cnn newsroom continues right now. thanks so much. i'm ashleigh banfield. so near and yet so far away. two young florida boys who allegedly were kidnapped almost a week ago from their grandmother's home in tampa florida are now believed to be in cuba today with their alleged

captors, aka their parents. those two lost custody of four year old cole and two year old schas after a run in with police in louisiana last june. how they wound up in cuba and what happens next are matters that i put to my cnn colleagues. and victor blackwell who is in tampa. give me exactly what we do know from any cuban officials at this point who may be talking about this case. >> reporter: well, the kublen officials say that three are not aware of this. they have said that the u.s. has not asked them for any assistance. here's what we do know about their cuban connection. the hills bore/county sheriff's office here, they say that they received information that the family had arrived there. they're not releasing the source yet. they're not saying he exactly what that information is. we do know from a uls official here in the united states that

u.s. officials in havana are involved with the situation and they're aware of it, obviously to what extent, what their involvement is, that information has not yet been released. but we are still waiting for the hard confirmation, for someone either with the state department or with the cuban government to say, yes, the family is here and this is their condition, their whereabouts. that yet has not come. >> and then just remind me of the sear eels of events that led up to though alleged absconding with children internationally. there was a custodial issue with these parents and sharon's parents were the custodians of these kids how did they allegedly kidnap these children. and how did that go down. >> reporter: well, you brought up the grand parents, and i want to say this. the grandmother is here talking with detectives right now. we are not aware yet that

there's a planned statement. but of course we're leer if that happens, if there is a news conference. but let's talk about the cuss to toadial issues. the parents lost custody. they lost parental rights on tuesday. how did that happen? we've gt to go back to june 2012. this is where the story starts. it's sly dell, louisiana. the parents and the boys are in ha hotel room. there's alcohol, drugs, guns. there are also joshua there, the father saying that they are in a journey to armageddon. and the police were spooked by that. they thought the children why in danger. they took them. two weeks later, hammond, louisiana the father showed up with a gun trying to take them. he faces charges in both of those jurisdiction for those two incidents. then on wednesday we're told that he showed up at his mother-in-law's home, sharon's

mother. at 6:00 or so in the morning. >> tied her up after breaking into her house, took the boys, took her car and sped off. the car was found. later his truck was found. and then there was the report that he bought a boat. just 25 foot sailboat. and that is what we're told led to the reports that they have been in cuba or are in cuba. all we're receiving from the sheriff's office here is that they received information that the family is in cuba. >> that's a far cry from saying that's where the children is. cnn is in havana as we speak. and we're chasing down the leads. we're going to get some clarity on where this family may be and whether the information they got to florida was accurate. in the meantime, there are huge legal issues between these two countries who do not get along. joining me now from philadelphia

is an attorney. is there anything the united states can do to get those children back if in fact they are in cuba? >> well, remember, cuba is not like any other country. we have a special relationship with cuba in the form of an embargo that we've had since 1960. and the short version of it is unless cuba wants to cooperate, there is virtually nothing we can do. we don't have an extradition agreement. this is not canada. this is not mexico. although amber alerts may be sent out internationally, ultimately finding these children in cuba presents a thorny international issue. and if cuba refuses to cooperate there is nothing the unit can do, short of some good diplomatsy. our laws mean nothing to cuba and vice versa at this time. >> when you say diplomatsy that's not usually a word we

connect with cuba. i know there is the u.s. section in havana. when you don't have relations you don't have an embassy. how do we talk with that country? it's not like this hasn't happened before. >> each administration has successively loosened restrictions on cuba so now it can't be said that we've gotten rid of the embar fwoe although certain commentaries say it is a certainty. we have as mooney people know we have a pllt base situated at one end of the island. so i mean, we have a presence in cuba. and we have officials there. and we allow students and missionaries to travel there as it is. so we do have an increased level, a modicum of diplomatsy in cuba. they're still a sovereign

nation. if they decide they refuse to cooperate we would have very little we could do short of sending in the apache helicopters, which i this is not an option at this point. >> and just to go back over recent history. i know this is i have tough as the story continues to break. but cuba has been a haven for people trying to escape the long arm of american justice. that doesn't mean that the cubans play ball. they often do send people back. is it willy-nilly? do we know what the standards are? >> well, it's up to cuba to decide who they deem to be a fugitive. but you're absolutely right. there have been accused cop killers that have fled to cuba and resided there for years and years. and of course the cuban government for whatever reason has declined to return then. so again, the watch word is we're going to come back to the touch tone of tlmtsy. because there's nothing legally short of declaring some kind of

military action, which of course is a form of diplomatsy gone bad. but other than that cuba decides who they want to keep and who they want to throwback just hike the fish they may catch in their ocean. in this case we have no power. it's up to diplomatsy, and i would suggest we handle their very carefully because we are virtually impotent when it comes to forcing cuba to do anything to. >> stay with me if you would. as a reminder, the united states government state department official in fact is not confirming that those children or that family is in cuba but does say that cuba is aware of this case and is in contact with local authorities to get more information. they also cited privacy as well. we're talking about children ages 2 and 4.

it is a little on the fly. so we'll join you as soon as we can get up live with you and tell you what we know about what's happening on the ground there. in the meantime, there's a high profile situation in cuba. beyonce and jay-z being slammed for taking an anniversary trip at a place where we're not supposed to have fun and games whether we travel. but did the unit government approve their trip or did they break the law? you may be surprised about what they've been doing since they've been there and how it might help their case. we went out and asked people a simple question:

permission and if they got m permission how they got it. listen. >> if you saw the foot and and the photographs from their visit to could youba, it looked just like what they, what the cuban government said it was. it was a tourist trip where are they were celebrating their wedding anniversary. and there are a lot of better places they could go where they're not feeding a monday trous ra jeenl. because every dollar that is spent there goes to the castro ra jeenl so they can further repress the cuban people. >> are lawyer and comment stater joins us today and he's joined also by a former juvenile court judge. let me begin with you, since we were already talking about cuba, let's digress a little bit. and what can you do legally to go to cuba. when it come does what jay-z and beyoncé are doing there, what might they be doing legally?

what might they have actually secured in order to do what they're doing without breaking the law? >> you know, that's a great question. what we just talked about just a few minutes before is very important here. this cuban embargo is becoming less and less stringent by each administration. specifically, cuban americans are allowed to travel freely. so we have americans that are allowed to go. we also have exceptions for missionaries. we have exceptions for students. so now it becomes a question of well, if some americans can go, what's et problem with other americans going? the rule, remember, is not, there's no prohibition against actually physically traveling to cuba. the prohibition is that you're not allowed to spend u.s. money there. it's almost impossible to do that. that's exactly how odd this embargo has become. it's a vestige not necessarily -- it wasn't borne of human rights problems.

it was borne of money. the cuban administration or the cuban regime sees u.s. aseats in cuba. so this is really an embargo that's about money. however, no one would support this regime. >> we will on the screen while you were laying out that case all the different ways you can legally travel to cuba, and the obama administration recently added these person to person visits. i want to tell you what the office of foreign assets control suggests you have to to. if you're going to go on a person to person visit, and there is some kind of reporting that that's the kind of paperwork that that couple got. stru to have a full time schedule of educational activities that will result in the meaningful interaction between the travelers and cuba. let me tell you what some of the things are on the list of jay-z and beyoncé's day to day activities in cuba. they visited a children's

theater group. they went to the superior art institute. they visited the contemporary dance company. they went to the old city with a top architect as well. and not only that, they, they had a number of interactions with some private musicians as i understand, whether it was in their homes or in private venues, it certainly seemed like that was under the cultural person to person guidelines that they lay out. so you be the judge. >> >> no, i absolutely agree. and i can't nanl people as prominent as jay-z and beyoncé wouldn't have sought some advice on this. and because the obama administration relaxed the restrictions as recently has 2012 and we have these categories of religion and educational exchanges and just to your point of haves delineated these pieces it seems that they've fallen within that

particular category. now really quickly. the thing is that the treasury department has said that they have a policy of not commenting on individuals as to whether they received license or what happened. so it sounds to me that they have a strong case. the penalties, though, on the other hand, up to $250,000 or ten years in prison, i would hope and certainly think that they would have researched this. >> i think i called it the person to person. let me just clarify. it's the people to people. >> people to people. >> but i tell you something i just spotted. there was a story that came across our radar yesterday about a man that was fined $6500 who travelled from mexico on a side visit to cuba. but 6500 bucks. and i'm seeing from the website. if you mess up on your license requirements, if jay-z and beyonce aren't doing what they're supposed to be, you can

face $65,000 for violation. has anyone ever faced that? >> the u.s. government has enforced those things in the past. and the penalty is for spending money. the premise is they're seeking to recover the money that was spent. but it is not based on that. it is a penalty, and it has been enforced. >> that's a heavy-duty vacation. >> let me tell you. thank you both for that. stay with us. we do have a lot more discussion coming up, including the defense in the jodi arias trial saying that the courtroom has now become such a circuit atmosphere. they're blaming the prosecutor for being the ringleader and asking once again to shut this whole thing down. i found out how to help. i downloaded the info. i spoke up... and told my friends... and they told their friends... and together, we made a difference.

the jodi arias murder trial is certainly getting crazy. this is day eight for the domestic violence expert. and the cross examination has been so brutal that alyce laviolette has an ontranl to help her get ready for her testimony in court. a little leak a boxer be being sent into the ring. before she went one more round

with juan martinez, one man was actually giving her a shoulder rub. here's a glimpse of what this was like for her yesterday. >> ma'am, in this case, you actually are biased in favor of the defendant, aren't you? >> do i believe the evidence that supports domestic violence, yes. i think bias is an incorrect word, mr. martinez. >> no. that is the correct word. isn't it true that you are biased in favor of the defendant, yes or no? >> i don't believe i'm biased. you're implying that i think that i'm lying about what i do. and i don't lie about what i do, mr. martinez. >> well, some of the questioning and the way that the questioning has come, not from this man, but from the prosecutor, mr. martinez, is starting to affect the case, so much so that this defense lawyer and his team have filed another motion for a mistrial.

they say they just can't do their jobs properly and they can't give jodi a fair defense because of all the courtroom antics. and that's not all. arias testified that during the killing she had it cliej the up onto some pretty flimsy shoe shelves to grab a gun and fire that gun in self-defense. so the prosecutors sent an investigator there last month to test those very shelves that jodi said with stood all her weight. now jodi's lawyers want that investigation kept out of court. that's another motion. brother' going to continue that coverage shortly. but i want to get you to some breaking news outside of havana cuba. these children who were abducted by their parents ended up in cuba. those are the children. >> patrick, you've narrowed your reporting and your search down

to a marina what have you seen? >> amazingly enough, we ran into the shame boat that this man hunt now has been looking for both in cuba and in the united states and the straits of florida. it's where most foreigners' boths would come into havana. and we drove throughout the entire marina. lots of boats. and there in the last slip of the marina, was the boat, the salty, the same one with the paw prints and the side that is on the hills borrow. site. we started shooting a little bit of video of their boat and could i see on the deck of the boat a small child playing. and while we were shooting, immediately cuban security became aware we were there. told us to stop filming the

security seemed like it was state security with sidearms on them telling us to stop filming. in the middle of this a man it came out, are you josh? and sure looked like josh. and he said yes. and he said who are you. and i told him we were cnn. he wanted to talk to him. he quickly ran to the boat and said i don't want to talk to you. i have nothing to say. got in the boat, security came over to us, told us to stop filming. we asked who this person was. >> they claimed not to know. i said is he under arrest? he's wanted in the united states. he said no, no. they're not under arrest. they let me approach without a camera and there on the deck of the boat was a man who looked like josh. a woman who sure looked like his wife and a small boy playing.

and they had sun glasses on. the man seemed very aggressive, very unhappy that i was there. and i told him why i was there that there was a couple that had fled the tampa area. and he kept saying i don't want to talk. i don't want to talk. the woman said -- i said there's a lot of concern are the boys snok she said yes. i left my card. we were escorted out by cuban security. but it appear ares the mystery of where this couple and their children has been all these days has been solved. we've seen their boat here in havana. >> so to be completely clear you had a direct beat on one child on that boat. there are two boys, aged 2 and 4. i'm not sure how close a look you got. were you able to determine if it was the 2 year old or the 4 year old? >> boy was playing, seemed very

happy. it was a beautiful scene, these were american boats, frankly, that come down and stay at this marina. and they could blend in very well, which may have been -- the only boat that had this kind of security presence harnd them, whether or not they are under arrest, in custody, they're certainly being very, very closely watched by security forces here in cuba. >> the fbi right now is currently assessing the number of american fugitives that are seeking refuge if cuba as right around 70. i want to ask you more about these security officials with sidearms. does their look like this is a braking situation for them as well? or does it look like they know darn well who this family is and that they are in the care and custody of the cubans now? >> it looked like the security officials had been there for

some time, and perhaps that's why they spotted us filming right off the bat. as soon as they were aware we were there they pounced very quickly and wondered kind of who we were. even though we were filming in public places, they told us we couldn't be filming we needed to leave. so it seems like they have a very close eye on their particular boat. there's concern, though, about officials today. there are concerns on the u.s. side about the children's welfare. some people -- the marina is tiny. cuban authorities and american authorities are working very closely to find the boat, but it turns out maybe we've already done that and found the boat in

the marina. >> this is stellar reporting on your part for tracking down that boat and three members of that family that are now officially fugitives of american justice. have you seen, or is it easy to spot any presence from american representatives? at least somebody from the u.s. interest section in havana approaching th approaching the boat? >> diplomats have certain plates. there's black. you can recognize them. i was looking. i didn't see any of those particular plates and identify officials in the marina, and i've b i've been talking to officials throughout the day and as of last night officials tell us they have alerted cuban authorities and are in close contact with cuban authorities.

it appears that the mystery, at least part of the mystery has been clared up. there's a big question now what happens to this family. of course, these crimes are not political. they're not revolutionary. and the government may decide to send them back. but what we're getting so far is that cuban and u.s. authorities are working very, very closely to try to resolve the situation, which is something of a rarity here where certainly these two governments almost never see eye to eye. >> and it just seems like such an odd way to end this journey, or at least thrush from justice to just sort of be sitting on the boat in a marina. does that appear that's where they're staying? that's their home? they're not looking for cover on land anywhere. >> this is it? this is where we're going to stay for now any way. >> they were very much hunkered down in the boat.

the child playing on the boat. it was such a peaceful scene. and if josh hasn't been so aggressive that i was there, you might have easily walked by this boat, but his demean irchanged very quickly when i approached the boat. and certainly, guys running at you, you know, their hands on their sidearms, certainly, is not something you take very lightly here. but the officials realized we were cnn. they told us we can't be there, can't talk to this guy on camera, without ever explaining why, throough. that's the big mystery. they don't appear to be in custody but they don't appear to be roaming around either. >> doing some stunning reporting. i want to clear you and let you continue doing your reporting, patrick and possibly get us some

of the video that you may have been able to shoot before being shut down by the cuban authorities. but confirming for cnn that the family has arrived in cuba, at least three members, not only sharon, but joshua, the parents, allegedly having kidnapped those two children from the maternal grand parents. an incident in a hotel room that involved strangs decklations and weapons and drugs. they found out they lost their parental rights the day before. they allegedly took off on board that boat with those two children. and our patrick altman confirming that one of those children, one of them playing happily on deck in the marina on that sailboat in cuba, while we

wait official word from the u.s. i don't even know where to begin. this is the most unusual circumstance. as you harold, does that sound like they are still on the ground in cuba trying to figure out what to do? >> that sounds like exactly what's going on. i think cuban officials, my guess, are recognizing that this is a highly plit sided issue and they no doubt recall not too long ago the elian gonzales case which in ha way was the reverse of what we're seeing right here. it was a custody type issue involving children and the return of children to the native country. only here, it's reversed. in this case, the parents do not have legal custody of these children. so, in essence, they are in the custody of the state or the guardian, because they've been seized temporarily or permanently, depending on the legal status of the case back home in the united states.

>> can you, can you see -- when you brought up ill yan, and i know that the florida congressman said make no mistake, this is nothing like elian gonzales. it's not even reversal other than just travel direction. she was so adamant about it. but could you see a scenario playing out legally where the cubans might consider extra dieting those children back to their rightful custodians, which are the grandparents, and allowing those parents to stay behind and physically separating a family by law? >> respectfully to the representative, she's correct in that this is vastly different because these parents did not have proper legal custody. but, however, from an international perspective, there's really very little difference because the cuban government can either choose to recognize any of our laws or none of our laws. so in that since it is very much like elian gonzales.

because as a nation we decided that we would honor the laws of cuba that recognizes parental rights. the rye verse is going on leer and cuba will have to make a decision. and it concerns me because they may look at this or frame it in parents having their children taken away from them. this is a country where we will give these people asylum from the evil empire, and of course i'm just rivering on the way they may frame it to their people. so in that sense, because cuba then has the ability to just ignore what the united states demands from it, which may be extradition, that could very much become a highly politicized international issue. and cuba, wisely, is probably putting everyone in custody and figuring out how to proceed from there. >> and i just want to remind people that the custodial parents that weigh are talking about now, the maternal grand parent of these children, patricia howser, that wouldable sharon's mother, was tied up.

and those children were allegedly kidnapped, forcefully from her home last week. you're seeing the picture of that home now on your screen. she is currently at the sheriff's department in tampa. that, that sheriff is the hillsboro county office. i don't now if she knows the news yet. i'm not sure that she knows that at least one of those children has been spotted with those parents by our patrick ottoman here at cnn. i now they're trying to connect with her on that information that we have. you brought up such a great point. recognizing custodial parenthood. when it came to elian gonzales, that's why that child was clearly the cubans will not forget that case.

so if ms. howser wants to make the same case now saying in reverse, send those children back, they technically belong to me, is it thought that the cubans will respond to that? or because we have a new administration or essentially a new administration there it will be apples and oranges? >> well, we have a, when it comes to the guardian asking for the children back, we have a couple different issues here. because there are two kinds of having your children taken away from you. the first is in this case where they saw the children or the parents may not have the present ability to parent, they can put them into a foster home. that doesn't mean the parental rights are per se terminated. the parents have the opportunity to show their best stuff and get the kids back. however, if they're unable to do so the parental rights may be terminated. cuba may look at this, if it's a case of the children were recently taken by the state, recall that the grandmother didn't take them. the state deemed them not safe soe and that their needles were not being met.

so if the cuban government frames this as the american government, and that's what it was. it was police that took those children hay way. if they view that as some kind of opressive event then the cuban government could potentially make this a political issue of the government wrongfully taking away children. it's possible. it's something we need to consider. >> i am going to test your mettle like you've never been tested before. and i apologize for doing this live on television, but do the cubans have the same kind of statute that we have whether it comes to these kinds of domestic issues, family law. is family law pret eye much state to state here in the unit. do we have any idea what they base their statute on? is it common law, british common law, international law? or is it a bit willie nil eye? >> i can't necessarily do the origins of cuban law, but i will tell you that even if they do have law that mirrors our own -- and moist countries have some sort of parental rights and parental take aways if children

are in danger. however, i think the problem in cuba, likely, is administration. they sinlly don't have the infrastructure to necessarily seize all children who are potentially in danger. and candidly, cuba has a different standard, a different definition of children whose, who are not safe and whose needs are not being met. that's continue scli the standard we use here. but here in america, that could be more than three, four kids in a single bed reasonable. in kukba that couldn't possibly be the standard, because it's an impoverished shake and they simply can't have the same standards for children being in danger. so while they may have laws that approximate ours in terms of terminating parental rights certainly in application and in practice think are going to be vastly different to what we are accustomed here in the unit. >> let pea remind our viewers. our patrick ottoman has made a verbal confirmation and eye

witness confirmation that this family that's been on the run for several days now, at least one of those children and those pa parents have been spotted at a marina in havana. they were none too interested in continuing the conversation and our patrick ottoman was canvassed by the authorities in cuba who he so aptly pointed out had sidearms and were asked to back off. but there you have it. on the deck of the boat, patrick saw one of the children playing. did not get a bead on the second child. but in the meantime i want to bring in a former juvenile judge. i want to ask you about the issue of stripping someone of their parental rights. that's what happened in the united states. those two people have been stripped officially of their

parental rights. and her mother, the maternal grandmother now is officially the custodian of those children. look. the cubans may or may not recognize when or when you don't get those rights back. but these people have left the country. they are fugitives from justice. they can't expect to get their american parental rights back now, can they? >> no. and i think most critical piece of this is the fact that these children were taken from their parents. custody was given to the maternal grand parents for very specific reasons. the court determined that these children were at risk, given the problems with the drug abuse, with the allegations that there may be some reference to suicide, that these children are not safe. and i cannot -- and i absolutely hope that through diplomatic

channels, very, very quickly, that they will understand that they need to be back with the custodian, grand parents in this situation, because there was a compelling reason for these children to be taken from their parents. and i work e worry about their . >> the judge mentions the at risk nature of these children. i can only imagine that this won't require protracted dliptic conversations with the cubans to sort this out when you have children who have been deemed at risk. am i wrong? >> i think that that, again, we're talking about an individual, not only an individual country, but an individual state judicial determination that children are at richk. and that dates back not to the fact that they took then on a boat, but that certainly, given the size of the boat could be an argument that they're not safe and their needs are not being met if they're living on a boat of their apparent size.

but it dates back to that incident in the hotel room. and for whatever reason the parents wouldn't understand that the state was having temporary custody or ultimately permanent custody of the children and placing them. and they decided to buck that system. in this case, the cuban government could just as easily potentially, not knowing what they're going to do, they could look at the children and sigh they look happy to us. these are two parents who seem like good parents to us. and they may not, they may choose not to honer a judicial determination. >> i disagree. there is compelling evidence. this is so, so compelling that they cannot look at these parents and make any determination these children are safe, given the history -- not just the fact that three are on ha sailboat, but given how they were taken from the grand parents, given the situation of why the grand parents got custody, i can't see any way the cuban officials could begin to
