even earlier than that. but ronald mcdaniel, beg him not to declare for president before the mid term elections in november. and the reason why he did that is to set up this entire argument that was just made, which is, i'm a, i'm a presidential candidate. i'm running for president and they're only doing this for that reason. but the bottom line is declaring that you are running for president does not give you immunity for any crimes you commit while you're running. and that's his problem. by the way, how could this work out? so donald trump now being prosecuted, he is the front runner for the republican nomination could very well according to the polls and frankly, according to minneapolis could very well quench that nomination while being under prosecution. is there any impact on? well, there are 2 questions here. one is politically, what is the impact on donald trump? but the other, since you're a former federal prosecutor, actually i want to ask you the other question, which is, is there any impact on the, the, the work of the prosecutors?

does it change the way you work when the person you are prosecuting is also running for president? in serious shouldn't. but in practice, i'm sure it does. i mean, i'm sure that what jack smith wants here is for this trial to be held before the election. and i'm sure what donald trump wants is to delay this trial any way he can until after the election. so in terms of scheduling and timeframe that is definitely a factor. and we're already seeing a potential delay right out of the chute today because trump really doesn't have a lawyer. i mean, he has the lawyers that are appearing for him. but if the 2 lawyers he had on this case quit hours after the indictment came out, i think i have theories as to why they quit, but they quit. so the 1st delay right out of the chute, could be trying to delay the rain man today be while he continues to seek to

hire attorneys. on the point you were making that it does change the way to prosecute a working task. and can you just, can you just lift the curtain a little bit on that and, and tell us how it may affect the prosecutor's work? well, i think it just affects him wanting to speed up the case. one to speed up the pace of the case. but there's also national security issues as well. um with a lot of these documents being highly sensitive and highly classified. so there's that element when in terms of discovery, in terms of jury selection issues with that. um redactions all of that. so there's, there's all kinds of the politics of this makes, makes it, uh, it in very complicated case for the prosecutor, even though the facts and the law are pretty simple. the political ramifications make it a little tricky, adolfo, what should donald trump defense be? well donald trump's defense is very simple. i had

a right to have the documents on the residential records act as, as a civil statute, but a pause criminal for, for a 2nd there. did he have a right to have those documents? yes, the presidents have documents all the time because its last advised document will containing information on your tape abilities. if i may, you do not interrupt the other guest. so the couple things i wanted to say absolutely. that's the, that's the case. you know, sort of famous american uh how much it from a different era. paul harvey, you haven't heard the other side of the story. you just sort of bunch of allegations by the government. and you're assuming those are, are factual. and if these are just let him talk, how the other guest i cannot, i cannot let this go with the with this doesn't want to speak about hillary clinton . it was mr. tell me who said there was a basis to bring charges against or there was a basis, different criminal charges. it didn't do it. he doesn't want to talk about it because this is a confirmation to, to your justice system. separately. he says from on the one hand, oh,

defense that's going to come forward to not only justify what president trump, but a lot of these allegations. yep, absolutely not foundation. and there at least that when you look at, that's the typical justice department stacking of obstruction cases to make it look bar for more serious than it really should. a don't for a question on a hillary clinton and i. and i actually didn't expect the conversation to spend so much time on that. but since you bring it up multiple times in 2016 when donald trump was running against or trump didn't make it a key use that as a political argument, that she had kept government information on a private e mail server. and he said in his campaign that that was a huge deal and made her own state for office. he kept also allegedly very sensitive military information. do you not? and, and now he's saying it's a which on, do you not see that is potentially double stands? i think some of our viewers may think that as well, there's

a lot of things to it. so i understand here. first of all, hillary clinton is not a former president. former prison has had legitimate access to this information, whether the document should have a re return and that type of thing, whichever the president has done, is a different question. but president trump has a right to pass these documents per permit information on like president trump's, at least on the allegations. i haven't seen that there's no allegation by mister smith at the documents of an altered or otherwise share mister call. me said that mrs. clinton's documents were absolutely have to assume those were his words for viewed by foreign, another sources. so for her information that was confidential, top secret, at least 10 documents were actually shared. there is meaning disseminated. there is no indication here or out of the navigation that any government or anybody else saw what president trump had in his possession. now what we're going to is rep for low risk rep, $3435.00 of an audio. that's what let me tell you that is unread concerns. we have

weekend, including this morning trash. the witnesses. um, you know, this is not the way normal. federal criminal defendant gets treated. so if anything, he's being treated with kid gloves, he's going to get pre trial release for all these serious charges, when most federal defendants do not get pre trial release. so, so i think they're bending over backwards to do everything that they can to show that they're fair. and i don't think he would have brought this case unless he felt the evidence was overwhelming. and i think any fair person who reads the and diamond would agree with that, and adolfo back to you. um my add something quick. my add something shortly. okay, that's what the question about about the about this being a slam dunk. okay. this same prosecutor had a slam dunk case pushed over the case a crunching case against the former governor of virginia. he was reversed 9 to 0 by the state supreme court by liberals and conservatives. mister smith on
