in a bipartisan way the house demonstrates that no one is above the law not even the president of the united states. that donald trump has a clear and present danger to our country. and that once again we are over the office to protect and defend the constitution of the united states in a late video message from the oval office trump did not address his 2nd impeachment and instead asked the country for unity what is needed now is for us to listen to one another not to silence one another. all of us can choose by our actions to rise above the rank and find common ground and shared purpose today i'm calling on all americans to overcome the passions of the moment and join together as one american people trust message will not stop this

more republicans didn't vote to impeach donald trump. well it was certainly the latter for me i thought this was a line that was crossed last wednesday and i felt that more republicans may have the moral courage to finally step up and speak their truth and to really what more than anything could be considered as a denunciation of donald trump and what he's done to the republican party by remaking in his own image that loud boisterous no holds barred really nasty side of him that often comes out at rallies it is a part that people liked at 1st in 2015 into 16 and i would say over the years the private whispers that i've heard from members of congress people i've considered friends and i felt that at some point the dam would break and they would have an a chance and a choice to make about coming out and speaking out against this president who last

election with all empirical evidence to show it this past fall but they did it and this with about moral courage this is about self-preservation the 206 republicans who did not cross over i'm sorry there were less than that when we got to 10 at the end of the day so $21201.00 that shows at the end of the day to not cross over and vote with democrats for impeachment proved that they do not have the moral courage to lead our country to leave their districts and to do the right thing if the words of general colin powell that really struck me the other night when he spoke with c.n.n.'s fareed zakaria and he talked about how many of us in america thought that our elected leaders our officials would side on the basis of truth instead of going on the basis of their own electoral races their primaries and so this was what it was about i will say one final thing i was most disappointed about only 2 women being part of the crop of 10 republicans who voted for impeachment i'm proud

that one of those is my friend representative jamie herrera butler i have supported financially in the past. i think it took tremendous courage on her part she's only in her early forty's and has 3 very young children one of them actually around the age of my child and i would say that i'm very very proud of her i'm praying for her which she did was incredibly brave putting country before party bruce it's unlikely that the senate is going to take up the article of impeachment before donald trump leaves office so the question now becomes is the senate within its constitutional right to hold an impeachment trial after a president's term has in it i'm asking you this because there seem to be 2 schools of thought emerging around this debate whether or not the senate can actually hold an impeachment trial to remove somebody who has already left office. well we have a precedent in 1976 secretary of war head rebel nap was impeached in the house for

corruption and then he was sent to the articles were sent to the senate he resigned so he was no longer in office when the senate took up the case he argued exactly as you stated there's no jurisdiction i'm out of office the senate rejected the argument by a vote of 37 to 29 went forward with a convict and impeachment trial. and that's at least the binding precedent if you will it's on the record the united states supreme court in a case called nixon versus united states not president nixon but a judge nixon held in 1993 that impeachment issues are solely for the senate to decide that courts do not have authority to review their decisions which means that the senate will have the final say on whether it has jurisdiction and certainly believe as of january 20th there's shortly thereafter when the new georgia senators are sworn in the democrats will have the majority and they will vote that there is jurisdiction the supreme court will not intercede and we will move forward one of

the arguments i think strongly in favor of retaining jurisdiction is that the consequence of impeachment and conviction is not simply removal from office but the possibility of disqualification him holding office ever again under the united states which for mr trump would be a bar on running for president or winning the presidency in 2024 that's why impeachment remains important even after someone has left office scott from your vantage point what does a trial in the senate look like this time around and are we any closer to knowing what the timeline will be far as when the house will be transmitting this article of impeachment to the senate. well 1st on the timeline it was interesting about a week ago through his political ally james kleiber representative clyburn joe biden indicated that he really did want to see a trial during the 1st 100 days of his administration when you're trying to deal with the crowbars pandemic try to deal with the economy deal with the social issues

raised for example in the mass marches last summer but he changed course in fact within 24 hours and said ok if the senate can devote half of its day to doing central government business they can then do half of that state to a trial which i think is a signal that yes the house can transmit the order when pietschmann out now that a trial can begin soon after an operation on january 20th when of course the democrats will have a narrow majority because a 5050 senate vice president countless will be the deciding vote i think the wider question in terms of what it looks like and this i want to come back to read it for guidance it depends on the republican party were as trucks fortress with in washington has been those house republicans you know the republican party which is divided it has 2 different factions it has the troposphere including 138 almost 2 thirds of the house republicans who after all the violence last week in the capital

after the deaths still sided with trump in trying to block the president elect biden and then you have the senate republicans who i'm not sure are as diehard metropolis and indeed i think the person i'm watching is the top republican mitch mcconnell because he's really signal this week that he wants to purge the trumpets and he wants to get donald trump as far away from the party as possible which is why the tunnels now say not only that he will accept a trial not aeration day but that he will consider convicting trop and if he votes yes to convict then a lot of senate republicans will follow his lead and we could see that 2 thirds majority which would be necessary to punish trump reno you heard scott there he was seeking guidance from you on this point as well so let's pick up on what he was saying obviously there. are indications now that senate majority leader mitch mcconnell you know is signaling that he might support impeachment that he might vote for impeachment how significant is that and does that mean that you could see enough republicans in the senate when this trial actually takes place voting to to

convict president trump in this impeachment trial. well people are of mixed minds about this and anybody who sees me on social media knows that i've been a fervent advocate for impeachment and removal i've been against this president since he declared his candidacy way back now 2015 this is the kind of thing where people will say oh your opinion is colored but i think this this was a fine point made by my fellow panelists that this was for joe biden something that really has to push his hand you know many folks like biden have wanted to unify the country and said that impeachment is something that they believe it really signals that it could be something that divides the country but what we saw very clearly last week signals that the country's already so divided and with yesterday's vote in the house some would say and i'm of this you know 2 minds about this as well on the one hand i think that many representatives were scared of political violence

but the part another part of me feels genuinely that they were very scared of trump supporters not just of them committing violent acts against them sitting members of congress but really the repercussions they face at the ballot box so this was about reelection self-preservation as i said earlier but secondly there is the part where we've heard senators really speak out and i look at my my home state of west virginia and i look at senator shelley moore capito somebody who was in the house for many years prior to going to the senate there are women and men who are republicans longtime senators who are genuinely concerned about their legacy as well as what this means for the country if the president is not convicted so you'll obviously have the usual suspects like senator mitch romney and senator lisa murkowski of alaska and they will do the right thing and convict and then you wonder who will join them and i think a lot of senators republicans are what worried about their legacy and worried about what it will do to the country if they do not convict and donald trump will be

a private citizen at that point so so what i think we ought to really look at are mcconnell. actions here and one thing is true there was a huge issue for mcconnell it remains right now if he can be in the senate prior to an operation day one of the main reasons he would decline reconvening for that for an emergency session to put the president on trial president trump on trial he did he wanted to avoid the conflicts that would come with all hands on deck security that slated for the inauguration and that's really important to know this isn't always a personal decision this is i think mcconnell saying i don't want to take away from that because we now know where we're at political violence the f.b.i. is warning us is a minute so the bottom line here and this is to take from my friend mike allen with axios who's done some incredible reporting around this with his team he says this is the bottom line he says a year ago this week trump's 1st impeachment trial began a week ago yesterday approached mob storm the capitol and

a week from today joe biden will be president those words really hit me and they should hit the minds of every american this is about doing the right thing for the future of our country so that we do not become a banana republic some will argue we already are but i think our our republic our democracy is very much intact a couple more steps and we get close to absolutely breaking so we must do the right thing every american must stand up and call on our elected representatives to do the right thing so that we continue to strive for a more perfect union as our founders genuinely wanted us to do you know bruce in your previous answer you mentioned that the senate can also vote to disqualify president trump from running for office again. we know that that would be a simple majority vote but my question to you i just want to try to clarify this is this a vote that can only happen if 2 thirds of the senate votes to convict mr trump would it only be able to happen after that vote yes it would be the it in nature of the

punishment and you could have a whole range of fun. spends after someone's been convicted of a crime but you still need to prove the crime beyond a reasonable doubt so the simple majority only would apply to the imposition of the punishment not convicting him but you can have simple majority as that can decide rules of evidence whether that be cross-examination the time in the length of the trial which can be very important here i think however that we do not want to get too preoccupied with the maneuverings for then you know the next 3 or 4 years this really is what's been said this for not only for the living but for the dead at valley forge and cemetery ridge and omaha beach and those yet to be born we really are confronting a rubicon here we have a president that not only incited the rebellions that he insurrection the seditious conspiracy 2 days earlier tried to threaten georgia officials with retaliation if they didn't falsify the votes a president who stood up without embarrassment said and then i have article 2 where

i can do anything i want as president and acted accordingly this is something that a caesar would say not someone of the president of the united states like george washington who turned aside a crown said i came here to be part of a republic indeed among other things that he said i can't go to war use the military often civilly unless congress authorizes it so it's not a question in my judgment of whether there it whether the the members believe they are aided or not if they're really americans if they're really faithful to the founding generation who risked their lives their fortunes and their sacred honor not just reelection they were going to go to the team well it was a good team and they were going to be hung and and killed as traitors if they lost the revolution that's what they risked so we could have self-government that's what this vote is about and it's just appalling that people are saying well you know because black lives matter you committed few acts of violence the president of the

united states can act lawlessly and then run around and commit the most dangerous acts to our constitutional dispensation with him. but anyway i want to underscore what i believe are the highest stakes if we do not convict mr trump can you imagine the next president whoever it is of biden and his successor oh i can do anything mr trump did and i will not be impeached and removed from office then we have lost truly the republic and i want to recall these famous words of benjamin franklin he exited the constitutional convention in 787 was approached by a woman who said what we got then but if we got dr public or a monarchy he says a republic if you can keep it it's up to us to keep it and the time is now. scott you know for 4 years we've seen the republicans not only backing donald trump just across the board but also refusing to condemn any of his behavior no matter how outrageous it may have been you know it's clear that republican officials now from

the leadership on down are are backing away in some measure to president trump are these damage control efforts going to work with the american public. how cautious i mean come with the american public is that there is such a diversity of opinion because we're not just talking about the damage of trump in office we're talking about the damage of disinformation we're talking about the damage of belittling media and belittling any types of reliable sources of information that you have had this polarization and that you've got americans and i know some of them some of them are my family who will help our high water they will stand with trump no matter what happens so you can't really i think basis on public opinion i think i'd rather bring it back to and again this might come back to what we know bruce aside as some questions regarding the republican behavior over the past 4 years because the fact is is before we get to last week is that almost every republican in the national legislature in the house and the senate not only

protected donald trump they enabled him i mean they protected him during the truck russia scandal where trump should have been removed from office for working with a foreign power to get elected they protected him and enabled him during the truck ukraine scandal when he should have been removed from office and indeed wasn't paged over trying to get a foreign power to blackmail or spread this information on his political opponent joe biden there should have been a sanction against him for the longest government shutdown in u.s. history 35 days there should in a sanction against him for all kinds of rhetoric and actions in which he has belittle immigrants belittle black americans belittle other people of color belittling well then we can go on and on. in other words what i'm saying here is is that there is no type of like a pit fanie in the sense of an ethical or moral change on someone on the part like mitch mcconnell without mitch mcconnell donald trump would have begun from office but without donald trump mitch mcconnell could not have got his agenda through such

as packing courts with conservative judges i do think having said all that though that even from a calm and even for many republicans albeit not those in the house of representatives or almost all of them that attack on the capitol was a line that had been crossed i mean you have to remember this is the 1st time that american citizens have attacked the seat of their own government in u.s. history and they attacked the capitol and they threatened legislators and they threaten the vice president might cons and they shouted hang pence and where is nancy pelosi the house speaker as those legislators hid on the instigation of the president so once that unprecedented moment happens then perhaps even the most cynical of politicians takes a step back and says look maybe by doing what we've done over the past few years we've benefited politically from a truck in office but there has been a great cost as well list see what happens with that reassessment even as the biden stray she takes office reno we only have

a couple of minutes left let me ask you this latest video statement from donald trump in which he's condemning violence i mean how much pressure is he under right now that he would agree to do this this is speak to how worried he must be to potential legal consequences. well there's credible more reporting this morning from sources at c.n.n. sources that c.n.n. has spoken to that and then i quite believe and it's that jared cushion or his son in law put a great deal of pressure on president trump to do this video the sort of me a couple of the sort of the giving the sort of words that would indicate this was contrition perhaps on his part at some point in the future and contrition is sort of needed for a future president to pardon somebody and so i think this is a bit of a set up for that and i think it's been calculated by questionnaire and his wife ivana trump who is the president's daughter and listen we know over the years that the president has listened to him from as well as her husband because they they
