to 24 hours before their bodies were found. what happened here has terrified and mystified the community. fbi investigators marching into the district attorney's office space in kaufman county courthouse. an ominous scene and a nightmare. mike mclellan and his wife and the killing of one of his assistant district attorneys is causing grave concern here and throughout the state of texas. >> i suggest everybody be careful about what goes on and i think this is a clear concern to individuals who are in public life, particularly those who deal with very mean and vicious individuals whether they are white supremacy groups or the drug cartel s we have. >> as of now it's not known who

is responsible for the killings, but it is soon there related. in december, the state of texas issued a warning. high ranking leaders of the aryan brotherhood inflicted mass casualties of death on law enforcement involved on indicting members a month early. on january thrown31st, a man pa his car in this lot and going to work at the courthouse a block away. a masked gunman stepped out and he was shot and killed. the county's chief public defender andrew jordan ran to the parking lot minutes after. >> i got there roughly the same time. >> he didn't know who the victim was yet. it was mark. he was supposed to see in court minutes later. >> we're had a case that we had spoken about the day before and

we were going to meet in court to finalize the plea. >> that same his now deceased boss issued these forceful words. >> i hope that the people that did that this were watching. because we are very confident that we are going to find you. we are going to pull you out of whatever hall you are in and bring you back and let the people of kaufman county prosecute you to the fullest extent of the law. >> although the district attorney's office was involved in the aryan brotherhood case, mark was involved minimally if at all. less than two months after the murder, the director of prisons was killed. tom was shot at his home and a prison parolee was killed in a shootout about an hour 1/2 away from kaufman county, texas. the shootout led to an

investigation to whether the two killings were relate and then just over a week later, mark's boss, the man who deplored the kills ring of his assistant district attorney was killed in his house with his wife in kaufman county. the scene was awful with rifle casings on the scene. kaufman county is 35 miles from dallas, but is the kind of rural place you move to to get away from crime. >> it's a sense of disbelief and takes a while to set in. >> for now the prosecutors continue to do their jobs, but the governor of texas announcing that they appoint a replacement district attorney as soon as possible. for government workers and for the 13 remaining assistant prosecutors in the office. bruce wood is the judge which is

texas's equivalent of a county administrator. >> we are in shock and disbelief and everyone that works in this courthouse i think feels the same way. we are all dealing with it and hoping with it the best we know how. >> does the warrant shed any light on whether they knew someone was in their house or they put up a struggle? it said nothing about whether they struggled or what happened. we know it was brutal and terrifying. some said they were in bed. others as they were running away from the gunshots. they are purposely being quiet. don't interpret the quietness saying they don't know about what happened in this case and they possibly might know something about the perpetrators. the fact that they're quiet is relevant. as they saw before, the former district attorney spoke out forcefully. it appears to be a strategic

decision. we expected it after the first day after a weekend event. they want to mention a short time ago, they pointed out that the governor will announce the name of a permanent district attorney, but has made temporary district attorney who is a prosecutor who will hold the job before the new da takes the job. >> thanks very much. we will dig deeper in a moment into the white supremacist group being considered in connection with the killings. i want to bring in a friend of the late district attorney. thanks very much for coming in. you knew mike mclellan. what kind of person was he? >> he was a very honorable man. he served the united states and the army before he retired and in 2010 decided to run for district attorney. the first on sought to public office. he was in office over two years

and running if are ree legz and let everything day the way it was before he got there including keeping mark haszy as the top prosecutor. very good man in the community and the public lost. >> after his deputy was killed, mclellan was outspoken after catching those responsible for that crime. did he fear and his family, did they fear they were in any type of danger? >> i would say anybody in that role whether you are the da of cuffman county which has 100,000 residents or dallas county that has almost two million citizens, any time you necessary that role, your is public. on the internet and they know where you are and where you live, anything after the death of mark hassy was on heightened alert. we do dangerous jobs.

the assistant district attorneys do dangerous jobs, but it's a calling. i was not surprised to see them out there making the statements. he is the leader of the local justice system and needed to know everything was under control. >> it's a small county. just over 100,000 people live there. what effect have these crime his on people in the county, particularly those in law enforcement? >> this just doesn't happen. i think one of the members we heard from the 1960s that they have been keeping records of assistant district attorneys or elected d a's getting killed, the number is 14. this just doesn't happen. if you take out a prosecuting attorney. you are not going to affect the case. this type of killing has the blueprint of a personal killing because if this was a case that somebody was trying to change, they would have been going after

witnesses and not the prosecuting attorney. having that type of environment going on where people who are just doing their jobs or getting assassinated, this is what this is. elected officials getting assassinate and that is sending a chill through the community and the community in general. i'm a criminal defense lawyer and still a commissioned officer here in texas. i am carrying a gun more now than i did as a plaintiff. it is sending a chill until these people are found. >> that's what i am hearing from a lot of your colleagues. thanks very much for joining us and deepest condolences to you and everyone on the scene for this horrific loss. let's continue the conversation. joining us is our senior legal analyst and prosecutor and joining us is the criminal defense attorney. prosecutor murders here in the united states have been relatively rare, but threats against prosecutors in judges

clearly have been on the rise for years at the federal level. they more than doubled over the past decade. any sense of what might be driving this bad trend? >> maybe i'm too cynical, but i have been surprised there were not more threats and violence against prosecutors and judges. it's the job of prosecutors and judges to make the lives of criminals terrible. they are angry about it. there have been relatively few cases of actual violence against prosecutors. i know here in new york there has been an informal rule from the mafia. they leave prosecutors alone. they had protection at various times and never actual violence. fortunately there has not been that much violence until this awful recent case.

threats, yes, but violence, no. >> two in texas and one in colorado. >> is it judges and prosecutors and those who are being targeted? this is something that cross the minds of defense attorneys. is that true? >> i do agree with jeff. some of the anger in the how incensed people get. there is also and i don't mean to make light of it, but people ask about isn't that a dangerous job? we often say no, the dangerous part is over where family law is. i can you we had a commissioner's murder in los angeles which has been unsolved for years now. three years ago we had a lawyer who did some civil and family law. that is generally where you see these people get very upset. there was an around the mulberry

bush in van nuys where the opposing council was stalked by a man with a gun. you generally see it when people are fighting about family law, custody or money. it is an exceedingly rare thing for prosecutors to take the brunt of it. as jeff said and mr. schulte said before that, is not going to help a defendant in the case because the case moves on. the witnesses are still there and prosecutors are there. it doesn't help much. there is a personal aspect to this. i'm sure they are exploring. >> jeffrey, short of arming and a signing armed full time guards to every lawyer and judge and criminal defense attorney dealing with dangerous defendants, that's not in the cards any time soon, is there a way to prevent these attacks? >> realistically, i can't think of a reason. as i said, when i was a prosecutor, there were times

when there were specific judges and prosecutors who received specific threats and got protection. in general, there far too many prosecutors who -- there too many prosecutors to protect them. the case i am familiar with is tom weals in seattle who was murdered in his home. they are under similar circumstances to the last case. he was sitting at home and shot through a window on october 11th, 2001. that crime has never been solved. i think it was easy to solve these crimes because the list of suspects is pretty apparent. that crime more than ten years later has never been solved. >> does any of this cross before taking on a case be it the

prosecution or defense? officers of the court like you live with the knowledge that you are involved and may have a target on their backs? >> yeah, obviously it goes through your mind. you are not supposed to let it affect you. about years ago, i had taken on a particularly hated defendant and somebody ended up planting a bomb in the porta potty in front of the house. something you think about. you are not supposed to let the person's reputation affect whether or not you will take a case or not. it goes through your mind. >> the thing that's different about the aryan brotherhood if we say they are the suspects, they don't have the usual checks and balances. the mafia knows if you kill one prosecutor, you have another waiting in line and more motivated group. the aryan brotherhood is crazy. even by law enforcement standards. first of all they are mostly in prison already so they have less

what could their motivations possibly be? >> the aryan brotherhood of texas was a chapter in texas, but it was denied injury and created their own subsetsubset. they are one of the most violent in the united states. if they decided to do this hit on this family, they changed a lot of the rules. there has always been a rule that law enforcement didn't mess with your family outside of you and you didn't mess with law enforcement's family outside of them personally. them attacking and killing his wife is going to change the scales. >> that would indicate to me. a further insight as to how it operates. if they began this targeting local officials. will they be deterred by a massive hunt by law enforcement or continue killing?

>> i don't think that this is going to deter them. it will be interesting to see in the long run if as you guys said, they did dot first hit and they have done the second hit. i know they are offering protection to different people in the courthouse, but 30, 60, 90 days out, are people going to want to pay for the guard and once that diminishing and goes down, will they decide to hit again. the aryan brotherhood put the hit out on everyone else in texas to try to show that how tough they were and how superior they are to other groups. >> some speculation that another prison gang was behind the murder of tom clements, the colorado department of creeks chief. how does this compare with the 211 crew?

. no one was expected to see this. duke faced off in the regional final. with less than seven minutes to go, they went up and landed the wrong way, breaking his lower right leg in two place where is a shin bone broke through the skin in an injury too gruesome to show. his teammates watched from the bench several feet away.

you can see them recoil in horror. he was rushed to the hospital where he had two hours of surgery where he reset his leg. he is said to be in good spirits, but has a long recovery ahead of him. our chief correspondent sanjay gupta is here to tell us more about this injury. we want to talk about startling new numbers on attention deficit hyper activity disorder. the injury first. what exactly happened? >> well, it's a pretty unusual type of injury. he is obviously a big guy. he jumped far horozontally and vertically and landed in an awkward position. when you think about the leg below the knee, you are talking about two bones. the tibia and a smaller bone called the fibula. i will show you an extra. this is not his x-ray, but this is a reflective type of injury that he had.

if you look there, you see the two bones and how they are broken and in that case, the tibia is protruding through the skin. you bear a lot of weight on that part of your leg. if you have an awkward jump and landing the way he did, it can happen. it's a pretty unusual thing, but that's probably the best way to describe it. >> in terms of recovery, he will play basketball seriously again? >> i think so. i talked to a few people about this. this is an unusual injury so you can't say 10,000 people. one thing that is worth pointing out is the fracture that is pretty bad. a couple things that happened that were important. when the bone breaks through the skin, one of the biggest concerns is infection to the bone and also stripping away the blood supply to that bone.

both of those can dramatically reduce healing. the biggest key is getting into an operating room. he was getting an operation within two hours. that will work in his favor. she up as you showed on crutches now. you want to push that bone together. they put it back in place and push it together almost loading it. she starting to do that. it's a season ender, but probably and hopefully not a career ender. >> let's hope indeed. we wish him a speedy recovery. let me switch topics and ask you about the numbers on attention deficit hyper activity disorder for the centers for disease control. the "new york times" did the analysis. here's the upshot of what we know. 11% of all school age children received the adhd diagnosis at some point in their lives. that is an increase of 16%.

the highest rates are with older boys. 19% have been diagnosed with adhd. nearly 23 of kids diagnosed are taking medication for it. in five high school boys diagnosed with adhd, a staggering number. you say there problems with the study. >> i don't love these studies and i'm not sure i appreciate the value. it's a survey. this is not looking through medical records or a diagnosis with the kids. calling up parents and basically asking them questions about their children.

a controversial plan in tucson, arizona to give away free shotguns. the man behind the plan said he wants to give them away in high crime neighborhoods saying it will brick down the crime rate. a mass shooting in 2011 history six people dead and 13 others injured including then congresswoman gabrielle giffords. in a moment her husband mark kelly will join us with his thoughts, but first here's miguel marquez with more on the plan to give away guns. >> at the tucson trap and ski club, they are as common as sunshine. here in tucson neighborhoods, the idea for some of the giving away shotguns to homeowner who is couldn't afford them -- >> my gut reaction is to be against it.

the shooting that killed six and wounded 13 others including gabrielle giffords. joining us is her husband, mark kelly. thanks for coming in and what's your reaction to handout shotguns to people who want them? >> well, wolf, i think it's somewhat of a distraction from the debate right now. to be honest with you, it seems to be a lot to be like the nra leadership plan to arm teachers and put more guns in schools. i don't think that's the answer. the answer is to make sure the criminals and the mentally ill don't have access to firearms thoochlts through a universal background check. when all the shotguns are given away and they have done the check, it would be nice to know how simple it was and how easy it is. we can make sure that the background checks are part of the process for all gun sales. >> you and your wife gabby have been involved in the struggle.

right now it looks like uphill in washington to get major changes through congress. to those who say the moment for serious movement on gun control has passed, you say what? >> i don't think it's passed. i am speaking almost on a daily basis with members of capitol hill. there is a lot of momentum. the momentum is from the american people. they are pushing to do this. this is something that 90% of all americans support. that's a universal background check. even 74% of nra members support a universal background check. no reason why we shouldn't pass that legislation now. >> given the fact that even some republican senators threaten to filibuster, i am not talking about the magazines and the assault type weapons, but universal background checks. a senator said he is ready to filibuster even that. they would require 60 votes to

break. is that doable? >> it certainly is doable. to the senators that are planning to filibustering the bill, they should recognize that for instance like senator rubio in florida, 94% of his constituents support a universal background checks in kentucky where rand paul say senator. it's over 80%. when members of congress don't listen tote constituents, there consequences for that. >> what's most important to you? if you can't get everything, all the comprehensive gun control legislation, what is the single most important element? >> by far the most important thing in the debate is the universal background check. it's to make sure that criminals don't have the access to a hand gun by going to a gun show or over the internet. it's the most common sense thing we can do to reduce the guns in

the hands of criminals and the mentally ill. that's number one with regard to the legislation. then gun trafficking and getting the mental health status of people who are mentally ill into the criminal background check system. that is so important. >> sorry there any way the obama administration gun control supporters in congress should be handling this whole issue differently to be getting more of what they want? any recommendations you have? >> this is a process. the way it's impacted, it can be a slow process. i met with a senator today and they went with the colleagues and in the house. the american people want this and want this now.

there is a story behind this sweet moment. the boy's name is dominic. i spoke to his mom christiania. it's not every day that someone's son gets kissed by the pope. what was that moment like for and you dominic, especially for dominic? >> you know, it was really moving and he w moving and really moving. dominic is a people person, but he understand that that was exceptionally special and you can see that in the picture and the video. he broke out in a huge smile and wrapped his arm around the pope. that was very moving as a mother. for my family to see that was a beautiful moment even for the people around. there was not a dry eye around us. it was really, really moving. >> we're saw his arm around him and saw the big beautiful smile come from dominic's face.

that was very, very powerful. did you have any idea that that might happen when you went there yesterday? >> no. i didn't even know if we were going to get seating. we left a lot later than we expected. i have four other children and when we got to the piazza, it was packed. really at my older children's bidding, we sent my husband out scouting to see if we can get in and found the entrance and told we had to be separate and only one could go in. normally it would have been my husband, but for whatever reason he said why don't you go in. i went in. not in a million years did i expect to get a kiss from the pope. >> a professor of theology
