coronavirus. italy's largest mafia trial in decades gets underway in a custom built high security prison courthouse. just amid all the sports news poll since manchester united top of the premier league 3 points of defending champions liverpool. welcome to the news hour in about an hour's time the u.s. house of representatives will meet to consider whether to impeach president donald trump for an unprecedented 2nd time so democrats accuse trump of encouraging his supporters to attack the capitol last week they want him charged with incitement to insurrection this is their 2nd push this week to remove trump from power on tuesday the house passed a resolution calling on vice president mike pence to remove him from office but

pence is refusing to take any action now trump has dismissed attempts to oust him from power as a witch hunt he says his opponents risk dividing the country mike hanna begins our coverage from washington d.c. the resolution is that without objection the motion to reconsider is laid on the table ultimately this appears. to be an exercise in futility as expected given the democrat majority in the house the motion was passed but there is only after the vice president stated he would not invoke the 25th amendment and remove president trump from office in a letter to the speaker of the house the vice president said and i quote i do not believe that such a course of action is in the best interest of our nation or consistent with our constitution he added under our constitution the 25th amendment is not a means of punishment or usurpation invoking the 25th amendment in such

a manner would set a terrible precedent. the debate did serve to indicate the arguments that are likely to be used in the impeachment process that will now begin in the house on wednesday the president was hell bent on trying to challenge undermine and overturn the results of the election in all of the events leading up to january 6th and on january 6th that is a profound during. the president's judy. there are those republicans who strongly disagreed including one who was controversially awarded a medal of honor by president trump on monday in kenya calls to impeach the president or remove him from office for using the 25th amendment i don't think are healthy for our nation early in the day the president made his 1st public appearance since the eruption of violence in the capital last wednesday while besetting a portion of the border wall he continued to deny any responsibility for the damage
4:04 pm
and the deaths lashing out at those in congress seeking his impeachment the impeachment hoax is a continuation of the greatest and most vicious which aren't in the history of our country and is causing tremendous anger in division and pain. but the majority of house members are adamant that the violence in the capital last week was a direct consequence of what they call incitement by the president the seed has resulted in what the f.b.i. and the acting u.s. attorney say is the most extensive criminal investigation ever launched in the u.s. . i think the scope and scale of this investigation in these cases are really on presidents and not only in f.b.i. history but probably d.o.j. history in which essentially the capitol grounds outside and inside are essentially a crime scene. charges have already been laid against some 70 individuals and this number will increase substantially in the weeks and months ahead the department of
4:05 pm
justice says the crimes being investigated range from misdemeanors like trespass to conspiracy sedition and murder. my kind of washington are let's bring in alan fischer for an update allan is joining us from the white house so allan just talk us through the order for events in just about an hour's time sir. well the house will gather they will have a vote it's only the democrats and their team will lay out the case for impeachment it's possible that some people may speak in defense we've already had from the likes of jim jordan very close ally presented with the medal of freedom or monday he might well argue against the whole process is certainly claiming that it would divide the country even though he was one of the people who of course voted against the certification of the electoral college votes even though there was no evidence
4:06 pm
to back up the claims that he was making in the house chamber there will then likely be a vote it's almost certainly going to go through and we know that there are support there from republicans liz cheney who is the number 3 republican in the house she's the daughter of dick cheney remember that name vice president under george w. bush she has already said that donald trump is essentially a disgrace to his office and the orth that he took to protect the constitution so she is definitely a yes vote then it if it passes then is up to nancy pelosi to decide when that goes to the senate and you'll remember that when there was the 1st impeachment vote on donald trump she held it for several days before sending it to the senate she could well make a decision to send it immediately and the we know that there is support in the senate even among republicans to impeach donald trump mitch mcconnell who's the leader of the republicans in the senate is on the record as saying he believes that
4:07 pm
donald trump may well have committed offenses that impeachable if you lose mitch mcconnell there may well be others in the caucus who will vote to impeach donald trump but of course he would be allowed in the senate to make a defense so we've got some indication of what the argument there would be 1st of all that if you take this standard of incitement it doesn't meet the criminal standard that's not exactly what the senate have to decide. and of course if it still leaves till after he leaves office there is an argument that tom's lawyers will put forward that you can't impeach someone once they have left office no what is interesting is that it has happened before not for a president but for a judge and he was impeached after he left office there's always the possibility that there could be legal challenges to this but the supreme court have said in the past really impeachment is a matter for the senate it's really up to them to deal with it it's nothing to do with us and that could well happen again so a lot of questions still over the whole process but the 1st step will be
4:08 pm
a vote in the house and it will almost certainly vote to impeach donald trump for a 2nd time and alan any news about the president and how he's feeling about this and his mood i mean obviously his no longer on social media because his accounts have been suspended. do we know about his mood as he watches all of this unfold. and also overnight by and by you tube so he continues to lose any access he has to social media platforms we know that donald trump was very bullish when he spoke to the media for the 1st time on tuesday as he headed down to texas he's in the white house he's not in the oval office at the moment but it is very early he tends to get their own mid-morning he apparently is very angry at the whole idea of another round of impeachment hearings he's already said that it's just a continuation of the greatest witch hunt which of course is what he refers to when he talks about the russia investigation and of course the subsequent investigation
4:09 pm
into his phone call with the leader of ukraine he is not very happy with the whole process he has been calling allies over the last few days to find out where exactly he stands but if people think he's going to resign because he might be impeached that's not going to happen if you're think that may happen that's not who donald trump is and it certainly would be so out of character from the president that we've seen over the last 4 years and today enters his last week in the oval office all right alan fischer thank you for that update from the white house let's keep the conversation going with theatre johnson who's a senior fellow at the brennan center for justice he's joining us from washington d.c. thanks very much for your time with us on the news hour how likely is it that donald trump becomes the 1st president in u.s. history to be impeached twice. it's extremely likely very likely the articles of impeachment are supposed to be brought before the house today the democrats have the majority but even without that we've seen
4:10 pm
a number of republicans suggest that they would also support these articles of impeachment so the president will be impeached twice and he will be impeached twice as the sitting president and the question is what happens after that and this is where the constitution and interpretations of the constitution are a little vague a little blurry and scholars will have to engage the debate there but there is no question that chuck will be impeached twice it is unlike the last time this time will be a bipartisan effort to impeach the president for inciting the ride that we saw at the capitol last week and now he will go down in history as the only president that has enjoyed such an honor. of being impeached by a right and then what will happen in the senate when that trial actually takes place i mean do you expect that 2 thirds of the senate or at least 17 republicans vote for conviction how likely is that. yeah so this is an open question i do look the senate is in recess until just before an i.q.
4:11 pm
ration so the likelihood that they will take up the articles of impeachment before an occupation day is very unlikely i think in order to reconvene every single senator must agree to reconvene that means 100 senators and this is this is a high bar to clear so the question then is after inauguration can president trump then be convicted of the articles of impeachment passed in the house and then be barred from future office based on those votes this we don't know but here's what you know but assume that all these things are possible could the senate clear the bar that would require $67.00 senators 50 democrats or 40 or so democrats plus 2 independents and then 17 republicans to get on board about a dozen republicans have suggested in the senate have suggested that they would support convicting the president and removing him for you know being eligible for future office that paul short now importantly speaker mcconnell or leader mcconnell
4:12 pm
has to basically told senators to vote your conscience and not try to whip the votes in order to prevent the convicting conviction of the president this is different from the last time and so now senators have a little bit more latitude and they will absolutely be thinking about their political fortunes and futures based on this decision of to convict or not i can't specifically i meant mcconnell how much of a turning point is this how much of a turning point is this for mitch mcconnell because it's reported that he is pleased about the impeachment and he said that trump could have. it could be accused of committing impeachable offenses. so i think what mcconnell is doing is looking at the future of the republican party and i think he seems that once something has gone a republican party that's closely tied to trump ism doesn't have much of a future in united states of america so this turn that mcconnell has done kind of forecasting it for the last few months certainly the last several weeks is about
4:13 pm
the future of the party and its ability to compete in the country this is not a change of conscience this is not a moral appears to me this is about political expedience or i think our johnson thank you so much for speaking to us from washington and to the u.s. federal authorities have executed a woman for the 1st time in almost 7 decades she was convicted of killing a heavily pregnant woman and cutting the baby from her womb in 2004 the child survives montgomery's lawyer has pleaded for clemency saying she suffered from mental illness following years of abuse samus ravi has more one of the few legal battles the trumpet ministration would win in its final days the right to carry out the 1st federal execution of a woman in nearly 70 years lisa montgomery was sentenced to death for strangling bobbie jo stinnett a 23 year old pregnant woman in 2004 and cutting the baby from her womb the crime was barbaric but so too was the punishment said montgomery supporters before her

do he is going back into a situation where we know that the russian orthodox use who deny having any involvement in what happened to him while some in russia we know now are saying that they want him to go to prison for what he food food for the sort of situation that he has found himself in so all eyes now on moscow on sunday to see what will happen to mr when he finally gets back. all right dominic kane reporting from berlin thank you dominic. just to bring you some breaking news coming out of the united states and we're now hearing that new york city is saying that it will be terminating business contracts and president donald trump this coming after the insurrection at the u.s. capital alan fischer once again joining us from the white house this news just coming in allan what more are you learning. well the new york city says it looked at the contracts that it has with the trump organization there what they do you see around $17000000.00 and they decided that they hide
4:45 pm
a note was that anyone involved in criminal activity gives new york city the opportunity to cancel those contracts they're saying that as the company the head of the company donald trump even though he says he's not involved in the day to day running of his operation anymore because donald trump is involved with the company then it has the right to terminate the of those contracts because he was involved in an insurrection against the government of the united states pretty strong words donald trump will see this really as a political move by new york city in particular new york mayor bill de blasio he says that new york which is democrat run really doesn't like donald trump and you remember that the attorney general in new york has carried out several investigations including closing down donald trump's charity because of double dealing essentially what they were doing was taking money from people saying it was going towards the charity and then investing in their own company and you remember that not only donald trump but 3 of his adult children eric jr and ivanka have to
4:46 pm
get permission before they can set up any further charity in new york city so this is a blow out simply because donald trump will suggest that he's not involved in the day to day running that he doesn't make those sort of decisions is left to dawn junior and eric to make those calls but this is a clear message from new york city that donald trump's time in new york where of course he was lauded and he would suggest loved by many people in the city that that love affair is no over and they are canceling contracts worth $17000000.00 with the trump organization all right alan fischer thank you very much. an important gathering of north korea's ruling party leadership has wrapped up with a commitment to a further develop the country's nuclear arsenal so the party congress outline pyongyang's policy agenda as it prepares for a change of leadership in washington rob mcbride reports from seoul. this rare party congress has ended on
