a party or other politician, powerful people prosecuting him, the reality is, in georgia as in new york, florida and dc, he was indicted because of the prosecutors presented evidence to grand jurors composed of average americans who are called upon do that civic duty and those average americans found probable cause that a crime was committed so he's painting it differently to the way it actually works in our legal system. and if he decides to go to trial, he can put the burden of proof on the prosecutors to convince a jury of his peers, again, average americans, they have to convince them beyond a reasonable doubt that he committed a crime and i think our legal system is working as it should. brian, do you agree the legal system is working as it should? it is
1:46 am
a system that has worked for a long time but picking the bacteria is more important than a jury of your peers and people see president trump try to move the atlantic case to a federal court and i don't think anyone takes the new york cases seriously. you had a prosecutor who stretched the law. we had the former attorney—general, even kind of downplay the prosecution with respect to that. but the jury is important but it is more important that you pick thejury but it is more important that you pick the jury that will help. you pick the “ury that will hel. ., , , , you pick the “my that will hel. ., ,, , ., , help. congressmen davis what is our help. congressmen davis what is yourthought _ help. congressmen davis what is your thought on _ help. congressmen davis what is your thought on that _ help. congressmen davis what is your thought on that as - help. congressmen davis what is your thought on that as the - your thought on that as the former president has cast out over the validity of the legal system? over the validity of the legal s stem? ., ., ~' over the validity of the legal s stem? ., ., ~ i. over the validity of the legal s stem? ., ., ~ ,, ., system? look, when you have la ers system? look, when you have lawyers who — system? look, when you have lawyers who agreed _ system? look, when you have lawyers who agreed with - system? look, when you have lawyers who agreed with you | system? look, when you have i lawyers who agreed with you and let you down a path that puts you in a situation where you are indicted in georgia, and they were indicted with you, it just goes to show that you have

got to have good representation, and certainly i hope you had better lawyers now that he had back then because they are going to be sitting with him at the defendants table all throughout this trial. but in the end i don't think anybody in america believes that if the shoe were on the other foot that a democrat will be treated the same way the president has. he has got a very good case to talk about being prosecuted by those who were in power at the beginning of his administration! the andy mccain of the world. as they created his campaign they created the ability for the mullen investigation to commence and what we saw as evidence after that was that it was all based upon hillary clinton's campaign opposition research which made people believe that president trump was unfairly prosecuted and he has been able to play up
1:48 am
that unfairness to his advantage and that is why you see him leading by a very large margin to become the republican nominee. ijust saw margin to become the republican nominee. i just saw a margin to become the republican nominee. ijust saw a poll today to that had him tied with president biden and there are those in metropolitan areas and blue states that cannot fathom that but i would argue that is also a reflection on the unpopularity ofjoe biden and the democrats and what they are doing to our country right now. congresswoman murphy, i would like to get your thoughts on what we just heard from the congressmen. i what we just heard from the congressmen.— congressmen. i would say regarding _ congressmen. i would say regarding the _ congressmen. ! would say regarding the former- regarding the former president's impeachment over the budget situation, you know, it followed the course that it was — it followed the course that it was supposed to. he was impeached by the house. we had a senate — impeached by the house. we had a senate trial and thereby not enough — a senate trial and thereby not enough to convicted he was not removed — enough to convicted he was not removed from office but nobody stormed — removed from office but nobody stormed the senate to change the outcome of that so i don't think— the outcome of that so i don't think there is really equivalency here. regarding the

provides itself - reelection. it definitely provides itself a - reelection. it definitely - provides itself a challenge. the challenge is so unpopular — president biden is supremely unpopular, president trump is supremely unpopular. it is a race to the bottom. people are going to turn off the tv by april. friends are going to be disinvited to picnics because they are going to be on different sides. we live in a very polarised country right now and it is not president trump that made it polarised, it is not president obama who made it polarised. maybe it was bill clinton but that was before most people's time. it is the media itself, social media, the network that we are on. we don't go on the street and talk about consensus. we go to these shows and talk about conflict and talk about our differences and get ready for whatever fights are ahead and as long as we have cable television that pushes these things and social media that allows these messages to be promoted in the partisan ranks, it will invest every part of
1:51 am
our society and it is now trying to invest ourjudicial system. it is only going to get worse for democrats. the escalation is only going to continue until somebody fights and offramp and my fear is there is no offramp. congressmen davis, do you agree? if so, how do we get through the next election season? ~ through the next election season?— through the next election season? ~ ., ., season? well, we have gotten throu~h season? well, we have gotten through the — season? well, we have gotten through the last _ season? well, we have gotten through the last few _ season? well, we have gotten through the last few that - season? well, we have gotten through the last few that have | through the last few that have been pretty crazy. and we're going to get through the next election season because we are americans. because, in the end, although we disagree vehemently, even more so now than we have ever before in my lifetime and probably stephan brian's lifetime, it is nothing new. i mean, think back to the late 60s when had hundreds of bombings because of political differences. we don't see that right now. we have seen some pretty terrible events, a few that steph and i have been a part of, but in the end, we are
1:52 am
going to watch the peaceful transition of power once again to whomever is chosen by the american people to be the next president. i personally cannot fathom that we may and meet most likely will have the exact same candidates we had in 2020 running in the general election. i certainly hope republicans and democrats take a step back and realise we are at an inflection point in our country when it comes to polarisation. we are at an inflection point in our country where people are losing faith in institutions and it is not just republicans. it is all americans. and when we look ahead we have to do better as not only leaders — we have got to do better as politicians. we have got to do better as members of the media in covering where america works, rather than just trying to find the entertainment value that brian mentioned. if it is entertainment value and social media depolarisation is going to get worse. we will see the
1:53 am
violence on january to get worse. we will see the violence onjanuary 6 that steph and i witness. we will also see the violence that i saw from a left—wing gunman firing at us in alexander virginia six years ago. that violence, no matter where it comes from, has to stop. mas comes from, has to stop. was certainly _ comes from, has to stop. was certainly hope _ comes from, has to stop. was certainly hope there _ comes from, has to stop. was certainly hope there is - comes from, has to stop. was certainly hope there is no violence butjust to underline the fact that he is the former president and it is something we have to cover when he is facing his fourth indictment. and i want to say we can now show you the mug shot of the former president. this is from the reuters news agency. we heard this would be part of the booking. this is the first time in us history a former us president has had his mug shot taken and i don't know if our panellist can see this mugshot right now, but, brian, ifi right now, but, brian, if! can, i would love to get your take on what we are seeing. i can't see the mugshot but that will be the best thing and look at but i suspect it will be a
1:54 am
$20 million mugshot for the trump campaign and i would say this to and i will do my own research on this — george w bush got arrested for a dui and i am pretty sure he took a mugshot. it was probably destroyed many decades later. that is something i will also have to look into, brian, so thatis have to look into, brian, so that is something we can both look into. congresswoman murphy, we are looking at this mugshot. foryour murphy, we are looking at this mugshot. for yourjanuary 6 committee it took months to go through all of this evidence. we are looking at this mugshot in a case where the former president's team says "we cannot have a speedy trial because there is so much evidence to go through." do you understand that argument? i think a judge will make a ruling and determine what is fair and what is fair as far as how much time is needed for the defence, but, again, if they do go to trial, the burden of proof is in the prosecutor's

court. they have to be the one to prove beyond a reasonable doubt that crimes were committed.— doubt that crimes were committed. * committed. indeed. and we will see if we can — committed. indeed. and we will see if we can bring _ committed. indeed. and we will see if we can bring that - see if we can bring that picture up again, but as we are waiting for that picture to come up again, congressmen davis, want to bring you in on this as well. you were just talking about some of the divisions in the country. most of your former constituents would say they see this as a 2—tiered justice system. how hard will it be then for the current president prospecting to cut through that with a message? it to cut through that with a message?— to cut through that with a messaue? , , ., message? it will be very hard but the current _ message? it will be very hard but the current president's i but the current president's team to cut through. all you have to do is look at the polling numbers. the more donald trump gets indicted the closer he gets to beating joe biden. that has to be concerning to democrats and they have got to do what they can to make some changes to be able to win but in the end i think donald trump is the only republican candidate best even the craziness we saw on the
1:56 am
republican debate that turned into what i would call a professional wrestling match — all of them onstage i believe can bejoe biden in a head—to—head race. i don't think donald trump can and it won't be because of the trials but you mentioned the mugshot, and i know donald trump well enough to know that when they took that mugshot they had to take multiple. i bet he asked to see which one he wanted them to see which one he wanted them to put out and i bet you the one that he chose is the one that you were going to show and i know you said to me that you are going to show everybody*s mugshot who came into the fulton county jail *s office and got it taken, but i guarantee you the amount of time the bbc and every other media outlet is going to spend it showing president trump's nephew outweigh all of the others combined to the 10th power. others combined to the 10th ower. * ., ., ~ ., power. brian, do you think that is what happened _ power. brian, do you think that is what happened in _ power. brian, do you think that is what happened in the - power. brian, do you think that is what happened in the fulton | is what happened in the fulton county jail?— county jail? yeah, i mean, listen - — county jail? yeah, i mean, listen - l— county jail? yeah, i mean, listen - i know _ county jail? yeah, i mean, listen - i know president . listen — i know president trump _ listen — i know president trump i_ listen — i know president trump. i had a relationship with— trump. i had a relationship with him _ trump. i had a relationship with him. i worked with him.

guy, the prosecutor in new york. they are upside down with independents. they don't look much betterfor this. so, yeah, the photo will amplify the fatigue that people are feeling. democrats don't feel that. they are seeking revenge but the photo is just going to be another weapon that the president is able to weaponised into rallying support and goading figures for that kind of narrative for himself. congresswoman murphy, is that something that concerns you looking ahead to the election? what concerns me is that the democratic party might have a blind spot much as they did in 2016 because of the way that they felt about candidate trump. they did not imagine that anybody would vote for him and i think they were taken by surprise. you know, we cannot look at national polling all we want right now but what really matters is polling in the swing states and that is the polling i would be most interested in

see if that does happen as anticipated. live from washington, this is bbc news. fulton conty officials have released the mugshot of former president donald trump after his booking in georgia. and the us defense department says it is likely prigozhin was killed in russian plane crash. thank you forjoining us. former us president donald trump is on his way home to bedminster, newjersey, from georgia right now, where he turned himself in at the fulton countyjail. trump faces 13 charges in connection with alleged attempts to overturn the 2020 election results in georgia. he arrived at the jail in a long motorcade of police and emergency vehicles, and after 25 minutes inside a fulton countyjail mr trump was released on $200,000 bail. a plea is expected at a later date.
