as president obama surveys the banquet room with everyone in white tie and finery you have to wonder what he's thinking. so little time. so much to redistribute. >> tonight is not about the disagreements governor romney and i may have. it's what we have in common beginning with our unusual names. actually mitt is his middle name. i wish i could use my middle name. >> the campaign can require a lot of wardrobe changes. blue jeans in the morning perhaps, suits for a lunch fundrais fundraiser. it is nice to relax and wear what ann and i wear around the house. >> after my foreign trip in 2008 i was attacked as a celebrity because i was so popular with our allies overseas.

i have to say i'm impressed with how well governor romney has avoided that problem. >> president obama and i are each very lucky to have one person always in our corners, someone to lean on and a comforting presence without whom we wouldn't be able to go another day. i have my beautiful wife, ann. he has bill clinton. >> tomorrow it's back to campaigning. the cities and towns across our great country. i hear the same thing everywhere i go. honestly we were hoping to see michelle. >> usually when i get invited to gatherings like this it is just to be the designated driver. >> just think two days ago obama and romney were stopping each other during a consench s tenti debate.

president obama sat down with jon stewart. >> we weren't confused about the fact that four americans had been killed. i wasn't confused about the fact that we needed to ramp up diplomatic security around the world. >> you would admit it is not the optimal response at least to the american people as far as us being on the same page. >> here is what i will say. if four americans get killed it's not optimal. >> and those words not optimal are making the rounds on conservative websites this morning and will be for mitt romney. dan lothian joins us to talk about that. >> reporter: you are right. we have seen the romney campaign really go after this white house on the issue of libya, concerns that this administration has not been transparent and concerns that this president has not been strong enough in addressing the issues of terrorism. and concerned about the way that

the administration has been slow to really roll out the real story on libya. as of yet the romney campaign officially has not released anything on this but senator john mccain who is a surrogate for the campaign was on fox news and said, quote, it is just so inappropriate and i'm sure that the families of those brave americans are not amused. i did reach out to a couple of officials on the white house. one official told me they would be getting back to me shortly. so far nothing from the white house in response to the president's comments on the jon stewart show. when you are in the campaign season even on a show like this where it is about having fun that the president's words can be dissected and get him into trouble. >> dan lothian reporting live from the white house this morning. as both campaigns fight for women and their votes they might want to take note of a new poll.

according to gallu up 39% of the registered voters say the top issue is abortion. it's abortion that ann romney talked about with the ladies on abc's "the view." >> one of the things with your husband was that when he was a governor he was prochoice. and now is against abortions except in the case of rape and incest. were you the same way when he was a governor? have you changed? >> you know, the good news is i'm not running for office and i don't have to say what i feel. i am pro life. i'm happy to say that. >> during the interview ann romney explains her husband's views on abortion changed when he was given a stem cell bill to sign while he was governor of massachusetts. foreign policy will be the topic

of the discussion. in order news this morning jerry sandusky's lawyers are asking for a new trial, filed an appeal arguing there wasn't enough evidence to convict sandusky. he was sentenced to no less than 30 years in prison. now for the first time the victim whose accusations launched the investigation is speaking out. his name is aaron fisher. he is known as victim number one. he told "people" magazine -- fisher wrote a book about the the abuse. it comes out next week. the boy scouts are apologizing to some members and their families after the release of confidential files on accused child sex abusers and showed the group banned more than 1,000

volunteers after they were accused of inappropriate conduct involving boys. >> reporter: one shows one was placed in the file in the early 1970s. he took treatment and he was allegedly cured. the suspected molester got cleared to lead scouts again. in 1982 he was accused of molesting two boys on a camping trip. he responded he was guilty and everything was exactly as the boys had indicated. the boys parents agreed not to proceed with prosecution and the scouts never reported the alleged pedophile to police. >> these go back to 40 and 50 years old where we did not do the job we should have. and for that we are profoundly sorry. i'm convinced that this organization has a firm and ever lasting deep commitment to youth protection. >> reporter: scouts are now taught to recognize, resist and

report abuse and that two adults be present at all activities preventing one-on-one situations with leaders and scouts. the files alleged pedophiles lure the child to the homes and molested them. a scout leader disrobed after cornering a boy. >> we can learn a lot. it is consistent. it's almost always somebody that is the pied piper. >> reporter: he says those popular scout leaders are rampant in the perversion files. now on several legal fronts lawyers for abused victims are trying to get more names of alleged pedophiles, in some cases suing to get the confidential files made public.

that's not all. abuse victims lawyers are calling on congress to audit whether the youth protection methods are working. >> those files span from 20 years from 1965 to 1985. the boy scouts say two-thirds of them have already involved law enforcement. an 83-year-old lesbian is celebrating. the act denies benefits to same sex couples. critics are accusing the court of imposing views on america. the issue is expected to end up in the u.s. supreme court. alarms wake us up and tell us when our laundry is done. you think we wouldn't need more alarms but you are wrong.

pastor of a church that opposes same sex marriage. welcome. >> good morning. how are you? >> i'm good. this issue will be decided in the u.s. supreme court. it does seem that you're on the losing side. do you see it that way? >> i'm always on the winning side when i'm on god's side. but i feel like culture seems to be outwinning our faith. we are going to have to really do a call for the church to step up on its principles and values because it is our responsibility to impact culture, not for culture to make us a just faith. >> the issue of same sex marriage has split the african american community although it appears the split may be shrinking. the n a aacp said it supported same sex marriage in the state of maryland and that pastors support it, too. >> as a christian pastor i affirm the naacp's position that civil marriage is a civil right.

this really is not a religious issue. >> so that's from one of the other pastors in the baltimore area. the naacp is on board, too. what do you think of his comments? >> i think it is a grave injustice. you will notice that they would not bring an imam from the mosque to make a statement that it was not a religious issue. they would not bring a rabi out to say that. they found a few group of compromising ministers. they are at the microphone because of their position. i think the black church has always been forth right about our accountability has to stay strong. what kind of house can stand in a planet that has no consciousness? >> churches are -- aren't forced

to marry same sex couples but it is a civil matter. >> we have to reexamine what family life looks like and how the country is based on a christian representing that marriage is defined with one man and one woman. and i think that our communities are going to become resolved when our pastors become clear headed about our faith. >> i would add one more thing because the federal judge that helped make that decision in the federal court in new york said this is really a civil rights matter. homosexuals are not in a position to adequately protect themselves from the discriminatory wishes of the majority public. t that came from a conservative judge in new york city and said it is a civil issue and not a religious issue and said same

sex couples should have the same rights. >> it is a difference when you get married you do it under a witness under god. it is a sacred ceremony with clear and deep religious overtones. it is performed at the alter. a bible is the focal point. we understand the original intention of god beginning in the book of genesis is a marriage family between adam and eve. i think america is going in a downward spiral. as we move towards the supreme court and very well past it it is a death processional about the morality of our nation and where we need to return back to. >> thanks for joining us this morning live in baltimore. vice president joe biden is at it again. republicans are pouncing on another comment biden made on the campaign trail. we'll ask you if that comment was out of line. i'm a conservative investor. i invest in what i know. i turned 65 last week.

39% of women say abortion is their number one issue. what i didn't see is how many of those were prolife and how many of those were prochoice. and i think that is a very interesting break down. where the economy is and where jobs are and families with so many kids unemployed and so many women hard hit it is surprising to me that this would be the number one issue. it has gotten an enormous amount of attention in the debate and political trail. >> you are not kidding. another congressman made comments about abortion last night and they are quite controversial. >> this is an issue that opponents of life throw out there to make us look unreasonable. there is no such exception as life of the mother. and as far as health of the mother same thing with advances in science and technology health

of the mother has become a tool for abortions anytime under any reason. >> he appears to be saying that women are using the excuse of health of the mother to get abortions, at least that is how it sounds to me. because these comments are out there, might that be a reason that women are concerned about the abortion issue? >> absolutely, carol. i think those kinds of clueless remarks really make women think about what it is that republican men are trying to do. there is a huge dissidents in that. i think women are looking across the landscape of state legislatures across the country in florida and virginia to very important swing states where 83 laws have been passed in the last year restricting abortion services and providers. and in that they also restrict

health care for women. i think that in terms of women they are looking at this and saying so all of these republican men are trying to tell me what i need to do with my body. and i don't think that they appreciate that. and this has been something that the gop has put front and center. and i don't think it is going to be helpful to them in the 19 days left to the election. >> it is true mitt romney is pro life. he believes there are exceptions for the life of the mother in cases of rape and incest. when you have comments like what joe walsh just said, it just paints republican men in an unrealistic way, perhaps. >> carol, let me tell you something, if we got rid of every congressman and legislator who said something ridiculous and ignorant we would be left with precious few people in the united states congress. i almost would say we need

biology 101 class before anybody is elected to congress. that comment strikes me as ridiculous and unscientifically correct. and i just think that it is not -- i think men should be careful when they are talking about things like abortion and rape and things that they clearly don't understand. maybe our solution is to let more republican and democratic women to office who understand these issues better. i would give some advice to everybody running for office don't use metaphors using rape, abortion, the holocaust, slavery, using guns and cross hairs. let's keep it on the substance. >>. "animal practice" has been cancelled and peta is celebrating. >> they protested the show featuring a monkey dressed in a lab coat and they said that is cruel. they are crowing saying the cancellation sends a strong message that using animals for cheap laughs on tv shows is uninteresting to today's viewers. the ratings were weak which is why it was cancelled. it probably didn't help that the show was most memorable to irritating viewers.

months old. he loved me. >> you should bring him home. bring him home to new york with you. >> reporter: i'll pack him inside my bag. >> bye mitt and barack. foreign policy will the topic of the presidential debate on monday night. >> turning to a developing story in the middle east where a car bomb has robbed the city of beirut. the car was reportedly parked in front of a library and a lebanese news agency reports at least eight people have died, another 78 have been wounded. the scene is described as chaotic, one that shook the windows at cnn's offices ten minutes away. we'll continue to monitor this story and bring you any new details as we get them. >> for the first time the man known as victim number one of the jerry sandusky trial is speaking out. here's what aaron fisher told abc news.

>> you weren't able to say, nope, this guy's a monster and sexually assaulted me. >> i couldn't do it. >> why? >> embarrassment, fear of not being believed. >> fisher wrote a book about the abuse. it's coming out next week. in the meantime jerry sandusky's lawyers are asking for a new trial. they filed an appeal arguing there wasn't enough evidence to convict sandusky and they didn't have enough time to prepare. a 14-year-old girl shot in the head by the taliban has recovered enough to be able to stand up on her own this morning. malala cannot speak yet but her doctors say she is communicating very freely by writing notes. this latest report is encouraging, suggesting malala is well on the road to recovery.

>> it's earnings seasons on wall street. google is blaming the printer for sending out the numbers four hours early and shares dropped nearly 10% because of that? what happened? >> reporter: a big oops, that's what happened. google is blaming financial printer r.r. doesn'tlnnelly. to anybody who follows these releases, this came as a big shock. earnings come out four times a year, it's down to the hour, it's very, very routine. what happened is these earnings came out early yesterday. they weren't complete. a goodnd kateor of that, look at the top of the filing, it says "pending layy" it just wasn't

ready for primetime. google wasn't ready putting it together. you look on twitter, "pending larry" was immediately put on twitter, the jokes started flying. it was funny. look at this. the stock dropped immediately after the release. even offer the nasdaq, google shares had to be halted from trading for a while before they resumed before the closing bell. at the end of the day, though, google shares ended down 8%. carol, maybe it wouldn't have been so bad if google's earnings were good and released early but the problem was they weren't good. google's third quarter profit and revenue missed expectations. but right now shares are recovering a little bit, up a fraction of a percent. carol? >> all right. caught on tape, americans working as contractors in afghanistan accused of drinking

wrestling, shouting at the man videotaping them. >> [ bleep ]! >> reporter: this is amateur video from earlier this year of people working for an american security contractor in kabul, afghanistan. this man identified as the country's security manager for the contracting firm george scientific. >> it reminded me of any times i visited my friends going to college that were in fraternities. the parties at the frat houses were out of control. >> reporter: john nelson is one of two former employees filing a seven-pig lawsuit against the firm for allegedly committing fraud against the u.s. government. they say they were harassed for trying to blow the whistle. the company denies that. they allege rampant drinking, drug use, the misuse of firearms. the video was shot on a cell phone by another former employee, kenny smith. he tapes himself complaining he's being awaken by the

behavior. >> reporter: how often did you observe this behavior? >> the misbehavior was actually almost every other night, several times a week. it was just at any given time they could just say, hey, we're going to get together tonight and walk outside. typically at the end of the evening, sometime late afternoon. >> smith said he and nelson tried to stop the behavior, taking it to the top levels of the company. he says they were told it would be addressed. in this section of the video, a man identified as the security firm's medic appears incoherent. there's a syringe on the floor. the plaintiffs claimed he'd injected a horse tranquilizer called ketamine. >> how can the medic be doing his job or security contractors be able to protect those training the afghan police? then you have the fact that they're having this behavior in the middle of kabul, so they're

blowing up ammunition in bonfires. >> reporter: that's a reference to this video of a bonfire at the kabul facility, which the suit claims led to injuries. contacted by cnn, george scientific issued a statement saying it took decisive action to correct the unsemable behavior of limited up in of employees. but george scientific denies committing fraud. representatives for the company say the man identified at security manager and the other man in these scenes did not have top security roles, that they had administrative and support jobs, sometimes driving. i asked the plaintiff's lawyer about that. >> the people representing the company say these guys had no security detail, that they were just administrative support. >> that's a gross understatement of what these individuals did. these individuals are the security manager for the facility and the operations manager of security for the entire country of afghanistan for the company. they were supposed to protect

their own people as well as the local afghans from attack. >> reporter: george scientific refutes that, reiterating those men did not have a protective role for local afghans and that they would not have been tasked with protecting the facility from attack. company representatives say no one involved in the video is still working for them and the firm is conducting its own investigation. the military is supposed to oversee those contractors. contacted by cnn, officials from the nato command, the international security assistance force, said they take the allegations very seriously and they said the u.s. army's criminal investigation division is looking into the allegations. we made attempts to reach the other two men in that video aside from that medic and were not able to. brian todd, cnn, washington. >> vice president joe biden is at a again. republicans pouncing on another comment biden made on the campaign trail. it involved bullets. government employee like the university of iowa discriminate against a potential employees because of their police call beliefs. the trial should wind up today where she says she has e-mails that discussed her political beliefs, they worried it might be a problem. she once worked for the national right to life foundation. she says she has proof. it wouldn't be a big surprise. 75% of college professors self-identify as liberals to only 15% conservative. former harvard president larry somers, who worked for president obama, has worried that this could be a result of discrimination in higher education. i think that presents real problems. >> she's even saying it's a constitutional issue, but it's discriminating against someone's political views a constitutional issue? >> she's making a first amendment claim. she's saying by denying her this

job because of her beliefs and associations, they're intruding upon her first amendment rights. the government has said -- the supreme court has said the government cannot deny you employment, cannot base your hiring decision based upon your political beliefs. they make one exception and that's for policy makers. for example, barack obama could deny a cabinet position to grover norquist, right? they don't agree and that's kind of an important part of the process. but are colleges policy makers? are law schools policy makers? that's an important answer to that question. i think no, unless we're treating universities and law schools as like institutions for teaching a certain way of thinking or a certain ideology, we've got a real constitutional violation here. >> in fairness to the university and it's not commenting because this thing is going to court, right, the university claims that she had a terrible interview and that's really why she wasn't given the job. so you can't really rule that out, right? >> no, you can't.

people who live in and around denver are quite upset at madonna saying her gun stunt is insensitive. it's part of madonna's routine during the song "gang bang" but the community is still recovering from that shooting in nearby aurora. >> reporter: carol, madonna and even more controversy. to think colorado residents are still healing after the deadly shootings in places like aurora, we can't forget about columbine. they were a little upset and sounded off on twitter. given madonna's past, a lot of people think this is a publicity stunt. on this tour alone, let's count the ways she's generate $ her share of attention by putting a swastika on the photo of a french politician, flashing a crowd in turkey, mooning a crowd and protesting an anti-gay law in russia and i don't think

those incidents even rank in madonna's top ten of absolutely outrageous stage stunts. but on this tour she's consistently brought out a fake a.k.-47 at stops on her shows and really used it as a prop. this may be a case of the local crowd being sensitive to something madonna didn't consider. perhaps there were reports that madonna was two hours late to take the stage. this is a complaint that has followed her around the world. the tickets may say 8 p.m. but madonna doesn't take the stage before 10:00 p.m. that's the real schedule. if you're going to see her, be prepared to just wait a little bit perhaps. oh, madonna. >> a question, are her concerts sellouts? >> they're doing quite well. one of our supervising producers here who actually got the rare chance to see the backstage happenings, you know, how the whole production takes place says it's quite impressive.

political types everywhere are keeping a close eye on the senate race in missouri. you know, the race that features congressman todd akin and

senator claire mccaskell. they squared off in a big deb e debate, missing one key things, the comments that akin made about legitimate rape. last night you could call it the elephant in the room. senator mccaskell talked about feminine issues but did not bing up the comment. >> he supports the boss being able to decide whether or not you get paid less because you're a woman. if you look at congressman akin's office, he is a boss that does that. his women staff make 23.4% less than the men in his office. >> claire mccaskell seems to want to escape from the failed basic economic mess that's been created in washington. and of course her advertising and everything backs up anything but taking a look at where we are with the economy and jobs. >> joining me now, political

in missouri? >> you know, it's probably easy watching this from around the country to think how can they be talking about anything else? but when you think about it, how many things can you say about one sentence? i will say senator mccaskell's campaign has clearly made efforts to tie other issues into this. if you listened to much of the debate last night, a lot of it was about women's issues, the equal pay, contraceptive access, those kinds of things, which she obviously is opening feeds back into what people know about the legitimate rape comment. >> it's interesting because a new gallup poll came out and said the number one issue for women voters is abortion. does that surprise you and might it be why claire mccaskell was talking so much about women's issues in the debate? >> yeah, i don't know if she had that poll specifically in mind. i think that she does realize that for her to win this, she needs to reach the middle. i mean, she's not going to get

the conservatives in this race. missouri's become a more conservative state in the past few years, we know that. so she's trying to reach those women who might not agree with her on every economic issue, might not agree with her stance on stimulus spending or affordable care act but doesn't want the government in the business of regulating abortion. she didn't actually say the word abortion last night. she speaks more broadly about women's issues. any time you talk about women's issues in the missouri senate race, anybody who is paying attention, that's a button that's being pushed, the legitimate rape, todd akin's comment. >> and just a final question. it's about the polls in missouri. some polls say senator mccaskell is up by 14 points, others say it's neck and neck. what's the truth in your mind? >> well, we had a poll right after his controversial comments in august that showed her up by 9 points. she had previously been way down. that was a huge swing. her campaign followed up with

one that showed a similar spread. she came out with the 14-point poll. that was an internal poll. we tend not to pay that much attention to internal polls. if i had to guess, i'd say you're probably somewhere lower than the 9% that it was. he's making a real effort among conservatives. but a pretty clear that she has the upper hand. >> thank you so much for joining us this morning. >> thank you, carol. >> it was hot this summer, no doubt about that. now it looks like that warming trend will stick around for winter. rob marciano joins us now. how hot is it going to be this winter? >> in spots it will be above average. last winter was the fourth warmest winter on record. some of the bigger cities got barely any snow at all. you hear us talk about la nina

and el nino, we were heading into an el nino but pretty much it stopped and here's the forecast going forward. we don't know what's going to happen. that is a particular challenge for the folks at the climate prediction center. they unveiled it yesterday at noaa. here's your best crack at what's going to happen this winter. we'll talk about the nest three months as far as precipitation is concerned, expect it to be below normal, using a very mild precip and for cold as well. should be below temperatures across the florida peninsula and above average temperatures out west. are we going to see the big snows across the northeast that we saw two, three years ago? that's possible. that's more determined by things that happen in atlantic ocean

she wants to. >> so of course, mike, this fight isn't over. tell us exactly what happened in court and what do you expect to happen in june? >> yesterday the judge granted a temporary injunction, which means under the legal standard there's a substantial likelihood of success on the merits of the case. basically he upheld the girls' right to free speech that's been upheld by the supreme court and lower courts for decade. it's a well established principle of law that students and teachers do not shed their rights to constitutional free speech when they walk through the schoolhouse gate. if you're in the hallway between classes or on the football field, you're still an american citizen and you get the right to free speech. there's a trial date for next summer but we hope that's not necessary. the school can retract its policy. if they do that, we can restore the rights of these students once again. >> rebecca, who complained about your signs?

>> i don't know. the point is we can still continue to do it regardless of who complained. >> i wondered if one of the football players is jewish or muslim and objects to running under the sign, what would you say to that? >> i would not force them to run under the sign. they don't have to do anything they don't want to do. that's how free speech works. >> are there jewish or muslim students going to the high school? >> no, there's not. >> the community has been 100% in support of the cheerleaders. they've gotten support from all around the country, even around the globe this thing has touched a nerve because people realize religious expression is under fire in many ways on public school campuses. free speech applies to all. at liberty institute we win 99% of these cases because the law really is well established. this is a good reminder to that. >> rebecca, if the court rules against you, what will you do?
