12:02 am
jeffrey epstein. the 61 year old prince has consistently denied the claims, but the case will now be able to proceed in new york. gabriel is under joins his live from there. so what we know about how this will proceed. well, it appears that with this judge's ruling, there will be a trial, at least that's how it appears right now. trial most likely will be towards the latter part of this year. the judge has already set a date of july 14th for the lawyers to start getting together and submitting some of the documents and, and witness list that they might use in the trial later this year. now the big question is, will prince andrew be required to be at the trial, assuming it takes place later this year as we believe that it will? the answer to that is probably not. and that's because this is a civil trial and not a criminal one. and in civil trials,
12:03 am
the person accused doesn't necessarily have to be at court every day. and it's assumed that prince andrew will not want to do that. and there is he's, and there's no extradition. the court cannot require the u. k, to extra guide him in a civil case such as this either would only be in a criminal case. now, does he have diplomatic immunity? the answer to that, according to most legal analysts, is know that he doesn't only the queen in her immediate household would have any sort of diplomatic immunity, of course. and he is not part of the immediate household as defined by the law. the bottom line here is, is it prince andrew and his lawyers wanted this whole thing to go away. and that's why this is a major set back in those efforts. because now just the opposite is going to be happening as this moves closer and closer. now to a potential trial at the end of this year, of course, prince andrew has denied any wrong doing in these allegations. vehemently, however,
12:04 am
we have heard from virginia go for his lawyer. she, he put out a statement saying that this is an important step in virginia godfrey's, heroic and determined pursuit of justice as a bayver of sex trafficking. that was a statement put out by her legal team courses. all stems this case is civil case to her allegations that she was sexually abused by prince andrew 3 times once in london, once in the caribbean, and once in new york in 2001. and that is what this civil case is all about. again, the allegations have been denied by prince andrew, but now the legal process will continue here in new york with a potential trial, a raise on to thank you very much. richard senior really is a former assistant us attorney for the southern district of new york. he joins us on skype, thanks very much for being with us. how big a legal blow would you say this is for prince andrew?
12:05 am
this is a devastating decision. he's now going to be forced to participate in what we call discovery, which will require him to produce documents, all of his communications with relevant persons, including epstein maxwell, the plaintiff, others, and then he'll be forced to participate in a deposition. we will have to give sworn testimony over many hours with the plaintiffs a very competent legal team. so this is a, a terrible day for him. he has terrible options ahead of him. and if he doesn't participate, he'll be defaulted. a judgement will be lodged against him. if he does participate, then you'll have the choice to give substitive testimony or take the 5th amendment, because there are still a active federal criminal investigation into all of the her
12:06 am
crimes surrounding. ah epstein and maxwell tell me, is there any chance that he can appeal this, this current decision he can try but in federal court, interlocutory appeals, which would, which is what it would be called are, are few and far between i any appeal would have to wait until after the case is over in the district court, which is our trial court, then he would have all parties would have the full right to appeal whatever asked for the aspect of the case. he's on a fast track. this judge has fast tracked this case. discovery has to be completed by july. this judge ruled almost immediately on the motion to dismiss. ah, and this judge is not going to tolerate any delays, any frivolous actions on the part of any party. and prince andrew is going to be forced to deal with this case unless he chooses to settle the case. and i know
12:07 am
lightening it you expect that to be an attempt to settle it. i think he be foolish not to seriously consider settling. he's not in the same bargaining position. he was in back in july, when the plaintiff's lawyers tried to settle with him. confidentially. he turned that down. i think that was a mistake. ah, he will always have the opportunity to settle. but i don't think he'll will come very cheaply for him. ah, and he may not want to settle. he may want to fight this, but that could, that could be a mistake from his perspective. it really depends on what the underlying facts are . and he has to be cognizant of the fact that there is an ongoing criminal federal criminal investigation he is presumed innocent. but you know, he is a part of, or allegedly, a part of this investigation. and we talked a game in his own dial, corresponded about they're not getting in touch in court and you,
12:08 am
you said they would need, they would need to be depositions and so on. would that be done remotely? if he's, if he's not likely to appear in the states, it, it, it might be done remotely. but i, i, this is so important that ah, a plaintiff's lawyers. i could see them now flying to london to take his deposition there in person. i think they would probably prefer to do this in person, but it could also be done remotely. many of us, many depositions during the coven, your are being conducted, ah, remotely. but i have a feeling. this is going to be an in person situation. i don't think he's setting foot in this country and that's going to be another problem for him and defending this case because he's gonna have to do this remotely. i think his lawyers have probably advised him to be very cognizant of potential criminal exposure. and again, though he is presumed innocent and tell us how this fits in with the kind of in the atmosphere off to the ruling in the knee with the judgment and maxwell case. what

was the kind of contacts for this? this is a very interesting thing, maxwell is his convict, that she's facing a potential life sentence. but there have been allegations or issues pertaining the up a ledger and misconduct. she may get a new trial. she has not cooperated to date, but she may now take advantage of, of the, the legal law issues involving the jurors in order to turn states evidence and cooperate ah, against all of the alleged mail abusers of the minor victims in the epstein situation. in order to avoid a possible life sentence, ah, so it remains to be seen. what if anything she will do along those lines. ah, she's being very ably represented. i know her lawyers have, i'm sure, have discussed with her all her options. and to the extent she has material

a james space was monitoring the meeting from the united nations in new york. well, it's very grim picture from yemen. remember, the country has been in turmoil for more than a decade. and war has been raging in the country for almost 8 years. well, with that backdrop, what has happened in the last month? things have got much worse. they say there has been a deterioration of the humanitarian situation, an escalation by all sides of that military action. and we also heard from a senior humanitarian official from the united nations. again, briefing the security council saying that over 15000 people have been displaced in the last month. and the number of civilians that have been reported killed is 358. that's tied for the highest figure at any point in the last 3 years. very grim news from yemen often described by people as the forgotten war. but it's a war that continues to rage. join us novice guy is marashi button. who is
12:13 am
a political analyst on yemen, just on that point that, that james base was making, the kind of forgot who brings up to date with, with where the escalation has been happening and what the problems have been. well, the current situation is there is an ongoing really severe battles happening around the outskirts of the city of matters in the north of the country. and it is significant because this is where the oil fields for the richer all the fields of the country are said. so the be in full for the last year and a half happening around the outskirts of the city of modern and yesterday, just the spokesperson of the sub collision announced a new operation. and they have succeeded in to slightly pushing back that who sees from some, some of the districts that they have taken during the, during, during the last year. so this is in terms of the terms of the updates and the,
12:14 am
the current situation as the you and boy, he, he, yes, the stated that there isn't a sustainable solution from the bustle ground, but he also forgot to mention that the also the problem is the the ongoing thing because there is a lack of implementation often that's gonna agreements that have already been signed in the past. so we have an international community who seems to be tired, very much fatigue from the ongoing conflict. they come sometimes run into an pressure for agreements, but they're very bad into following through implementation and seeing through that the agreements that have been signed are being implemented and then that's a pull back. i think it's just an ongoing problem with the current dynamics inside the inside the occupations. so all not me who, who might be in a position to put pressure on either side lead tradition or the who sees to, to try and come to an original come to a solution for the complex the,
12:15 am
the main problem is, the former you an invoice started by dividing the problem, so he started by focusing on minor parts of the conflict. and basically he exhausted the amount of 2 years of his time in, in yemen, trying to resolve small bits of the conflict while neglecting the overall effect of the, of the conflict with some pretty humped approach to this, you can see sustainable piece process. the 2nd part which is also important is the implementation becomes and so if you can't have a form of an, a sustainable and clear mandate for how are you going to implement, for example, of withdrawal from this area to that area. and how you are, you know, you, you're going to oversea, for example, a demilitarization of certain zones. then you're really locked in this quagmire. nobody will be able just to hand over willing be their weapons or arms, just because there is a, you know, they just find a find
12:16 am
a piece of paper. and we are in a situation where the conflict has the ability to resume, to continue for more years. if there is nothing is being done, and in the meantime, the humanitarian situation is dire and as being pushing out again by the un today. but they also said that the previous appeals for money aren't fully funded. how likely is it little get? but the money that they need now, if they haven't already got last year's amount of money. yeah, that's, that's absolutely true. so the, the main problem is again, there isn't a political solution and if you don't achieve a sustainable solution, ne, begin with some signs of political solution. then the humanitarian situation is just going to continue going, you know, from dyer into morse, will worse until more humanitarian situation. and the stated,
12:17 am
the main problem is the last appeal by the united nation hasn't been achieved. it's stated that it needed around 4000000000 dollars last year that hasn't been achieved . and again, now it's calling for another appeal this year. i personally doubt that they're going to get this figure because simply, the international community are exhausted. there was some kind of action activity in 2000 and seen and 2018, but as time is passing, they're really tired and exhausted or she been. thank you very much. indeed for talking to us please. i'm a bit of break up on that line. thank you very much. and it is extra journal has warned of a real risk of, of conflict in europe. ultra high stakes meeting with russia ended without breakthrough. both sides say significant differences remain up to what they described as frank and open discussions in brussels. moscow forced the west to the negotiating table by massing tens of thousands of troops near the border with

the us and nato raised concerns late last year about russia's quote, large and unusual troops build up near the ukrainian border. more than 100000 russian troops of last in an arc along ukraine's frontier fronting fears of an invasion. satellite photos from november revealed russia hardware including tanks, artillery, and a long range rocket unit, deployed to several southern training grounds. just a few 100 kilometers from ukraine. laska also increased its forces in equipment along the crumb in peninsula the ukrainian territory. it annexed in 2014 morning that go to mike. hannah, who draws his lie from washington, dc and mike just one time there was no break through those talks on wednesday, the u. s. maintains the door is still open to find common ground there. so u. s. has maintained the position that it is intent on. forging some kind of dialogue with russia. it wants to stay away from any open confrontation while at
12:22 am
the same time having drawn its own lines in the sand, which of course, or is any action against ukraine will be met with a retaliation by the u. s. and its nato allies. so russia for its part is insisting, for example, that ukraine cannot become part of nato. it insist that it has no malignant intentions towards ukraine despite that troop pulled up. so there's basically a immovable force and irresistible object going on here. and yet, during this week, it's essentially a traveling diplomatic circus. there were talks, unilateral talks between the us and russia on monday. and then the talks in, at the, with nato in the course of to day. and then in the coming 24 hours, there's going to be a meeting of the o. s. e, the organization of security and corporation, europe. and that involves 57 nations, all of whom are involved in the current crisis. very importantly, including ukraine. now the us made a clear earlier the secretary of stated that this meeting is pretty critical
12:23 am
because it does involve all the parties. and although the meeting is at an ambassadorial level, it's not at a foreign minister level. the o. s. c, e is a very, very important body in terms of creating diplomatic structures within the region. and it's very clear that the u. s. wants to use at this particular meeting as a way in which to try and push forward opening greater degree of dialogue with russia. so although the talks in brussels have ended in a stalemate or with no clear result, the u. s. is still intent on continuing some form of dialogue with russia and finding ways in which it can come to agreements on the points that are dividing the entire region. and in the meantime, us democrats consider new sanctions against russian individuals, including the russian president as well. but not is all us democrats, sir. senate seth introduced
12:24 am
a legislation of proposed legislation in the senate, insisting that should russia advance on ukraine or attempt to take it over or escalate its actions against it. then there will be sanctions imposed against russia's banking system and against particular individuals including the russian president. so this is very strong legislation in the senate. basically what it is saying is that it will be up to president biden, to determine what russia's intentions are, shooting to find the intentions as a takeover of ukraine. that would automatically trigger the mandate re stir sanctions. now a couple of very important points here in a deeply divided senate. this is an absolutely bipartisan issue. this is similar to legislation that republican democrats introduced at the beginning of the week. and importantly, it's got the full backing of the white house, has been a white house statement saying that president biden is right behind this legislation being considered in the senate. so as i said in

12:34 am
london. thanks for being with us, sir. what's your reaction to what the debris h o says on this issue, whether it's becoming endemic? i completely agree him and i said, said we've had 15000000 cases in, you know, the 1st week of january and it is 43000 deaths that happened reported during the most rapid growth of sar school we 2 that we've ever seen in the course of the span demik, i mean, that is not endemic, and demick means that there needs to be a lot of stability of predictability or constancy in the population. and we're certainly not seeing that research. so we to and there are no indications that we're going to be seeing that any time soon given the rapid evolution of this virus and the possibility of new variance emerging. so what is that? what's the key measure? that means that you can call it and make them, is it to do with prevalence will and, and didn't do that at any point, take into account for sort of the difference between the case rates and the, and the, the numbers of the deaths or hospitalizations. no, so,
12:35 am
and damage does not mean miles to diseases like malaria, t b are endemic in many parts of the world and the kill, i mean, malaria killed hundreds of thousands of people. so, and then the city has nothing to do with minus what it means. and epidemiological terms is that there's a stable level of disease in the population. you don't see these massive, our great sac we're seeing with our school we to. so the, our rate, which is how many people a person transmits to remains around one because of a level of immunity in the population. so i'm in the direction we're responding and pot when they to the spanish prime minister passengers on monday saying he lost european officials to consider treating. carried 19 more like an an endemic homeless. what, what are, what would that mean? do you think in practice? so i don't know what that means because to many politicians, it seems to me my odor. that's what it means to sausalito is here to stay. and that's something that i think politicians and scientists need to be honest about
12:36 am
this is not going to magically become milder necessarily, or magic a going to die a natural death because he wanted to, we have to adapt to it. and that means long term adaptation. that means things like investing into ventilation with an infrastructure and workplaces in classrooms, in businesses like many countries like japan and south korea are doing, as well as, you know, educating people about a bond spread, which will happen no matter what the radiant. i mean, vaccines are very, very important part of this, but clearly we're seeing bays that can evade vaccines to an extent don't provide full protection. so we need multi measures along with vaccines. light ventilation, hydrate, mass as b, 2 mos which massively reduce your risk infection. and we'll do that no matter what the agent may encounter in the future. but we need to at least acknowledge that we need to take measures to contain this and saying that it will become and demick shouldn't mean a license to lead to spread across the population. and cause mosse, death and suffering on, on, on that me, one of the reports from

a spanish helpful authorities. we're, we're, we're drafting a new monitoring system in which every new infection would not need to be recorded . and the people with symptoms would not necessarily need to be tested or what are the, the risks or advantages if there are any in scaling back testing for instance. i don't think there are any advantages. i mean, if you can monitor, if you contest, you can identify cases, you can see what's happening. you can contact trace. you can identify the context of that person. you cannot isolate these people who are sick, so they keep circulating but in the population infecting others. i mean, if you want to reduce the level of testing required, the best way to do that is to reduce transmission. if you don't have that many people infected in the population, then you won't need that many tests. and that's one of the reasons that testing capacity has been all round in many countries, which means test trace, i say systems which are critical to maintain disease at your level. stopped working, dig to go to sunny. thank you very much for talking to us onto their o. u. k. prime
