"ac360" starts right now. -- captions by vitac -- www.vitac.com we begin with strong words from a politician in full support of gays and lesbians. i'm not talking about president obama. we're talking about mitt romney who said he quoted full equalitity for, quote, gays and less ons. what is not clear is what did that mean to mitt romney then and what does he believe now? we'll get into the specifics about what he wrote 18 years ago in a little while. but this report comes from jessica yellin. two senior administration official says that joe biden met

with president barack obama and apologized to the president for hitting him in a tough position. biden spoke out on "meet the press" about gay marriage saying that he is comfortable with same sex couples having the same rights as heterosexual couples. biden's spokesperson said that the president has been the leader on this issue since day one and the vice president never intended to distract from that. once president obama voiced his support it was all anyone was talking about. here's what romney said after the president's interview when romney was asked about his position. >> i have the same view on marriage i have expressed many time. marriage is between a man and a woman. >> keeping him honest back when romney was running for senate in

massachusetts, romney positioned himself as the gay rights candidate. he met with the log cabin club in massachusetts and in a letter dated october 6, 1994 wrote, quote, i am more convinced than ever before as we seek to establish full equality for america's gay and lesbian citizens i will provide more effective leadership than my opponent. romney writes in the letter if we are to achieve the goals we share we must make equality for gays and lesbians a main stream concern, a promise from mitt romney for full equality for gays and lesbians. one might ask how that can be the same as his stance now. what can it mean other than the right to marry? chris wallace brought up the log cabin letter and asked the

following question. take a look. >> you have still more of a champion of gay rights than ted kennedy was? >> i don't believe on discriminating against people as result of their sexual orientation. i wanted to fight against discrimination. at the same time, chris in 1994, and throughout my career i have said i oppose same-sex marriage. marriage is a relationship between a man and a woman. >> romney has opposed same-sex marriage but pledging support for the gay community and in an interview he said i think that the gay community needs more support from the republican party and i would foster anti-discrimination efforts. romney was asked about that in nbc's debate and what he has done to stand up for gay rights. >> from the beginning in 1994 i said to the gay community i do not favor same-sex marriage and

that has been my view. but if people are looking for someone who will discame nate against gays or try to suggest that people have different sexual orientations don't have full rights they won't find that in me. >> all his words back then. we'll leave it for you to decide. romney's position on whether gays should be allowed to adopt children is open to debate as well. >> if two people of the same gender want to live together and have a loving relationship and adopt a child in my state, individuals of the same sex are able to adopt children. in my view that is something people have the right to do but to call that marriage is in my view, a -- a departure from the real meaning of that word. >> back in 2005 romney opposed

of the idea. he was at an event in south carolina and said same-sex couples are marrying in massachusetts and having children born to them. we have been asked to change the their birth certificates to remove mother and father. full rights and full equality, a promise not to discriminate against the gay community how does that square with romney's position today? what did full equality mean back then? >> >> i don't know the full context of the debate in 1994 but in answering that question and talking about the issue he was talking about discrimination and he did not believe then that we should discriminate against people based on their sexual i

denity or orientation. on the issue of marriage it is how the government defines it and the contract between two people and his belief is that a marriage should be defined very simply as a union between one man and one woman. >> but in south carolina when he was talking to conservative groups in 2005 he made it sound as if he didn't like the idea of gay people having kids. >> well, i don't know what the -- i don't know what the exact specifics of that question or that debate were. i know there have been discussions in different states and jurisdictions about what the laws would be as they relate to adoption or gay adoption. that question may have been phrased as one down in south carolina. i know in mass the law differs there from other states. >> do you see an evaluation in governor romney's position from the time he was running in massachusetts to now? >> a devolution.

from committing in writing to the log cabin club for full equality and now saying i don't support discrimination. yes, he does. governor romney wants to kick people out of the military because they're gay. he wants to reinstate don't ask don't tell. it kicked people out because of their sexual orientation. he wants to change our most precious founding document to write discrimination into it. >> i thought he doesn't want to the up don't ask don't tell at this point? >> he wants to reinstated. maybe kevin can tell us his new position. i'll double check that. >> paul, under your definition then back in 1996, president obama was for discrimination. >> yes, he was.

>> and president clinton who signed the defense of marriage act was for discrimination. >> they were. they have evolved. when mitt romney was for equality only 20% of americans held that view. that was a bold thing that mr. romney was saying. the american people have been on the same journey that former president clinton has been on and that president obama has been on. the majority of americans have been on the same journey as president obama. but i think the position for governor romney will. he's going the wrong way toward more discrimination. >> there are a lot of americans who believe we should not discriminate against people because of their sexual orientation but the definition of marriage should be a union between one man and one woman. time and time again when that question is put to voters, 32 states, 32 times, people have

made that -- their voice heard. what they believe should be the definition. >> doesn't he open up to an argument about flip-flopping if he is running against ted kennedy he is talking about full equality and today he is talking about, you know, opposing same-sex marriage and even civil unions. >> look, anderson. i think there will be charges of flip-flopping all over this campaign. it's up to the voters to really decide. i don't believe that right now voters are going to be talking about what happened 19 years ago or 50 years ago they will be talking about the issues before us. we have a contrast on the two candidates and how they define what a marriage should be. governor romney believes it should be between a man and a woman. and voters going to the polls animated about this issue will have a clear choice. >> paul just for accuracy's

sake. i just looked this up, romney would indicated he would repeal the don't ask, don't tell. >> i will stand corrected, then. i thought i heard him say he would reinstate it. that is a form of discrimination. >> kevin, i appreciate you joining us. getting to the raw politics. those who say that president obama's stance could hurt his base with african-american voters. but that is not necessary the case. i spoke to him before our -- mr. bond about that and about what he believes mitt romney definition of equality is. >> back in 1949, mitt romney talking about seeking what he said was full equality for gays and lesbians. to you, what does full equality

mean? >> it means enjoying all of the rights that everybody else in the country enjoys. if everybody else enjoys rights one, two, three and four you enjoy those rights too. >> mitt romney did not favor same-sex marriage or civil unions. does that sound like full equality to you? >> not at all. it doesn't sound like it and it isn't like it. >> you have been very outspoken advocate for marriage equality. what was your personal reaction to the president's endorsement yesterday? >> i was thrilled and excited. i always felt that he felt this way. i was waiting and waiting for him to say so. i wish it had been sooner. >> were you surprised he said this before the election? >> well not because of the series of events that preceded

it. in statement from vice president biden, the secretary of education and the rising tide of people in the country who changed old ideas and said the time for change has come. it is inevitable he would say it sooner or later. >> there is question about support among african-americans for same-sex marriage. some have expressed strong disapproval of the president's position and some wonder if it will effect their support in november. what do you think? >> i don't think so. i think that african-american communities the tide is shifting. younger people are saying these are old-fashioned ideas. we don't feel that way. my mom, dad and grandfather may but i don't don't think so. but president obama is going with the tide. people are different now and he's willing to take a risk that this will effect his election but i don't think it will effect

it one wit except for the people who say my enthusiasm for him has grown. >> do you think people look at the african-american community and say there is not a lot of support there. do you think the tide is turning among the african-americans? >> i know the tide is changing. i can see from poll results where the support for same-sex marriage used to be minimal. it grew and grew and grew. and i think at least a majority if not more of african-americans say this is the right thing to do. >> you, though have been out in front in comparing the fight for equality to the fight for equality for african-americans, to the civil rights movement. you say that really this is the new front of the civil rights movement. why? >> i think it is. any time a group of people are

denied rights that is a civil rights movement. what is peculiar to me is that when women were struggling for their rights as they had for many years no one said they were trying to ape the black people's movement. this question is only raised when gays and lesbians are at issue it is a front for homophobia and hostile feelings which exist among all people, black, white, gay people everywhere in this country and we ought to help them achieve equal status with the rest of us. this is a country that likes to be proud of its stance on civil rights. this is another step forward. >> do you think what the president did yesterday makes a big difference? do you think it changes something? >> first is it an endorsement. when the president says he is for something it means we now know how he feels. and we says that it sends a

yet another strange twist in the investigation of that charity that claims to raise money for disabled veterans. we have been reporting on the disabled veterans national foundation. its tax filings show it has raised $56 million in donations for veterans in the past three years. but not one dime of that money has gone to help disabled veterans that we could tell. i have given an announcement to the president of the foundation to make yourself available to me or anyone who is doing the reporting to explain what you have done with the money. drew grich sent an e-mail to see

if she would come on the program. and last night he got a strange response. the e-mail said she disagreed with the reporting and the only thing she had to say and she wrote this out were the lyrics of the hit song "careless whisper" we got all the lyrics in the e-mail. we got a statement from a spokesman for the group who claims that someone hacked into her e-mail and facebook account. the statement says that the bizarre communications were sent from the account when it was outside her control. by the way that is the wrong spelling of her first name in their own statement. their error, not ours. we want to know everyone about our services and financial support we provide our veterans.

and this "careless whisper" thing might be funny if the allegation gagss were not so serious but they are. and nowhere in that statement is answers about the failure of monetary help to the veterans groups. recently drew caught up with the president of the charity and tried to get answers. look at what happened. >> you are the one from cnn? >> that's right. >> meet the president of the disabled veterans national foundation. we found a small vfw office. >> i didn't think you would do something like this. we agreed to talk to the you. >> only in writing. >> none of the money has gone to any veterans. >> so if the $56 million they raised isn't going to veterans group what does the dvnf provide veterans groups? >> 2600 bags of cough drops and

2200 bottles of sanitizer and 11,520 bags of coconut m and ms. >> that is the executive director of a veterans center in birmingham, alabama. i spoke to him tonight along with drew griffin. >> the allegations that the e-mail account was hacked. what do we know about is this? >> the only information we have is from dvnf that they sent to us this afternoon. we know it would be a federal crime. we asked if there was a police report filed about this. i was notified that the fbi may be calling to look into this. i also did reiterate our, suggestion, that they come on the air and answer questions and tell us where the money went but we have not heard back on that. >> you told drew that what this

charity is doing is stealing. those are your words. stealing when it gets right down to it. why do you think it's stealing? >> mr. cooper, we help veterans every day in the trenches. working with the homeless veterans on the streets. we struggle every month to pay our bills. we are on a non-profit organization and we are all volunteers. what and they are claiming they did would fund my organization for 300 years. they are taking money from patriotic americans to help veterans and what they are doing with it we don't know. it is not getting to the streets to help the veterans. we have guys on the streets i can't find housing for. i'm running out of food and money to pay the bills. and organizations like this are just stealing. there is no other way you can put it. there are groups like me all over the country. i'm one small guy in alabama trying to do my part. there are hundreds of me out

there. there are three hots and a cot. three hot meals and somewhere warm to sleep. there are limited resources out there. and this company has and $56 million and done what we don't know. >> in their promotional material they say that in alabama where your center is what they sent to the centers in alabama we send items that these centers say they need desperately to provide the daily outreach. have you ever requested thousands of bags of coconut m and ms or hundreds of pairs of navy dress shoes from this organization because that is what they sent you. >> no, sir. they called me the three truckloads they sent me. they said we have donations coming in from the dvnf.

send us a thank you letter and we'll send them to you. we bring them to a central warehouse and we get what we can use out of it which is little and the rest we give to other organizations in the community that might be able to use them. the 11,000 bags of m and ms. i cnn the last four bags i had. we got tired of them around here. nothing against mars, but that is not what our homeless veterans need. they need work boots and work gloves and clean shirts and we need money to help get these guys bus passes so we can find them jobs. m m and ms is not the answer. >> have you asked for a specific item for help?

>> i asked for $38,000 in november of last year to replace storm windows in our centers and they send me a declined letter in february of this year. that's the only thing i have asked for and they said no. >> where do things go from here? we are trying to figure out what they spent the $56 million on or where it is. >> we do know where it went. it went to the chief fundraising company, this private company named qadriga arts. but we are having trouble finding why they are charging the charity more than a dollar to raise a dollar. that is where we are. and quadriga raise funds for 500 charities. we want to find out is this the same pattern for all the

backpage.com is not backing down. they are ignoring calls to shut down the adult services section despite evidence that it is a tool for people who want to sell kids for sex.

prosecutors resting their case against john edwards. they wrapped with testimony detailing how hundreds of thousands of dollars from donors went to private jet flights and luxury hotel rooms. prosecutors claim it was to hide an affair with rielle hunter. joe johns joins us live now. a lot of testimony about edwards jockeying and laying down roads for future positions. >> leo henry, he said that when

it became clear in january of 2008 that obama was going to win the iowa caucuses immediately almost john edwards sent him to a top adviser for obama, tom daschle and ask for the vice presidential slot and a few days later asked for the attorney general's slot. j john palmieri says he was delusional and wasn't even being vetted. but john edwards was confident even though he had this stuff in his background. >> there was a lot of talk about whether rielle hunter would be called to testify but in the end she wasn't. why? >> she wasn't called at least if you listened to the testimony she has been called a loose connen. she has been called someone who is unpredictable. edwards called her a couple of

times, "crazy" it's clear that the government wasn't willing to take a chance with rielle hunter but the defense might call her if they put on a case. >> so she could end up on the stand. when the court recessed yesterday edwards was overheard mouthing something to his lawyer. what did he say? >> that's their case? sort of a question. and i saw around the same time you describe there, his attorney with a half smile on his face. it sounds cocky and these guys are trial lawyers. they are cocky but talk to the other lawyers in the courtroom and a lot of people are waiting for the other shoe to drop in this case involving edwards. the problem they say is a lot of the key witnesses the people you most want to hear from just haven't been on the stand. why? elizabeth edwards, she's dead. fred baron, he's dead.

another keeping them honest report about backpage.com. last week we reported on the push to shut down the adult services section where underage girls are sold for sex. that was on friday. on monday, robert turner from new york introduced a house resolution calling for the owner of backpage.com to shut down the ads immediately.

pressure on the website has been building for months. the attorneys general, religious leaders, ngos and a petition with 230,000 signatures are calling for the media company to shut down its adult services section. but back with page.com is not backing down one inch. to understand the outrage look at what we found on the page. >> when we get a case involving the trafficking of prostitution, usually the story is going to start on backpage.com. >> the daughter i know is a kid that likes to color. >> reporter: for dawn that's where the story hook her 15-year-old girl, a child who ran away with a man who seduced her online. he sold the girl into prostitution. allegations detailed in a criminal complaint. >> he officially took her and

beat her into submission to raping her and then held her into prostitution. it totally, totally crushed me. to know that somebody actually did this to her. >> reporter: the accused pimp in that case has pleaded not guilty pending trial. it's one of more than 50 cases in 22 states of people charged with advertising underaged girls for sex on backpage.com. >> the new york city council held hearings on a resolution to stop those ads. one of the people that testified described how she ended up with a pimp after running away from home. she told her story from blind a screen to protect her privacy. >> he felt he made the most money from back page. at this time i'm 12 years old and back page sent me at least 35 dates a night. >> she says 35 dates a night at the age of 12.

liz macdougal the lawyer for backpage.com says that shutting down back page will make it harder to catch child predators and sex traffickers. the ads brought them $27 million last year after craigslist shut down its adult services section in 2010 the ads migrates to back page and that has been a windfall for the parent company. you say this is not a site for prostitution. but any reading of these ads can you say for with a straight face it is not a prostitution site. >> any illegal activity is unwelcome. child trafficking and illegal prostitution. >> it is full of ads for illegal activity. >> we actually have more than 85% of our content has nothing to do with the adult category. >> but that is where you make

your money. >> we are on a multitude of categories. we are a business and do make money. but keep in mind we have 80% of our staff dedicated to policing and cooperating with law enforcement to prevent cases of exploitation from ever making it live on the internet so we can facilitate rescues and ensure convictions when there are those opportunities. >> there are ads clearly for prostitution. i mean i looked at these ads for a brief amount of times. you can find ones saying slim filipino dominican hotty about good times and freaky pleasures. come to my garden and enjoy the rose bush. do you think she is a gardener? >> i don't think she is a guard guardener. there is not a black and white line between legal sex work and

illegal sex work. there is legal sex work of a variety of kinds and particularly in this economy people are engaging in legal sex works as a means to pay their bills and survive. >> so you believe -- >> and we are doing our best to find the lines between what is illegal activity and what is not. to do that better we need more collaboration with law enforcement and with ngos and with projects like cnn's freedom program to focus on preventing exploitation. >> but to be the sheriff's of the internet, the actually sheriffs the states attorneys general want to shut you down. >> the states attorneys general are not the sheriff. if you talk to the vice officers on the ground. i provided a list of those officers they say just the opposite. they say that back page is the most cooperative and one of the

most valuable -- >> i have talked -- >> for arresting the -- >> you do respond to law enforcement and they appreciate that as does the center for missing and exploited children. i have talked to law enforcement who say they wish you would shut down. there are police who believe you are providing a street corner for the prostitutes to work on. >> the law enforcement we talk to -- we have hundreds of thousands of e-mails of accolades for our assistance. but the assistance is not just providing the stings we are pursuing rescues. since january of this year i can give you four examples of rescues. in january we rescued a child in seattle, washington. our moderator before the ad got online identified this as a potentially exploited minor. we reported to nick mick. >> there are other ads -- there was an ad that -- a woman rights

about make me beg, spit on me, degrade me. >> as i explained to debra if that language got through it should not have. that is a mistake. that is -- >> but you are saying in order to stop prostitution which is an illegal activity you need to give pimps websites. does that make sense? >> what you say doesn't make sense. we are not giving pimps websites. >> there are plenty of places to advertise. but you are giving them the biggest -- >> my red book is the biggest one. if you would like to call them. but the fact is -- >> you are a big slice of this pie. >> there are according to shared hope international 5,000 sites and we could drive them to other ones off shore that we can't get when they are off shore.

>> just because there are other bad actors doesn't mean that what you are doing is right. >> it's right because we enable rescues and convictions the other sites won't and don't. >> you say you don't allow underage people. you just have to check off the person says i'm over 18. >> we do far more. we have filters for terms and two tiers -- >> they can lie in the ad. >> they can lie in the ad. we have people examining the images to identify if someone is under age. >> the u.s. governor of mayors has asked for physical verification. there are websites that someone who wants to place an ad they have to go to an office and show an i.d. >> i was so glad to get that letter from the mayors this week because finally, some elected officials are taking an intelligent approach to this problem. >> would you consent to do that?

>> we have explored that for months. >> what does that mean? you have been in business for a very long period of time. there are been plenty of people who wanted this before. this is not the first time you considered this idea. why not just say we're going to do this. i know it costs money but if that is the right thing to do. >> money is not the issue. the issue is how do you functionally implement this? there are ways to verify the age of the poster but there the no -- >> unless the person comes in. >> which -- >> and you have to show an i.d. >> if you have an knowledge of how the internet works is a practical impossibility in the internet realm. what we are exploring is ways to make it a possibility. >> you have -- >> when we do we will set that standard not just for us but for the entire online service provider community. >> do you know when you will -- >> it's not a matter of decision. it's a matter of exploring and

programming and collaboration with other online service providers, other technology providers, with law enforcement. there are experts who have looked at how to better identify whether an image is somebody who is underage or not. >> but whether you are talking about internet verification you could just say anybody photographed in an ad has to come to your office in whatever city it is. you have these set up by cities and states and just show an i.d. why would that not -- >> that's where you have a complete misunderstanding of the functioning of the internet. >> i'm not talking about the internet i'm talking about -- >> exactly. >> this is -- you say this isn't about money but it seems like this is only about money. >> no. there -- in no way is this only about money. this is about the functionality. setting up an office in every place that we have that we have a site you would be asking craigslist to do the same thing. >> craigslist stopped the

service and you benefitted from that. >> we achieved some of the -- obtained some of the ad advertising from that but to claim that craigslist is out of this business is grossly ignorant and one of the fallacies that has been perpetuated with saying taking down the adult category will cure human trafficking online? >> i'm not saying this will eliminate human trafficking. it seems to me the only reason you are in this business is to make money. is it helping the parent company which is having losses in other areas of the business. this is a hugely profitable area of business. you are coming up with reasons to explain why you are doing this but the bottom line is you are in the business to make money and this is a way to make money. >> that is your articulation of the bottom line. i joined back page a couple of months ago with a decade of fighting cybercrime and in anti-trafficking.

breaking news right now. a.m. a.m., the suspect in the tennessee murder kidnapping case is dead. the two girls he is accused of kidnapping have been found reportedly alive. joining us is martin savg save judge and sunny hostin. >> we have been told by a high level federal official close to the investigation that adam mayes is dead. he was killed. the two girls have been found and are alive and right now are been transported to a hospital to be checked out. the additional information we have is that this all took place in union county, mississippi. that means that adam mayes never ventured too far from where this originally took place. supposedly there was a s.w.a.t. team that was moving in on a wooded patch as they were closing in, they heard a single gunshot. when they got to the middle of the wood area they found adam

mayes dead and they found the two girls. it is naturally welcome news for this family that has suffered the loss of a mother and a daughter but the two youngest daughters are alive. >> and martin, the two who were found dead explain where they were found. wasn't it -- it was in the yard by the home of -- it was adam mayes' mother's house correct? >> on the 27th of april you had the kidnapping orchestrated by adam mayes. the mother that is -- i can't think of her name. >> jo ann -- thank you. jo ann bain was kill along with their daughter adrianne in whiteville tennessee and their bodies along with the younger girls an 8-year-old and 12-year-old were transported

down into mississippi and of course it was in the yard of his mother, adam mayes' mother where the grave was dug and where the bodies were found and then of course the whereabouts of adam mayes and the two girls became the focus of a nationwide search but it was felt by authorities that he never went too far away from his home down there in downtown mississippi and that is exactly what happened. he didn't go that far. a s.w.a.t. team moves in on him and he apparently took his own life. >> stand by on the phone is bobby booth. his sister is charged for her alleged role in helping adam mayes. first of all, bobby your thoughts on hearing that your former brother-in-law has been shot and is dead. >> all i'm worried about is that the children are safe. the rest is not a concern.

thank you, god for letting the kids come home. >> your sister teresa had called you several days ago expressing her concern that adam mayes had killed -- had killed bobby -- >> jo ann and adrienne. >> explain what your sister said to you. >> she told me -- she told a family friend who had he had killed. and she just told me about the grave. >> your sister has been charged with first degree murder. what are your thoughts on that? >> i'm going to be honest. i'm overwhelmed right now. i don't know how to answer that. i'm just glad the kids are safe. >> i can understand that. sunny hostin, i mean legally this is done.

he's dead. >> it's done for him as you mentioned. his wife has been charged with first degree murder. we know or believe that the two girls are okay. i don't know that we know all about the circumstances surrounding the death of jo ann and her daughter adrienne. there is a lot of work to be done in this case to determine everyone's role. >> and -- the mother is in custody in all this. >> i wonder sometimes if this was, perhaps, a law enforcement way of pressuring adam mayes or smoking him out. sometimes that does happen. but again, by certain reports, teresa mayes was involved or could have been involved in the murders of jo ann -- >> she allegedly told her sister she had driven a vehicle with some of the people involved in this in that vehicle, again it's not clear exactly what her involvement was. >> that's righ
