a custom built high security court house. thanks for joining us the u.s. house of representatives is meeting right now to consider whether to press ahead with the unprecedented decision to impeach president donald trump for a 2nd time so democrats accuse trump of encouraging his supporters to attack the capitol last week they want him charged with incitement to. this is there a 2nd push this week to remove trump from power on tuesday the house passed a resolution calling on vice president mike pence to remove him from office but pence is refusing to take any action now it's not only trump's political career taking a hit it's also his business interests we've just heard that new york city will terminate its business dealings with. because of last week's events on capitol hill

. we'll have more on that shortly with alan fischer at the white house but 1st let's bring in hyde is o. castro she's joining us from capitol hill so that unprecedented meeting just starting heidi talk us through what we expect to see it happen. the ring will expect the house to convene at any moment and they will start by debating the rules that will lead in to that will govern really how this impeachment article will be discussed later in the days so there's going to be some housekeeping at 1st by mid day we're expecting around early afternoon perhaps the debate on this article will actually commence 2 hours of debate likely what is this article will it cuse is trump of inciting violence against the u.s. government 2 hours of debate on that again is likely followed by the vote in the house and at this point it appears there are enough votes to officially impeach

trump for the 2nd time the 1st president in u.s. history that has ever happened to this fall is on the tails of another historic vote we saw last night in the house that passed with one republican in support which called on vice president mike pence to invoke the 25th amendment immediately removed from office or pence delivered a letter to house speaker nancy pelosi said he is not going to take that action which is why we're seeing the impeachment proceedings happen so quickly in the house it's always been the backup plan for democrats knowing how unlikely the 25th amendment being a vote would be but what is major really different about this impeachment as compared to a year ago of course when troubles impeach for the 1st time what we're seeing 2 major differences 1st it's the timing with only 8 days 7 days now left in office

for the president and democrats are going to forego all of the inquiry phase those hearings we saw unfold a year ago well that's not going to happen again it's just 2 hours of debate before the article itself is voted upon. before trump is officially impeached the other difference is we're seeing a growing number of republicans in the house break with the president saying that they will vote to impeach as well the last impeachment was completely supported by only democrats but now at least 5 house republicans perhaps up to 20 we're hearing may vote to impeach as well then this would all head over to the senate where the current senate majority leader mitch mcconnell republican has signaled that he is quote pleased that this is going forward this is a dramatic shift as compared to the 1st impeachment and those words from the connell may give cover to his party members in the house to vote for this

a very serious charge and i think that many senators and members of the house felt that their life was in danger and they're taking this very seriously. and of the fact that mitch mcconnell is reportedly saying that he's pleased about the impeachment is this a turning point for not only the president but also for the party itself. well i do and that remain i think that what mcconnell has said is that he thinks this will enable them to curb trump ism from the party but many of the newly elected state legislators are she would on types right and so there's a lot of people in the party still who have trouble like attitudes but i think you know it could very well be a turning point if other republicans choose to make it what so what does that then and i mean for the republicans is this about symbolism or is it more about strategy is there a strategy behind them not wanting him to run for office a 2nd time of course that's if he's convicted in the senate it could also just be

just as great i mean so the capitol is the closest thing to a sacred secular space we have right and it was damaged the people attract feces and urine and so and the members of congress felt their lives were in danger so this could just well be a vote of justice. what about those republicans who put forward the argument that the impeachment might be divisive too divisive for the country at this point yeah those same republicans were the ones who were objecting to certifying the electoral college so i don't think their opinion counts at this point however there is one take on this so a measure that the senate doesn't act until biden takes the presidency well biden wants to use the 1st days of his presidency to roll out zach scene plans to roll out economic plans and to be able to function effectively is going to have to work

with republicans that the senate mcconnell saying that will suggest that impeachment will not in however if you have peace process becomes highly partisan then that could possibly slow down his rollout of his program and that might not bode very well for biden would it not. well so yeah it would be he wants to have support of the republicans he can win 50 votes if he holds all the democrats in line but we have mansion at least on the democratic side who is very conservative there's a couple of others so it would work better if he has some support from some republicans. if this actually gets the senate and the likelihood is that it will get to the senate i mean will 2 thirds of the set or at least 17 republicans vote for conviction do you think. it doesn't have to be 17 people come and then don't

the 1st federal execution of a woman in nearly 70 years lisa montgomery was sentenced to death for strangling bobbie jo stinnett a 23 year old pregnant woman in 2004 and cutting the baby from her womb the crime was barbaric but so too was the punishment said montgomery supporters before her sentence was carried out it is not about getting her out of prison it's not about excusing the crime it's about you know explaining why it is that this is that situation where a president should exercise mercy montgomery's lawyer said her parents put her through years of sexual and physical abuse from an early age the details of what she suffered as a child were horrific including torture which led to her mental illness those who campaigned for her including her sister said the death penalty was too severe so many people let her down yes i started out the same way but i went into

as these have no place in our republic these shocking and sobering events rest high on our minds today as well they should certainly january 6th 2021 will live in my memory as the darkest day during my time of service as a member of this house after these grave events we as a nation and as an institution have an opportunity to come together president trump has conceded to 2020 election congress has certified the results of the election and next wednesday president elect biden will be sworn in as the president of the united states congress and the nation can move forward knowing that the political process was completed as designed and the constitutional framework that has governed our republic since 1789 held firm but instead of moving forward as a unifying force majority of the house is choosing to divide us further with only

a week to go and his term the majority is asking us to consider resolution impeaching president. as in trump and they do so knowing full well that even if the house passes this resolution the senate will not be able to begin considering these charges and till after president trump term ends mr speaker i can think of no action the house can take is more likely to further divided the american people and the action we are contemplating today emotions are clearly running high and political divisions have never been more apparent in my lifetime we desperately need to seek a path forward healing for the american people so it's unfortunate that path to support healing is not the path the majority has chosen today instead the house is moving forward erratically with a truncated process that does not comport with the modern practice and it will give members no time to contemplate a serious course of action before us and every modern impeachment inquiry and

investigation and committee action has proceeded bringing an impeachment resolution to the floor in part this is to ensure that members have the full facts the opportunity to engage expert witnesses and have a chance to be heard it also provides due process to the president the united states and again and every modern impeachment inquiry the president has been given an opportunity to be heard in some form or another this is necessary in order to ensure that the american people have confidence in the procedures the house is following and it's also necessary not because of the president's inappropriate and reckless words are deserving of defense but because the presidency itself demands due process in the impeachment proceedings unfortunately the majority has chosen to race to the floor with a new article of impeachment for going any investigation any committee process or any chance for members to fully contemplate this course of action before proceeding

professor jonathan turley is correct when he called this. a quote dangerous snap impeachment and impeachment that effectively would go to a vote without the deliberation or inquiries of the traditional hearing professor turley also noted that quote the damage caused by the rioters this week was enormous however it will pale in comparison to the damage from a new precedent of a snap and pietschmann unquote if the majority seeking consensus this is hardly the way to create a majority failing to provide the house with an opportunity to review all the facts which are still coming to light to discuss all the evidence to listen to scholars to examine the witnesses and to consider precedents this is not the type of robust process we have followed for every modern impeachment and the failure to do so does a great disservice to this institution and to this country mr speaker i can think

of nothing that will cause further division more than the path the majority is now taking rather than looking ahead to a new administration the majority is again seeking to settle scores against the old one rather than seeking to heal america they are seeking to divide us more deeply and rather than following the appropriate process as the house is used in every modern impeachment majority is rushing to the floor tripping all over themselves and their rush to impeach the president a 2nd time what's worse though the majority seems to believe that this course of action is so i haven't and that's simply not the case i have to tell them it's not members that have reviewed the same conduct and i've come to dramatically different conclusions legal scholars like professor turley and professor alan dershowitz both of whom condemn.
