we'll be talking all things nfl later in the show. good evening. ben stokes is set to play for england again next month. the star all—rounder found out earlier this week that he will be charged with affray after a brawl outside a night club last september. he was left out of the ashes as the police investigation took its course. now that charges have been brought by the cps, the ecb have decided that he can play for england and is set to feature in new zealand injust over five weeks' time. let's speak to our sports correspondentjoe wilson, who is at lords. the former england captain michael atherton says the ecb's decision is illogical if stokes gets a date for a court appearance, yes, andi yes, and i can't take that point because you might say what has changed? because you might say what has changed 7 there are because you might say what has changed? there are still criminal proceedings ongoing, still a

presumption of innocence before guilt, a key part of our legal system. the ecb would say they are waiting to see what the cps were going to decide, so we had this decision to charge ben stokes and i think the ecb would have liked the criminal proceedings to have been done and dusted before they picked ben stokes but what we now find our cells in a situation where there could be a trial in six months or a year, so do the ecb let ben stokes sit on the sidelines while they wait for that? he is a star player and a contracted player, so they have said they don't think it would be fair or proportionate to leave him on the sidelines while they wait for those criminal proceedings to unfold. that would be their logic. they say that

central to this is that he has vowed to fight this charge of affray. if he gets the state for a court appearance and things accelerate, it would be less disruptive than if he got pulled out in the middle of an ashes tour, it's only new zealand. there is that, the ecb realised the complexity of it, never mind the image of him representing his country with this charge hanging over him and the ecb are aware that over him and the ecb are aware that over the next few weeks and months, at any point stokes could miss training for matches to attend court. the idea of him going out to new zealand rather than australia, the level of media scrutiny that he'll get in new zealand will not be anything like it would have been in australia, so let's imagine he arrives in auckland with a couple of
