for six straight weeks. rick santelli and bob, am i right in thinking there are little signes this could be better than expected this season? >> yes. you're right. on both counts. it is early but there is very interesting announcements in the last 24 hours. let me show you four of them moving all of their respective sectors. alcoa, very bullish on china. danaher, big multicountry business. earnings above expectations. seagate, that's a surprise. yes, signet, big holiday jewelry company, saying they were higher than expected. take a look at multiindustry sector here. big companies, operate across many different countries. look, bullish comments from

that capacity. he is a long time government servant. former aid to tip o'neill. he has experience at all of the issues coming up before congress. he has experience as hillary clinton's chief of staff. he will leave a void that in replacing rom emmanuel. who is very valuable and controversy. but jack lew is opposite of that. he thinks he las the set of skills he needs among candidates to replace jack lew as chous chief of staff. one source tells me set leading candidate. we will see if that announcement is made tomorrow as is jack lew for treasury. >> if jack lew is secretary treasury, it'll look something like this, whatever that is.

president's view, is it a safe 35ir of hands. looking for an insizer, not someone that will rock the boat. there's not been any new brand plan put forward. a steady as she goes strategy. a lot of people would have liked to see a more radical choice. any number of other candidates. but i think what we are see sgt president is not unveiling anything big and surprising at treasury. >> the man has no banking experience. this is the most important banker in the world. >> that's absolutely right. and i think that you can see though the push back from the final community against folks who, like insler, the more banking experience. one thing i will say is i think his international experience is particularly important. we are entering an era where they are less correlated. i think that it'll be really important for someone that understands the multipolar economic world as well as

multipolar political world. >> what do the market think of jack lew? >> i think markets would want them to go through quickly, plannedy. i think market would not want uncertainty. we have enough uncertainty. if on top of that we have a lengthy discussion about qualifications or otherwise, and if there are delays. that's going to be very negative for the market and for over all volatility. i would rather see that happen quickly. >> he will be named as early as tomorrow. i want to get back to markets in general though. obviously this is old adage, if we have a good first week, there a good month. if it is a good month, it is a good year. would you be buying into that. with budget dealings we have to get through this year. >> as brian said, i wouldn't go with the historic comparison. there are lots of reasons why the current year does different. one is we never had this fiscal discord that we are going

this is an incredibly crucial time. yet we are playing games in d.c., how do you see this shaking out? >> it is like wall street and washington are in parallel universes. i was just down in d.c. >> separated by delaware. >> exactly and you don't want go there. >> i was down in d.c. talking to new congress mman and every is pessimistic about the next round of debt talks. i don't think it'll go smooth by, i don't think the fiscal talks went smoothly, but i don't think it'll be very good this time around. >> if you look at jack lew's past, there is of an implied assumption that jack lew is not going to talk it pch whether you agree or not, the money has to come from somewhere. which may mean more tax raises but the republicans said no way.

the third in three days. our very own phil lebeau has been following this since the beginning and you have the latest for us now. phil? >> we heard from boeing executives an hour and a half ago hearing where things stand for the 787. defending it is a reliable aircraft. as we look at a picture of the ntsb increst gating the batteries, the trace the cause of the fire on monday, boeing today on a conference call defended the use of lithium ion b batteries. boeing says it has 1 million miles flown with those batteries pch they believe it is safe in the future. chief engineer is asked whether he was worried about whether or not the problems with the dream liner will hurt the plane or boeings reputation mp here is what he had to say. >> what impact he the customer serious to me, anything that create downtown on the airplane when the airplane should be flying, serious to me.

anything that creates media attention is serious to me as well. so i'm concerned about the things that everybody is concerned about. there's not a single one standing out as a particular concern from safety or economic perspective. >> by the way, we have talked about the dream liner the last three days. there are major suppliers from nine different countries building parts and opponent for this plane. we aren't talking about the suppliers at countries around the world. boeing has other 699 dream liners wp one thing to keep in mind, there have been several positive comments. not just on wall street, brian and mandy but also from some airlines flying the dream liner. qatar air saying, we stand by

something that doesn't happen in other models. >> if you think that it hasn't resulted in the loss of life. mary, if there was a more serious problem. something that could have loss of life, what would happen them. >> so far luck is with boeing and we hope it continues. if there is a lot of life what could happen and judging from what happened a long time ago wheb it was fairly new, faa could yank its air worthinesser is can cave cat and they recertify the plane or and certainly not without a major accident. the ntsb is helping with the investigation. that is the long run, though boeing probably doesn't like it, in the long run it'll spell an additional measure of safety for the plane. additional inspectors are always a good thing. by and large there aren't many federal inspectors on an aircraft. in the long run, it'll be safer.

the a-380 in air boss from recent memory, it is hard to know how normal, how normal is it for a new mass produced jet to have these level of problems? >>ity's typical but unfortunately, a lot of them have come in the space of a very new days. on the triple 7, there are problems but unfolded over months. here with the fire it is a dramatic event. this plane does have more fire suppression systems than on older kinds of planes so that's a positive development. but it was just very shocking given so many in a short period of time. >> mary, we have to leave it there. mary, there. a story nearly a year in the making. herb going to take us inside

transactions. in particular given all of the interest around hash el life, he wac's walks through the investment thesis. let me walk through with you some of that letter. it is important. in particular to herb's description and bill ackman's accusation after pyramid scheme, he said quote and i think we have a full screen on this. the pyramid screen is a if you accusation study. we do not believe it has merit. the short thesis rests on the motion that ftc was asleep at the switch and will shortly awaken at the behedged short seller to shut down the company. we find this to be preposterous. while the shot of sellers presentation wag lengthy and he is describing bill ackman but not naming him in this particular case, presenting no efd that herbalife was, that cross the liep to compel

regulators to shut to down. very no new news when the president interviews even the short seller conceded the fcc was not looking at herbalife practices. part of the letter describes his expectation that company could be worth what he said somewhere between 55 and $68 a share. he said that a function of if management were to deploy the buy back authorization in the 40 to $45 range. they estimate a run rate of 2013 of 5.50 to 5.70 then what they say is a modest 10 to 12 times earning multiple. we give them somewhere between 40 to 70%. up side if you believe it. at the very end and not at the end of the letter but maybe this is the most crucial piece, you know, we talked a lot about the ftc and whether they would shut this thing down. he writes the ftc by all accounts receives a very low

volume number of complaint annually about herbalife. fewer than 40 percent year. we find it hard to believe that hundreds of thousands of people scammed are too ashamed to speak up. that's the dan loeb version of what is happening. >> first of all, on the volume of complaints, i sat down with the head of consumer protection, just departed from the ftc a number of months ago, he mentioned that also regarding consumer complaint. but i will tell you, in my ten-month investigation talking to so many former distributors. what i can tell is you the overriding theme is embarrassment. they did it to themselves. they won't complain. it's been drilled into them. you didn't work hard enough, en if you follow the plan. i want to respond to the ftc not responding to a short seller.

latory intervention that changed how the company did business we are comforted by the fact that 80% of renew comes from overseas. so the implication there, if he is saying, maybe the ftc does go after these people or whatever. maybe it doesn't get touched. >> if they take action you could assume because there are issues in other countries that that could take a domino effect. so i think you have to look at that. one thing when he talks about they can change the model, the way i look at this and i've said it a number of times and you look at other companies in direct selling and how they do business, that if there is a change of the model, you could end up and i keep saying this, with a reset in that business model. >> all right. >> i have a request kwek for you, andrew, this goes back it

said once it would be stupid to introduce a phone. there are good phones, like the iphone, why would they go through the trouble and expense of building their own phone. >> facebook is still young in growth and advertising so taking on the task of building a phone, a new platform, doesn't make a whole lot of sense to us. they would need a lot of support from apps to other companies like google to make that work. i don't think it makes sense for facebook at this point. >> could facebook build a building? remember they hired frank gary? could this actually be a like a structure? >> well, i don't know if i should specifically talk about that. i don't have any perspective o on whether they are showing off a new building. but certainly facebook has a lot of room for expansion and in terms of hiring lots of engineers and so, it wouldn't be completely surprising for them

term, a lot of lawyers that were -- a lot of inexperienced lawyers. how has the enforcement apparatus changed here? >> well, i think some of the comments don't pay sufficient credit to the sec staff whose been here for years and working great cases but we have taken a new approach, creating not only specialized units that focus on particular markets as experts to come in and sit with us and consult with us at deposition tablees a and ask questions of people under investigation and just bring their expertise to bear. we have done more in data analysis and proactive investigation figuring out before a fraud blows up and investor money is gone. what are earnly morning signs. stop it or defer it in the first place. >> there are a lot of casis in the financial crisis but also a lot of cases about insider

trading. there is a lot of perception out there that it hasn't been adequately prosecuted. i know there was a goldman sachs case. but how do you address it, who was inforcement for years and also general council on wall street? >> our record in the financial crisis case says very strong, over 150 individuals and entities charged. 65 of which are ceos, cfos or either senior officers. i think there a perception, understandable, that lot of pain and also that came from the financial crisis resulted from fraud and wrongdoing. but it is the case that, that's not always the explanation for it. that a lot of the excesses of the financial crisis involve issues other than fraud and wrongdoing. which is why dodd-frank is so important but we are out there looking in every nook and cranny to have it done. >> director of enforcement,

on this date in 2007 steve jobs announced the first ever iphone. six months later the iphone was released to epic fanfare and five generations of iphone later the stock is up more than 500%, and all interpersonal communication has ended. >> why did they talk like that? >> hello and welcome to the news. they didn't talk like that in real life back then. >> who doesn't talk like that, mandy? what are you talking about? don't make me -- >> okay. staying with tech now. let's come back from the future and into the present. heard a lot of talk about the death of the pc. even debated is here on "street signs" a number of times, i believe, but new models are being shown at this year's consumer electronics show. jon fortt is over there right now. jon, what's selling? what's hot and what's not? >> well, mandy, the pc industry showing it's still alive and kicking with the new designs that pop off. they flip around.

and they slide. this toshiba, in the toshiba booth kind of cool. here from intel is one way to think about it. >> if the tablet and notebook had a baby this is kind of what you would expect to see. >> pc sales down 8% in q3, all these companies are trying to figure out new designs with touch kind of tablet like to invigorate pc sales. let's talk about price. the sweet spot for laptops these days is around $500, $600, but the challenge is to get the touch laptops with windows 8 down into this price band. we saw a $600 touch laptop in the holiday season black friday, but we don't know how long that price is going to [ laughter ] some of the ones that i touch behind me are starting at around $800 and above. intel has been trying to get the prices down, but listen to what walmart had to say about what the pc industry needs to do to really hit the price point. >> i think there's two things that the computer industry

really has to lean into, first getting the price right. the price value equation has to be right and, of course, the more prolific, the more products that are out there, the better the efficiencies and the lower the cost will be, but the second is they have got to continue to challenge themselves to solve real customer problems. you know, the day of presenting a laptop where you're focused on r.a.m. and r.oil. m. and speed is behind us. >> key for the pc business, get the touch prices down so consumers might start buying pcs anyone creasing numbers yet again. guys, back to you. >> do you think some of these are too expensive? do you? >> they are. they are right now because we know where consumers are buying. it's that $500, $600 price point. right now for touch you're paying more. intel said on the last earnings call they are working on the supply chain to get that price down by the second half of 2013. that's going to be key if the pc industry is really going to come back >> jon, thank you. let bring in the editor-in-chief

of laptop and laptopmag.com. mark, is the death of the pc greatly exaggerated? >> well, if you see all the journalists around the show covering ces they are not using tablets to file their stories. they are all using laptops, granted not all window pcs, a lot of macs here which microsoft might not appreciate but i think it's been exaggerated. >> what do we want out of a new laptop these days and is the ces showing off the kind of things that people are going to buy? >> what intel and its partners are trying to do is tell the best of both worlds approach so you have a tablet and a pc in one device. that's why they are calling them convertibles. that's not getting across to the consumer. the value proposition is you're getting two values in one and that's why there's a little bit of a premium but consumeers have been conditioned to pay $500, $600 for a laptop so they will have to try to drive those prices down and also communicate that you're getting more for your money. >> what's the hot trend, mark?

>> well, for us, it's really about detach ands. we actually change for the best of ces awards. last year we called it laptops and this year we're calling it convertibles. with all the devices behind me they are finding new ways to transform from tablet mode to laptop mode and back again, and for us the detachables make the most sense because you don't always have to have the keyboard with you. you can sort of lay back and put it right back in the dock when you're ready to work. >> we started this with talking about the death of the pc. clearly it's not dead. what is dying out there in the tech and gadget world? >> well, i mean, i think the traditional notebook is dying because people are looking for more functionally, and i was meeting with one vendor who say 40% of their loonup will be touch-enabled and back-to-school time will be really critical for the people supporting the windows platform because there's android devices out there using this hybrid device where you can snap it into a keyboard dock so microsoft is facing competition, not just from the ipad, but from
