well, in frank, donald trump's lawyers are arguing that donald trump's defence team had been attempting to have this case thrown out. that isn't what has happened, but instead, the sentencing may now not happen until after donald trump's presidency — questions as to whether it will actually happen at all. both sides have to submit their argument by early december, but even before that, donald trump was calling if this is in fact a nation - of laws and a jury of his peers found him guilty, there needs to be some accountability- or that entire experiment, . i think, comes into question. thejudge in donald trump's criminal hush money case has ordered that sentencing be

had expected or at least had been scheduled will not happen and there is no new date for that sentencing. instead, what thejudge that sentencing. instead, what the judge has ordered that sentencing. instead, what thejudge has ordered is for donald trump's defence team to submit their full donald trump's defence team to submit theirfull arguments. submit their full arguments. they want submit theirfull arguments. they want the case submit their full arguments. they want the case thrown out altogether by early december and for the prosecution to file their response to that. but of course, the clock is ticking all the while and donald trump will be inaugurated onjanuary 20. will be inaugurated on january 20. , . , , will be inaugurated on january 20. , . ,, ., 20. there will be attempts to net this 20. there will be attempts to get this turn _ 20. there will be attempts to get this turn out _ 20. there will be attempts to get this turn out completely i get this turn out completely before the inauguration? the defence team _ before the inauguration? the defence team are _ before the inauguration? tie: defence team are definitely trying to get this case dismissed. looking ahead to the presidential term, though, what the prosecution have signalled — they may be open to — is to delay sentencing for quite an extra ordinary length of time, until the end of his

presidential term. until the end of his presidentialterm. bear until the end of his presidential term. bear in mind he wouldn't lead office —— leave office for four years starting on january the 20th next year, so 2029, but that is what the prosecution has signalled — some openness. what is defence team have done is try to get the case thrown out on a ruling that gave the partial immunity. there is still quite a lot of uncertainty hanging over this case, but there are questions about when the sentencing really can happen and if actually it will happen at all. jessica, thank you very much. meanwhile, donald trump has nominated former prosecutor pam bondi as his new pick for attorney general, after his previous nominee, matt gaetz, who was the subject of an ethics investigation, withdrew his name from consideration. ms bondi, who previously served as florida attorney general,

defended donald trump during his first impeachment trail and was part of his legal team when he falsely claimed the 2020 presidential election had been stolen. there's been a positive reaction from many republicans to ms bondi's nomination but question marks remain over some of the president elect*s picks for his top team. let's talk about this some more withjoe moreno. he's a former federal prosecutor. joe, great to have you with us on the programme. ijust want to if i may get your take on the latest on this hush money case. ,, , . , case. sure. the trump team is advertising _ case. sure. the trump team is advertising this _ case. sure. the trump team is advertising this as _ case. sure. the trump team is advertising this as a _ case. sure. the trump team is advertising this as a complete | advertising this as a complete victory. i wouldn't go that far. a complete victory would be a dismissal and they did not get that. this is the second best thing, but basically saying the case is put on paul's for at least four years —— on pause. the government cannot argue now that donald trump is a convicted felon because you're not a felon until you're sentenced. it's goodin
8:06 pm
until you're sentenced. it's good in that respect, it's bad in the fact it's hanging over his head for the next four years. so, it'll be interesting to see perhaps the da office lose its interest in it or if on the immunity point, as her correspondent mentioned, the trump team can get it thrown out the next four years, but being elected president is not itself a basis for dismissing a state case. sure enough, the trump team did not get that. interesting. back on to pam bondl interesting. back on to pam bondi, assuming that she is confirmed, what we see from her as attorney general that we would or would not have seen from match gaetz if he had been confirmed? both trump loyalist -- matt confirmed? both trump loyalist —— matt gaetz a. we confirmed? both trump loyalist -- matt gaetz a.— -- matt gaetz a. we saw it was absolute shock _ -- matt gaetz a. we saw it was absolute shock when _ -- matt gaetz a. we saw it was absolute shock when matt - absolute shock when matt gaetz*s name was announced. he has a swirly number of ethics issues around him and he's barely practice as an attorney — basically two years. pam

bondi is very different. i think there were some surprise that her name wasn't previously floated, but when you think about it, she was a twice elected attorney general of the state of florida — third largest state in the country — she's tough on drugs, illegal immigration, and she's a trump loyalist. i think that's a mistake trump is determined not to repeat this time. i think he felt the first one in his left turn, jeff sessions, really failed him. ithink turn, jeff sessions, really failed him. i think he thought bill bar also failed him. i think what he's saying is whether it's justice or fbi or another senior white house appointment. he is going to appointment. he is going to appoint people who know him and that he knows and they're going to put him first. but the attorney general is supposed to be at attorney general is supposed to be a- , ,., be at independent finger, so are ou be at independent finger, so are you saying _ be at independent finger, so are you saying we _ be at independent finger, so are you saying we won't - be at independent finger, so are you saying we won't see |

are you saying we won't see that? ., , , , that? people feel differently about that — that? people feel differently about that point _ that? people feel differently about that point because - that? people feel differently | about that point because yes, the attorney general by all ethics standards should be independent, but the fact is that he or she does work for the president and the president is the head of the executive branch. all powers exercised by the attorney general and any other executive official derive from the power of the president. you could have a president. you could have a president who keeps the attorney general at arms length or a president who wants the attorney general to follow his lead, to not go far astray and keep them on a short lesion. i think the latter is what we should expect to see. this is a oint should expect to see. this is a point that _ should expect to see. this is a point that was _ should expect to see. this is a point that was made _ should expect to see. this is a point that was made by - should expect to see. this is a point that was made by a - point that was made by a number of people i've interviewed in the last couple weeks. it was always a plan to put forward matt gaetz first of all, thinking that he likely wouldn't get through the confirmation process or would withdraw, and in the idea being here's a new pic and everyone else thinks, no issues.-
8:09 pm
else thinks, no issues. that's sort of a _ else thinks, no issues. that's sort of a four— else thinks, no issues. that's sort of a four dimensional- sort of a four dimensional chest area. it's possible. i think the shock that came when matt gaetz*s name was announced was powerful and i didn't think there is a chance he would be confirmed. it could be a head fake where his name was so controversial that he dropped out so quickly. i think pam bondi is a fairly safe choice. you but if i had to guess now, i would say she probably get few if any democrat votes. 53 republicans will be enough. and republicans will be enough. and incomin: republicans will be enough. and incoming president losing one pic is not critical or shocking. i guess problems happen potentially if more of those pics are called into question don't make it to the confirmation process. there's been a lot of chatter around the pickford defence secretary. do you think we will see some of the other candidates that
8:10 pm
donald trump wants not getting through that process?— through that process? donald trum is through that process? donald trump is determined - through that process? donald trump is determined not - through that process? donald trump is determined not to i through that process? donald| trump is determined not to go for a traditional washington pic. he's going very outside the box and getting very creative. it will be interesting to see how the folks due under confirmation scrutiny. it's great to say they'll come in here and shake things up and not be traditional, but the fact is you need tremendous managerial skills to oversee these departments that are huge, especially defence. he might be a great american and it's wonderful he served in combat, but he's never managed anything quite as large. he'll get a lot of scrutiny they are not just from the fact that he's not a traditional washington insider, but can he actually handle the job. putting aside the fact he is fought for the country, he is fought for the country, he is not managing thing like this. i
8:11 pm
is not managing thing like this. , ., a, this. i 'ust wonder with matt gaetz this. i just wonder with matt gaetz having _ this. i just wonder with matt gaetz having withdrawn, - this. i just wonder with matt | gaetz having withdrawn, does that give the senate a sort of sense of actually, if we put pressure, we can effect change? i wonder how many of those republicans in the senate will think if we're not happy with someone else, let's try and push them out. we someone else, let's try and push them out.— someone else, let's try and push them out. we have seen over the years _ push them out. we have seen over the years the _ push them out. we have seen over the years the two - push them out. we have seen j over the years the two houses of congress really start deferring to presidents of their own party. this was very different 100 years ago. it doesn't do that so much any more. it'll be interesting to see if the republicans in the senate defer donald trump and largely give him what he wants, whether it's confirmations, laws being proposed or executive orders, or they push back. that will be interesting. this will be the first time to see how those initial hearings go. if matt gaetz is any indication that the white house realised it may have some
