of north dakota. they are clearing the front of the capitol now. the metro dc police say they were sprayed with chemicals and that's how they entered the capitol. let's listen to this >> on the steps at this part of the u.s. capitol the people who were up there have come down now i don't know if we can walk a little bit -- we don't want to get too close, but i don't know if you can see some of what has been left. people have put up signs you can see some of the signs on cars about pelosi and people have been standing on top of that car
5:01 pm
it seems like capitol police have started to get control of this area. they are not leaving entirely, but have backed them down from in front of the door where they have been for so many hours now. ellison barber speaking with savannah guthrie this will end and order will be restored >> president trump said we don't want violence and they said we are not doing violence and then people said they needed to fight and be patriots and come back.
5:02 pm
some people dispersed. some saying we should go home. others saying absolutely not we did see people getting peppered sprayed in the last hour or so and they have started to leave we have been told by protesters that they are making their way to the supreme court which is just across the street >> reporting live in front of the capitol where police and law enforcement are clearing the area of protesters who overtook the capitol and occupied the chambers of the house and senate it's 5:00 on the east coast and 2:00 p.m. on the west coast. i'm shepard smith and this is the siege on capitol hill. >> this man said next time we
5:03 pm
are coming back -- he is part of a militia group in florida. i have been asking people did it have to go this far. someone was injured. is this what you wanted to see happen so many folks have said over and over again this is what needs to happen because they feel as if the election has been stolen they are using words that the president has used over and over like communism and socialism it is an unbelievable sight to see. a couple hours ago when katie was on air, she was asked what will other countries be thinking i have covered situations like that in the middle east.
5:04 pm
they say this is things we deal with i am not sure what that sound is you have heard repeatedly. it might be a pepper ball spray. we don't know what it is we have been seeing over to your left, spotlight from where that noise was coming p again, it seems at this point -- people are yelling at the camera that's what they do, to be expected so apologies in advance if anyone says anything of profane nature at this point is people are dissipating. there is a 6:00 p.m. curfew. it has been quite a day.
5:05 pm
just to see the sight knowing what it looks like normally. and then again there is sthat smoke from the inauguration balcony. we are seeing flash grenades going off i believe on the inauguration balcony that is where the president-elect will be standing taking the oval office but today, two weeks before we are seeing flash grenades going off over and over again as capitol police are trying to disperse crowds there. it is an unbelievable sight. it seems like people are starting to retreat from that area again, there we go.
5:06 pm
>> miguel, just make sure we are focusing on where the sound is coming from, the flash grenades. py believe it is coming from this area of the inauguration balcony. i don't know how many. maybe three or four flashbangs we heard >> reporting live on scene it is the sort of thing that you watch in the united states from a world away it's the sort of thing you watch
5:07 pm
happen in fledgling democracies or third world countries where one side is fighting with the other for control or a military coup this is the steps of the capitol. that is the stage on which joe biden is to be inaugurated you heard her. it is other worldly. there is another flashbang these are live pictures. we are listening to her off air and she is saying that's tear gas. let's listen >> we are in the air direction of the tear gas. let's move away. >> it would apapear, if that is law enforcement tear gas, we know a decision has been made to clear the area
5:08 pm
# and the retreat from the united states capitol after it was overtaken and occupied for much of the day. news crews move away, trump flags move away. more flashbangs on the stage where president-elect biden is to be gnawiinaugrated there is a bigger picture concern. >> it is reports there are protests in wisconsin, colorado, minnesota and las vegas. the counting has stopped in georgia out of an abundance of caution.
5:09 pm
this looks like degradation like democracy is teetering they must restore order and they vow to do so and continue with the business of the government but that does not solve the division in our nation that are stark and appear to be growing and the belief in lies that at least at the moment can't be right. do we know yet whether the senate has continued because it seems they are bound and bent to move forward and continue the peaceful transfer of power >> it does seem like that. but we don't know what the plan
5:10 pm
is for where and how to resume the sent has bron brougeen brou undisclosed secure location. we don't know if they intend to clear the senate floor and whether or not the american people will be able to see that happen as a resumption of the constitutional process capitol police officers are in the neon jackets pushing the crowd back the front line police officers will be dealing with crowd control. you see it in the shots as they try to clear the states. that is the inaugural platform with rioters and flashbangs. capitol police higher up will be dealing with a couple other
5:11 pm
questions. what is the intent of the core group of people at the heart of this riot. did they intend violence or a symbolic gesture we know there were gunshots inside the capitol building. we don't know how many weapons are inside the building and what they intend to do with the weapons. the other big question will be organization the protest we were seeing breaking out in state cap tolit around the country some of that happened early, about the time this event started. is there an organization behind this are there leaders here who have been designing this operation with people in other states to do this at the same time how you stop an operation like
5:12 pm
this is finding those people and taking them off the field so to speak. one of the things we saw d.c. police do earlier this week was arresting the leader of the proud boys, the right wing lead leader he was arrested and said he was not allowed here this week because of the arrest. that was trying to freeze one of the leadership of this group that didn't work law enforcement will be trying to figure out what is the intent of the people still inside the capitol building and who is organizing this and how can they reach these people and put a stop to it >> thanks. linda sanchez is with us congresswoman, thank you
5:13 pm
seeing this stark division, occupation of capitol, moving in of federal troops to clear so the senate can continue their work, how do we chart another one. the one we are on is destructive? >> i wish i had the answer, but i don't think we can address the problems our country is facing until we have everybody working off the same set of facts and reality. there is a segment of our society that fact, reason, logic to the contrary. they will believe what they want to believe it turns ugly and makes me weep for our democracy and makes me scared for the future of our country. >> it is astounding to see we waited for many hours for the
5:14 pm
president to come. i am talking to a democrat all aside, the president coming out and spews falsehoods, he bears responsibility >> i do, too and egging people on to commit violent acts they are responsible as well we will be dealing with this, but we will get the work done. it is the peaceful transfer of power. we are intent on seeing the job through. we have always prouded ourselves on that. it is shocking to see what has evolved here at the capitol, but we will continue that work until the process is complete. >> i am told that you refused to
5:15 pm
evacuate is that true >> i will not evacuate and be in crowded conditions with members who refuse to wear masks i will not do it >> members are refusing to wear masks? >> they took us to a safe location, a room quite crowded with members and there are members that they refused to wear masks i have chosen an alternate location that is less safe but for my own purposes i believe it is safer for me. >> you are bringing up another -- in the middle of one crisis, you forget about another. we have a vaccine rollout that is not working the way it had been promised. we are at a national high, historic high, number of deaths
5:16 pm
and hospitalizations, we have chaos in our government. it feels like the nation is teetering, congresswoman it is because we have a lack of leadership in the executive branch we have a leader who has given up and gone golfing instead of facing the urgent issues of our country. we will get through this, but he has tested the limits of our democracy and institutions we have a lot to repair, but i believe we can rebound, but i believe with the right leadership we can get past this. and someday we will look back at this ineffective self absorbed man and scratch our heads and wonder why anybody ever voted for him. now we have to continue our work
5:17 pm
at hand as best we can but it is very disappointing and disparagi disspiriting when in the middle of one crisis, colleagues won't do something so simple as wear a mask >> linda sanchez is in an undisclosed location i am getting a live report let's listen in. >> you can see that the rioters on the platform are starting to
5:18 pm
leave. there are still hundreds of them up there, but they are making their way off the platform as we told you earlier, getting them off there will take a little time because there are not enough stairways for everybody to get down at one time so they are trying to get them down as safely as possible, trying to get those people off that stage and platform. we haven't seen any more flashbangs in the past few minutes. [ inaudible ] . >> i can't to get with another senator. we have spoken many times over the years. yours has been a rocky ride
5:19 pm
through this party i wonder if you look at where we are today, where your heart is and what your observations are >> it's good to talk to you again and i wish you well. i, like every american, horrified seeing what was happening at the capitol and saddened now we have to move ahead. shepard, there are always a few in congress who think their actions don't really mean anything they know that other members of congress will step forward and do the hard things they will do the things that, if you will, are not truthful to the hard working americans i would hope, because of what has happened today, members of congress in the house and senate realize that what they are doing is aiding and abetting the
5:20 pm
president who showed his true character today and has over the last period of time and they in fact own what is happening if they continue on they know this is not real they know that -- i hate to say it this way, but they are humoring people which is a tragedy. these hard working people, they rely on folks who are in authority to say and do things they help create the situation that has occurred today. hopefully they are having conversations in the capitol that this is real, their responsibility to be truthful to the american people. their responsibility to stand up and be counted and not rely on other members of congress who are willing to do the hard things i saw this numerous times when i was there, but if they don't
5:21 pm
reverse course, it's sad for our country. again, from where i stand, they own what has happened today and will continue to own that as part of their legacy >> specific kwally, senator corr does ted cruz own this, lindsey graham >> those who support -- >> those are two of them we danced around things for a long time and today we watched a mob overtake the people's hall they overtook the chamber where you once served. as they did we waited for the president to come to a live microphone and beg for calm. instead he sent out a twitter video filled with lies about the
5:22 pm
election should president trump step aside? >> we are 14 days out from that occurring. >> what can happen over the next 14 days? >> a lot can happen. i think once this episode ends in the next 24 hours in the house and senate, then hopefully all of this will be behind us. any senator -- i don't know who are all of the people are. i wasn't aware senator graham signed onto it those leading it, senator cruz and others back in 2013 it shut down our government and damaged our country and republicans. people understand inside the senate this is a ruse, there to
5:23 pm
maintain status with a base who they don't want to upset but the fact is as an elected official, it's their responsibility to be truthful to the american people. i hope they will come out of this, stand down, move ahead republicans can be thankful for some of the policy accomplishments over the last four years, but hopefully we will never want to return to this type of leadership ever again in america >> what's your message for the president, senator corker. if you reached out, what would you say? >> enough is enough. he knows he has lost this is all about something. enough is enough it is time for him to go back to florida. again, i think about some of the accomplishments he has had, which have been considerable
5:24 pm
and some of those accomplishments have made our country better for lots of people i think the economic growth has been good for our country. certainly any republican would have put those kind of policies in place i think what has happened in the middle east has been very, very positive with normalizing relations between the arab countries and israel much more of that is going to happen it's a game changer and we should celebrate that. but these other things that have undermined our country, our democracy, the character of our nation is being undermined we have created such a divisiveness that it will be hard to overcome i hope republicans will never, ever return to that type of leadership >> senator bob corker, former senator from tennessee
5:25 pm
nice to speak with you again homeland security secretary under president bush, what do we do now >> first of all, the image of having rioters in the senate chamber in the house is to my mind comparable some of the imagery of 9/11. we need to first of all hold accountable those who broke into the capitol. though the extent they can be identified, they need to be arrested and prosecuted. there needs to be a look back why the capitol police seemed underprepared for the onslaught they might face. people should never have been in a position to get inside the
5:26 pm
building finally, as senator corker said, we need to acknowledge that this incessant rhetoric has stoked a certain percentage of people into extremist violence. not just what we saw today, but bomb threats, threats against public officials in states this has really been pouring gasoline on a fire we need to push back on this, not only on the rhetoric, but also those extremists groups that are capitolizing. >> when you look at the former homeland security secretary, when you see that a bomb was discovered at the rnc which has been detonated a mob that listened to the president spew angry falsity,
5:27 pm
and the mob react and nothing from the president other than move along do you see this and wonder if our democracy is in real, real trouble? >> i think our democracy is at risk, at stake there is good news -- >> is our democracy at risk? >> yeah, but there is good news, too. the courts have been uniform in opposing the law no matter which president appointed them state officials have been courageous in pushing back most of the members of congress have not signed on to this effort to try to undo the people's will, but unfortunately, a significant minority have. as ben franklin said, it's your republic if you can keep it. we have good institutions, but in the end we have to cherish
5:28 pm
them, enhance them and strengthen them. that means we have to push back sharply. >> mr. secretary, are we at a point where we wait out the next 14 days or have we gotten to the point where a group of former presidents maybe should step forward, including president bush 43 for whom you worked and in a joint way, much like the secretaries of defense did in their letter to editor say this has to stop. >> i think that would be appropriate. frankly, there are people hoping president trump will resign.
5:29 pm
i don't have o hope for that and there is the 26th amendment. somebody suggesting impeaching or removing him. i don't think there is enough time for that. the problem is hedging his power so he doesn't do anything reckless when nixon was getting crazed towards the end of his impeachment process, apparently his secretary of defense told the military if you get an order from the president, you come and check with me first. we may have to have that in place with agencies. >> have you been in touch at all with former president bush and if so, could you share any thoughts >> i have not been in touch with him about this issue
5:30 pm
over the years i have been in touch with him, but not recently with this. >> were you still the whhomeland security secretary at this moment, what would be your plan in maintaining order >> i think what you should use is what we did for a period of time after 9/11. capitol police, enhanced with screening personnel and enforce with nonlethal force people not obeying the rules. you want to have the maximum amount of security needed. in this case i think maybe they were not prepared with the necessary capability >> muriel bowser didn't ask for
5:31 pm
the capability -- >> it's not the mayor. the mayor has done an excellent job. she has mobilized the national guard and talked to neighboring jurisdictions to get support the problem is the capitol grounds are not subject to the mayor's authority. they are subject to the architect of the capitol, so the mayor had no ability to do anything on the ground because she has no authority there it is federal property she has been effective in dealing with this. >> secretary chertoff, there are
5:32 pm
questions where we go from now for americans sitting at home going what has happened, give me some hope, what would you say? >> what i hope is going to happen is that congress will either in the chamber or some other place finish the business of certifying the vote i think people who raised objections should with draw them, realize they have lit a fire that won't burn out if they don't step back. several people need to be arrested and prosecuted. and get to the business of preparing for transition of power. until we get this calmed down, people are right to be angry and alarmed. >> secretary chertoff, secretary of homeland security under
5:33 pm
president bush thank you. >> this is brand new in to me. five weapons have been seen on the capitol grounds. 13 people arrested on the capitol grounds today. we saw more than 13 people inside the halls of congress who we are told by d.c. police used chemical spray on them to gain e entrance you hope they face justice it would be a strange new world if you would occupy the capitol of the united states of america and not face some repercussion >> there is a statement from venezuela condemning the violence in the united states.
5:34 pm
the venezuela government saying they are concerned about the violence and condemn it. it is the kind of statement you have heard from the united states in the past about violence in other countries. one of the questions as night falls in washington, d.c. is how do you clear this in the dark it seems like a small thing, but a logistical challenge to find where everybody is, who they are and make sure you can clear the capitol building room by room and see what the decision is by law enforcement there seems to have been some
5:35 pm
paralysis by law enforcement of what to do they seem to be holding their position and not clearing although we did see the flashbangs and tear gas. they are now finding weapons inside the capitol that goes to the concern of figuring out who is in the building and what they are hoping to do tonight in terms of making a statement it has to be done cautiously but still done >> the live pictures shows there are hundreds of people in front of the capitol waving flags. let's listen in. >> this was a dangerous situation for hours with all of those people climbing the scaffolding. if any of that scaffolding had fallen, it would have been a
5:36 pm
mass casualty event. you see police surrounding the capitol complex. every direction you look you see red and blue lights flashing they are still trying to regain order. a riot declared inside the u.s. cop toll -- capitol something i never thought i would see in all of my years covering riots >> the people of washington are as stunned as all of the rest. breaking news from the associated press u.s. officials now say the capitol building is secure i have been staring at a.p. news
5:37 pm
wires on a news set for at least 25 years i have never seen anything like that except in the wake of the task of 9/11, to look down at the lines of the flash wires saying u.s. officials saying the u.s. capitol building is secure. all of this is other worldly the day began with a rally by the president at 11:00 this morning. thousands of people out. and then the senate began the process of moving forward, counting the electoral college votes procedurally to move forward and as they began at 1:00, the people from the rally came over. up the steps, pepper sprayed or
5:38 pm
some sort of chemical agent, breached the capitol and occupied the senate chambers members of the house and senate whisked away at one point told to take with them gas masks while we saw an occupation here it is occupiers of the senate chambers this is from this afternoon in the chamber of the united states it went on for hours scaling the sides of the place other worldly and here tofor unimaginable and finally it is declared it is
5:39 pm
clear. dateline washington, police used tear gas and percussion grenades to begin clearing protesters from capitol grounds so the building is cleared let's listen to the audio, the natural sound from there >> just a half hour until the curfew finally pushing people back. there are still about 1,000 or 2,000 people near the scaffolding. how those individuals are going to be pushed back i am not sure. but you see the police department going back and systematically forcing people back >> live report now i want to keep listening to
5:40 pm
5:41 pm
5:42 pm
grounds. associated press reported that police have used tear gas and percussion grenades to clear people from the capitol. the goal is to clear people out so curfew can begin at 6:00 which is 18 minutes from now let's try listening in again that's a reporter trying to call in for nbc identification we are using each other's
5:43 pm
reporters. the process of clearing to keep this from happening again. police and federal authorities are well aware there are anarchists there the senate vows to continue the counting to move forward with the process. some people have been injured. there is a report from police that one person was shot one woman has taken out of the capitol bleeding heavily and taken away, but there has been no loss of life. there appears to be a fairly orderly process. this has spread to some degree as there are protests that have popped up across the country
5:44 pm
there have been demonstrations and protests in wisconsin, colorado, new mexico, stop the steal rally in las vegas and where they are still counting the votes in georgia, a suspension of counting -- let's listen >> things have dialed back d.c. metro police have managed to push the protesters off the lawn so a couple hours ago there were thousands of folks trying to breach they got inside the capitol. they were trying to push the protesters off the capitol hill steps. then the capitol hill police and d.c. metro police began pushing
5:45 pm
the rioters off the steps gradually. this is something they do. we have seen it throughout the summer with all of the protests in the black lives matter movement i am going to step away. you see behind me lines of d.c. metro police and they gradually push the protesters and rioters back that's what they have been doing for the last hour or so as we creep closer and closer -- i don't know what time it is, but we are getting closer to 6:00 p.m. with this police line behind me, they have been pushing the protesters and rioters back for the last hour or so.
5:46 pm
more and more rioters disperse we have gone from thousands and thousands of people on the mall to a couple hundred. they are getting in the face of the d.c. police, confronting them, angry with them, but the police are maintaining calm. >> from msnbc reporting there in front of the capitol now about 14 minutes until the curfew begins. here on cnbc, a quick market update as the country was in chaos, the markets were soaring at a brand new high today, but i do need to report this first. nbc news chief justice correspondent williams said
5:47 pm
there was a shooting at the capitol and that in fact the shooting vick tomorrtim has died we don't know who shot the bullet we only know it is a woman being brought out of the capitol bloody, a female victim has died of, apparently, gunshot wounds there at the capitol so on this day that the capitol was overtaken and occupied for a number of hours, a woman has died i will say this, the white house staff, according to kristen welker is strongly urging the president to make a statement, take some action so far all we have is a short twitter video that included lies
5:48 pm
about the election but a call to step back. and now 13 minutes before the curfew begins we go back to global headquarters for an update back to you. >> extraordinary events we have been watching unfold the market moves today was that much more extraordinary. the s&p 500 finished off its high, but relatively strong going into the close >> held up relatively well did take some air out of that rally. the basis of that rally, catalyst overnight is the market figured out the complexion of the new government, which would be democratic controlled there would be economic friendly policies, more stimulus.
5:49 pm
over the last couple hours i think you did see traders giving up some. things backed off a bit because of volatility. >> volatility was the headline in the afternoon we saw the spike in the afternoon. it did creep higher towards the end. we didn't see the tenure giving up the 1% level since march. backed off a bit from the highs, but not much from the safety play you would think could have unfolded >> it was not a wholesale rethinking of the base always a question of whether the market has already carried far enough in this direction to account for some of the economic
5:50 pm
improvement we have all been waiting for. maybe this creates excuse for people to back off i wouldn't be surprised if that was the case the market is pretty much cuss cut /* -- cut to the chase the market, the feds didn't see too much in a lot of the unsettling footage today to unwind a lot of their expectations >> if there is something the markets have proven to be good at, it's good at looking forward. we saw all of this play out, a riot gripped the country in multiple cities over the summer with black lives matter and the market looked past that and we are in the same situation where the markets are digesting what blue wave means.
5:51 pm
5:52 pm
the extraordinary events this afternoon. >> there was urgency they want to hasten this transition and just move on. that's been very clear very interesting that ceos felt moved to comment within hours. >> the reaction of the market overall with the notion that a blue wave was going to happen. we knew that reverend warnock was going to win the ossoff contest was called in the afternoon. the original consensus thinking was that would mean higher taxes, higher regulations and bad for the market it took that in stride >> we saw hints of that in
5:53 pm
november the thinking of what do you have on your mind, the perhaps $2,000 per adult and infrastructure will be either the top priority or will outweigh any incremental tax increases. that's the calculus at the moment things change and priorities shift. it also makes sense to focus on the fact this has been a global move markets around the world are rallying, commodity prices go up around the world it is not just d.c., it is global >> china has recovered entirely from the pandemic. even here in the united states things, even though at this
5:54 pm
moment things look dark. shep, are you back >> yes it is extraordinary to see the nation crumbling and the markets soari soaring. >> main street crumbling and wall street hitting record high after record high. >> thank you both. continuing coverage on the extraordinary events in washington i want to go to tony, the deputy press secretary under the bush administration i wonder, when you look at this, given that you sit up in the middle of all of this and picture there is a president in the white house urging him to go out and make a strong statement, urge for things to be different and we see nothing how do you process that? >> it's tough to watch
5:55 pm
you can hear the emotional reactions that you expressed, everyone at cnbc has expressed and michael chertoff and others. i worked in that building looking at that film and understanding that is a symbol of freedom and democracy all over the world you want the president to come out and show leadership. the problem is he is culpable in this he has a role in inciting this going back to even before the election by helping to spread this lie that the election was stolen from these people i don't know that he's capable of filling that role you hope that someone like a mike pence could come out and do it we saw a forceful speech on the
5:56 pm
floor before the rioters got in. you really want to have that from a president, but i am not sure this president is capable of it and certainly not in this particular situation right now >> it comes to mind, tony, throughout history, when we need calming, when we need unity and rallying, we will hear from the president soon in my lifetime, the president has always met it at some level, usually for partisans of all stripes. today when the capitol was occupied, there was nothing. i wonder if there is a fear that that could be a tipping point
5:57 pm
because when january 20th happens, it is not as if millions of people are not going to believe the election is stolen, that's not changing. >> we did see the president-elect out today trying to fill some of that void. we probably need to hear from him more in this period. you are right. i remember all of those moments very well you just went through with those presidents. when it's a particularly challenging time for the country. we have never had a situation where the president himself has been a driver of that mistrust of our institutions. that's what we have today. that's not a partisan -- i am a republican -- it's not partisan. it's observation that he has
5:58 pm
made a large segment of the population believe they are victims of the electoral process. we all know it's not true. so to give that strength and comfort that we need to help citizens of this country understand what happened in this election and to deal with it in the graceful way that we have always dealt with these transfers of power, i don't think we can look to him for that it may be a situation whether it happens by the kind of accident jay timmons was more than hinting which is something involving to the point of -- or defacto, we turn our eyes to a joe biden. >> i don't know who there is to employ a nixon moment or whether such a thing would even be
5:59 pm
possible but as kristen welker reported in the last hour, the senior staff is urging the president to do something the briefing room is open. the president can walk into the briefing room at any moment. tony, you have been on the line and holding for a long time. i can't thank you enough for technical reasons i have to go so we can get set up for the next hour. >> the curfew here in the district of columbia is about to begin. mayor muriel bowser's office is dispatching a recording. over a loud speaker, there is a voice telling people who have been sheltered in place since
6:00 pm
the 1:00 hour, that if they are not gone by the 6:00 hour, they will be arrested the scene outside the capitol is still -- lighting fires, smashingreporters' camera gear as many hours of this situation unfolding within the capitol has now continued outside the capit capitol. as for the leadership here in washington, we got a recorded message from president trump today. joe biden who gave a live address earlier this afternoon calling on president trump to address the nation more force fly a fully and saying this is not a protest, this is
