a lot new there. one thing that is new is they are alleging germ misconduct and that is very vague. in fact, the, the defense asked the judge for more time to develop the points that they've made here because some of them are so vague, they're hard to know what they're specifically referring to. but one of the reasons they're bringing up term is conduct is because one of the jurors has been getting interviews publicly and had talked about going, or he actually hadn't talked about. it did participate in march in washington dc in august. and when he was asked on the questionnaire or whether he had participated specifically in any protests over police brutality, he said no. so that may be one of the grounds, although i don't think that has any merit either. but this is a standard motion that defense lawyers would typically make after a conviction at trial. this was of course, such a high profile case. the verdict was so consequential, not just for the family,

but the, for the country. the whole. is that something that the judge would take into consideration when examining this appeal that he has to take into consideration? and if you look at the, the grounds itself, it talks about the judge abusing his discretion. and so trial judges have a why i way to make decisions. it's not just if they got it wrong, it's if they abuse their discretion. he's already ruled on almost all of these motions. this was a really intense trial. it took many days to do jury selection. there just isn't any way that the judge is going to grant a new trial, but one of the reasons the defense is doing this is to lay out the grounds that they want on appeal to our appellate court. so talk about that a bit more what, what does that mean? exactly. so we have the trial court,

and that is the judge who, who saw the trial, who oversaw the trial, but in appeal goes to what is called our court of appeals. that is a number of judges who will only be looking at the transcript. so a written copy of what's what was said at trial. and so that's one of the reasons why the defense is asking for a hearing about jury misconduct. so they can make that part of the record. if it's not in the record, the appellate judges won't look at it. and so what happens at appeal is the judges look at the record and they see if there were errors and did they affect the outcome in the trial? and that's another important thing here to the evidence was overwhelming. and so typically the appellate court, even if there weren't years, a trial will say that they were harmless because the evidence was overwhelming. mary many thanks for explaining that to us. mary maria, a former hennepin county chief public defender in minneapolis,
