base but one republican his base but one republican strategist was making the obvious point which is that on current polling, he is below 50% in terms of the general public support. he needs to get over that 50% and candy with all of this? in the background? we don't all of this? in the background? - don't know, basically but we can look at the past year or so. he has lost support from republican leading independents and some independence we saw that in the midterm election results. and a lot of that was connected to the attack on capitol hill onjanuary the connected to the attack on capitol hill on january the 6th connected to the attack on capitol hill onjanuary the 6th and his role in that which has been investigated by a congressional committee. so the question then becomes, would sympathy for him over this court case, with the view that the court cases pool size, one that he is pushing, one that the district attorney is denying, would that become prevalent? with that then change peoples minds? or is the

bigger picture of his actions in the past going to be the presiding determination. don't forget, of course, that he had several other cases or investigations, i should say, that are under way. and these deal with those issues and those efforts to overturn the election in the state of georgia and his role in the state of georgia and his role in the january six riot and the way that he has handle classified documents all quite serious issues. and if those investigations and up making criminal charges against mr trump while this other case is going on, that will also perhaps have an impact. 50 on, that will also perhaps have an imact. . ., * 4' ., on, that will also perhaps have an imact. . ., * ~ ., ., on, that will also perhaps have an imact. . ~ ., ., ., impact. so much we don't know and of course one of— impact. so much we don't know and of course one of the _ impact. so much we don't know and of course one of the key _ impact. so much we don't know and of course one of the key things that - impact. so much we don't know and of course one of the key things that we . course one of the key things that we don't know is how donald trump himself will react because he is notoriously i predict.

5:33 pm
the former attorney general, william barr, who doesn't think this is a good case, it would open the door to a politcised, other politcised cases, he did say he thought it would be a bad idea to put donald trump on the witness stand because i according to him donald trump had no self control when he speaks. so, i think it is something the legal team will keep in mind but nevertheless he will give a statement at his person or estate when he comes back from new york. clearly indicating that he thinks, and his campaign thing think this is a political issue. it thing think this is a political issue. , , ., , issue. it will be interesting to see how much. _ issue. it will be interesting to see how much, much _ issue. it will be interesting to see how much, much inside _ issue. it will be interesting to see how much, much inside the - issue. it will be interesting to see - how much, much inside the courtroom the public will see the judge will make a decision on that in the coming hours we are told. interesting you are referring the attacks on the judge and the attorney general there in new york because it is a judge who will have

5:38 pm
but there would also then need to attach it to irregularities in terms of election financing and campaign financing for it to become a felony. those are all details will be waiting to hear about when the charges are finally made public exactly what the strategy is here in terms of how new york state courts, the district attorney of the state, plans to prosecute a former president. plans to prosecute a former president-— plans to prosecute a former president. plans to prosecute a former resident. . , , president. over the last few days we have had indictments, _ president. over the last few days we have had indictments, we _ president. over the last few days we have had indictments, we had - president. over the last few days we have had indictments, we had an - have had indictments, we had an arraignments, and yourfriends have had indictments, we had an arraignments, and your friends are grand jury arraignments, and your friends are grandjury and all arraignments, and your friends are grand jury and all these terms. for people walking around the world, the indictment came after the grand jury had heard weeks and months of evidence. who was actually sitting on the grand jury? who mix that up? the grand jury would be made up of new yorkers, people who do jury

was see the specifics and comb over it. then, they may file to dismiss the case because they feel that as much as they have heard, that it doesn't amount to a case that could be prosecuted. so, that could be one of their steps but they made the points in an interview at the weekend that they were going to look very closely at what exactly the charges are, there could be more than two dozen charges related to this issue and then they will take action against it. they have made quite clear that donald trump will plead not guilty and he will fight it and they will fight it.— it and they will fight it. when we're talking _ it and they will fight it. when we're talking a _ it and they will fight it. when we're talking a couple - it and they will fight it. when we're talking a couple of- it and they will fight it. when | we're talking a couple of hours it and they will fight it. when - we're talking a couple of hours ago i made the point that over decades we've seen the same tactics that donald trump's legal team has use in his court appearances and business cases and it is basically a check and delay. we see in the attack site over the last few days, is there a all of this stretching out and
5:42 pm
stretching out even up to 202k? it’s stretching out even up to 2024? it's reall stretching out even up to 2024? it*s really difficult to say, matthew, exactly how this would play out and whether it was stretch that far. i would think it's unlikely because for a trial to last 1.5 years but if mr trump and for a trial to last 1.5 years but if mrtrump and his for a trial to last 1.5 years but if mr trump and his team feel there is a value in doing its perhaps that might be likely. it's really difficult to say. in might be likely. it's really difficult to say.— might be likely. it's really difficult to say. might be likely. it's really difficult to sa . , ., difficult to say. in terms of the wider republican _ difficult to say. in terms of the wider republican party, - difficult to say. in terms of the wider republican party, we - difficult to say. in terms of the i wider republican party, we have difficult to say. in terms of the - wider republican party, we have a situation where all of this dominated the headlines as a huge background to the politics but we seem virtually none of them breaking ranks to put distance between themselves and donald trump in terms of potential candidates, have we? no, you have seen pretty much a circling of the wagons when you're
5:43 pm
looking at the 2024 candidates and those who are expecting to throw their hat in the ring including from running descent is the governor of florida who is seen as a mean contender at this point. you have some of the potential candidates not really seen much at all. you have many of them saying that it is politcised and going along with that line but not really getting into the substance of the charges. you did have one candidate who just announced it, the former governor of arkansas us, who said it would be better for trump to step aside because he would be a sideshow and the court case would be a sideshow and distracting. he is the one who was on the furthest in terms of actually standing against... or making some criticism of mr trump and his candidacy but to the moment
5:44 pm
most of them have supported him in some way which does show his power in the republican party. it will be interesting to see how it plays out interesting to see how it plays out in the primary. interesting to see how it plays out in the primary-— interesting to see how it plays out in the primary. barbara, we talked olitics in the primary. barbara, we talked politics and _ in the primary. barbara, we talked politics and law, _ in the primary. barbara, we talked politics and law, what's _ in the primary. barbara, we talked politics and law, what's about - in the primary. barbara, we talked politics and law, what's about the | politics and law, what's about the public? this is simply fall into the category that american politics is hog hardly divided and partisan and you're either in one camp or another?— you're either in one camp or another? ~ . ., , another? yet, i think that it really will show up _ another? yet, i think that it really will show up again, _ another? yet, i think that it really will show up again, the _ another? yet, i think that it really will show up again, the deep - another? yet, i think that it really will show up again, the deep for. another? yet, i think that it really i will show up again, the deep for and divisions within the country. you did have a surge of support in the polls for mr trump from republican voters and those were measured against other republican primary candidates. mrtrump against other republican primary candidates. mr trump was the front running before and now he's significantly the front runner. you have not seen a mass of outpouring of support here in florida. the
5:45 pm
people who, to protest or show support has been in the dozens rather than the hundreds and are very much die—hard supporters. how that would affect the votes of the republicans when they choose their nominee around the country will have to wait and see. in terms of the general election, as i said before, the average voter or general voter mall who may be republican leaning or not a member of the party, that's a question... many american analysts do think it is not necessarily going to help mr trump in the general election and this will not change the mind of those who took their votes away from him, especially republicans in the suburbs which is where he lost a letter votes. it's 1.5 years at least until the election so it's still early aid days and would have to follow along as it goes. and definitely we will. barbara stay with us but as you were
5:46 pm
speaking there we are watching the pictures of the trump project beginning to move and to do the early parts of the text seen as donald trump begins thatjourney from florida to new york to face the criminal charges. however bullish he has been in the four or five days since the indictments, this is not a journey he would've wanted to make because it sets a precedent. the first former president to face criminal prosecution and we are bound to see an enormous amount of focus, attention, on donald trump tomorrow in new york, in lower manhattan around the courthouse. we still wait to see exactly how that plays out. the mechanics of it. let me ask you about that barbara the sub donald trump has to hang himself

5:48 pm
he will appear before the judge. how he will appear before the judge. how he would enter the courtroom is still not clear either, one of his associates, who faced a trial, face legal action, associates, who faced a trial, face legalaction, entered associates, who faced a trial, face legal action, entered the court through a side door early in the morning and managed to evade me to media scrutiny that way. i don't think trump will be able to evade media scrutiny no matter where and when he arrives, i suspect there will be checking of his every move from trump towers where he spending the night to his courthouse. star; the night to his courthouse. stay with us i can _ the night to his courthouse. stay with us i can see _ the night to his courthouse. stay with us i can see gary _ the night to his courthouse. stay with us i can see gary donna you all are corresponded in new york setting himself up and will bring in shortly. we continue to watch the trump jets on shortly. we continue to watch the trumpjets on the tournament —— or tarmac. let me bring you back in

barbara for a final word. if people are tuning around now. explain to them what they'll be watching and them what they'll be watching and the significance of these moments. we are watching the former president donald trump are about to take off from parma beach airport in florida to go to new york where he used to live to face legal action. he's going to be entering the courtroom there and handing themselves over after being indicted on criminal charges and will be facing the judge to hear what the are and we are told he would plead not guilty. the significance is that he is the first former us president ever to face criminal charges which is a big step, historically speaking in the us. it does cross a certain boundary line because, although it is been legally possible to implicates or
5:50 pm
indict former presidents, it is never been done. and the other thing is this is happening as the election seasonis is this is happening as the election season is beginning and mr trump is going to be running for president again. going to be running for president aaain. . ~ going to be running for president aaain. ., ~' ,, going to be running for president aaain. ., ,, i. ., ., ,, , again. thank you for taking us throu~h again. thank you for taking us through that, _ again. thank you for taking us through that, barbara. - again. thank you for taking us | through that, barbara. perfect timing because we can see that trump jet just timing because we can see that trump jetjust beginning to edge its way to the main part of the runway before taking off and he's heading to new york and that's where we are heading as well because gary r harshman and is there as well. gary why don't you start price is not the scene where you are customer. matthew where outside the courthouse in lower manhattan which is also the office for the district attorney and this is where the former president will come tomorrow for his arraignment. all of those details still being worked out, the minutia of what is happening. you saw his plane started to take off from florida and it will be at 2.5 maybe
5:51 pm
three hour maximum flight from west palm beach florida up to laguardia in queens new york and we understand he would take a motorcade to trump tower, his building in midtown and that's where he would stay overnight before coming for his arraignment tomorrow. you can tell from looking around here there is a lot of worldwide interest in what is happening to donald trump. the first everformer president to happening to donald trump. the first ever former president to be charged with a crime step i think it was still only go roll over the day and certainly tomorrow. a lots of planning going on in the city. the new york police department and secret service which looks after former presidents sup he has a detachment of people who would look after them all the time and they will be coming to or and the authorities looking to work out all the details of the event tomorrow. it will be one of those moments in time, an image for the ages if you

sooner rather than later. in other words, not wait until tomorrow when the former president has pled in front of a judge and left the building, that should happen today. we are waiting to hear from the judge about his rulings on that. nothing that we can tell so far that she's decided. his history is apparently that he is not too keen on having cameras around and that may give some indication but these are extraordinary circumstances as everyone knows, so there will be significant pressure on him to do things differently. however, they have to do it by the book. that's important to them in one of the things in question is whether or not there will be the classic mug shot taken tomorrow. i think some of the authorities are concerned that could somehow become politcised and is not generally speaking released in the state of new york under new york state of new york under new york state law and this is not a federal

5:55 pm
a year is classed as a felony. it doesn't mean you get a jail term, meaning if you are convicted for misdemeanors or phonies but that's a distinction. i think people will be looking for those classed as a felony which could be accomplished in addition combination of financial crimes with other potential crimes with federal law that rice to that level. if it was just a list of misdemeanors, i think people will be wondering what all the fuss is about but people will be combing through that detail tomorrow and going through it bit by bit. it does sound like a lots of charges, doesn't it? the only thing i can think of which is pure speculation on my part, is that when you look at the detail of this case it does seem to relate to a whole series of payments to michael coyne,. what she said where reimbursement for the money he said he paid stormy daniels before the
5:56 pm
2016 election. 11 days before that election, that $130,000. he back in instalments and there are multiple acts, if you like, if that is true in that financial accounting that took place. you can see, potentially, how there is a couple of indictments per transaction if thatis of indictments per transaction if that is what they are thinking. that is pure spy collision on my part but thatis is pure spy collision on my part but that is why... that is one way you can possibly explain the high number of charges people are talking about. gary, in terms of the extraordinary drama we will see over the next 24 hours, where are the us public and all of this? it’s hours, where are the us public and all of this? * , . hours, where are the us public and all of this? *, ., hours, where are the us public and all of this?— all of this? it's a good question. the public. _ all of this? it's a good question. the public. it — all of this? it's a good question. the public, it is— all of this? it's a good question. the public, it is difficult - all of this? it's a good question. the public, it is difficult to - the public, it is difficult to generalise. i think a lot of people

are bemused by this. certainly a lot of those who were supporters of donald trump are very much fired by this —— orfired up by this. we have seen it in the last few days with the rally in waco texas. you've actually seen it in the polls of republicans in terms of the nomination for next years general election. donald trump is now the clear front runner and election. donald trump is now the clearfront runner and he election. donald trump is now the clear front runner and he wasn't before this all started. it was much more in neck and neck so he's had a bounce in that sense among core republican supporters. he raised $5 million and $48 after the indictment was announced. in terms of engagements, it is difficult at this stage. he talked to people anecdotally and you hear the whole inspection. people who think it's about time and then you hear people who say you shouldn't do that to

former presidents and he come from different walks of life. so, i think we are in uncharted territory subject it's a cliche, i know, but is generally true in this place and one thing i've said all along in this process is that this event for donald trump is clearly a problem but it's also an opportunity for him. it's a problem because who wants to be charged? and there could be other charges in cases, we know that. at the same time, it allows them to renew himself as an outsider, and being an outsider, breaking the mould, same things people wouldn't say, that's what got him the nomination, he steam—rolled to the nomination in 200016. it wasn't a close thing. he blew his opponents out of the water without political playbook. the problem with being an outsider you can only play once unless you renew, and here he

is renewing. i’m once unless you renew, and here he is renewing-— once unless you renew, and here he is renewing. i'm pausing because we have half an — is renewing. i'm pausing because we have half an eye _ is renewing. i'm pausing because we have half an eye on _ is renewing. i'm pausing because we have half an eye on the _ is renewing. i'm pausing because we have half an eye on the trump - is renewing. i'm pausing because we have half an eye on the trumpjets i have half an eye on the trump jets which is looking like it's making its final manoeuvres before the take—off and you mentioned there in your answer that of course this is setting a precedent for a former president facing criminal charges but of course the backdrop is he wants to be the next american president and how all of this impacts that political run. that is months away as we see the jet begin to take off. tomorrow will be all about what happens in the courtroom in new york. i'm coming to the end of my programme as you watch the jet take off. a pointer to the viewers here in the uk, they would have the 6pm news with rita check her varsity
