be going down in history as only the the 1st president to be impeached twice ok also lose access to his intelligence probably haven't i'm sorry to cut you off those proceedings are underway let's listen and probably paul di irving sergeant at arms. without objection the
7:08 pm
resignation is accepted pursuant to the provisions of section 208 a of the legislative reorganization act of 946 the chair appoints timothy spall blodgett of the state of new york to act and to exercise the duties of sergeant of arms of the house of representatives affective today right there without objection the chair will now it minister of the oath of office please raise your right hand you salame lee swear there you will support and defend the constitution of the united states against all enemies foreign and domestic that you will have a we're just going to have this for a 2nd of course some procedural motions playing in the. in the chamber right now
7:09 pm
just for viewers just joining us to remind you of what we're expecting to happen in the next few moments we are expecting to see the. motion going forward presented in the house which is likely to call on mike pence to invoke the 25th amendments that's the amendment that will be needed to remove president trump from that resolution is happening night let's listen house resolution 22 resolution allotting a member to a certain standing committee of the house of representatives without objection the resolution is adapted and a motion to reconsider is laid upon the table.
7:10 pm
without objection that chair lays before the house the following resolution. house resolution 23 resolution electing a member to a certain standing committee of the house of representatives. without objection. ok there's quite a few resolutions to it appear as soon as we get that resolution that's going to ask. mike pence to invoke the 25th amendment. oh the judiciary charge from further consideration of h 21 and there's virtual media consideration in the house the clerk will report the title of the resolution house resolution 21 resolution calling on vice president michael r. pants to convene and mobilize the principal officers of the executive department of the cabinet to activate section 4 of the 25th amendment to declare president donald
7:11 pm
j. trump incapable of executing the duties of his office and to immediately exercise powers as acting president for what purpose does the gentleman from west virginia writes i object objection is heard pursuant to section 5 a one b. of the house resolution 8 the house stands adjourned to 9 am tomorrow so the house then of journal mind tomorrow that resolution is being presented as before the hosts we have heard one objection that let's cross back to see castro who is on capitol hill for us heidi if you could just explain there's a lot of procedural a lot of procedural things in there but we did hear that resolution 21 calling on mike pence to invoke the 25th amendment just explain what's happened what this
7:12 pm
means and what's likely to follow sure. this is a very rapid fire of course so this is the pro forma session of congress so we didn't see you know those debates that our viewers they have been used to which is all expected and what happened here was democrats tried to present for unanimous consent that resolution calling for the 25th amendment to be invoked by vice president mike pence and you need only heard a republican representative from virginia object to that which strikes the measure down and it wasn't unanimous democrats will respond or expecting that now tomorrow they'll bring up the same resolution up to house floor vote and if it passes with just a majority of members then it would give mike pence 24 hours to do as asked by this resolution which is to invoke the 25th amendment convene cabinet members to remove trump from office hence has already said he is opposed to that idea and in fact this resolution is non-binding it's just
7:13 pm
a wishful it's demand but if he does nothing about it nothing happens except something will and the fact that democrats are expecting to then introduce the articles of impeachment the one article i should say of impeachment against president trump that has already been drafted and they that they have been keeping in their back pocket to be introduced as early as tomorrow afternoon once this 24 hours is up for mike pence or to be introduced wednesday and this article which already has $210.00 democrats signed on it reads that it's charging president with inciting willful violence against the u.s. government not only does it cite the speech that he gave last wednesday at that rally of supporters telling them to march up beyond the u.s. capitol here to overturn the presidential election which of course leading up to that mob violence that we saw here in these hallowed halls but the article also
7:14 pm
says that this is part of a pattern that trump has been trying to. site and overturn the presidential election results calling georgia's secretary of state about a week ago trying to find the number of votes needed in georgia to overturn the presidential what results are there so there are enough democrats to to pass that likely it's nearing the majority in the house already which would a impeach president trump making in the 1st u.s. president ever to gain cheap peached twice in office but what does that leave us with with him only few days left in office trump would leave january 20th joe biden will be inaugurated as planned and then there's talk of possibly still holding a senate trial to see whether or not trump will be convicted of this impeachment that has never happened before with this sort of timing where you bring a former president at that point back to congress for an impeachment trial but
7:15 pm
democrats are saying it's important to do to to have as the last punctuation point in this troubled presidency of president for the history books and also because if he were convicted in the senate the body could also move to bar him from holding office in the future which would be in practical terms. barry's consequential and that trump has long said he doesn't want to run for president again ok. explaining it all to us thank you very much indeed unless head back to the white house. is still there for us. one could assume president trump is breathing a sigh of relief given the attempts to force the vice president. 25th amendments has been delayed there's no unanimous consent.
7:16 pm
is likely to happen next do you think from the president's point of view. well it's delayed no more than that i mean the president is probably calling republican lawmakers to see if he still got a level of support he was certainly heartened over the weekend according to reporting here in the u.s. that there were a number of republicans who still went on t.v. to defend him a number of republicans who said it wasn't the time to impeach on a number of republicans who attacked the democrats but even considering such an action against donald trump but the reality is he's in his last few days this is his last feel week as president there's been a standing joke here at the white house that we were always going into infrastructure week and always seem to get derailed by the president tweeting something but this week is definitely button is showing the legacy week that's what the they want to do they're hoping that they can get the president out about seeing promises made promises kept one of the things that they intend to do is to go to the border on tuesday he's going to
7:17 pm
a place called very close to the border with mexico not the alamo but a place in texas where they have built somewhere in the region of 640 kilometers 'd of wall now you know that donald trump said that mexico was going to pay for it that's a promise that he hasn't been able to kate but they're mexican simply haven't done that and of course he did say that he was going to build a wall from she sea to shining sea about 2000 miles or 3200 kilometers in fact the only money 6640 kilometers a lot less of that is actually new wall so for the rest of the week that's one thing that he's going to do we also expect to see a round of pardons they have been controversial in the past people are watching to see whether or not the president gives himself a partner as he walks out the door that too would be highly controversial and be challenged by the supreme court he's also thinking about executive orders particularly ones targeting kick tech companies is not happy with twitter kicked
7:18 pm
off the platform and friday he's not been happy with facebook for a while and he thinks they should act to remove the legal protests. actions that they have that would take an act of congress but they're looking at what they can do through executive order and that is something we might see before the end of the week as well he's doing all this against the backdrop where 57 percent of americans in a recent poll say he should go no and 70 percent disapprove of his behavior particularly in the run up to what happened on wednesday it is possible that donald trump could leave the white house someone who's never enjoyed huge approval ratings with the lowest approval of any president and that even includes richard nixon ok alan fischer there joining us live from the white house for an hour hour and thank you very much indeed but stay with us we can go to i suggest sugarman he's a professor of law at ford and university school of law and joins us by skype from newton massachusetts creates everywhere there's here on al-jazeera.
7:19 pm
just tell us what it in terms of the situation that the united states finds itself in right now do you think it's likely that the 25th amendments will be enforced. i think it's unlikely now the moment really was last week and vice president pence abdicated his responsibility to move forward one reason why several cabinet secretaries resigned last week on friday is that they were waiting for about 24 hours to to find out if they were needed the 25th amendment process requires not just the vice president but cabinet members to vote together on the question of the president's quote inability they resigned when it it seemed clear that pence had thought and then rejected the use of the 25th amendment and so i think that the house democrats are have waited too long for this
7:20 pm
process and so now the impeachment process is not going to actually move quickly enough to to remove president trump that's a do you think this is a missed opportunity that because if the 25th amendment is what needed to happen and it's not happened there's only 9 days left with president johnson yes that's. this was yet again a major error by the house democrats not taking its powers seriously they delayed subpoenas and oversight over the last 2 years it's one reason why the trunk tax returns never made it to congress was because the house botched the subpoenas but with both delay and legal errors and frankly these articles of impeachment should have been voted on on friday and once that window once they didn't do it on friday it allowed a whole weekend pass and now the what's at stake with impeachment is not trump's removal but his disqualification from holding office in the future that's important
7:21 pm
but we all the crisis was his grave last week and if we were to take congress seriously that they thought that trump was inciting insurrection my question is why didn't they do this on friday and what do you think happens then if if they if these delays continue if there is this going to be no 25th amendment. they might put forward the articles of impeachment but it looks unlikely it is going to be a trial in the senate. in the near future it seems that there are going to be no consequences for the dance of love last week what do you think. this this means for american democracy then. to be blunt the american the americans need to get new leadership in the democratic party. this this was i think a major mistake both morally and politically that the democrats who are under siege
7:22 pm
physically themselves on wednesday that they couldn't return to in their offices with broken glass i understand the trauma but look i think it's really important to know that it's that one of the processes is going to be a senate trial on not just removal but after troops out of office disqualification is a punishment but let's also remember that trump even if he pardons himself regardless of my argument is that that cell pardon would be invalid but he faces state criminal prosecution which the federal pardons cannot do anything about federal pardons only work on federal crimes and trump is facing state crimes is it possible that drunk could face prosecution for the events that happened last week my view is that trump speech itself was not enough but i think between his intervention in the george of the phone call he made to georgia election officials to georgia state law
7:23 pm
he could then if he pardoned him self georgia state prosecutors may be prosecuting him and it's possible that he will face state prosecutions for is omissions and for his his is gross misconduct on wednesday ok i'm afraid we're out of time to commend but and thanks very much indeed for sharing your thoughts and your analysis minutes here on out to vera thank you for having me. other news now in the u.s. is preparing to designate yemen's hooty rebels as a terror group in response the hoodies declared it america is the source of terrorism aid groups warn the blacklisting could have catastrophic consequences in a country already suffering the world's worst humanitarian crisis. reports.
