most expensive painting ever sold. the prices are going to keep going up. >> crazy. thanks very much, guys. i'm glad we could squeeze that in. my thanks to the panel. that does it for us on "closing bell." "fast money" with scott wapner in for melissa lee starts right now. "fast money" starts right now live from the nasdaq market site. i'm scott wapner. the traders tonight are dan nathan, brian kelly and karen finerman and guy adami. we have the man behind the calls coming up. and plus, tesla ceo elon musk taking to twitter saying he's got a major announcement on the horizon. it's not a car. the details just ahead. but first, we start with what else, the broad-based rally we saw on the street after last week's heavy selling. all throw of the major indices seeing gains and the dow is jumping up. so tonight we asked the question, how real is this rally
5:01 pm
and dan nathan, can you trust it? >> of course you can trust it, we're going up here. listen, when you think of it, everything participated today. but there were a few things that didn't participate. i think it's worth noting when you think of it, apple is up 3%. huge gaper here -- gainer here and there were tech stocks that didn't trade well. alibaba, facebook all day on the down. that's more than $1 trillion in market cap that did not participate in the rally. so when you asked the question can you trust it, yeah, sure. it seems like a little bit of a quarter end window dressing especially for a quarter that has been kind of volatile and is basically set to close flattish. >> so karen, dan kind of went there with the window dressing thing. do you think that's what this was? was there china news which had to play a role. >> i think that put some floor under the market. but we are 24 hours away from the end of the quarter. i think window dressing after last week that was very messy. so i wouldn't be surprised to
5:02 pm
see more follow through tomorrow. i didn't see any fundamental reason beyond china for this rally today. >> amazing how volatile the markets have gotten right before today you hadn't back-to-back s&p gains in 28 sessions. >> pretty wild. >> that's crazy when you think of i. >> i think this is going to continue. i think the chinese news was big, i think the merger and acquisition news out there. >> four different biotech ones today. >> they had a lot to do with it. i think the russell, the iwm stays above 121. to dan, i think it's intact, as long as the russell stays above 121. even more so if the transports can recapture 168. and 158 now. >> except for the fact, brian, you have earnings right in front of us here. they won't be great. >> well, they won't be great. everybody knows that. i would mention today, you said
5:03 pm
earnings they were hurt by the strong dollar. today we had a strong dollar, yet the u.s. stock market rallied. there were incongruities out. there when you lock at other markets besides the u.s. stock market you had oil down most of the day which has been a negative signal in the past. >> and it was of the leaderships. >> i don't know if you can trust it today. we have to wait until wednesday an i do think the friday payroll's number, not being on a -- when the markets opened is going to create a tremendous amount of volatility. >> i wonder if people in the day and subsequent days are getting ahead of a nontrading day on friday. one of the rare days you'll get the jobs report when the markets are closed. >> we have over the last five quarters so the question is can you trust this rally right here? look at the chart. in first month of the last five quarters, you have had draw downs from the highs of about 4% in that first month. which is really interesting. really showing you now obviously there's been strong gains that
5:04 pm
chart is telling you over the last five quarter period. you had upward momentum and then a sell-off in the first quarter. so we will see over the next couple of weeks and i suspect when you think about earnings season and you think about that q2 guidance won't be great because of the strong dollar. >> you bought some puts today. >> i did. it wasn't a huge bearish call -- >> is it a hedge or the overall feeling of you're worried because of earnings? >> well, volatility is low. we have friday we won't be able to trade, i'm worried about earnings. it was a cheap way to play this and if we get a down day -- >> why don't you buy the vix if you're worried about protection. >> it's 1451. >> unbelievable. >> for me, every time i have traded the vix i just don't like the vix. i don't know what it is. one of those things. i use the volatility on the spy.
5:05 pm
if you start to see an inwind there you can see people running there as a hedge. >> big move into the close as the yemen oil fears begin to ease up, but the drillers have been some of the hardest hit names in the oil space this year. one name in particular is lagging its peers. we're looking at the specific stocks or sector moves that could be on the verge of major move lower. we have that trade. carter? >> that's right. if you think of tech, there's two types you could have a relative problem and you're underperforming or have an absolute problem and they have both. it's down 27%. much worse than the energy sector, down 12. of course, the trend line is very clear. i mean, literally it draws
5:06 pm
itself. it keeps failing at the line, over and over. the stock has not been up really any month this year. energy hasn't made a low since january. has stabilized. and so the down trend very much intact and then the longer term patterns. draw the lines this way. it's all quite symmetrical. head and shoulders top and neckline. either way it's heading back to the '03 lows. closed today at 26 and change. we think down towards 20. >> all right. so what do you think? >> i happen to agree with carter. this is trading north of 40 times earnings. doesn't auger well if you're short but i think they're right. every rally in the stock has been a selling opportunity. i don't think anything going to change because i'm one of the people that think there's another leg down in crude oil. >> i wonder if any of these moves higher are selling
5:07 pm
opportunities because you have seen some of the stocks that are positive on the year. >> well, that's the way this recovery seems to happen is that the -- the equities recover before the underlying commodity. i don't know if this team will be the same. but in the past, many times, not just oil. other commodities as well, the equities lead the way up. >> one thing that can help is m & a. before we had the oil, we had the halliburton hayes deal. it's a 13.5 breakout fee that's nice little embedded put so that's one where you see the charts -- that's the triangle of death. i know carter calls it something different. when you see that dying i think baker hughes is the thing to buy on the pull back. >> well, it's testament to something is wrong. stay away.
5:08 pm
>> all right, carter wirth for us. we have a news alert in the music streaming space. julia worsten has the latest. >> that's right. alicia keys is on stage announcing the relaunch of title which was a music service that was purchased by jay z, sean carter. what's amazing right now, she is standing on stage with the co-owners which include along with alicia keys and jay z are kate fire, beyonce, calvin harris, chris martin, kanye west, dead mouse, nicki minaj, rihanna, usher. there are a huge number of the biggest music stars in the world up there to launch this streaming music subscription service. taking on beats which is owned by apple. this is a key team because it shows that the musicians are sick of the kind of payments that they have been getting from services like spotify and and pandora. they're trying to take ownership, literally, by opening the new systems that are
5:09 pm
offering streaming music. they were talking about how title is a platform that's owned by artists, designed to evolve over time. they want full you have line capabilities so you can listen to your music even on the subway. so they're talking more about what makes this platform so revolutionary. i think the key thing here is on the heels of taylor swift pulling her music off of spotify and pushing back, we are seeing the rise of artists tries to take control of how they sell their music to fans and offer more than just music to sell more different things and give more access to fans as the music industry continues to evolve. >> so first thing, julia, look at shares of the pandora. see what they're doing. secondly, does this mean that all of those artists are no longer going to offer their tracks on pandora or spotify or anything else? >> well, i think this is more
5:10 pm
competition specifically with spotify than pandora. pandora is free, spotify is a paid service, this is a paid service. i think it's more in competition with beats. as well as competition with spotify. pandora is governed by a different set of rules because it's internet radio. pandora has to pay the standard internet radio fees. spotify is different in that it does have to make deals with the record labels. so we saw taylor swift pull her music off of spotify. i suspect that the artists will continue to offer their music on oh services. it would be silly to give up the revenue, but i think they'll offer more different types of content. exclusive access to recording sessions and do that on this new platform. more music videos to build that one-on-one relationship. perhaps they can sell more merchandise to their fans. anything to own that one-on-one
5:11 pm
relationship with fans. >> interesting. julia, thanks. julia boorstin with the latest out in l.a. >> pandora, if you look for a trade i think it comes in the form of pandora. there were rumors they were going to hire goldman sacks to pursue a deal. to me, where there's smoke that's fire. and bill miller -- >> friday out in detroit. >> stock has gone nowhere. with that said, it's not -- it is expensive, but again, where where there's smoke, there's fire. i think the risk/reward with pandora sets up something interesting here. >> especially if you have a sell-off tomorrow. if you have a sell-off because of this -- >> then no impact as julia said. >> there's why there's an opportunity if there's a sell-off. >> spotify has about 10 million paid subscribers so disagree on pandora. i think they get taken under at some point, because i think the internet radio thing i don't think it works.
5:12 pm
you're seeing the land grab with the artists. think about who's on the beats side. dr. dre, they will line up a ton of artists themselves and all the people on the stage with jay z they won't pull their tracks from itunes. there's 800 million ios devices out there on the planet. well, tesla ceo elon musk has another tweet, announcing a new product is coming april 30 and it's not a car. gopro gets an upgrade. it's had a tough ride so far. and later a big day for biotech. we sit down with the recent ipo player in the space, tackling the fight against genetic diseases. we're back on "fast" in two. ay . ay . i was determined to create new york city's first self-serve frozen yogurt franchise. and now you have 42 locations. the more i put into my business the more i get out of it. like 5x your rewards when you make select business purchases

so we were just talk about companies that have to sales and $2 billion market caps and you're $1.8 billion, no sales yet. let's get to valuations in a bit, but i want to start by what you do. your ticker is once, so you're in gene therapy. what is that? >> well, genes ultimately play this role as a blueprint in underlying how cells function. so the concept is actually that you take a normal copy of a gene or a healthy copy of gene and you bring it to those patients' cells and by doing so, you're able to potentially correct the underlying basis of the disease. so the idea is that if you can deliver that to the patient, there's a potential for the patient to then correct what they need to do on potentially on a long-lasting basis if not on a curative basis that's the promise behind gene therapy. if you think of what we're doing in a first area that we're working in is is this area of inherited blindness. where there's more than 200 different genes that account
5:37 pm
play a role in normal retinal health. so we're working on the first of those. we showed in earlier studies that we can restore functional vision in patients that have this type of inherited blindness. we are now in the middle of a fully enrolled phase three clinical trial in the second half of this year. i think people are excited about the potential of having seen the earlier data and now seeing the readout in the second half of the year and we can talk about where we'll take that from. there but that's leading to the potential first filing of an approval request with the fda in the united states next year and then moving to launch following that. >> if you talk about potentially curing blindness -- >> there's the potential for that. what we saw and what the earlier studies suggested if you take patients with this genetic form of this disease that end up in the end state of blindness, what we're able to show is that we can restore their functional
5:38 pm
vision. for example, this was one 8-year-old that was in our trail that when they entered the trial was dependent upon braille to function in the classroom an following the one injection was able to play little league baseball. so if we can show that in the phase three trial in the different set-up, we think that that's a strong case there to be made to seek approval following that in 2016. >> so phase three results coming in the second half of the year. i want to ask you about your valuation because you guys just went public earlier this year. you already tripled in value. $1.8 billion market cap, you're not in the market yet. does this make sense? >> so we have gotten a tremendous reception from investors. i think what they have seen is that what they -- what they have communicated to us because we have a late stage clinical trial it's based on tangible human data that you see and actually literally see with a video. you can see this kid go from
5:39 pm
where he was functionally before to afterwards and that's very powerful. one, we are seeing that investors are eacting to that and it has a potential to be successful. i think furthering that, we actually are -- our plans next year if the data is positive is to file for approval in 2016. i think it's not to be underestimated to what that means. so from our perspective, we would theoretically would be bringing the first approval with the fda. whether it's manufacturing, we have the ability to set the stage for how the rest of the field going to operate. then so that's first. secondly, i think the other thing investors have reacted well to is to leverage all that work on the first application in the next one and the next one. they see that as a potential derisking of what we might do
5:40 pm
subsequently th subsequently. they're excited about what we're doing and we started on a second eye disease in this quarter. which turns out 3 1/2 times the number of patients, so people see that ability to extrapolate. >> can i ask you quickly the story about with, the one injection is amazing and brings hope to a lot of people. i'm wondering what one injectson like that would cost and weigh in the debate that seems to be percolating out there about the cost of drugs and treatments in this country. >> for us it's too early to talk specifically about price. i think our perspective on this is that if you can really bring something that's transformative to patients and i think what i just shared with you you would characterize as such. >> sure. >> if you can bring something that's transformative, that affects a debill thaitive disease like blindness and do wit a one-time treatment, i would welcome that discussion on the back side of the phase three
5:41 pm
