a hush money payment made to an adult film star just before the 2016 presidential election. trump calls it political persecution, and the witch hunt is noise. say they'll fight it out in court. ah, but i won't carry johnston. this is al jazeera, well not from dough. so coming up, we condemned the detention of mister girl glitch in the strongest in the strongest terms. condemnation from the white house softly, us journalist is arrested in russia and charged with espionage. plus an al jazeera investigation on covers a money laundering ski implicating some of the southern africa, largest banks. ah . former us president donald trump has been indicted by

a grand jury in new york after an investigation into a hush money payment made by his former lawyer to an adult film star. while this is said to have happened just before the 2016 presidential election is the 1st time a former u. s. president has been charged with a crime. kristen salome begins our coverage from new york adult film star stormy daniels and her alleged sexual encounter with donald trump is at the center of the criminal case against the former president after she threatened to go public about the affair. in the final days of trumps. 2016 presidential campaign trumps, then fixer michael cohen paying her $130000.00 to keep quiet. cohen, who testified before the grand jury has said he made the payment at trump's direction. and in 2018, i pleaded guilty to violating campaign finance laws for which he served time in prison. not we've been right. what this is,
5:03 am
is that accountability. i don't want to see anyone including donald trump in guided, prosecuted, convicted incarcerated, simply because i fundamentally disagree with them. this is all about accountability . he needs to be held accountable for his 30 deeds. the former president has always denied the affair. he also initially denied any knowledge of the payment, but now says it took place as a legitimate legal expense ah. under new york law, it is the falsification of business records, not the payment itself. that would be trumps crime a misdemeanor. and only of prosecutors can prove he made the payment and falsified records. specifically to hide the affairs from voters or the i r s. would it be a felony or more serious crime that could come with jail time with those of occasion of records for the purpose of committing tax evasion would be the addition

. tional specific crime to elevate falsification of business records from a misdemeanor to a felony. so he need, he needs a thing like that. complicating any prosecution. cohen's former legal advisor, a trump ally told the grand jury cohen couldn't be trusted. know, listen if they want to go after donald trump and they have solid evidence, so be it. but michael cone is far from charlotte evans, president. trump has described this case as a witch hi, but it's far from the only criminal investigation he's facing. in georgia, prosecutors are looking into his alleged attempt to overturn jo biden's victory in the state in 2020, and several government bodies are investigating his alleged role in the attack on the u. s. capital. on january 6th, 2021. the case marks the 1st time in history that a u. s. president has spaced criminal charges. kristin salumi al jazeera, new york,
5:05 am
or donald trump has himself reacted in a statement he call the indictment, political persecution, and election interference at the highest level in history. he blamed it on what he called radical left democrats, engaged in the witch hunt, to destroy the make america great again movement. and he said this which hunt will back fire massively on joe biden. i speak to gabriel at his under who's outside the manhattan district attorney's office right now in new york or gabriel fast moving developments with a 6 jerone situation. but right now, is there a certain quiet before the impending storm certainly is. it is quiet. it's a little after 10 pm here in new york city, but there are only a small handful of protesters that we're out here very briefly. but right now it's very quiet. we do not expect to hear from alvin bragg, the district attorney this evening. he's already left and gone home,
5:06 am
and now it is wait until the next part of this process. and that is going to be a very critical part of his wealth. what is that next step? it will be the former president, donald trump arriving here at the district attorney's office to give fingerprints to have his photo taken. and then he will have his 1st arraignment in front of a judge. donald trump, the former president, will have to turn himself in to authorities. here. we do not know when that will happen. alvin bragg, the district attorney said he's a, he's beginning that process of discussing that surrender of donald trump. 2 authorities here with trumps attorneys. but we do believe it will happen early next week perhaps. and that will be a very critical moment with a lot of security here as well. the secret service f b i the new york police department, as well as court security officials,
5:07 am
all making arrangements on how they negotiate. a former president, turning himself in to authorities, is very unprecedented case. will he go be brought in through the front door? will trump try to address the media before he goes in? will he be driven to an underground parking lot and not even be seen by anybody? these are all questions that will be answered once sat arraignment, and trump turns himself in again, which we expect to be early next week. indeed, and with this coming process, many may wonder if we'll see donald trump in handcuffs. for example, i mean imagery come important. cons it sure there's sir, so many unanswered questions, unlikely that we will see donald trump in handcuffs. why? because he has not been convicted. this is only an indictment and it's very serious indeed. trump as a 1st former or current u. s. president ever and
5:08 am
u. s. history to be indicted, but an indictment does not mean he's convicted. this will most likely go to a trial and that is when a jury will decide if he's guilty or not guilty. so when he turns himself in here, ah, presumably, early next week, as i said, it is part of the normal, procedural judicial process. very rarely, in cases like this are, are the suspects put in handcuffs. nevertheless, he does have to turn himself in and that in of itself will certainly be quite a, a dramatic image to see uh donald trump arriving here. c to turn himself in, but will he be in handcuffs highly unlikely? of course anything's possible, but highly unlikely. it also should be pointed out that if he's convicted of these alleged crimes in this indictment, by the way the indictment has is still under seal. it has not been released to the
5:09 am
public yet. if he goes to trial, presumably he will, if he's convicted, that this would be a maximum for years in jail. however, there is no mandatory jail time by law for this. so even if he's convicted chances of him serving in a jail time for this case, and this indictment are very unlikely. gabriel, thanks very much indeed for that update. well, staying with this now at might, hannah joins us live from washington. d. c might. how does this play into trumps bid for president? could it hinder him or even help him? well, it's a very serious question. some would argue that it's going to help him and that may include trump himself. he's been adamant to that he needs to get his supporters out 10 days ago. he pre empted news of this indictment and called on the sort of porters to get out into the streets. so on some level,
5:10 am
he thinks that maybe this indictment would help him would galvanize his base galvanized supporters. some other republicans appear to share that belief to looking at the reaction to news of the indictment. you do have many republicans calling on people to turn this indictment around and go out and vote, trump himself, sit it in the letter on his social media page. so on that level, yes, there may be a galvanize ation of trump support base. but then on another level, trumps detractors would argue very strongly that these charges just go to prove that he is and that for high office, he wasn't fit in the past. they argue he would be unfit to run. again, they will be making a lot of capital out of this, the opponents of donald trump. so the, all these 2 factors to go into account, which way it will go, well, we'll have to see how that plays out in the weeks to come significantly. the
5:11 am
governor of florida who may well be trumps opponent in the race to get the republican nomination has made very clear that he complete the rejects this indictment along with many of his fellow republicans. when indeed, this is going to be extremely awkward for any potential republican nominees and the democrats maybe pondering. how's that going to handle this? very much so they are no doubt looking at what this impact will have on the presidential race in 2024. and indeed, on other races around the country, we've heard from adam shift, who has made very clear his belief that the indictment shows that nobody is above the law, no matter how powerful are the democrats in particular, will be arguing very strongly as i said, that this is an indication of trumps and fitness for offers. whether they can use this to galvanized support in the streets the way that trump in tens using the
5:12 am
indictment to galvanized support on his side. once again, that's something that will only see as this election season gathers momentum. one thing that must be mentioned as well, significantly, perhaps, is despite the many republicans coming out and describing this indictment as a, with an ice asian of justice as they put it at very senior republican. mitch mcconnell, the minority lead in the senate, has stayed absolutely quiet. on the matter, no reaction whatsoever. so there is an indication that not all republicans are behind the movement to attack angrily the news of this indictment. but also this mentioned that many of the republicans have been saying to that the act, but shouldn't, by the district attorney of new york undermines the electoral system by bringing these charges at a time when trump may be running an electro race. now that is ironic, given that another of charges that is being investigated against donald trump is
5:13 am
interfering with the election results in the state of florida might live 1st in washington d. c. thank you. well tim konstantin is a political writer and senior vice president of diplomacy and external affairs for the washington times. it was florida, chairman of republican candidates above those account, paid the price $10996.00, joins us from st. augustine florida. welcome to the program. so what is your initial reaction to this extraordinary development? you know, it's fine. donald trump is rude. he is brash or he's loud. i can't understand why a number of people would not like him, but what i worry about here, you use the phrase, the weapons ation of the judicial system. but it's really the politicization politicization of the political system of the judicial system. because if his name was hillary clinton, they would not charge this,
5:14 am
this charge is utter rubbish. you have an unsavory story, an unflattering story, where he allegedly paid off a porn star because they had some sort of sexual tryst. so it's on the headline, that is certainly get attention. but is it really a felony charge? is it? and the answer is no. there's some bookkeeping. the alleged char, we haven't seen the official charge of the alleged charge, is that it's a bookkeeping thing. they didn't report it properly, and so they're going to charge him. and i thought if this was literally anyone else on the planet, they wouldn't do it and be rude. and being boorish is not a crime. it's a fancy, but it's not a crime. so i think there's some politics at play here, and that's the disturbing part of all of us. many would say that with this indictment, that a grand jury is made up of randomly. so that could citizens, they decided to 70. well, they haven't decided anything other than to indict him,
5:15 am
but what people don't understand about the grand jury process is typically the prosecutor is not required on like a regular jury trial. you're not required to present both sides of the store. a prosecutor only has to present that sign, which he believes is the case that the if he believes to was wrong doing, he presents the evidence and the grand jury decides whether or not there is enough evidence to move forward. an indictment doesn't mean you're guilty. an indictment means you've been charged, and so this means there's enough evidence for them to show. well, maybe donald trump did something he shouldn't have done. but again, if his name was hillary clinton, i give you an example. bill clinton paint paul jones, $860000.00 to be quiet. she can't say we're a confidentiality agreement. no one said that was the legal. ok with that gave a gives me about the spot. what you sell it, what i'm going to charge,
5:16 am
you does seem to thrive on publicity, doesn't am i, does this galvanize his a portal or does it turn the why that republican party against him? you know, when he says he drives on it, it's true and it's both shameless and shameful. it's crazy. the way this guy loves the attention no matter what that attention is. be interesting to study his childhood, i suppose. but if you look at his supporters, you know, the media loves to talk about donald trump, and there is a core group within the republican party, probably about 20 percent of the republican party that allows donald trump. they would do anything to get donald trump back in office. they love the man more than they love the office. they love the man more than a lot of the countries they are just devoted to them. but the majority, republicans don't even want him to be the candidate, let alone be president again. so i think you may put some,
5:17 am
some off behind that 20 percent. the wife's donald trump. but i think you're also going to reinforce every democrat who doesn't like him every independent who doesn't like him, and that 80 percent of republicans who would really prefer someone else. all this is going to do is strengthen the result for all of that. now, you mentioned a democrats that, i mean, how are they going to handle this going forward because it's a serious legal situation, but inevitably, is going to be something of a circus, isn't it? absolutely, it will be a circus. i wrote a piece in the washington times about a week ago that talked about that. and i said, if you're a democrat, this is your fantasy, you would like to be running against the circus. that is donald trump. and donald trump probably won't be the candidate in 2024. but if you arrest him, if you indict him and if you put him on trial for 6 months or 8 months, donald trump is the story. donald trump, whether the party wants it or not, he will be the face of the republican party for months to come. and while that's
5:18 am
not what the g o p wants, that's not what rob mcdaniel wants. that's not what the other candidates want. he's still going to be the phrase for the next 8 or 10 months. so politically, if you're a democrat, you're thinking great. this is exactly what we'd love to say. 10 konstantin. we very much appreciate your time here now to say thank you. a care what? earlier i spent, david bozer, who worked for joe biden, when he was a senator. bolger says indictment is unprecedented but is not political members of a grand jury. are there 12 or 15 individuals who are citizens of the state of new york? decided that we're convinced that there is a possibility that someone has broken the law. this is not joe biden. this is not any republican out there. in fact, they're doing just the opposite. this is a just citizens who found a,
5:19 am
beyond the reasonable doubt that there's possibly a violation of the law. so there's no politicization here. and i think it's a little disingenuous for the former president to be saying that he is raising funds off of this. and this is the, the whole point about donald trump, which i think many in this country do not understand is that he hasn't. he is not interested in the common man. he is not interested in benefiting society. he's only interested in one thing. and that's donald trump. he adores this tomorrow morning in newspapers around the world, he will be on the front page and that is donald trump's main purpose. ah,

another news now brazil's, for what present viable sonata has returned home ways facing investigations for crimes, including inciting rights. he was greeted by supporters as he arrived at his liberal parties. headquarters in brasilia doughty officials. i think he will lead a position against president millis and i see a new to the silver malaysia's highest court has dismissed an attempt by former prime minister j brazza to have his corruption conviction reviewed the j be serving a 12 year sentence. the case relates to the new thing of the states investment fund . big biggest money, logan scandals in history is the country's 1st former leader to be jailed of florence louis is life for us now? inquired in florence, tell us more about this case. what can happen now? quite so this was not to abrazzo last chance to have his guilty verdict reversed.
5:21 am
this is his last legal route and while that has failed and so he will be returning to prison. the judgment was read by a 5. the decision was given by a 5 member panel of judges from the federal court. the court you see behind me, this is the highest court in malaysia. now, 4 out of one judges dismissed his application for a judicial review notches. lawyers had attempted to argue that he wasn't given a fair hearing in his previous trials, and particularly in the last decision by the federal court. that the arguments by his lawyers to for a postponement for the chief judge to recuse herself that these when taken into account. and these were refused. now, now that he has failed, he will be going back to prison. not yet still has one more chance to leave prison without serving his full sentence, and that as if he obtains a royal pardon, though it has to be remembered that the guilty verdict was handed down by a high court in 2010,

20. and it was reaffirmed by 2 different appellate courts in 2 successive years after that. so in 20212022 the financial scandal of one m d b. it was so big that it actually led to a sort of change in politics in malaysia. it was really anger of the scale of the corruption anger over the fact that attempts to have the attempt to have this corruption investigated was frequently shut down by those in power at that time. that sort of anger let to a change in power in the 2018 elections and it was the 1st change in political power since the country gained independence in 1957. so that's how big the impact of this financial scandal is. and now that no one has failed in his attempt to have a judicial review of the earlier decisions he will be returning to prison in canada . and for us that florence louis, thank you. a journalists from the wall street journal has been arrested in
