9:00 pm
big brother on the whole disease. a lot of the stories that we cover all hardly conflicts so it's very poor we make them is on the stand as return as correspondents will be strong enough to do. the. poem fully back to bill in doha this is the news hour on algis iraq coming up in the next 60 minutes accidental discharge a police chief in the u.s. state of minnesota says he believes a black man was shot by one of his offices by mistake while just nearby a cardiologist's how's the trial of the former police officer accused of killing george floyd that his death was absolutely preventable. he not been
9:01 pm
restrained in the way in which he was i think he would have survived that day i think he would have gone home also this hour israel's prime minister says he'll never let iran obtain nuclear weapons just hours after tehran blames israel for an incident that is smain nuclear facility and vows revenge. on german astrid sports a new survey shows that 70 percent of the japanese public on the olympics canceled or postponed for the country does have something to celebrate mostest go for champion by the name of a decade. thank you for joining us racism and violence towards black men at the hands of police are back in the spotlight in the u.s. with 2 events happening just kilometers apart in minneapolis the trial of
9:02 pm
a former police officer for the killing of george floyd is underway it's now into its 3rd week and nearby protests broke out after another black man was shot dead by offices. fixed opp police believe the officer didn't intend to fire. the was. the. basin footage captured on body cameras minnesota's police chief says the officer mistook the gun for the taser the police and dante wright sonly a calling for calm 500 national guard troops have been deployed in response to the unrest right sammy said he crashed his car after police shot him is my belief that the officer had the intention to deploy their taser but instead shot mr wright with a single bullet this appears to me from what i viewed in the officer's reaction in distress immediately after that this was an accidental discharge the resulted in
9:03 pm
the tragic death of mr wright. well we have 2 correspondents in minnesota today john hendren is outside the court in minneapolis for the latest on the derek shelvin trial but 1st we go to allan fisher who joins us live from brooklyn center where this latest shooting of a black man happened allan we heard the police chief there during a news conference saying that this was an accidental shooting tell us 1st about what more they have said and what have been the reaction there. was certainly there was a reaction from the mayor who said he was astonished flabbergasted that such a thing could happen at a time where just 16 kilometers away during children is on trial for the murder of george floyd something that happened in this area just a year ago the police chief believes that it was a tragic accident but certainly the people that we've been speaking to here protesting in the last couple of hours aren't buying it they wonder why it
9:04 pm
escalated from a traffic stop to a fatal shooting just a few moments later you can see that the police are here in numbers they've been here since late last night when hundreds of people marched to the brooklyn center police station to protest they were here in large numbers they were loud and they were angry at some point some businesses were looted is thought around 20 local businesses state troopers were called in to back up the police service here and the national guard and you can see them here on duty no just trying to swell the numbers what was described as a chemical or to tear gas as we would better know it was fired into the crowd at sporadic intervals eventually the crowd started to despair and the mirror announced that he was imposing a curfew there is an uneasy calm here but certainly what this did not need particularly as many people are on edge was another black man being shot at the hands of a police officer indeed and the body count footage that we've seen from this latest
9:05 pm
shooting is pretty dramatic we've heard. the family of the man who was shot down to write calling for calm police calling for calm are people likely to heed that call . it's interesting that dante wright's mother was actually on the phone with him when the traffic stop was occurring suddenly the line went dead she called back and ended up speaking to his girlfriend who said that it was no lying dead in the driver's seat that's how quickly this all happened certainly the calls for calm are going out around the community not just here in brooklyn center but in other places people some people that we've been speaking to traveled 304050 minutes to come here to express their anger at what had happened overnight certainly the police are hoping that by being open and transparent and answering the questions at
9:06 pm
the news conference just in the last though they will sure that there's nothing to hide and of course a full investigation is know under way to find out exactly what happened and then best to gauge and that is separate from the brooklyn center police believe me the local community are watching that and they're hoping for answers and answers quickly alan fischer in brooklyn center minnesota thank you very much for that let's cross over now to the derrick chauvin trial in minnesota where a cardiologist giving evidence has said the former officer derrick chauvin restrained george floyd in a life threatening manner dr jonathan rich says for died of low oxygen levels because of the way he was held chauvin is on trial after he handcuffed and now turn for its neck for more than 9 minutes after reviewing all of the facts and evidence of the case i can state with a high degree of medical certainty that george for he did not die from a primary cardiac event and he did not die from
9:07 pm
a drug overdose had he not been restrained in the way. in which he was i think he would have survived that day i think he would have gone home or wherever he was going to go had he not been subjected to the prone position restraint that he was alive to on just here's john hendren who's outside the court in minneapolis john before we talk about the the doctor's testimony and the questions he was asked i want to ask you 1st how what's happened in brooklyn center in the shooting of another black man there has played into to the trial and and what we've heard there today. well it had the impact the 1st thing that happened this morning was a good judge listen to both lawyers because the defense attorneys said after noticed talking about this event that was only 16 kilometers away he thought the
9:08 pm
jury should be sequestered isolated so that they had no ax to access to any news media or other people who might be able to talk to them about what had happened over there the concern by the defense was that the case of another black man dying at the hands of police so close by might influence the jury might make them think that this was an incident too many and they might tie those cases together in that that would go against their and show them the former police officer on trial here but the judge said no that's an entirely separate case and then he gave us a key to the duration of this trial he said we will we can sequester them starting on monday that is when he anticipates there will be closing arguments so we are in day a live in now the prosecution is had 2 weeks to to make its case and now they are winding to a close we know there will be at least one other expert witness this is
9:09 pm
a use of force expert someone in law enforcement and then we expect what they call a spark of life testimony that's from the brother of george floyd following his floyd and the idea behind this in under minnesota law is that you've got someone who would test if only to the kind of person the victim was to put a human face on that victim now in other states that tends to happen at the sentencing point just before sentencing but here it happens in the middle of the trial and we expect that to happen as soon as this afternoon well we heard earlier from the cardiologist dr race who said that if. george ford had not been restrained in the way he was the. he believes he would have survived that and the cardiologist of course was cross-examined by the defense as as the prosecution's case is nearing its end john i wonder what we can expect from the defense from what we've heard so far what this strategy is likely to be after the prosecution's case.
9:10 pm
well their objective so far in the cross-examination has been pretty clear they want to suggest that derek chauvin was not the primary cause of death for george floyd although we know it on his neck for over 9 minutes and they want to show that there was some kind of other cause and so when the cross-examination of that expert witness this morning the cardiologist they pressed him on a number of other ailments the george floyd had narrowed order reasons some cases the doctor was asked about that he said no that was not. that was not a primary cause of death. but forgive me i'm hearing noise in my ear. and then one thing after another these are just that he didn't have the heart disease couldn't have caused that he had a tumor that did not cause it and also he had drugs in his system and the doctor is
9:11 pm
one after another had suggested that those were also not the cause of death and so i think what we're going to see is the defense pull up witnesses who suggest alternative causes of death for george floyd their suggestion seems to be that he would have died had he not even encountered police on that day. thank you for that john hendren outside the court in minneapolis for us let us now speak to bradford colbert who's a professor of law at mitchell hamin school of law also a former public defender he joining is joining us from st paul in minnesota by skype thank you so much for being with us i want to ask you 1st about the events in brooklyn sent and the killing of another black man there 'd which spawns protests and anger in the community how might it might it influenced the trial of derrick so vain and the defense case is this bad news for them
9:12 pm
or you know i don't think so i did to city minneapolis and actually this area is on edge and this is some other killing put to the city itself and then when county in particular are on edge but i don't think it necessarily impacts the trial i don't you know that this is a jury that has you know everyone who's on the jury panel has admitted to knowing about you know the george florida homicide and seeing the video so it's hard to believe another incident would somehow prejudice the jurors in the minds in their minds right we heard today from the cardiologist who again said that george floyd. died because he had been restrained in the way he had and then the conti ologist was later cross-examined by the defense the defense is focus and i know you're an expert in this a focus seems to be on the medical records of george floyd as well as his
9:13 pm
use of drugs what do you make of their strategy so far. so what they're arguing is an issue of causation the state has to prove a legal all the elements of the crime one of the elements of the crime is their causation so they have to prove beyond a reasonable doubt it's important. beyond a reasonable doubt that the officer's actions caused the death so what the defense is trying to show is that there's some doubt that actually the officer's actions caused the death and there is no they haven't presented any evidence of their own because they haven't presented their case right to life but you think they've been successful and raising they've been successful at raising that dolls that you talk about i don't think so it doesn't appear to be i mean i think in the sense of the experts have been pretty unequivocal that this was all we have to show it's
9:14 pm
a substantial fact they don't have to show that it was the only factor in the fact that he had drugs in the system or that he had and a heart condition that's not that's that doesn't end his story so they seem to have shown pretty i would say beyond reasonable doubt frankly as of now that you are shortens actions were a substantial factor in causing us to so as a former defense attorney if any of you why you know what the case sounding so and the prosecution's case wrapping up where would you if you were the defense way would you raise doubts nala in this case. 2 of the 50 there's there's 3 flash points that i see for the defense the 1st one is the reasonableness of offices shoguns and you couldn't so in minnesota a police officer is allowed to use force in arresting and so there's no question that he was arresting and no one's arguing about doing galatea if they ran the
9:15 pm
question is was the force reasonable and that's where you've seen the defense try to hint at the idea that you know that. someone is taking bribes he could respond this way or he could response to trance is trying to point out that in fact officers showed his actions were reasonable and state has to prove that they were unreadable beyond a reasonable doubt so that's the 1st part the 2nd issue comes up in the 3rd degree murder charge and that involves office ruled in state of mind and then asked to do with he asked to be so deliberately indifferent to mr floyd's death and you could see what came up in the defense with the ad was when they started talking about crowd and so what they seem to be implying i think they're going to be arguing that walk they he wasn't trying and no i'm saying intentionally cause it that's what they're saying he wasn't oh he was doing was it was a volatile situation right was paying attention to the crowd and so that's the
9:16 pm
other case but look there it is what you alluded to earlier is causation so those are the 3 issues i anticipate and do you anticipate that the defense will put floyd on the stand not fully tare actual vaine on the stand. it's a good kind of the question in the hour and a lot of the depends on how we think such as children will come across because he comes across as someone who's really reasonable and likable then. the jurors may go well it didn't seem like the person that was in the video but the state will get to cross-examine you know give the interview you know they'll get to see and test so it's a difficult question and i don't think it's at all clear as to whether he's going to testify thank you so much for talking to us very good to get your insight on this bond for colbert as a professor of law at mitchell ham in school one of the on joining us fan from st paul minnesota we appreciate your time thank you. thank you. there's lots more ahead on this news hour including. i.

the israeli government but the media here a widely reporting this as an israeli attack it comes as the u.s. and iran are preparing to resume power low talks in vienna aimed at resuscitating the 2015 nuclear deal a deal that the israeli prime minister persuaded president trump to withdraw from and which he still vehemently opposes a tense backdrop then to benjamin netanyahu 1st face to face meeting with a senior member of the biden administration u.s. defense secretary lloyd austin and we both agree that iran must never possess nuclear weapons my policy as prime minister of israel is clear i will never allow iran to obtain the nuclear capability to carry out its genocidal goal of eliminating israel earlier asked into an israeli air force space with defense minister benny gantz who unlike netanyahu talks of working with the americans to revive the iran nuclear deal on the incident at natanz austin didn't say much i'm

bring in john hendren. covering this trial for us he's outside the courthouse in minneapolis so we heard an emotional testimony there from george toit's brother just remind us of why the defense decided to bring him on the stand and to have him testify today. well in minnesota. the prosecutor has the right to bring in a family member for what they call a spark of life testimony and that's what this is it's really not to present evidence at all it's to humanize the victim of a crime and so interestingly you heard there flown is floyd talking about his brother's love for his mother how he knelt at her casket when she died several years ago and kept saying mama mama. and it really comes through how much he loved his mother because of course that was also what he said when he
9:46 pm
as he lay beneath derrick chauvinists need saying he couldn't breathe that he thought he was going to die and then he cried out his mother's name and said i love you. this was a way for the prosecution to connect those 2 things to say that this was a human being away a love for his family you know to say didn't go into the didn't have alone is floyd going to a lot of facts or details nothing that the defense could cross-examine and question on was really just an opportunity to show what a human being george floyd was normally this is something that happens before sentencing but minnesota this is how they do it right and no cross-examination often on a story to buy the defense talk us through what we can expect to happen next today and in the next few days. well we assume that the prosecution is going to be closing its case here this is a powerful witness but there was also talk of them offering up
9:47 pm
a use of force witness somebody who can testify about the police techniques that were used on george floyd now normally you'd want to end on this family testimony something really powerful and emotional that connects the crime to a human being and it really shows the jury what is its stake here that these people the family of george floyd have lost someone important to them that is a strong way to end the case it would be unusual for them to end with the use of force witness so we don't know whether they've abandoned that idea or not but in any case we see that the prosecution is winding its case down either this afternoon or in the morning and then we expect the defense to present its case and the number one thing that events has to do is offer up testimony showing that there was some of the reason that george floyd died rather than just being under the knee of derek children they've offered up many 3rd theories that he had clogged arteries that he
9:48 pm
had a tumor in his pelvis that he had. that he had drugs in his system that might have caused him to overdose every witnesses so far has been called up by the prosecution they're all prosecution witnesses but they've shot down every one of those theories that offense is going to need to come up with someone who can say otherwise because what the prosecution is trying to prove is 2 things that derek showing used force that he was not authorized to use under the circumstances and that the force he used directly led 'd to the death of george floyd it doesn't have to be 100 percent of the cause but it has to substantially contribute to the death of george floyd the defense has its work cut out for it but we don't know what witnesses they're going to be calling up what we know about how long it's going to take and that's because. the judge said he denied a request by the defense to sequester the jury to isolate them in a hotel where they are unable to read media or see other people that was due to the

unrest after the police shooting of a black man just about 16 kilometers from here yesterday what he said we may sequester the jury beginning on monday that's a week from now and that is when he expects there to be closing arguments so if all goes to the judge's schedule this trial will last one more week and then we should have a verdict ok john thank you very much for the moment john hendren live for us in minneapolis minnesota let's turn to other news now and millions of children and their families are expected to face hunger in somalia in the coming months because of a no class infestation and a extreme weather report from save the children says crop and vegetable production is expected to plunge by up to 80 percent this season livestock sales on the basis of survival for many families that income is set to drop by more than half as animals die and others are no longer fit to sell and milk production is expected to

victory at augusta so him become the 1st player from japan to win a man's gulf mate or as david stakes reports. one of the most famous prizes in sport the masters green jacket now sits on the shoulders of a decade or the 1st ever japanese man to win a major golf title course in my book it's really him to think that there are a lot of youngsters in japan watching today hopefully in 5 or 10 years some of them will be competing on the world stage and they can follow in my footsteps. but that's yama started the final round at augusta 4 shots clear but the nerves began to show in the closing stages. but he took shots at the 15th and 16th holes and was in danger of throwing it all the way. but luckily for him despite another bogey at the last his one over par round of $73.00 was enough to secure a famous victory by want to shot the 29 year old without a win on the p.g.a.
