joe biden's team was hoping for a smooth election, and a clear victory. that didn't happen. but mr biden now thinks he has enough votes to win. lam not i am not good to declare that we have one. but, i am i am not good to declare that we have one. but, lam here i am not good to declare that we have one. but, i am here to report that when the account is finished, we will be the winners. president donald trump has unleashed his legal forces, in a bid to maintain his lead in some key states. last night, before the race was over, he declared an unsubstantiated victory. we were getting ready to win this election, frankly, we did win this election. some swing states have still not declared a winner, but the key state of michigan has been projected for biden within the last hour. we'll keep an eye on the places that decide who wins the white house.
11:31 pm
hello i'm katty kay in washington, christian fraser is in london. the us presidential election is hanging in the balance — with both donald trump and joe biden‘s teams saying their candidate is on course for victory. the margins are tight — with just a few thousand votes in a handful of swing states set to decide who wins and who loses. in the last couple of hours, michigan has been projected as a biden win, and it it looks like he has also won wisconsin. that puts him ever closer to the magic number of 270 electoral votes, which opens the door to the white house. mr trump's team have started several legal actions, including to stop the votes being counted in pennsylvania — a state which could go either way. here's our north america editorjon sopel. the hoopla of election night in the us.
11:32 pm
and as the polls close, the democrats are talking bullishly. joe biden‘s on a smooth path to victory. smooth? what a fantasy that's turned out to be. donald trump was performing way better than the polls had predicted, nowhere more so than florida, the sunshine state that was once again a black cloud for democrats. cbs news projects president trump has won florida. but then fox made a big call forjoe biden out west? the fox news decision desk is calling arizona forjoe biden. that is a big get. maybe the 77—year—old could still win. it was clear he thought so, and and just after midnight, he came out and told his supporters this. i'm here to tell you tonight we believe we're on track to win this election.
11:33 pm
we knew because of the unprecedented early voting and the mail—in vote, it was going to take a while. we're going to have to be patient until the hard work of tallying votes is finished, and it ain't over till every vote is counted, every ballot is counted. that brought an immediate and furious response from the president, tweeting that the democrats were trying to steal the election. and then, just before 2:30am, a night that had been simmering exploded — donald trump entering the east room of the white house to make this statement. this is a fraud on the american public. this is an embarrassment to our country. we were getting ready to win this election. frankly, we did win this election. there's no evidence of fraud at all and the votes that remain to be counted were cast
11:34 pm
on or before polling day. and the president ratcheted up the tension still further, saying he wanted the supreme court — which now has a decisive conservative majority — to order a halt to counting. for the good of this nation, this is a very big moment. this is a majorfraud on our nation. we want the law to be used in the proper manner, so we'll be going to the us supreme court. we want all voting to stop. we don't want them to find any ballots at 4am in the morning and add them to the list, 0k? for the moment, counting continues on postal votes in these key swing states, which were always expected to give joe biden an advantage — after he encouraged his supporters to vote by mail and the president railed against it. tension is still great, and that was palpable on the streets around the white house last night, as black lives matter protesters gathered.
11:35 pm
in the dawn light, things are becoming clearer. yes, there are still millions of ballots to be processed, butjoe biden has picked up wisconsin and is projected to win michigan. no declaration of victory yet, but it wasn't far short. after a long night of counting, it's clear that we're winning enough states to reach 270 electoral votes needed to win the presidency. i'm not here to declare that we've won, but i am here to report that, when the count has finished, we believe we will be the winners. there is, though, still a fragile unease, with shops and offices boarded up. this could still get bumpy, and americans will need to show patience, trust and fortitude — all commodities in desperate short supply. michigan has 16 electoral votes —
11:36 pm
and four years ago, donald trump took them with a tiny majority in the final vote. it was close this time as well, but the state has now been called forjoe biden. that might not be the end of the story however — because the trump campaign has said it will take legal action. live now to detroit and our correspondent lebo diseko. is correspondent lebo diseko. there a chance still for donald is there a chance still for the donald trump campaign to overturn the result with this legal action? that is certainly what they would like to do. they filed this action earlier on, trying to stop the count. they were saying that there election monitors, the challenges had not been allowed access to proper access to be able to observe the vote in the votes are being counted and at the station here, pallets are being counted in earlier on, there were some really ugly
11:37 pm
scenes where the democrats and republicans were demanding to be let into the building and basically, officials were sitting there too many of both sides in the room where things are being counted and so, they were taken outside and people we re they were taken outside and people were demanding to be let inside the building, banging on the windows and demanding to be led into this room as well. speaking to an election official, they said they knew some official, they said they knew some of the people there shouting out here and said what was happening was not fair. he does have faith in the process though, so, yes. you have to see whether or not donald trump is successful and the action that he had filed. but as you are aware, you will hear people, announcements as we speak. yet, legal challenges, i will let you go ahead. this seems to be another announcement. .
11:38 pm
will let you go ahead. this seems to be another announcement. ij will let you go ahead. this seems to be another announcement. . i think it was someone being called. be another announcement. . i think it was someone being calledm sounds like somebody being called. the work that those people are doing is very important. but, i imagine from the people describing, shouting to stop the recount, it must be quite stressful to for them. this quy quite stressful to for them. this guy was saying that he was really hurt. he knows these people and it is upsetting that they are basically saying, he is preventing them from doing with their constitutionally allowed to do. they wanted to be allowed to do. they wanted to be allowed in to watch what was happening, but there is a process and there are rules. interestingly, he has faith in this process and i was speaking to a few people from michigan outside the building who told me, look, don't know why anyone is surprised that it's taken a while this vote to be counted and obviously, this is a year of a
11:39 pm
pandemic and things were going to be different and they said they have absolute trust in the process and one lady was saying to me that she also has trust in americans. she called the people in this room, the building, patriots forgiving of the time to make sure that votes are counted. it took them a while in 2016 to call the votes in michigan. he did go to a court case locally, didn't it? the point and try to make is that counts and elections don't necessarily finish on the night of the election result and it could go on for days afterwards and that is quite normal. and into it was not the year of a pandemic, we did not have this volume of postal ballots coming in so late and these rules have been changed this year and the republicans challenge rules allowing
11:40 pm
votes to be counted earlier and so, postal ballots, absentee ballots, as you say coming there are questions, challenges raised as well, so doesn't necessarily mean that anything was wrong at all. so interesting. i love seeing the people at work, makes it all seems so people at work, makes it all seems so much more real than we can see them sorting this out. a lot of those people are volunteers in their giving of their time to do this. why make a giving of their time to do this. why makea mix giving of their time to do this. why make a mix of force this idea the donald trump is trying to say that there are votes being found behind there are votes being found behind the sofa in boxes are being shuffled into the count later on. you can see i'm a people there are their supervisors there, there are people who take their account very seriously as you have told us repeatedly when you're processing melon ballots, there's not one but
11:41 pm
two people there checking every signature making sure it is done correctly. the idea of the condition of her votes into the system is for the birds. it is time and is labour—intensive and we heard that from the attorney general from nevada. they do everything they can to make sure that it is his free and as varied as legitimate as possible and it's a process particularly year around. is the count was ongoing, the strategist joins us from is the count was ongoing, the strategistjoins us from boston and joining us from washington is the communications director was with the donald trump transition team and thank you for your contributions in the past 2a hours. what do you sit at the moment? what distributor of the race as it stands? joe biden will be the next president of the united states and i will not rule out the fact that democrats could still at the senate. it could be in
11:42 pm
georgia, alaska and some other places, we have seen them come ahead and message michigan forjoe biden of the democrats, i would not reload carolina either, but they will not update their election board information for eight more days and so, free and fair election, count every ballot, that is what the american stands for. another of the statement taken from donald trump in the early hours of the morning, some of the democratic side saying that you have to match fire with fire. when you listen tojoe biden talk just a short time ago, did you hear enough from him? would you like to? what did you think of it? once again, joe what did you think of it? once again, joe biden, just like during the campaign but he was a stark contrast from donald trump rallies with no masks to really being safe and protecting people from getting covid—19, he is doing the same thing with the selection and showing
11:43 pm
strength through confidence. but still being conciliatory, saying that there is a place for everybody in this country. but he made it clear, he is going to win, it's got the most votes is got more votes than donald trump, more than hillary clinton and more than any of the person who has run for president in the united states and i will only continue to grow. that is the kind of signal that the country needs to hear and see to come out on the other side of the selection and begin to heal. brian, we have been ofa begin to heal. brian, we have been of a roller coaster we have been through this and it looks very good for donald trump and now it is looking good forjoe biden again. on your side when you're talking to the campaign, whichi your side when you're talking to the campaign, which i know you do on a regular basis, what is the mood for donald trump campaign? they see pennsylvania going their way, they see north carolina going their way, they see georgia very tight but securing it. it goes down
11:44 pm
to arizona, which they believe is in play, or even nevada. if donald trump wins those three states, those are a gamble. you are finally at the end of the point we certainly do not have the double—digit landslide the pollsters talked about the strafe hours ago, but they know they are running out of states and arizona and nevada are critical, either one of those are critical to them. you've always been clear eyed about this, you've always said that donald trump has path, we are in the same position now. they're sounding confident, but we look at this map, you can see it as much as i can see it, it looks more likely thatjoe biden is going to be in the next president of the united states, doesn't it? donald trump, the campaign has to be perfect and they do not have a lot of stakes to play with. georgia could fall tonight in
11:45 pm
game over. they have to survive these dominoes and one of those dominoes provides clarity, the math is the math, if he loses any of those three... do you think the president will accept that?” those three... do you think the president will accept that? i do. i do. i think, president will accept that? i do. i do. ithink, he is a president will accept that? i do. i do. i think, he is a fighter, president will accept that? i do. i do. ithink, he is a fighter, he knows the process but at the end of the day, if it is not there, it is not there. he has walked away from deals before. he said it yesterday, losing is more difficult than winning and so, he has gone to the experience of losing. it sucks, but we all predicted a landslide, senate controlled by the democrats, republican gained seats in the house of representatives, not the other way around. i would not be surprised if the president were to lose this very tight election, they turns around and runs again in four years from now, same asjoe biden.
11:46 pm
around and runs again in four years from now, same as joe biden. here's a tweet that the president is to sin. he said our lawyers have asked for... —— present asked this. are two things about this. he seems to be shifting in his mood about this and it seems like the tender of that tweet, the same time, he is calling into question integrity of the whole ballot. that his prerogative make, people are going to come back and push against that and it's going to play a role. i think what we've learned over the past four years when president trump isolates himself to something, he has been proven right more tense and wrong in changing the rules that would have been pennsylvania, anytime you change the rules, you are disenfranchising one candidate or the other. i think it's on the
11:47 pm
president is asking for, consistent rules and goalposts, if he feels pennsylvania move the goalpost. the son a republican legislator. and to be fair, that it's already been kind of litigated at the supreme court. let's bring marianne back and before we have to go to a break. marianne, are there any scenarios that you see as you watch these numbers and that would make you think that actually, nevada, arizona, those could still swing back to donald trump. is there way you see joe swing back to donald trump. is there way you seejoe biden, if he doesn't get to 270? i don't. arizona and nevada are not going to swing back, the margins are pretty clear with what's outstanding there. joe biden does not need pennsylvania, he does not need georgia as we as discussed. he does not need those two states. he does not need those two states. hejust he does not need those two states. he just needs to keep arizona and nevada, keep wisconsin and michigan, it is game, set, match. that's it.
11:48 pm
that is where this is headed. i think it is important to be clear about this. donald trump is tweeting and saying things that don't serve anyone well. there is a reason my last night, he appeared before the country just before last night, he appeared before the countryjust before wisconsin and milwaukee county ballots, under police ballots showed up and there's a reason either hoarding press conferences making the statements today, he strained to set the story so when he does not prevail, that it was rigged, that he was wrong in history will prove otherwise as to the facts in the data. a great pleasure to have you with us through the last 2a hours and thank you both very much indeed for your analysis. she tried getting some sleep now, you deserve a rest. —— try getting some sleep. let's hear now a little more from the man who might well
11:49 pm
be the next president, joe biden. he's just a state or two short of reaching the 270 electoral college votes need for victory. a short while ago he spoke to his supporters and said he was confident of a good result. here, the people rule. power cannot be taken or asserted. it flows from the people. it is there will that determines who will be the president of the united states and there will alone. and now, after a long night of counting, it is clear that we are winning enough states to reach 270 electoral votes needed to win the presidency. i am electoral votes needed to win the presidency. iam not electoral votes needed to win the presidency. i am not here to declare that we have one, but i am here to report that when the count is finished, we believe we will be the
11:50 pm
winners. the first polls closed during the us and there is still a bunch of states that we do not know. it is not unprecedented you've been pointing this out by correctly in the past however many hours that it has been. we do not always know the result we go to bed on election night and there are some states that linger and take some time counting in the midst of a pandemic we should not be surprised by that. but, you look at georgia, arizona, nevada, pennsylvania and north carolina where he may not have a result for a little while. but it could be critical and that's crossover. let's cross live now to one of the states where the result is still hanging in the balance. larry madowo is in north carolina. he said we would not get a result out of north carolina and another week, there does seem rather long.
11:51 pm
about eight or nine days, they'll be a little while. an understanding of a little while. an understanding of a little while. the reason is because in north carolina, e—mailing ballot that is bookmarked by 5pm on election day, it can be delivered up to november 12 and it will be counted. anything you see on the state boa rd of counted. anything you see on the state board of elections, those are unofficial results and with the state boa rd of unofficial results and with the state board of elections do right now is verifications in an audit of those results and when the different cou nty those results and when the different county boards of elections meet, they will verify an audit those and make the final announcement and they do not expect a whole lot of movement so, right now if president trump is leading on those by 76,000 votes, however, there is still about 117,000 mail—in ballots have not been delivered. talking about the senate race, one of the richest congressional races ever run and they pulled an extraordinary amount of money and the incumbent, the
11:52 pm
republican up against him. that is a crucial race now becausejoe biden desperately wants control of the senate. what can you tell us about that? cal cunningham did surprisingly well in this race considering thatjust in the dying days of his campaign, he had a bit of scandal there. some kind of sex sting scandal been in the final vote, it looks that he gave him a very big run for his money and so, that might be one of the other races that might be one of the other races that he needs an official verification on november 12 for the 13th to determine exactly if he's going to get reelected or if the democrat has won and what is not being called the most expensive senate race ever run in america. thank you. i think is going to be a lot of questions about the polling on the senate races the amount of money at that was spent by democrats
11:53 pm
to try to take the seats and does not seem to have panned out for them. no election complete without a bit of a scandal and you can look that up yourself. we can speak now to elizabeth neumann, who worked as deputy chief of staff of the department of homeland security under president trump. you have left the white house needs become a critic of president trump you been working on this campaign to make sure that he did not hold on to the white house. it is looking good forjoe biden, but if you look around the country who voted and how they voted, it is not by any means a resounding repudiation of donald trump is it? no, it is not. iwas disappointed last night did not see that blue wave, especially in the south. i am optimistic about bc is the accounts coming in today and that she reported, north carolina 92 next week, but maybe it looks more
11:54 pm
like a blue wave that it does today and certainly the country is extremely polarised and it is disheartening because of the profession that i'm in in the industry, i'm very concerned about when you have extremely polarised electorate where you have an us versus them mentality which the president continues to stoke even after the election and is continuing to stoke this idea that people are out to get him and it creates for a very vulnerable individuals this process towards radicalisation and sometimes violence. so, i am concerned and we have a lot of work to do on the side of the election to restore civil discourse and bring back unity in our country.|j restore civil discourse and bring back unity in our country. i am intrigued because you work in the white house and he is up and down. how do you think you would deal with this tonight? i have worked in the white house but not during the
11:55 pm
donald trump administration. certainly, the department of homeland security, he is very, we we re homeland security, he is very, we were always on edge. he is mercurial. and i am hopeful that a lot of strong republican voices will castle him and i honestly, after experiencing bush versus al gore, and understand the crooks are there for a purpose and out the process moves quickly, for the sake of the country, i hope that he takes in the council that he should bow out gracefully soon, if that's of the votes into being counted. thank you very much forjoining us, elizabeth. 25 seconds left of airtime to fill. do you have anything more to say? it's been a long, long night, but i think it has been fascinating. i
11:56 pm
really enjoy it. and it has changed in ebb and flow, over the course of the evening and is such a great us election. great fun. we will see you back here tomorrow, by the way. hello there. it's pretty cold out there it's on the parts of the uk. what followed was a generally dry and sunny autumn day, but for scotla nd and sunny autumn day, but for scotland and northern ireland, with some more cloud moving in during the afternoon and evening. he could see that clearly on the satellite picture from earlier on. that cloud moving very slowly southwards and we actually had weakening weather from bringing some damp and drizzly weather and lowering the cloud onto the hills. we have high pressure on the hills. we have high pressure on the south and this is where we got the south and this is where we got the clear skies and veeck at lower temperatures as well. mild in the north, but colder in the south. maybe some thrust around from mid wells, the midlands and southwards,
11:57 pm
not just wells, the midlands and southwards, notjust some wells, the midlands and southwards, not just some frost, some wells, the midlands and southwards, notjust some frost, some mist wells, the midlands and southwards, not just some frost, some mist and fog too. and that is going to be dense and places in the morning. gradually, that will turn to lift and break, maybe in the home counties but some sunshine coming through but northern england, looks quite cloudy, damp and misty over the hills. further north, we have more present in the atlantic that significant and bringing a lot of clout in the cloud breaks to the high ground in the east escarpment and a bit of warmth a bit of warmth of 16 and a bit of warmth a bit of warmth of16 and 60 and a bit of warmth a bit of warmth of 16 and 60 degrees. ten to 12 similarto of 16 and 60 degrees. ten to 12 similar to what we had on wednesday. but this time, we got some mist and fog and into friday morning, again there'll be some dense patches of fog and more likely from the mitten southwards, this time on friday, that fog will tend to lift more readily and that's because the breeze will pick up a little bit more and we should see sunshine and low cloud around, misty over the hills in the cloud turning to thin and some sunshine coming through away from the northwest. temperatures ten to 12 degrees again, little bit milder perhaps
11:58 pm
towards the southeast, but the winds are picking up in the far southwest in the wind direction is changing just in time for the weekend. that is going to be quite significant because i would drop some of their airand because i would drop some of their air and pushes very slowly northwards. instead of the high—pressure that is keeping it quiet at the moment, quite cold, thatis quiet at the moment, quite cold, that is moving away towards continental europe and lowering pressure from iberia means we have the threat of some rain coming up from the south. maybe the odd shower around on saturday, greater chance of some rain in north and western areas on sunday, temperatures gradually rising and higher temperatures towards the south and possibly up to 16 17 celsius.
12:00 am
this is bbc news with the latest headlines for viewers in the uk and around the world. i'm kasia madera. joe biden and donald trump both say they're on course to win the us presidency as the vote counting continues. i'm not here to declare that we won. but i am here to declare that when the counting is finished we do believe we will be the winners. we were getting ready to win this election, to win this election, frankly, we did win this election. we did win this election. angry poll watchers are barred from entering a counting hall — as the trump campaign says it'll take legal action in key states such
