york. >> and i'm john berman live in boston. it's monday, april 29th. it's 5:00 a.m. in the east. we're back in boston this monday morning following all the latest developments in the boston marathon bombing investigation. our lead is reconstructing exactly what happened in russia. the fbi is now working with russian security officials to piece together suspected boston bomber tamerlan tsarnaev's every move during his 2011 visit to russia. investigators say they believe the tsarnaev brothers were likely self-radicalized and used the internet to make their bombs, but they are still looking at the possibility that other people in russia or in the u.s. may have been influences or accomplices. among these people, their mother, along with tamerlan's wife, who converted it's to islam when she married him in 2010. the bombing suspect's father

postponed his trip to the united states. he told russian state media he is in the hospital because of a blood pressure spike. two weeks after the boston terror attack, more than two dozen people are still recovering in the hospital. right now officials say dzhokhar tsarnaev is able to speak, he's locked in a 10x10 cell. our pamela brown is live with the latest on the investigation. good morning, pamela. >> reporter: good morning to you. according to a prison hospital official we spoke with, dzhokhar tsarnaev is speaking with hospital officials, we're not sure whether he is speaking with other officials and his attorney, but that does mean his condition has improved. inside these prison walls, bombing suspect dzhokhar

tsarnaev is living in solitude in a 10x10 cell, a slot for food and watched 24 hours a day. the accommodations are spare, a toilet, sink and bed. there is only room for 30 offenders in this special section, and now tsarnaev is one of them. as investigators figure out how and why he allegedly killed out the attacks with his brother, the justice department's role in the investigation has come under intense scrutiny. tsarnaev has stopped given substantive information since being given his miranda rights. in an exclusive interview on saturday night, attorney general eric holder commented on the situation. >> can you comment on tsarnaev's

m miranda rights? >> we had a two-day period we were able to question him under the public safety exception. everything was done appropriately and we got good leads. >> reporter: republican congressman peter king strongly disagreed saying more time to interrogate tsarnaev could have brought forth new critical information to keep america save. >> disgraceful. that interrogation could have ended up saving many american lives. we don't know what the full consequences are. >> reporter: tsarnaev's brother tamerlan and his mother had been listed in a u.s. counterterroism database since russia raised concerns about them in 2011 and intelligence officials told cnn it was within that same year that an official with knowledge of the situation is saying that a communication was intercepted between the mother and one of

their sons discussing jihad. the information came on a wiretap of the mother that the russians turned over only in recent days. vladimir putin acknowledges that the situation could have been handled better. to my great regret we were not able to provide our american colleagues information that would have had operative significance. attorney general eric holder declined to comment on the wiretap. in addition to the terrorism charges tsarnaev faces, he could face more charges soon. a grand jury is being presented with evidence and an indictment will be presented sometime in the next few weeks. that we can expect to see tsarnaev in court. john? >> our thanks to tampa brown in massachusetts where tsarnaev is being held now. we want to go to russia right now. we have new information out of russia. nick what is the latest out of

moscow? >> it is a complex chain of events here, but it leads to a village at dagestan last night where at 5:00 in the morning russian special forces killed two militants they are linked through their own investigations here, tangent links between them and tamerlan tsarnaev. tsarnaev was linked to a man off his youtube page. we don't know if they met, but tamerlan was interested in his activities. that man was killed in december, but in his group are a number of other militants. one of them was killed last night by russian special forces in dagestan. they surrounded the house he was in. there appears to be a standoff and quite a violent end. we know these men were linked, not only have we seen pictures of them hanging out together in the forest, you can see some of these pictures here. we also have seen a police wanted list at a police station in russia showing these men,

showing them as part of the group, all sought by russian authorities. we don't have a direct tie between those men and tsarnaev apart from the link on the youtube page. right now the fbi are hunting people stateside, the fsb, special services here, are hunting down the militants who have some sort of links to tsarnaev. and one of those raids ended deadly early this morning. >> at a minimum, a great deal of activity among the russian special services directed again at this group that tamerlan tsarnaev was interested in here. at least that's where he posted videos, correct? >> absolutely. this is the key thing here. we heard very little information from the russians about what they knew when publicly. they seem to be handling information through closed channels to the fbi. though some suggestions are that this was belated. on the ground now, this may be a

coincidence, a man linked to the militant group who tamerlan tsarnaev was interested enough in to link to on his youtube account. that man was hunted down last night with his accomplices. it is said perhaps he is the brother who took the leadership of this group, a group responsible for some outrageous crimes in southern russia, and he was hunted down early this morning. >> all right. a lot of activity going on. thank you. back here in boston, we're standing in front of the memorial, just two weeks ago this was the finish line of the boston marathon. now this memorial is growing bigger and bigger by the day. more remarkable messages i was reading here this morning. >> it's quite lovely. maybe you can share some of those messages with us later. new this morning a mississippi man due in court today accused of sending letters

to president obama and two others tainted with the deadly poison ricin. 41-year-old james everett dutschke, a martial arts instructor and former political candidate was arrested over the weekend. he is charged with possession and use of a biological agent. dutschke allegedly sent the letters to the president, a local mississippi judge as well sgloch . four people recovering from injuries after a man with a knife charged a church choir in new mexico after its closing hymn. witnesses say the suspect jumped over several pews and started stabbing people. parishioners including the flute player tackled him and held him until police arrived. >> i just dropped my flute, i charged the guy. i got him into a bear hug and pinned him against the wall, but he was much taller than i have. we had one woman, 80 years old, she wouldn't have been able to defend herself. >> 24-year-old lawrence capner

was arrested. he is not a member of the charge. the four people who were stabbed are expected to recover. president obama will nominate charlotte mayor anthony fox to become the next transportation secretary. that's expected later today. foxx's city hosted the democratic national convention last year, and the nomination would make him the only african-american picked for a cabinet spot in the president's second term. a big milestone in new york city today. at noon eastern, the final sections of the spire will be raised to the top of 1 world trade center. once they're installed, the freedom tower will officially become the tallest building in the western hemisphere at 1,776 feet. a proud day for new yorkers and the entire nation after more than six years of construction. only two buildings in the world will stand taller once that spire is in place. the burj khalifa is the tallest,

wife, who converted to islam when she married him in 2010. the bombing suspect's father postponed his trip to the u.s. he told russian media he's in the hospital because of a blood pressure spike. we just got news a few minutes ago that russian special forces have raided a group with possible links to tamerlan tsarnaev. we'll bring you much more on that later. let's go back to new york for some of the other news. a developing and disturbing story. it's a desperate search for the person who stabbed an 8-year-old girl to death. she was discovered saturday by her brother inside their home in the rural community of valley springs, about 60 miles southeast of sacramento, california. leila fowler's mother says the family is devastate. that leila was so full of life and she's pleading that someone turn the killer in. paul vercammen is in valley springs. what is the latest on this investigation? >> right now in this foothill community you have sheriffs

deputies out looking for any clue, trying to solve this mysterious and heartbreaking killing of an 8-year-old girl. it's a rural community on edge. >> they had the helicopters going over our house last night. >> reporter: a place where doors go often unlocked, now bolted shut. >> i'm sure a lot of families last night locked their windows and doors for the first time. >> reporter: a killer is on the loose. the killer of an 8-year-old girl, leila fowler. police say she and her 12-year-old brother were home alone saturday afternoon when he saw an intruder leaving the house. the boy called his parents who called 911. he then found his sister stabbed, severely wounded. she later died. since then, police have been running down leads. they have no specific suspect they are looking for a white or hispanic male, about six feet tall with a muscular build wearing jeans and a dark shirt. he is considered armed and

dangerous. >> we're searching extensvely into attics, storage sheds. it is a difficult area to search. >> there are a lot of empty homes and outbuildings around here. a lot of huge rock croppings where somebody can hide. >> reporter: authorities have combed the home and neighborhood for evidence. >> we did collect some fingerprints during that search. we also collected what we believe to be dna. those prints and that dna will hopefully be processed within the next week. >> reporter: there will be an added police presence today at schools and bus stops in the area. as one resident said, this kind of thing just doesn't happen here. and this little girl would have turned 9 years old in june. >> that breaks your heart for the family and that community. paul vercammen live for us this morning. thank you very much. a developing story this morning in peru. rescue teams searching the coast

for a hot air balloon pilot and a passenger. they have been missing since that balloon plunged into the pacific south of lima. search crews are trying to find the other two. authorities say the balloon was not equipped with life jackets and right now it's not clear why it crashed. the lawyers in the michael jackson wrongful death trial will deliver their opening statements in a few hours from now. the civil suit was brought by jackson's mother and three children. it claims concert promoter aeg live is liable for jackson's death because it hired and supervised dr. conrad murray. murray was convicted of involuntary manslaughter in the criminal trial. the civil try is expected to last three months. there was pain and gain at the box office this week. the mark wahlberg action film debuted at number one, followed by "oblivion" which took in more than $17 million. and "42" came in with $10.7

out, the justice department's role in the investigation is under intense scrutiny. according to sources, tsarnaev stopped giving substantive information since being read his miranda rights last monday. attorney general eric holder says a judge was just following what the law says, but one ropen congressman says we could have learned so much more if interrogators had more time. here's what they had to say. >> can you comment on the suspect being read his miranda rights and whether that was appropriate? >> the decision to mirandaize him is one that the magistrate made. that was consistent with the laws that we have. we had a two-day period that we were able to question him under the public safety exception. everything was done appropriately, we got good leads. >> it's absolutely disgraceful that interrogation could vended up saving many american lives. we don't know what full consequences are going to be. who else is involved, who was involved then. could who could be involved in the future. we may not know because of eric

welcome back to boston, i'm john berman. we're standing in copely square, the site of the memorial for the victims of the boston marathon attacks. about one block away from the finish line. i want to show you something special here what you're looking at there is one of the message boards. you can see every inch of that giant piece of paper is filled with notes, remembrances, people are leaving messages from all around the world. there are four of these giant pieces of paper there now. parks officials told us over the weekend they had to switch these out six times so far. they roll them up, take them away for something special they have planned later on. hundreds and thousands of notes from people all over the world who are really sharing in this incredible experience. it's a very, very special place. we are here in boston, covering the latest developments in the recovery of the city but also

the investigation. let's bring you up to speed on that. we have a new development this morning. we learned that russian special forces raided a militant group with possible links to tamerlan tsarnaev. they took out this man a key part of that group. you can see the building going up in a fireball there. this is part of a special forces raid there by russian authorities this comes as the fbi and russian security officials try to piece together tamerlan tsarnaev's movements during his six-month visit to russia back in 2011. they think he and his brother were self-radicalized watching online videos, but that has not ruled out the possibility that others in the united states or russia may have influenced them or helped them in some way. investigators right now are looking into the mother, they're also still trying to talk to tamerlan's wife, katherine russell who converted to islam when she married tamerlan in 2010. tsarnaev's father has postponed

it is monday, april 29th. it is 6:00 a.m. in the east. we have some brand new developments this morning in the boston marathon bombing investigation. i want you to look at this man right here. a key part of a militant group out of rush that that may have ties to alleged boston bomber tamerlan tsarnaev. today russian forces took him out, bombing this building in dagestan. all this as investigators work to -- actions in russia. the fbi is joining forces with russian security forces to piece together his every move during his six-month visit back in 2011 and even though they don't believe the brothers were self-radicalized online watching videos they're still looking into the possibility that other people in russia or maybe here in the united states may have been influences. among them, people in their inner circle like their mother, and also possibly tamerlan's wife katherine russell who converted to islam when she married tamerlan back in 2010. the bombing suspect's father has

of boston, bombing suspect dzhokhar tsarnaev is living in solitude, in a 10x10 cell equipped with a steel door, and ama window where he's being observed 24 hours a day. the accommodations are bare, limited to a toilet, sink and bed. in a restricted area reserved only for high risk inmates. there's only room for 30 offenders in this special section and now tsarnaev is one of them. as investigators try to figure out how and why he allegedly carried out the attacks with his brother, later killed in a police shoot-out, the justice department's role in the investigation has come under intense scrutiny. tsarnaev has stopped giving substantive information to authorities since being read his miranda rights, sources have indicated. in an exclusive interview with cnn's brianna keilar at the white house correspondents dinner saturday night, attorney general eric holder defended the decision. >> will you comment on the suspect being mirandized and whether that was appropriate? >> well, i mean, the decision to

mirandize him was one that the totally consistent with the laws that we have. we had a two-day period that they were able to question him under the public safety exception so i think everything was done appropriately and we got good leads. >> reporter: republican congressman peter king strongly disagrees, saying more time to interrogate tsarnaev could have brought forth new critical information to keep america safe. >> absolutely critical because that interrogation could have prevented saving many american lives. we don't know what the full consequences are going to be. who else was involved? who was involved then. who could be involved in the future. we may not know because of eric holder. >> tsarnaev's brother tamerlan and his brother had been listed in a u.s. counterterrorism database since russia raised concerns about both of them in 2011 an intelligence official told cnn. it was in that same year an official with knowledge of the investigation is now saying that russia intercepted communication between tamerlan's mother, and one of the two sons discussing

jihad in a conversation described as vague. the information came from a wiretap of the mother the russians have turned over only in recent days. earlier in the week, russia's president, vladimir putin, acknowledged the situation could have been handled better. to my great regret, he said, we were not able to provide our american colleagues with information that would have had operative significance. attorney general eric holder declined to comment on that wiretap. now, in addition to the terrorism charges tsarnaev already faces, he could face more charges soon. a grand jury is looking over evidence, and then an indictment will be presented sometime in the next few weeks after that sometime down the road we'll see tsarnaev in court. john? >> all right, pamela brown our thank you. pamela brown reporting for devens, massachusetts, about 40 miles west of boston where dzhokhar tsarnaev is currently in custody. thanks, pamela. we want to find out more now about that militant group that may have ties to tamerlan

tsarnaev. cnn's nick paton walsh is live in moscow with details for us on this development. really breaking overnight, nick. >> absolutely. the early hours of sunday morning that this raid you're seeing, remarkably violent it appears, was aimed at trying to kill the man. let me wind back a little bit and explain to you why he's significant in the tsarnaev case. he is part of a militant group led by a man called abu dujen, a video of him was by tamerlan tsarnaev on his youtube channel. we don't know if the two men met but it's interesting that this man went. he links the video of him. a member of that militant group, his brother is reported, became the leader of that militant group once abu dujen was killed

the man accused of sending letters to president obama and two others tainted with the deadly poison ricin is due in court today. 41-year-old james everett dutschke, a martial arts instructor and former let cal candidate was arrested over the weekend. he is charged with possession and use of a biological agent. dutschke allegedly sent the tainted letters to the president, mississippi senator roger wicker and also to a local mississippi judge in and four people recovering this morning after a man with a knife charged a church choir in albuquerque during his closing hymn. witnesses say the suspect jumped over several pews yesterday and simply started stabbing people. parishioners, including the flute player, taggled him and held him until police arrived. >> i took my flute and i charged the guy, and i god him into a bear hug and pinned him against the wall. but he was much taller than i am. we had one woman 80 years old, she was unable to defend

one of the tallest in the entire world. zplad you're with us, i'm zoraida sambolin in new york. >> i'm john berman in boston this morning. it is monday, april 29th. about half past the hour right now. we're getting new developments in this investigation. we want to bring you that news right away here. take a look at this man. this picture about to show you is reportedly a key part of a militant group based in russia. this group may have ties to alleged boston bomber tamerlan tsarnaev. and we're about to show you some video here, dramatic video that shows russian special forces bombing the building in dagestan where that group was hiding out. we are just getting that video now and the raid as the fbi joined forces with russian security to figure out where tamerlan tsarnaev's every move may have been during a six-month visit to russia back in 2011. even though they believe the brothers were self-radicalized online watching videos, they're

still looking into the possibility that other people in russia or the united states may have been influences. among the people they're looking into the mother of the tsarnaev brothers, also tamerlan's wife katherine russell who converted to islam when she married tamerlan in 2010. we've also learned that the tsarnaev's father has postponed his trip to the united states. he told russian state media that he's in the hospital because his blood pressure spiked. it has been two weeks since the boston terror attack, and two weeks to the day after the marathon, two dozen people are still in the hospital today recovering. right now this morning there are also new developments inside the prison hospital where 19-year-old bombing suspect dzhokhar tsarnaev is being held. he's locked up in a tiny 10x10 foot cell about 40 miles west of boston. pamela brown is there live in devens, massachusetts, with the latest on the investigation there. good morning, pamela. >> good morning to you, john.

19-year-old dzhokhar tsarnaev arrived here at federal medical centerevens early friday morning and we have learned from prison officials he is now talking and interacting with medical staff here. he is currently living in solitude in a 10x10 foot cell that is tucked away in a restricted area of this facility reserved only for high risk inmates. he's being observed through video surveillance 24 hours a day. accommodations are spare, with only a toilet, sink and bed within his cell. a slot for food and a small window as authorities investigate how and why the attacks were carried out the justice department's role in this investigation is under intense scrutiny. according to sources tsarnaev has stopped giving substantive information ever since being read his miranda rights last monday. attorney general eric holder said a judge was following what the law says but one republican congressman says we could have learned so much more if interrogators had more time. let's take a listen. can you comment on the suspect

being mirandized and whether that was appropriate? >> well, i mean the decision to mirandize him was one that t the -- and that was totally consistent with the laws that we have. we had a two-day period that we were able to question him under the public safety exception so i think everything was done appropriately and we got good leads. >> this is absolutely disgraceful, because that interrogation could have ended up saving many other american lives. we don't know what the full consequences are going to be. who else is involved. who was involved then, who could be involved in the future. we may not know because of eric holder. >> now, even though we know tsarnaev is now speaking and interacting with medical staff here, what we don't know is whether he's talking with investigators. prison officials won't tell us that. but now that he has representation, sources say that is highly unlikely. john? >> all right. pamela brown in devens, massachusetts. thanks so much, pamela. of course the investigation

continues in devens, in boston where i am, and on the other side of the world in russia. let's bring all these threats together right now and bring in cnn law enforcement analyst tom fuentes, former assistant director of the fbi. tom, i want to start with this development we're just learning about overnight, russian special for forces raiding a militant group in dagestan with possible connections to tamerlan tsarnaev. at a minimum we know that tamerlan had videos of this group on his youtube channel. what do you make of this development? >> i think it shows that the russians all along have been looking at that group very closely. they were monitoring tamerlan's mother going back to 2011 and the initial request of the fbi may have been not the russian's way of alerting the u.s., but the u.s. may be attacked but maybe wanting background done on tammer lab to see if he was going to make a link or connection to the group in dagestan, and attack russia. and that that may have been their focus so that when the fbi

investigates there, and finds no u.s. connection to anybody that looks like they're related to terrorism, or possibly fund-raising or the dagestani groups or any of that, that the fbi sends that to them and they figure okay, they're satisfied with that. meantime they're monitoring this group and his mother so you would think they would be well aware of his travel when he goes there. and so monitor his movement, who he meets with, and what he does the whole time he's there. >> let's keep the focus on russia for a minute. a group of runners is passing behind me at the memorial site. with the focus on russia we got this news over the weekend that the russians intercepted phone calls between the tsarnaevs' mother and tamerlan tsarnaev and another source where they were talking about jihad, and -- how effective or how useful would that information have been to the fbi if they had been told back in 2011? >> well, many aspects of that would have been very useful.

first the fact that they had a wiretap covering the mother in the first place would have alerted the fbi that there's much more of a serious connection here than just hearing a rumor on the street that he might be becoming radicalized. and i think that it would have led the fbi early on to say what more do you know? i mean they did request twice additional information before closing the investigation here. but, toy probably would have pursued that a little more strongly saying wait a minute, you know more than you're telling us. you know, they're now telling us this information in the past week. not two years ago when it really could have been useful. >> what possible motivation could the russians have had not to provide that information, if so basic? >> well, i think, as i said i think the motivation may have been they're only concerned about russia, that they didn't see him as a threat to the u.s. that they saw him as possibly with u.s. connections, maybe he's raising money for the group in dagestan or other support, and the threat was that he would

go to dagestan, get with that group, and maybe attack russia. i think their whole concern from the beginning has been to protect russia. and didn't see him because members of these groups have not come to the u.s., ever, in the past couple of decades of this whole battle between russia and chechen militants. so i think that was probably their thinking. we're guessing at this point. we don't know exactly what they knew, and what they were thinking at the time. >> we are guessing. but it does seem like a missed opportunity. tom fuentes, cnn law enforcement analyst, thanks so much for being with us this morning. let's go back to zoraida in new york for more of the day's other news. >> good morning, john. it's 38 minutes past the hour. we're following a developing story in northern california where police are investigating the stabbing death of an 8-year-old girl. leila fowler was discovered on saturday by her 12-year-old brother inside their home, in the rural community of valley springs. that's about 60 miles southeast of sacramento. investigators say the parents

were not home at the time, and police do not have a specific suspect. but they collected fingerprints and dna from inside the house and say they are looking for a white or hispanic male, who's considered armed and dangerous. >> our searching, you know, extensively into attics and storage sheds. it is a difficult area to search. it's rural, remote. the grass is tall right now. >> police say the dna evidence that they collected will take about a week to process. and leila's mother released a statement saying, quote, we are devastated. if someone is helping hide him, turn him in. look at our baby girl. she didn't deserve this. she came from a large family with many siblings, she loved her daddy more than anything in this world. she would joke that she would only be allowed to date when her daddy was dead. she was so full of life. she want everyone to remember the good in her, and not how she was taken from us. if you have any information on this case you are urged to call police. 39 minutes past the hour here.

death trial pitting jackson's family against concert promoter aeg live set to begin in just a few hours from now. jackson's family claims aeg is liable for his death. billions of dollars are at stake here and the potential witness list is star studded is, we understand. cnn's casey wian is live outside the courthouse in downtown los angeles. what can you tell us? >> well, zoraida, as you mention, we're expected to hear opening statements this morning, first this morning from attorneys representing michael jackson's family. then from attorneys representing the giant entertainment real estate and sports conglomerate aeg live. the key question in this case is who actually employed dr. conrad murray, the physician who was convicted of manslaughter in michael jackson's death. michael jackson was in the last weeks of rehearsal for what was to be his grand comeback. the exhausted 50-year-old insomniac died in 2009 from an

overdose ofdis and the surgical anesthetic propofol. dr. conrad murray was convicted of involuntary manslaughter for giving jackson the fatal dose in an effort to help him sleep. he's in prison. now the company that promoted the comeback tour, aeg live, is fighting legal claims by jackson's mother and children that it shares responsibility for the singer's death because it hired and supervised murray. >> what do you think, as his mother, caused his depth? >> i don't know. all i know is that they used propofol, and they shouldn't have used it, and they used it in the wrong setting. that's all i know. and that's what caused his death. >> the gist of the plaintiff's claim against aeg is that you controlled dr. murray and you used your control over dr. murray to pressure him into taking unnecessary and excessive risk with his patient, michael jackson, leading to michael

welcome back, everyone. i'm john berman live in boston this morning. i'm standing in copley square, the site of the memorial for the victims of the boston marathon bombings. we've been here all morning. when you come out as early as we do you see really interesting things. i want to show you this picture we took from a little while ago. this is a truck that we saw a short while ago that was delivering flowers here. this is a truck full of flowers. now, this is two weeks since the bombings here in boston. and this truck from the boston public works department arrived here a short while ago, and these men they brought out these bouquets of flowers, that have been piling up at different sites around the city for the victims of this blast. and they're so carefully placing them and keeping this a beautiful, beautiful site. again two weeks since the bombing and we're covering every development in the investigation. there were some new developments
