a private citizen that this impeachment trial is unconstitutional and we can cross now live to alan fischer who's following proceedings for us on capitol hill allan just walk us through what we've seen and heard so far. well you can see the 3 planks of what the democrats are arguing here 1st of all we heard from jimmy raskin who opened up the proceedings he's the lead house manager he's a democratic congressman from maryland and he essentially lead the case against donald trump and he did so in a video and it was a very telling video a very visceral a lot of the people of course who are making the decision about whether or not donald trump should face trial whether or not this is constitutional what people were actually here on what was a crime scene on january the 6th and they had no have to make that call what was interesting is that the with the also cut in donald trump's statements but more particularly his tweets as you saw the crowd moving through the capitol building

donald trump's tweets essentially decrying the job of his vice president as crowds as thousands were going through the halls of the senate trying to track down in the vice president many of them of course said that the intended to hang him for treason then you had from. a congressman to go see it from colorado he was essentially saying this is why this is a legitimate trial and he laid out the case the in quite definitive terms one of the things he said was that this is definitely constitutional and while donald trump might not know all about the phone being fathers the founding fathers knew about donald trump which is why they built into the constitution the ability to impeach a president even in the final days of his office a point made by jamie raskin there is no january exception to impeachment trials otherwise presidents could do whatever they wanted in their final days in office to hold on to power and face no consequences and he said that's not what the founding fathers were planning to do and then we heard from david selene from new york going

ahead they kept their arguments very targeted very secure but they think that they have a case here that republicans can answer what is interesting is that i've just been looking around the pool reports from people who are actually in the chamber they say that a number of republican senators have been ticking don't know it's mike lee among them he is a big donald trump supporter very strong constitutional law he's been making extensive notes he will of course get the chance to ask questions through written questions to ben cardin who's presiding over the impeachment hearing. and not only that some of them but rand paul what was said is that he is not winning a mask in the chamber but also he is just scribbling lines not really paying much attention i think there's a feeling among democrats that many of the republican senators have already made their decision they know how they are going to vote and it's unlikely that they will vote. to convict donald trump it is unlikely that there will be

anough forced to see that this cannot go ahead at this trial is going to go ahead but the republicans at the end of it will not be able to convict donald trump so let me rephrase that the democrats will not be able to convict donald trump because they don't have enough republican votes and so this is laying out the case essentially to the american public to see luke with everyone watched what happened on january the 6th in the way that they watched the events of 911 almost in short we couldn't believe this was happening at the heart of their government the watch what was going on in january the 6th they watched the mobs move through the capitol building they saw the violence they heard the number of people who were killed and injured after that and they're laying out that case to the american people just to remind them what happened even though it was just just over 4 weeks ago

a private citizen but that very same constitutional expert is in the newspapers or in one newspaper today tuesday here in the united states saying no no no the republicans have got my argument completely wrong i actually think you can go ahead and cut this trial and so that that gives an insight into. how well the republican side the donald trump team might not be prepared for what lies ahead because they have had only a week or so to prepare for this case and so when you start citing experts you need to make sure that the citations are correct but if you're in a rush to put together a case to defend the former president of the united states some of those things get messed some aren't done correctly it makes your job a lot harder to present to the senate when you've had to to rush and that is why although both sides have agreed to 16 hours of evidence and we don't think the

democrats will use all of that time it's highly unlikely that the republicans the demo donald trump's lawyers would use all of that time either one because they think their argument is pretty solid you can't. blame donald trump for what a mortgage did you can't take his words out of context and he has the 1st amendment right to free speech protections the other thing is they simply haven't had time to prepare a detailed case they can't put it together because we know don't transfers legal team fellow with them a week or so before the trial this new team has really come to rushed into the process of preparing that defense so it becomes much harder for them. to take the full 16 hours to present a case when they might not have the evidence the citations to back that up so we will hear from the trump team they will say this is unconstitutional no matter what you see it will go to a vote it only needs a simple vote for this part there is almost certainly going to be

peaceful transfer of power that's quite a factual distinction it seems to me and how do you think trumps knows will lay out . trump cannot be tried because now he is a private citizen. you know they have a real challenge now there's so much authority and it's gotten stronger in the last couple weeks including from very prominent conservatives we've seen their briefs and they won't really vary from and it's basically a sort of conclusion without a real argument saying impeachment must be for a sitting person or saying the constitution refers to the president but i think the house managers over the last 2 hours have put forward a very compelling case in text history everything you would want to look at and i don't think there's any rabbits for the trump lawyers to pull out of their hats
