we're going to begin in gaza. we're israel's carried out a wave of air strikes and armed fighters have retaliated provoking fears of a full scale conflict. palestinian islamic jihad says it's fired. a 100 rockers said it's really cities including tel aviv. israel says it's iron dough missile system has intercepted them. air raid sirens have been heard in the southern and central israel. a high rise. tar and gaza cities been hit. one of those killed was to see alger body, a commander of the all quotes brigades. it's the military arm of islam of jihad, at least 10 others also died including a 5 year old girl. dozens of other people had been injured. you now said reports from gaza. so until now we're still with the same ease railey raids on different areas of because it's stripped, the latest of which was a targeting of a home in jubilee that's in the north, in gaza strip. and i,

i local sources say that 6 people where injury to from that targeting or the ministry of health has not yet updated the number of injuries, or are people killed in these targets. it has been left until 10 people killed, including a 5 year old child, and a over 75 have been injured in different areas that the rates are very much tense in this cell. then causes strip as well in high newness and rough off how those 2 govern net with witness to lots of raids, violent trades lately. ah, in addition to the last raid, which was on the home in javala, as was caretaker prime minister. yep. who to says it'll do whatever it takes to defend itself. is ro carried out to precise come, tutorial peroration against an immediate threat? our fight is not,

got more on the international reaction where israel continues with, with what it calls this operation. and on the other side is let me continues to rockets into a throw. these really military says that now there's 120 rock has been launched into the country. so far we not him of any reports of injuries on the israeli side . a lot of those rockets being stopped by the iron dough, which is the israeli system against rockets to stop them even in the air. and those that have landed seem to have done so in areas where they haven't been able to to hurt anyone. will say something else is going on. it's quite movie account that we were hearing from someone living in gaza. in the macro level. there are other countries weighing in on this and other organizations. the united states is one of the earliest a tweet from the ambassador's israel,
2:06 am
saying that the united states firmly believes the israel has a right to protect itself. we're engaging with different par, isn't all sides for come. so that was seen as quite firmly citing with the, with the israel in the jordanian foreign minister, the countries li, just to the east took a different tone calling for an end to the condemned israeli aggression against the gaza strip. and the un who. so the special coordinator for the middle east peace process also waited and said that he was deeply concerned. egypt who various media is saying that there is a delegation from egypt that has come or is coming to israel to try and to try mediate between the israeli government and islamic jihad and try and stop this before escalates. still further correspond to need. abraham covers the occupied was bang for us and she says the tension there has been high since is really forces

arrested. a leader of islamic jihad bought some outside the in jeanine. on monday. the palestinian presidency has condemned de escalation, calling a dangerous calling upon the international community to intervene to stop what they called. it is rainy exclamation also we heard from the palestinian prime minister and from the you talking about the escalation thing. it's israel that started this week, people to enter my la, go out in the, throughout the pro to calling for unity calling for retaliation. we've also seen a 10 situation engineering in the north will be occupied with bank. this is we are a senior plumbing. she had the, there was a respite from engineering itself, has been the epicenter of our coverage and has been the center of attention in the past few months as use radio wouldn't have been conducted almost nightly, and daily. we to the outskirts of the refugee camp fear we know that there are

armed men, they are in the camps, their estimated at the lower hundreds. they will be fight and engaged in armed confrontations would be through the forces when they twice to enter the refugee camp. and arrest people are and we both of those armed men yesterday going and showing a 4th in the camp holding weapons. because as we know, ever since israel has arrested the san, beside the from jeanine on monday. these limits you have has raised its level of alert, has told it's all members to be ready to europe, to basically make israel page, which is the terminology that they've been using for arresting senior flemming to had with them. sadly from june to the us national security folks on john kirby says israel has the full support of the united states. this feels like a,
2:09 am
a solution. of course we were made to a. busy to jerusalem and that, but that we still wants to be on both sides have to want it to. rosalind joined jordan is joining us now from washington d. c. so john kirby saying that israel's got the full support of the united states . what else is the white house been saying about this? well, the by that ministration is also reaching out to what it calls the relevant parties . asking them to try to calm the situation to not aggravate attentions and to try to was stop by the violence that has been erupt. ing, i'm in is in southern israel and in the gaza strip by all day on friday and into
2:10 am
the overnight the by didn't ministration of course is are very much committed to a 2 state solution. but it has also been a very clear and we saw this when the u. s. president joe biden was in israel and occupied west bank recently that he knows that the situation is not at a place where the parties couldn't negotiate in good faith on trying to achieve a separate palestinian state. and so the president feels that his role is to try to promote trust building between the 2 parties to try to focus on economic development for the palestinians. but certainly the outreach that is coming from the by net ministration is really not going to include the most immediate. our parties are in the gaza strip hamas islamic jihad because they're considered terrorist organizations by the u. s. government. and so there are no cut communications of any sort between
2:11 am
u. s. officials and those parties. and that's part of the problem isn't answer rosalind. but it's that lack of trust of allowing any efforts to try to are preventing any efforts with young to try to build any sort of reform between any of this the sites. one would imagine that from what we're hearing that the joe biden admins job, but by the ministration may well like the status quo and want things to move forward in a positive direction. doesn't sound as though it's got much room for maneuver. well, it's not just that the biden administration isn't going to engage with hamas, or with as law islam of jihad, that has been the policy of previous a u. s. administrations. but the usaa government under joe biden has been rather explicit in its view that these organizations are proxies for iran, a country with which should many u. s. government have had considerable law problems and a rather high level of hostility. so it's a,
2:12 am
it's just not going to happen. you're just not going to see u. s. officials engaging with hamas or with islamic jihad. what you are going to seeing is engagement with the palestinian authority and its president mahmoud abbas . you're going to see an engagement, of course, with the israeli government. and you're going to see engagement with other parties in the region with egypt with jordan, with other countries that may be able to bring indirect influence upon hamas and islamic jihad. but you're not going to see the americans doing it themselves. that's just a nonstarter rosen. thank you very much indeed. rosalind jordan talking to us from washington d. c. with united nations middle east coordinators called for d escalation of the fighting. kristen salumi has more from the un in new york. there can be no justification for attacks on civilians. those are the words of middle east coordinator toward venice land in response to the recent attacks in
2:13 am
gaza. he noted that a 5 year old child is among the dead and express concern that this escalation between palestinian militants and israel. and what he described as the targeted killing of the palestinian islamic jihad leader could further exacerbate tensions in the region intentions, which have been growing and brewing not only in gaza, but also across the west bank. and of course, it's the united nations that gets called in to pick up the pieces after conflicts like this in the occupied territories. and he express concerned that civilians will ultimately be the ones who pay the worst price at a time when international support and international funding to help and situations like this is stretched very thin. so a word of caution from the middle east coordinator or words released on twitter and in statements to the media calling on both sides to tone down their response and
2:14 am
protect civilians. audiences as a professor of law at queen's university's previously worked for the united nations extensively in that garza and jerusalem. and joining us live now from ottawa via zoom. really good to have you with the sir now to 0. thank you very much indeed for your time. i'd like to talk to you about the legal accountability elements of all of this. we've been in this situation before where both sides have been trading rocket, fire and air strikes and often seems that the statistically and historically it is civilians within garza who tend to be affected most they're the ones who are more likely to die or be injured. let's start with israel, given the fact that there is a perception that israel appears to be immune from prosecution. how likely is it and who would bring any sort of legal action i have? i'm for accountability against israel. thanks to the question. thanks for having the accountability is key. it's key in palestine,
2:15 am
but also in any conflict in the world in order to have peace, you need accountability. the problem is you have an accountability vacuum when it comes to israel, palestine. so the question is, who and what form would be available to seek accountability for crimes that are committed either by the occupying power or my past. and you know, 2 groups in the short answer is the 4 are many, but few and far between at once and the same time. 3rd states, for instance, united states, canada, all hike and track the parties to the fortunately convention which governs treaty, which governs relations between an occupying power which israel is and they occupied population to the palestinian people are in the gaza strip and the rest of the occupied palestinian territory. these 3rd states have obligations to ensure respect for the terms of the convention, and that means domestically as well. so in principle, 3rd states may apply their own domestic laws to seek accountability for those who
2:16 am
commit order to be committed, war crimes, crimes against humanity, violations of the laws of war, you know, occupied palestine. but the real problem there is political will and, and that's a general problem both of the international level and the domestic level is a suggestion that the on groups that we see in gaza, but also across palestine as well. may well take some if not comfort, that at least be motivated by the fact that they to main or face any accountability . well, i mean, i frankly don't think duction in their minds the power disparity between the militant groups and gather and the regular armed forces of the nuclear armed state . israel is so mix that on the one hand, the gallons are basically wanting to free themselves of a foreign military occupation. that is last now for 56 years and are using very crude means to do it. sometimes those means violate international law. i can't put
2:17 am
my mind at myself in the minds of those who, who are engaged in this sort of armed conflict on their side. but i suspect they're not too concerned with being held accountable on by virtue the fact that on a daily basis they have to live with the structural violence of israel occupation on their lives. 62 percent of the gas is stripped, for instance, is unemployed. 78 percent of the water in the gaza strip is undrinkable and so on. so those are the more immediate concerns on israeli side. however, there is a concern most definitely a neighbor articulated that the international criminal court. and the prox, the prosecutor, which has now opened an investigation to the situation of palestine. we'll seek accountability in some way, shape or form in respect of action. they are taken in occupied palestine including in garza. and so one can only hope that that would serve as a deterrent the actions taken by the occupying power when these flare ups take place, which all too often unfortunately happen. it's dasia lubricant,
2:18 am
which i mentioned before that you previously worked for the united nations, both in garza and in jerusalem. when you've been working there, do you have an indication, do you have a sense that there is ultimately i desire to find a solution if not a long term to state solution or whatever might be the case. but even in terms of stopping the, the rocketry either with the air strikes in the rock of firing, going back and forth between garza and israel. is there an and is there a desire to do that? or there is, is there just an acceptance that this is how things are? yeah. well, your question, thanks to response is the 1st response is the immediate that these flare ups and violence occur by virtue of the fact that there is no long term political horizon like solution which would allow palestinians and israelis to live in peace security side by side et cetera, in line with un resolutions and international law. so the focus of inquiry needs
2:19 am
necessarily to be on asking why that is the case. what is it about the situation on the ground that makes it difficult for peace to come about? and frankly, all told it has everything to do with the fact that you have a 56 year old foreign military occupation of palestine by the israeli state. and they have no intention. and they've made very clear about this politically a publicly to relinquish that territory. and give the palestinian people their freedom. and so so long as you have a situation or foreign, illegal occupation of someone else's territory by israel, that will give rise to resistance. and therefore continued a struggle as the palestinian resistance is quite frankly, pleading when one considers the structural wiling sub these rings the occupation. now in place again, it for over 50 years and millions of people living without the right to vote, living a disenfranchised of all of their human rights, civil, political, economic,
2:20 am
social, cultural. and so $11.00 for instance, compares the international communities response to and rightfully to russia, illegal invasion and occupation and annexation of crimea within a very short period of time. there's been a robust response from the western countries in particular to apply international law and sanctions against russia to call it to count, to bring it back to its senses. you have no cit know similar responses when it comes to israel's foreign military occupation of palestine. and it's this, this, if you like, an inconsistency, a devil standard, which will only feed and fuel continued violence between of massive occupying power on one hand, taking more and more territory, palestinians, daily, and the palestinians who are just holding on for the life. it's really good to get your thoughts on this, so we appreciate your time. audience is thank you very much indeed for being with us and al jazeera. thank you. 2 other news now. china says it's going to
