minut minutes. after hiding in plain sight, a convicted rapist is back in jail. gary irving fled from massachusetts, and settled in maine to go by his first name which was enough to avoid police until he was arrested wednesday. a relative turned him in and he is due back in court monday. two fifth graders will be tried for conspiracy to commit murder for plotting to hurt seven members at their school. washington state law says that children their age should not be tried for crimes like this, but an exception permits a trial under certain circumstances. court documents say that the boys ages 10 and 11 have confessed to plot to harm their classmates and they brought a knife and gun with ammunition no school. we have all had a little bit of road rage, right? but not like this. >> [ bleep ]. and you will see her in a moment, and two guys in the truck tried to run them off of the road in north carolina, and in the video, turner confronts them apparently starting the fight and the two hop out and fists flying and turner's wife there who seems a little tad overdre overdressed for this party hands him a gun which he fires as the other two take off. turner and his wife face assault charges. earlier i spoke with holly hughes and asked if the couple could claim self-defense? >> they can't claim self-defense, because the threat was over. we see these men running away and getting into the vehicle before he fires those shots, so at this point, he is looking at anywhere from very serious felony charges like aggravated assault which is firing a weapon at, toward or in the direction of someone or he can be facing something as slight as discharging a firearm within the city limits, and it is going to

55-39, and you saw the president there, right. next weekend, they'll play. and the wichita shockers beat ohio state 70-66 tonight to advance. it's wichita's first trip to the final four since 1965. they'll play the winner of tomorrow's louisville/duke game. a major university demanding that students stop handing out condoms on campus. boston college says condom giveaways violate the school's catholic mission. a student group is praning to defy the school's order and keep distributing the condoms. our medical correspondent is elizabeth cohen, and she has this story from newton, massachusetts. >> reporter: catholic doctrine doesn't support using condoms. but some students disagree. crosses here don't go well with condoms.
