new citizens and that's about right. just under half of all medical staff in the uk are junior doctors. —— just under half of all medical staff in the uk arejunior doctors. —— you said thousands. they have been out on strike here just under three hours now and you can see the picket line has been building up throughout the morning. a lot of drivers have begun past, they are being asked to honk if they supportjunior doctors and they have been quite a few. i think we are going to see considerable brought disruption over the next three days because they are not going back to work until saturday morning. the last time junior doctors went on strike, in april, round about 200,000 appointments had to be cancelled, and that added to a situation where we already have 7 million people on nhs waiting lists in the uk.- nhs waiting lists in the uk. doctors have to study _ nhs waiting lists in the uk. doctors have to study hard, _ nhs waiting lists in the uk. doctors have to study hard, train _ nhs waiting lists in the uk. doctors have to study hard, train hard - nhs waiting lists in the uk. doctors have to study hard, train hard and l have to study hard, train hard and then work hard, rather famously, they're asking for 35%, that is
9:48 am
quite an uplift compared to lots of public sector workers, what has been some of the public response to this? let's run through those figures. the government is offering 5%, they say thatis government is offering 5%, they say that is fair and reasonable. but junior doctors say is that they are not looking for a pay rise, but pay restoration, because they say that over the past 15 years, because of inflation, they haven't had pay rises that haven't matched inflation so they say they are 35% down on what they were in 2008 and they won't pay restored, and they say that with a 5% offer, that doesn't even match the current level of inflation, which has been around 10% inflation, which has been around 10% in the last few months. in terms of public support, you have to remember that of course, during the pandemic there was widespread public support for people working in the nhs, we have people out on the doorsteps clapping for the nhs and all the
9:49 am
rest of it, so i think broadly there is a lot of support for the nhs. whether people think that 35% headline figure that they are hearing is too much, because in other areas we have seen sectors are settling for much, much less than that. but i think the main point is that. but i think the main point is that we are nowhere near a resolution, it would seem, to this industrial dispute, there is the possibility i think of further strikes throughout the summer. you talked earlier _ strikes throughout the summer. you talked earlier about the pressures facing the nhs. given the warm weather, the kind of hangoverfrom the pandemic, how are these shifts, this work that still needs to be done, people will be worried if their appointments will be cancelled, how are the health authority is planning to cover the work? i authority is planning to cover the work? ., ., authority is planning to cover the work? ~ ., ., ., , .,, work? i think a lot of people will robabl work? i think a lot of people will probably have — work? i think a lot of people will probably have found _ work? i think a lot of people will probably have found that - work? i think a lot of people will probably have found that if - work? i think a lot of people will probably have found that if they| work? i think a lot of people will. probably have found that if they had appointments today, those might have been cancelled already. but nhs chiefs are saying is that they have

10:16 am
because no one was at work and actually person x was put on furlough for nine months, so it is an important then, over that time our head of production had a duty of care conversations with him, but nothing else. it's important in terms of the process we went through that it stopped in march for reasons of lockdown. what we would say is that we had done, we feel, from a process perspective, but also from a human perspective, we asked multiple times of both individuals, both formally and informally, and so we felt that was proportionate to what we had, because we had no evidence, no one brought us anything tangible, either on the production floor or from the outside, there was only hearsay and rumour and speculation. the other thing we would say is that
10:17 am
we were very, very concerned about the state of mind of both phillip and person x, so phillip was not in and person x, so phillip was not in a good state as kevin will tell you, when he came out. very anxious, very worried, very nervous, worried about the social media backlash, all of those things. and person x could not relate grasp the media intrusion that was so prevalent in his life now. and so we had to balance how we asked questions and we did ask them formally, there were meetings, hr was present, so we did a balance of informal, is there anything we need to know, how can we help you to person x? how can we help you? what more do we need to know? you can do this confidentially, anonymously, talk to a counsellor, just because we wanted to make it easier for him because you are not used to being in
10:18 am
the press as often or in social media when you are in that position. so we were very mindful of our duty of care obligations butjust as a human being, not making what was a very difficult situation for person x and actually also phillip worse. we make sense to me as though you were saying the investigation was thorough and the decisions that you made... ~ ., thorough and the decisions that you made- - -_ can i i made... were well founded. can i 'ust sa made... were well founded. can i just say was _ made... were well founded. can i just say was not — made... were well founded. can i just say was not an _ made... were well founded. can i just say was not an investigation, | made... were well founded. can i| just say was not an investigation, i would not qualify this as an investigation, it was a review, an ongoing review, that every time there were periods of intense speculation we went in and asked more questions, but it was an ongoing review.— more questions, but it was an ongoing review. with the assertion then leading _ ongoing review. with the assertion then leading from _ ongoing review. with the assertion then leading from that _ ongoing review. with the assertion then leading from that be - ongoing review. with the assertion then leading from that be that - ongoing review. with the assertion then leading from that be that if i then leading from that be that if you could go back in time and do it all again you would do it exactly the same way and would probably have reached the same conclusion? ithink reached the same conclusion? i think that if we had — reached the same conclusion? i think that if we had time _ reached the same conclusion? i think that if we had time again, _ reached the same conclusion? i think
10:19 am
that if we had time again, let's - that if we had time again, let's see, i'm not hiding behind the kc, but let's see what they casey says because that's one of the things we want to learn, is there anything we could have done or spotted chris back at the moment, we can't see what that is, because we did interview both individuals as i've said, but also other people. we have a very, very clear and loud speaking up a very, very clear and loud speaking up policy, we really do. i mean, the vast majority of people when they reply to surveys that we do on this say that they feel confident that we will act if they speak up. that comes from a tangible quantitative survey, so we have done and we can talk about her speak up policy later, anybody at any time could have confidentially gone to our helpline, safe call, it's completely anonymous, run by an external company, they could have at any time said something about this, we had none of that. so therefore we feel
10:20 am
in the circumstances, and with what we had, that we had no legal reasons to go any further with an investigation. if we had any evidence we would have done a formal investigation, we had no evidence. absolutely it is not in our interest in any way not to investigate something that we know has evidence to support it. put it another way, had we gone into with no legal reason into a formal investigation it would have caused a huge amount of damage, i think. the mental health issues around the strained... the psychological strain on person x etc would have been quite intense. and so we didn't have any legal grounds to do that. this and so we didn't have any legal grounds to do that.— and so we didn't have any legal grounds to do that. as far as you are concerned _ grounds to do that. as far as you are concerned there _ grounds to do that. as far as you are concerned there is _ grounds to do that. as far as you are concerned there is no - are concerned there is no circumstances under which you could possibly have inadvertently or prosperously turned a blind eye to some serious shortcomings at this
