for a 2nd time for inciting his supporters to attack the congress last week so updates from our correspondents we'll talk to an official at the white house shortly about what donald trump is actually up to starting that with count story on capitol hill good morning to you heidi we've got impeachment and we've got 25th amendment take us through both of them and in crucially what order they are happening. that's right house democrats are essentially kemal wielding both of these tools at the same time trying to hold president trump accountable for inciting the mob violence that we saw unfold in the capital a week ago on this resolution for the 25th amendment it seeks to call on the vice president mike pence of trump's cabinet to essentially seize power from trump by declaring him unfit for office this resolution did not pass by unanimous consent yesterday as expected a house republican objected to that and so now we're seeing work to leading up to

a floor vote with that resolution returning this evening for a full house vote it is likely to pass but even if it does the gesture is largely symbolic because this is a non-binding resolution ultimately it's still up to pence whether or not he wants to invoke the 25th amendment and he is said to be opposed to the idea in fact he reportedly met with president trump yesterday at the white house for an hour and was said to have a quote good conversation with the president unclear whether this resolution and the 25th amendment was a topic of conversation so democrats are still giving pence another opportunity 24 hours from the time this resolution passes to take action if he does not democrats have a backup plan and of course that is the other option here the impeachment article that we saw introduced yesterday it is one single charge saying that president

trump is guilty of inciting violence against the u.s. government now democrats in the house are largely behind this effort and there could be somewhere between a handful to a dozen republican house members who jump on board as well and this is all leading up to a planned vote on this impeachment article tomorrow wednesday this is going faster than any impeachment and recent. history namely the one that happened to trump a year ago if you recall that took months well this time democrats are trying to race against the clock because if trump is impeached as expected his term expires in just 8 days and so putting him on trial in the senate will likely not happen until trump is out of office democrats are going forward anyway they say because this would be holding the president accountable it would also have the practical purpose if convicted of barring him from holding future office but anyway there's a long way to go before that namely also joe biden the president elect will be

a 2nd impeachment i have varying stories that yes he won't be able to run for federal office or he might actually knows the secret service detail afterwards or he might lose his pension is that do you know either way what the definitive was on the 1st of all being impeached. you know he's been impeached before he would have to be convicted by the senate now once he leaves office next week he can no longer be expelled from the presidency so the only question is can the senate hold a trial solely for the purpose of disqualifying him from holding office in the future and there are there are many different legal views on this and some. some credible. legal scholars and judges say is that he cannot that there is no basis to hold a trial for

a private citizen merely for the purpose of disqualifying him from holding federal office in the future now obviously the democrats are going to argue otherwise but this is never been tested there could be a legal challenge to even holding the senate trial. based purely on that if trump has already left office which he will be next week so then the question is that gets litigated up to the supreme court it's unlikely the chief justice john roberts knowing such a legal challenge can is coming can even preside over an a senate trial and remember the constitution requires the chief justice to preside over a senate impeachment trial so. i don't know how this is going to play out i don't think anybody knows his point michael you are going to choose my words very

we've seen none of that from donald trump in the last week he hasn't even remember congratulated joe biden won the election when the last thing we had from him talking about the election was the fact that it had been stolen from him and he repeated that even on thursday when he was calling for calm and saying that it was wrong to cause violence at the capitol he again repeated that he felt the election had been stolen from him so while we're getting some patterns of behavior that fit into the norm there's not he's not following the template that was created over many many years and really that's again the trouble presidency in an. show he has a not conformed to the template some people say that's a good thing as exactly why he was elected because he wasn't a politician he wasn't like all the others and that's what made him so popular but there are others who say there are certain things in a democracy in a republic like the united states that should be followed because that is what
