>> the louisville guard on his team, the recovery and the final four. and north carolina proposing an official state religion. can the tar heel state go its own way? live in the "cnn newsroom." good morning, thank you so much for joining me, i'm carol costello. new warnings in the killing of colorado's top prison official. tom clements shot to death at his home by a former prison inmate. investigators believe evan ebel may have plotted that with fellow white supremacists. clements had cracked down on their prison gang, 211 crew. thomas gilly and james ware are believed to be armed and any police officer who crosses their path could be in danger.

ebel spent a lot of time fantasizing about killing people in law enforcement, and that goes back years, long before he died in a police shoot-out in texas. martin savidge in denver, joins us by phone. you have a glimpse into his hate-filled mind. >> it was prison authorities as well. they knew that the interaction with prison guards, he had a real problem with authority, and he would threaten them. strike them, and he would threaten them with death and not just them, threaten their families, and ty managed to get hold of a letter that he was writing to on the outside. this is where the fantasy issue comes in. he was telling the person about alleged the abuses the guards were making and how he handled that. and he said at one point, "i just fantasize about catching them out on the bricks and subjecting them to vicious torture and event you'll

murder." authorities believe in the case of evan ebel, he went beyond the case of fan ta sizing. this is one more red flag that authorities had. evan ebel serving time forearmed robbery, prison documents show he was anything but a model prisoner. several times threatening to harm or kill prison authorities. in november 2006 this report describes ebel striking a family member. threatened to kill staff member and family in 2005, another chilling account of ebel's rage, telling a staff member he would kill her if he ever saw her on the streets and that he would make her beg for her life. new information on his violent behavior, combined with the revelation that a kerr call error led to being released four years early, led only to anguish and anger of the victims'

family. >> the family of the first person he is accused of killing. >> clerical error, it won't bring my husband back, my children's father back. how die tell my 4-year-old that daddy was murdered because of a clerical error? >> it took five days to investigate that the ankle bracelet had been disarmed. 7:20 a.m., march 14th. ebel makes his daily call to parole officials. eight hours later, tamper alarm goes off. instead of investigating, the monitoring service sends ebel a message to schedule a repair. march 15th. ebel fails to call officials. march 16th. no sign of ebel. not until march 17th did the monitoring company notify parole officials that he failed to come

in to have his ankle monitor repaired, the same day they believe leon was murdered. and march 18th, ebel's family was inquired about his whereabouts, and they search his home, and determine he has gone into hiding and begin the process of revoking his parole. that night, clements shot to death at his home outside colorado springs. march 20th. the state department of corrections issues a warrant for ebel's arrest. citing parole violations. and, of course, it was the next day that ebel was killed in a shoot-out in texas with authorities there. it should be pointed out, authorities never stopped their investigation, even with the death of the prime suspect. they always wanted to make sure there weren't names on a potential list and weren't other associates out there that might carry on after ebel. and that might explain why there is a search to find two other potential associates of his. carol. >> manhunt underway. martin savidge live this morning. watch "a.c. 360" tonight for an

exclusive individuaterview with widow of tom clements. kaufman county distinct attorney mike mcclelland gunned down in his home with his wife cynthia. today, a public memorial held for them. their killings two months after the chief felony prosecutor mark hasse shot to death. police concede that white supremacists are among their focus. months before the killings, state officials warned the aryan brotherhood could retaliate for dozens of gang members being arrested. abc news reports they wanted to attack anyone involved in those cases. this time, it could be much more than bluster. just last hour, cnn is learning north korea could launch a mobile ballistic missile within days or weeks, that's according to a u.s. official citing

intercepted communications. this as the united states is sending ballistic missile defense to guam. barbara starr live at the pentagon with more. what are you hearing? >> carol as we watched north korean rhetoric the last several days, it's the question of missile launches and nuclear testing that has u.s. and military officials most concerned right now. there are intercepted communications, satellite imagery, showing that north korea might be planning to launch a mobile missile. why is this of such concern? these mobile missiles move as you see on the truck launchers actually that can readily move around the countryside. makes it almost impossible for u.s. intelligence to track them and to follow them and to know in advance if they are being launched. so there is almost no warning about it. these mainly are intermediate range missiles if you will, that could attack targets in south korea, japan, guam, maybe as far

as hawaii. this put the entire region out there on edge, of course. u.s. watching all of this very carefully. carol. >> barbara starr, live from the pentagon this morning. forced spending cuts have president obama breaking out the checkbook. the president giving up some of his salary while other federal workers feel the pinch. don't look for those in congress to follow the president's lead. >> most of my colleagues are the bread winners in their families. pay cut to me doesn't mean as much. i don't think we should do it we should respect the work we do. i think it's necessary for us to have the dignity of the job that we have rewarded. >> all right. nancy pelosi said that on february 15th. dan lothian at the white house right now. so is this just a stunt or are

people really into this? >> i think this is more symbolic than anything else. the president won't feel any economic pain in this gift in addition to the big salary he gets for president, he makes outside income from books, but nonetheless, a lot of people out there who are feeling the pain from these cuts, so the president is reaching into his own wallet. president obama is putting his money where sequestration is he will give up 5% of his salary this year. makes 400,000 a year. that amounts to $20,000. and administration officials says the president will write a check to the treasury each month. an attempt to show unity with federal workers hit by the budget cuts. >> everybody at the white house and broader gop is dealing with consequences, both in many cases

in their own personal lives but in, you know, how we work here at the white house which is true across the federal government because of the impact of the sequester. >> reporter: the president is not alone in giving back. others writing their own checks, chuck hagel, shaun donovan and epa administrator. a handful in congress doing so as well. in february, kentucky senator rand paul announced he is giving back $600,000 from his senate office budget. money saved by being frugal. a word many federal employees may have to learn to live by. earlier this week white house spokesperson jay carney say 400 employees in the office of omb received furlough notices, in the white house, they have made some adjustments, cutting back on the use of air cards and open positions not being filled. so far no, specific information

about employees inside the west wing area, if you will, getting any furlough notices. carol. >> i have to say, all of the people giving back so to speak make enough money to be able to afford to do that. the average federal worker doesn't make $400,000. i am curious, where will the president's $20,000 go? >> reporter: the white house hasn't specified where it will go, other than to treasury. we expect it will go into the general fund, not earmarked for any particular thing. the president will be sitting down, we're told, writing out checks every month, until this whole sequestration issue gets resolved. >> all right. dan lothian rocketing live from the white house this morning. checking other top stories for you this morning at 11 minutes past the hour. earlier this morning in connecticut, lawmakers in the house passed a gun control measure comes in response to the sandy hook school massacre in newtown. it adds more than 100 types of guns to the state's banned list,

the governor is expected to sign it into law at noon eastern. in kentucky, people are lol looking for the person who gunned down a civilian outside of the ft. knox. the shooting stems from a personal dispute. a traffic accident leads to a parking lot shuffle between police and a woman eight months pregnant. police in springfield, illinois, say they had to use a taser on the pregnant woman when she resisted arrest. wow. police officials and the taser company say the electrical shock was safer to the woman and her unborn baby than a violent struggle would have been. it started with a prayer before a board meeting of north carolina state officials, and now those officials are facing off against the american civil liberties union. the aclu. lawmakers in every north carolina are pushing a resolution that says in part, north carolina has a right to

establish an official religion. sponsors say it allows county commissioners to pray. >> i want my right and any other right of elected officials in this state to be protected and to have freedom of speech and freedom of religion to practice as they so shoos. >> joining me now is the coed for of cnn's belief blog. good morning, eric. >> good morning, carol. >> that's a serious charge. what's going on in north carolina? >> earlier this week, two state representatives in the north carolina house of representatives, harry warren and karl ford, both republicans, introduced this bill to protect the freedom of religion for folks in rowan county. what's at issue is a lawsuit filed by the aclu against rowan county commissioners. they have opened up their county board meetings with an invocation, opening prayer.

aclu says that prayer is explicitly christian 97% of the time. ending in jesus' name we pray, and other assertions of christian doctrine and they say that steps on the rights of other folks in rowan who aren't christian. they are suing the county to stop the invocations and if they do them at all, make them broader and more inclusive for other religions. this bill filed, and not really a piece of legislation as it is a resolution, when people say the girl scouts are great and we should recognize them. similar to what we are doing, as opposed to getting them to amend the constitution. what this says, the constitution doesn't apply to our own state if we want to make rules regarding the establishment of religion. and that's what got people so fired up and critics went ballistic and said north carolina can't make their own state religion. karl ford, representative who filed this bill, gave a statement to his local paper.

let's take a look at that statement. we're not starting a church, not starting a religion. we're supporting the county sxhigsers in their freedom of speech. do the county commissioners, acting as state reps, when they deliverinvocation, do they have a right for free speech. no, they do not when they are acting broadly. here is what the aclu had to say last night about this resolution that went before the statehouse in north carolina. the aclu said the bill sponsors fundamentally misunderstand the constitutional law and the principle of the separation of powers that dates back to the founding of our country. carol, that lawsuit is heading its way into court. we'll see what happens and we'll be following it very closely. >> we'll check back with you. eric, thank you so much. brian banks, getting the chance of a lifetime after his life was changed by a crime he did not commit. banks exonerated in the rape and

kidnapping of a high school kidnapping. he served a five-year prison sentence before his conviction -- before his conviction, rather, he been a high school football star, and now he is getting a chance at the nfl. to further explain, the young woman who recused banks recanted. said she made it up, so he got out of jail. >> he got out of jail first. went to jail for five years, on probation and finally sent him a facebook friend request, weird, right? and she agrees i'll go back on what i said. admits it's all false. amazing story. his life, one of the best high school football players in the whole state of california, going to go to usc on a full ride. he went to prison and a second shot with the atlanta falcons, a great, great story. >> so does he have a contract? >> yeah, they assigned him to a contract. the seahawks gave him an invite to mini camp last year. pete carroll, the coach at usc

critics say it's unnecessary. one of three teens missing since easter sunday has been found. another hiker was found by one another hiker on wednesday night. crews are still looking for the other missing hiker. a motive sought in the killing of a west virginia sheriff killed while he ate lunch in the car. his accused killer recovering in the hospital. 37-year-old kenneth maynard shot and killed eugene crum, blocks from the courthouse. police chased maynard and shot him in the chest after he pulled out a gun. crum became sheriff in january and had a reputation of targeting drug dealers. >> he was my heart. best sheriff that mingo county has ever seen and probably ever will see. he did more in less time of

being in office than any sheriff i have ever known. >> heartbreaking. heartbreaking. the whole community is just heartbroken. because we knew he really cared and that he was really doing the right thing. the county and to keep our kids safe. >> cnn national correspondent susan canndiotti in williamsbur, west virginia. tell us more. >> reporter: carol, good morning. what is the motive here? it's hard to figure out. cnn has learned the suspect in this case said something to investigators after he was shot and arrested. they are not saying what it was. only that it could be interpreted in different ways. we also learned that the father told cnn affiliate wsaz that his son suffered from mental health problems after an industrial accident in alabama some time

ago. and that he was exposed to dangerous chemicals. again, whether that had anything to do with this, we don't know. we don't know how he got his hands on 40-caliber locked handgun that was used to shoot the sheriff, as well as what led him to this? it's stunning, the entire community here, carol. >> are other law enforcement officials worried there? >> reporter: they certainly are, and so are the residence. they have added extra security at the courthouse where the sheriff had his office and also brought in additional officers from the west virginia state police to help with added security, but also to give relief to the officers who are working so hard to try to get to the bottom of what happened in this case. and, again, we don't know -- we do know this, rather. there is a persistent prescription drug abuse problem here. they don't know whether that is the link to this crime, but it's one of the things they are looking at. >> you know, it's hard not to

universities responsible if students can't find jobs? it's tough out there. if you are a new college grad, good luck finding a job. sure, you paid upward of $40 k for that law degree. chances are you going nowhere fast, like this law grad who had to move back home. >> i thought this degree would be very important for me getting a job. >> especially since southwestern boasted 97% of graduates landed a job in nine months. with no legal job, liberman is suing the school, false advertising he says, and he's not the only miffed unemployed student. similar lawsuits in six states. actually holding universities responsible for the unemployed is a new trend. north carolina's governor, outraged by high tuition and what he calls useless choices like gender studies wants to limit taxpayer money to public colleges unless they put "butts in a job."

good morning. thank you for being with us. i'm carol costello. stories we're watching in the newsroom. wall street reaction to worse than expected jobless reports. jobless claims rose from a week ago. monthly jobs reports due out tomorrow. ringing the bell by the way, executives from atlantic trust. "the washington post" reports many cancer clinics are turning away thousands of medicare patients because of the government's forced spending cuts. doctors in the reports say reduced funding makes it impossible to cover expensive chemo therapy drugs and keep their clinics open. medicare patients will have to go to hospitals for cancer treatment. soon wall greens won't be filling prescriptions, they will be writing them. they can diagnose and treat patients for chronic illnesses

like asthma and diabetes. wall greens says it has nurse practitioners and fizzes on staff as part as expanded health care clinics. oh, to politics now. chuck hagel is doing it. so is president obama. i'm talking about giving back part of their salaries to show they feel the financial pain of federal employees who are going to be furloughed. the president is giving back 5% or almost $20,000 he makes $400,000 a year. chuck hagel will give back 14 days pay, or a little more than $10,000. critics accused the president of making a largely symbolic move, but democrats will say that the president is going farther than some in congress. this is now nancy pelosi addressed the issue during the talks about forced spending cuts. >> most of my colleagues are the bread winners in in their

trillion dollar deficit, talking about cutting $17,000 from the president's pay. it's admittedly symbolic, a gesture of what solidarity with federal workers. in the end, here is the deal. it's not dumb. what it is, a brilliant m macvelian maneuver to say this is so nice of the president to stand with the people and people like me to say that is so silly. get behind the scenes of the white house political machina o machinations. >> were you in the white house, will? wow. this is a sin veer gesture by the president. is it going to fix budget problems? of course not. that's not the point. the point for this president to do this is to underscore what he has said from the beginning which is we're all in this

together and roosevelt said the white house is not immune from shared sacrifice and this is the point that the president is trying to make. and when you have cancer patients on medicare like you reported, carol, being turned back and not getting treatments because of the sequester, when you have the elderly going hungry because meals on wheels doesn't have the money to continue, when you have children not being able to participate in head start programs, these are the things that matter to the american people and that's the point that will allow this president to make. have you republicans making fun of his gesture, admitedly will did not, but the rnc has. >> it's not a joke. >> wait, wait, wait. republican national committee, maria mentioned it to you, i'd like to read their comments, their statement. mr. obama giving back 5% of salary to treasury and hop on air force one and take a

$180,000 per hour ride to a fund-raiser with the same fat cat millionaires and billionaires that he campaigned against. so, you know, it is a valid point, right? >> there you go. >> i think so. i think it kind of undercuts a little bit of the -- i don't know. high-handed praise that maria just handed the president. look, a guy making $400,000 cutting back $17,000. you could make the argument, this is kind of offensive to cancer patients receiving reduced government contributions, that the president will cut that amount from his $400,000 salary and then hop on a plane and then go fundraise, come on. how is this some grand gesture? >> well, here is -- here is the point, of course, the rnc doesn't make. when the president goes on those campaign fund-raisers, they are not paid for by you and i, they are paid for by the campaign.

and so that does not come out of the money that taxpayers actually pay. so, again, let's focus on the gesture, the gesture is we are all in this together, and the rnc can poke fun at this, can make jokes about this all they want. you know who is not laughing? all of those kids, all of the elderly, all of the cancer patients who are not being treated because of the sequester. >> you know what, maria? you can say that all you want. but i think -- i posted this on my facebook page and you should read the comments. most people think none of them should be paid. they are so angry at the president, at congress, at everybody, they don't think anyone deserves a dime of taxpayer money. >> and you know what, carol? all of those people should absolutely make their voices heard to congress who are the people who don't want to compromise? not the president and not democrats. >> will, last word. >> i understand that people get upset about congress' salaries.

>> i think it is very fair to say here at the pentagon officials are trying to ratchet back their own rhetoric, indeed, noticing that what they may be actually leading to north korea ramping up its own rhetoric. so they're dialing back a bit here, trying to make sure they don't get into too much of a spin cycle. but behind the scenes, it is that missile launch that has them most concerned. if you look at this picture, this is the kind of thing we're talking about. a mobile launcher on a truck. these drive around the north korean countryside. they can be moved very quickly. u.s. satellites then can't track really where they are, where they might be launching from. the u.s. has been watching, gathering intelligence for several weeks now. they believe the north koreans may be getting ready to try to launch a missile from one of these systems, and that would be

the type that could hit south korea, japan, maybe as far as fwaum. why it's so dangerous, again, the u.s. might have very little, if no warning that this type of missile system was about to be launched. so a lot of focus on this type of thing even as they ratchet back some of these headlines we've been watching for the last severing days. a new york city city police officer has been placed under arrest, accused of leading a mob of armed robbers. federal prosecutors say the officer would pose as a cop and use fake warrants to arrest drug traffickers, then rob the drug traffickers. the group is accused of more than 100 armed robberies since 2001. joining us now is cnn's legal analyst sunny hostin. so a new york city police officer was i guess the

ringleader in this? >> at least one of the participants. the government alleges helped this happened. they're they're allegeding that he gave their crew of robbers, new york city police department equipment. they used fake arrests and search warrants and equipment to allow them to pose as police officers, arresting allegedly, pretending to arrest these drug dealers, and then stealing the drugs from them. as you mentioned, a hundred, more than a hundred robberies this crew was responsible for. they netted about 250 kilograms of cocaine and about $1 million in drug proceeds. now this officer, jose dehava, he is going to be arraigned today at about 2 pm on a three count indictment. he's going to be indicted forearmed robbery, narcotics,
