assess where we're going at the moment. well what we do know is that the democrats have a majority in the house and this motion is going to be passed but what we also know is that it would appear to be an exercise in futility given the fact that vice president mike pence has already said that he will not invoke the 25th amendment he sent a letter to the speaker of the house saying that it would set a terrible precedent he also argued that it was not constitutionally viable insisting that the 4th article of the 25th amendment is in fact designed to deal with the incapacitation of presidents as happened with george bush a number of years ago when he went under anesthesia so mike pence making very clear that he's not going to invoke the 25th amendment but the debate goes on and the vote will go on and although this may appear as i said to be an exercise in futility it's also giving away a dress rehearsal for what's going to happen tomorrow when the article of

impeachment will be debated by the house and we are likely to hear many of these same arguments being repeated there and where we are likely as well to get the same result as we get tonight and that is the motion being passed given the democratic majority in the house but what's very important and many democrats view this as well is for the vote tomorrow to be more of a bipartisan nature in other words for some republicans even though they arguing against this motion to actually support the impeachment process because this would send a signal that it is not a purely partisan process that it is not as president claims a political witch hunt and it would be something to reassure his supporters that this is not an action with a political motive it is an action rising out of concern that is shared by elements from both sides of the aisle this would be a very important step for many of those who want to see this impeachment process happen and it's going to happen as i said the house speaker nancy pelosi has

already know. 9 impeachment managers will guide the impeachment process through the house over the next 24 hours and of course mike there is a suggestion that a significant number you suggested yourself of perhaps republican house members will also vote for the impeachment. i just want to get your impression of what you've heard tonight i mean yes of course you know you have the democrats and one side the republicans on the other but there are a lot of republicans that are disassociating trump's comments from the actual mob that they're in they're in agreement with the democrats that the house was attacked but they're trying to disassociate the president away from the arguments. indeed you have some republicans arguing that the c evening but it's important as well that these are 2 separate issues there are some republicans who are going to vote against the motion to tonight because they actually agree with mike pence and

see it as a constitutional precedent that is unacceptable they would argue as we heard from some of the speakers there that the 25th amendment is not an instrument of punishment as the democrats would have in this particular motion that it is in fact designed to deal with a president who falls ill or is in cap incapacitated physically so although they may be voting against this motion there are some of them not all definitely not all but there may well be some who would still support a motion of impeachment now we know some republican representatives have already made clear that they will support impeachment we know as well in the senate which is where the trial would take place after he is impeached in the house that some of the republican senators are breaking ranks and some of republican senators including the number 3 senator cheney have insisted that they will support

impeachment now about all of this and this is a very important point the last time president trump was impeached it was a complete divide it was utterly part of it in part from one republican senator who voted to impeach after the trial in the senate but now it's very different you have as i said got republican senators who may conflict on the trial and importantly you have the majority leader in the senate mitch mcconnell keeping absolutely silent on the last occasion he was drawing all the ranks of the republicans to insist that the impeachment be resisted he is absolutely silent at present you have as world the. minority leader in the house who although he says he personally will not support. that impeachment has given no guidance to the other republican members of the house last time the instruction went out you will not vote for impeachment this

amendment of the senate needs to be prepared for an impeachment trial. i believe that there is utility in the 25th amendment in so far as it can remove mr trump from office immediately upon a letter from the vice president supported by a majority of the cabinet saying that mr trump is unable to discharge his duties namely to faithfully execute the laws and to defend the constitution of the united states against all enemies foreign and domestic and because he's devoted to taking a wrecking ball to the constitution indeed he is notorious for saying which he never retracted and then i have article 2 where i can do anything i want as president and that is exactly a statement that he's unable in to operate within the constraints of the constitution but it's the speed of the 25th amendment that gives it an advantage

percentage in order to reach the 67 mark that would result in 2 thirds vote to oust mr trump from office preclude him from running for 2024 if that's the case bruce i mean you obviously heard our previous guest who's an attorney and a republican strategist for maryland shortly he was talking about the divisive nature of the fractures that have been coals within the republican party this has set more than fractures through the through legislators both in the house and in the senate about what happened on the 6th of january how does this reverberate in the g.o.p. at this present moment in time when you have people like mitch mcconnell and mitt romney really at the forefront of maybe guiding many more of their colleagues into how they act in the next 244872 hours. well i think there will be some fracture but i think it would be largely minimal remember you've omitted liz cheney who is the house republican conference leader is the

daughter of dick cheney who also is one of. a half dozen a former secretaries of defense who also urged the military to disobey you know any illegal unconstitutional order of mr trump and clearly opposing and being appalled and is incitement insurrection and and seditious conspiracy and so and mr cheney is not on the centrist side of the republican party he's clearly on the very right side but you will find a handful maybe mr cruz from texas and mr josh hallie from missouri but it will be tiny and it will be a lot more healthy and the republican party will be able to heal much more quickly if trump is out of the running in 2024 because he's been disqualified from holding office again as long as trump hangs like a sword of damocles over the part because he could continue to run i think it will cause the party to remain

i think the most desirable is that he's out of office and he's unable to run again so he's no even potential threat but even if he's not disqualified it's surely true that once he leaves office the number of quivers in that he has an order to attack his enemy plunges considerably he's off of twitter is off of facebook it's not clear how much he won't be able to offer you know any pardons is not able to offer any grants he's not a year old offer any political favors and he's not able to threaten with investigations or anything else he could utilize executive power for treaty alley we know he's notorious for firing anybody and trying to isolate and fire from from positions of authority anyone who opposed him but that all vanishes once he leaves office he still will have a core of supporters but i think they will dwindle by at least half their a large portion of the electorate.
