new this morning, we're talking about the stunning revelation by one of hollywood's biggest stars. oscar winning actress angelina jolie revealing she's had a preventative double mastectomy. she carries a jean that dramatically increases her risk for breast and ovarian cancer. this is a lot more about hollywood and celebrity. it's also about medical decisions faced by millions of women. michelle turner is following developments for us this morning. this really surprised a lot of people overnight. >> absolutely, john. it did. you know, angelina decided to write this op-ed for "the new york times" talking about her procedure and talking about her journey to enlighten other women. she said her mother died of ovarian cancer in 2007 when she was just 56 years old. she battled it for ten years. angelina says she was screened. she found out she carries a faulty gene this gene called the bcra-1. after her diagnosis, her doctors

estimated she was at a very high risk of getting cancer. here's what she wrote in the op-ed. my doctors estimated i had an 87% risk of breast cancer and auto% risk of ovarian cancer. i decided to be pro active and minimize the risk as much as i could. i made a decision to have a preventative double mastectomy. she had the first par 4 on january 2nd. it rules out the disease in the area behind the nipple and also browse more blood flow to the area. this is painful. it causes bruising and increases the chance to save the nipple. two weeks later she had the major surgery where the breast surgery is removed and then temporary fillers are put in place and then she had the final surgery, reconstruction of the breasts and adding an implant. she was really descriptive. she opened up when talking about this. basically, she said like i was mentioning, she wants other

women to know about their options when they have to make a decision like this. >> there in a very personal way, michelle. obviously, as you said, angelina's mother died of ovarian cancer. that had to be an influence here. >> you know, angelina always talks very openly about how close of a relationship she had with her mother. also her father is jon voight, not as close with him. but she also -- she always talked about how strong her mother was and how much she loved her and how great of a relationship there was. in fact, she talked a little bit about it back in 2011 after her mother -- a few years after her mother passed. here's what she had to say about her mother. >> my mother was a full time mother. she didn't have much of her own career, her own life, her own experiences, her own, you know, everything was for her children. i'll never be as good a mother as she was. i would try my best. i don't think i could ever be. she was just grace. she was the most generous,

loving -- she's better than me. >> an emotional angelina jolie, also something we don't see very often. now, john, list wanted to mention she is getting very personal herement she's not the first celebrity to make this decision. christina applegate did the same thing in 2008. she also found out she had this faulty gene. and so she decided to have a preventative double mastectomy as well. >> i mention this is a decision maced by millions of women in this country. it's families also. of course, angelina jolie's family includes brad pitt. >> yeah. yeah, her fiance, brad pitt. she talked about him in this op-ed piece and she's fortunate to have a partner, brad pitt, who so loving and supportive. he was at the breast center where she was treated every minute of the surgery. we managed to find moments to

laugh together. we knew this was the right thing to do for our family and it would bring us closer. that, again, was angelina joe lee and "the new york times" op-ed times. >> a lot of people talking about this this morning. >> one of the things i love she does is brings attention to the genetic testing. it costs $3,000 in order to have that done. it's not always covered by insurance companies. to hopefully something will come out of that. >> that's right. this is the key part of the health care debate. >> yes, it is. it is five minutes past the hour. we're getting a chilling new look into the backyard of ariel castro. photographs taken by a neighbor and obtained by cnn revealing a pink barbie bicycle in the midst of very disturbing evidence. pam brown live from cleveland this morning. what else is there, pam? >> well, right now ariel castro's house is all boarded up. it's a crime scene. but one of the neighbors was able to say pictures that he

exclusively gave to cnn. these pictures give possible insight into what went on in the house of horrors and how castro was able to keep an eye out for unexpected visitors. >> chilling new photos give us a glimpse of ariel castro's backyard taken over the weekend by a neighbor. the backyard resembling a junk yard, spools of barb wire and chains. he saw hundreds of thick, heavy chains in the yard. and then this mirror hanging on castro's become door that may have allowed him to see if someone was coming up his driveway, possibly using it to prevent any surprise visitors. and finally, a pink barbie bicycle for a little girl. a bicycle that may have belonged to amanda berry's daughter, fathered by ariel castro. moments after this cell phone video was shot of amanda berry's rescue. >> we have ariel castro in custody down here at mcdonald's.

>> just released police dispatch reporting. and we're learning more about him from six different police reports filed about castro since 1989 when he had an argument with his wife in which he allegedly slapped her across the face several times, grabbed her and slammed her against the wall. in 1994, a neighbor claimed castro attempted to hit him with a shovel and threatened he was going to take care of him in arguing over a chainlink fence. castro remains jailed on suicide precaution, being monitored every ten minutes by guards. locked up in solitude, receiving no visitors, no friends, no family, no mail much the life in those respect not unlike what dejesus, knight, berry and her daughter endured for years. and castro has only received professional visits from his attorneys. that's according to the sheriff's office. he remains on restriction which is reserved for high profile

inmates. evidence is still being vekted in this investigation. an medical examiner was taking panoramic pictures inside the rooms. once all the evidence is xlekted a grand jury will look at that evidence and decide what other charges castro should face. >> i got to tell you, pam, the more we lrearn, the more we wonder if something was missed along the way. big questions, is the government trying to intimidate reporters infringing on the freedom of the press. the ap is threating action for intrusion by the justice department. the claim that the government was snooping on the news organization's editors and reporters. our brian todd is following the story for us. >> reporter: the associated press said the justice department secretly obtained two months of telephone records, of reporters and editors for the ap, records listed incoming and outgoing calls, the duration of

each call and the work and personal phone numbers of ap employees according to that news agency. they recovered numbers for the new york, washington and hartford offices and the main number for ap reporters in the house of representatives press gallery. the justice department notified them of the seizure on friday, the tenth. now there is nothing to suggest actual phone conversations were monitored. the ceo of ap is furious and he let the justice department know it. gary pruitt in a letter to eric holder says these records reveal communications with confidential sources across all of the news gathering activities undertaken by the ap during a two-month period. provide a rod map to the news gajing operations and disclose information about ap's activities and operation that's the government has no right to know. now pruitt wants justice to return all of those records and destroy the copies. on monday afternoon we got this response from the u.s.

attorney's office, "regulations require us to make every reasonable effort to obtain information through alternative means before even considering a subpoena for the phone records of a member of the media. the american civil liberties union criticized the move as did chairman darrell isa. >> they had an obligation to look for every other way to get it before they, in fact, intruded on the freedom of press. >> reporter: so what is this specifically about and why would the justice department sought the phone records? ap says government officials have said in public testimony that the u.s. attorneys office is conducting a criminal investigation into who may have leaked information obtained in an ap story from a year ago this month about a foiled terror plot. that story disclosed details of a cia operation in yemen that stopped an al qaeda plot to detonate a bomb on an airplane. brian todd, cnn, washington. new details emerging about the 1-year-old brother of leila fowler who is under the arrest

for the fatal stabbing of his sister. a student in a school administration source say the boy was suspended from his middle school for five days earlier this year after he brought a small pocket knife to school. the boy is not being named because he is a minor. he is being held at a juvenile detention center. because of his age, he cannot be tried as an adult in california. >> a suspect identified in the mother's day parade shooting in new orleans. police trying to find him. they're search for 19-year-old akine scott. 19 people wounded, three critically. still not clear if there was more than one shooter. authorities are offering a $10,000 reward in this case. new this morning, three boats carrying up to 150 muslim refugees capsizing off the coast of myanmar. search and rescue operations are under way at this hour and a spokeswoman says the boats may have hit some rocks. also last night, bruins won

mastectomy because she carried a gene that increases her risk for breast answer ovarian cancers. the surgery has dramatically cut her breast cancer risk from 87% to under 5%. now michelle turner is following all of the developments live from los angeles. angelina says she finished her three-month treatment late last may. why did she decide to reveal all of this now, misch snell. >> that's a good question. basically, she said because she wants other women who have to make a tough decision to know that they have options out there. yeah, she said april 27th was her last treatment. that's when she had complete reconstruction of the breast and had implants put in. but she did go through this entire journey which she does lay out in this "new york times" op-ed piece. it was really personal, raw. she really went into detail about the decision to make and it's because she was screened and she found out that she carries this faulty gene, brca.

after getting this diagnosis, she was told by doctors she had an 87% risk of getting breast cancer and a 50% risk of ovarian cancer. that's why she decided to have the double mastectomy. she also wrote in the piece that she chose not -- she says, i chose not to keep my story private because there are many women who do not know they might be living under the shadow of cancer. it is my hope that they, too, will be able to get gene tested and if they have a high risk, they, too, will know they have strong options. >> you know, she specifically does talk about that gene testing which is a very expensive test. it's $3,000 and the fact that insurance companies don't always cover it unless you have a really strong history of breast cancer in your family. it will be interesting to see if something positive comes out of this with that screening. all right. so what has the reaction been like from hollywood? >> well, it's early out here in los angeles. people are already, celebrities already taking to at which timer

to offer their support for angelina jolie. a moment of quiet respect forng. juliana was diagnosed with breast cancer and had a mastectomy and she says proud of her for using her incredible platform to educate women. lots of other people starting to react as well. >> i was recently diagnosed with breast cancer. i got to tell you, the fact that she is sharing this very personal journey, talking about the femininity as well and how that affects your decision moving forward is really absolutely remarkable. i'm going give her kudos this morning as well. thank you for bringing us that story. >> i'm bringing you kudos. i'm giving you kudos and sending you so much love. >> thank you, girl. i appreciate it. thank you.

>> you're going to kick its butt. >> yes, i am. thank you. >> yes, you are. 33 minutes after the hour. we're going to first look into the backyard of a house of horrors this morning. these photos taken by a neighbor last weekend show piles debris behind the home of ariel castro including barb wire chains, a barbie bike right there. and a mirror installed on the back porch apparently to detect any visitors coming down the driveway. chilling. right now castro was on suicide watch, jail logs reveal he likes to walk around his cell naked. he frequently makes himself cool aid and he is using strings from the floor mat to floss his teeth. he is being checked by guards about every ten minutes. and the more we hear, the crazier it gets, right? 34 minutes past the hourment we're learning more this morning about the brother of leila fowler who is under arrest in the stabbing death of his 8-year-old sister. a fellow student and a school

administration source say the 12-year-old boy was suspended for five days earlier this year after bringing a pocket knife to school. cnn's dan simon is live in valley springs, california, with the latest on this investigation. what else do you know, dan? >> good morning. the fact that the suspect brought a knife to school and was suspended is note worthy given the fact that he's accused of using one to stab his sister. we're getting a better sense of what the suspect may face in the months ahead. >> reporter: chris piper knows the 12-year-old suspect from gym class. you say he made threats to you and others? >> yeah. roip can you tell me about the threats? >> he'd say like i'll stab if you don't -- he said he would stab us. >> reporter: he called the threats lighthearted but told us of an incident when the 1-year-old brought a knife to school. did you see the knife? >> yeah. >> reporter: did he show it to

friends and classmates? >> he showed it to kids. >> reporter: was it a swiss army knife? >> yeah. >> reporter: what happened? >> he was showing it to people and so then he gave it to -- someone told on him and he went it the office. >> reporter: it landed him a five-day you is spengs. the boy seen here at a candlelight vigil days after the killing had some people suspicious at the outset. >> we kept kind of behind closed doors as saying, you know, we thought it was him. >> reporter: the young boy told investigators an intruder stabbed his 8-year-old sister while his parents were at a little league baseball game. her daughter also knows the suspect from school. she thought it seemed strange the killer would only hargt leila and spare the brother's life. >> you don't kill a person and then leave a witness, you know? and that's why we kept saying that, you know, they're not going to leave him alive if there was somebody else that did it. he witnessed this guy. so in my heart, i thought it was him from get go. >> reporter: the boy is

currently being held at a juvenile detention center. >> because the child in this particular case is 12 years of age, he cannot be tried as an adult. if he was 14 years of age or older, of course, and because of the allegations that will be raised here, he could have been tried as an adult. >> reporter: this attorney has represented minors in cases involving serious crimes. >> these proceedings are going to take place behind closed doors. this isn't going to be an open trial like it would be if he was an adult. in this case, the public is not going to be allowed into the proceedings. >> reporter: well, if the 12-year-old is charged and convicted of murder, the law here in california is that he would be in custody until the age of 25. at this point we still don't know what the evidence is and the boy's father told the associated press that he believes his son is innocent until he sees evidence that

proves otherwise. >> dan, i just want to clear something up. did the police take knives from the house in order to test those to see if those were the ones that were used? >> reporter: there are reports that knives were taken from the house. also dna evidence collected. we don't know the results of those tests. we don't know, you know, if, in fact, one of those knives actually goes back to the suspect or links him to the suspect. >> all right. dan simon reporting live for us. thank you very much. o.j. simpson telling his legal rengs in 200 # was a far cry from the dream keep of cochran and company. he claims they botched the case that sent him to prison for murder ashgs sault and kidnapping. now he is asking for a new trial. this time, he is set to testify. that could be something. we have the story live from las vegas this morning. good morning, paul. >> reporter: good morning, john. o.j. came into court, it wasn't exactly a grand entrance. you can see what seemed to be

4 1/2 years of strain in prison show on his face. heavier and grayer, zrased football legend stepped into a las vegas courtroom after 4 1/2 years in prison for kidnapping, assault, and armed robbery. the new simpson legal team is presenting 19 claims they say showed he was so poorly represented in the 2008 kidnap trial that he should get a new trial. new lead attorney patricia palm argues simpson was never told about an offered plea deal and should have taken the witness stand. emphatically told the court monday he wanted simpson to testify then. >> o.j. is a very he will consequent person. and he can explain himself very well. and so i thought he would be a great witness. >> reporter: simpson's lawyers tried to show the former heisman trophy win her been drinking

alcohol which impaired him from seeing his cohorts carry guns into the confrontation. the new simpson team argues that he knew about simpson's plans to get back some of his memorabilia. simpson's daughter took the stand saying she was with her father and galanter at dinner the night before the incident. >> was your dad drinking alcohol that evening? >> yes. >> do you recall overhearing any conversation about your dad's plan to go look at his property the next day? >> yeah. >> and who did you hear talking about that? >> mr. my dad was talking to you. >> simpson is waiting to testify in this hearing. >> this will be his first time to be able to tell what happened and, you know, instead of hearing it in bits and pieces and, you have to remember the evidence in this case was extremely conflicting from all the witnesses. >> simpson may take the stand as soon as wednesday. and 19 claims, the judge has to

welcome back to "early start." there may not be a more hated man in america than boston marathon bombing suspect dzhokhar tsarnaev. since his arrest, countless women have been publicly professing love and their support for the terror suspect. they're doing this online. it is not the first time we've seen this infatuation with a

notorious criminal. disturbing trend or teenage attraction, a startling number of followers are tweeting out their love and support of dzhokhar tsarnaev, the surviving imprisoned boston bombing suspect. here's a sampling of tweets. dear god, make me a bird so i can fly to dzhokhar when he is looking out the window and stay there to give him comfort. but our love is like wind. i can't see it but i can't feel it. one admirer tweeted out she is getting a tattoo. nobody understands why i want this tattoo. i'll get people's attention. then maybe people can open up their eyes to what is happening. >> a lot of that has to do with the way that he looks. he's considered to be very handsome, very cute by girls. and what's really disturbing is that they see him as this very innocent individual. though at the same time, being sort of dangerous. >> reporter: this attraction to notorious criminals had as a

you probably had to grab a coat when you came into work this morning. temperatures once again are dropping down into the 30s. even some locations down in the 20s. we're talking for areas like new jersey, massachusetts, and well into new york. now it looks like by tomorrow we're going to start to see warmer temperatures working in. i don't expect to see all the freeze warnings and watches in place. notice out there we have 31 degrees. a lot of the interior regions are going to be coldest. the warm air you're seeing towards the west, it is going to be making its way over to the east from parts of the northeast as well as new england. but there is sort of a bad side to that. we'll get to it in just a moment. we want to show you the temperatures. these temperatures for today are running roughly about 20 degrees above average, 87 for kansas city. minneapolis, you're actually going to be warmer than dallas. and this warm air is having an effect. let's go to video and take a look and listen to this video coming in. what you're seeing is actually a

actress angelina jolie making a stunning revelation that she has had both her breasts removed. chains, barbed wire, and a barbie bicycle. disturbing and revealing new images from kidnap and rape suspect ariel castro's backyard. and devastating developments in the stabbing death of 8-year-old leila fowler. new information about her brother's troubled past as he faces a murder charge now. good morning, everyone. welcome to "early start" i'm john berman. >> and i'm zoraida sambolin. tuesday, may 14th. 6:00 a.m. in the east. new this morning, it's a stunning revelation by angelina jolie, one of hollywood's biggest stars, that she's had a preventive double mastectomy because she carries a gene, the bracca gene, that dramatically increases her risk for breast and ovarian cancers. she talks about the entire process in a very candid new op-ed. nischelle turner is live with details from los angeles. nischelle, everybody is really shocked, and i would imagine rallying around this very brave woman. >> exactly.

shocked and supportive this morning of angelina's words in "the new york times" op-ed. you're right, she got very raw, very candid, went in to depth about her journey and what she's been facing over the last few weeks. actress, activist, advocate, mother, angelina jolie is many things, and tuesday the actress added pro-active survivor to the list. in an op-ed piece for "the new york times" the actress talked about her decision to undergo a preventive double mastectomy after testing passive for brca-1, a gene that increases a woman's risk of certain cancers. jolie writes, joet, my doctors estimated that i had an 87% risk of breast cancer and a 50% risk of ovarian cancer. >> you guys look awesome tonight. >> reporter: the oscar winner began her preventive process in february, at the pink lotus breast center in beverly hills where singer sheryl crow was treated for her breast cancer in 2006. now, nine weeks later, she says the final surgery has been

completed. and her breasts have been reconstructed with implants. cancer is something jolie knows only too well. her mother died six years ago after a decade-long battle with ovarian cancer. she was 56. jolie talked about her in a 2011 "60 minutes" interview. >> she didn't have much of her own career, her own life, her own experiences, her own, you know, everything was for her children. i will never be as good a mother as she is. i will try my best. >> reporter: at 37, jolie doesn't want the same legacy for her six children, writing, quote, i can tell my children that they don't need to fear they will lose me to breast cancer. jolie says she wrote "the new york times" op-ed to tell other women that the decision to have a mastectomy was not easy. but it is one i am very happy that i made. adding, she chose not to keep her story private to let other women know they have options if they, too, are high risk. it's a bold and public step from a woman who is well-known for

her privacy. she also talks about how she does not feel any less of a woman, or feel any less feminine by making the decision to have her breasts removed, which we do know is a very big decision for a lot of women facing this same situation. zoraida? >> you know, i am facing a double mastectomy. i'm going to have it on the 28th. i got diagnosed with breast cancer. i'll tell you that's the toughest decision for me. i'm really excited that she's talking about it. she said i feel empowered that i'm in a strong choice that in no way diminishes my femininity. it's nice to hear somebody else talk about it and have that support of a lot of women around you. the last time we saw jolie was on the red carpet months ago. my big question, i guess, did we see her covered up after the surgery? do we know anything about how she recovered from it? >> it's interesting. first of all, let me say we are all so supportive of you and i'm glad you're being able to talk about it, as well. >> i know. thank you. >> we give you so much love. you're going to kick cancer. >> yes, i am.

>> we saw angelina jolie just a few weeks ago. you know, we hadn't seen much of her in the public for awhile. but on either april 4th or 5th she did attend a woman in the world summit and she had on this green, flowy saint laurent gown and i remember people at the time commenting how covered up it was. it was very demure. and we know now, since she said the last treatment she had was on april 27th, that's when she had the total reconstruction of the breast, that she was in the middle of this procedure. which she was on the red carpet. so that definitely could be a reason why she still looked beautiful, believe me, but it was a very different angelina jolie that we saw. >> it's a very long process. that you have to go through. and i'm so grateful that you're bringing us this story this morning. nischelle turner live from los angeles. thank you. >> you know, talking about it obviously so important. i think your openness has made it easier to talk about and digest for everyone around here, including me.

i think angelina jolie's talking about it is going to be something that affects millions of people around the country. and a lot of people are asking questions today. one of the big questions is, you know, who should get screened, when should you get screened, what are the issues here? our senior medical correspondent elizabeth cohen joins us from atlanta to talk more about this cancer gene and the tests that angelina jolie took. >> right, because when you hear this story, you think gee if angelina jolie got tested maybe i should get tested. let me explain sort of what doctors recommend. if you have breast cancer in your family, talk to your doctor about whether you should get this test or not. it depends, you know, sometimes just even just your mother had it you should get tested. other doctors will say your mother and a couple sisters or an aunt or first degree relative versus farther away relatives like an aunt or a grandmother it all depends on your individual situation. but this is not a test that everyone needs to run out and get. if you don't have breast cancer in your family, it's not a test that you need to run out and

get. but, if you do, as we've seen with angelina jolie, it can make a huge difference. you can do something. you have this gene that gives you a really, really high chance of getting breast cancer in your lifetile, you can do something about it. you can get your breasts removed, and reconstructed. john? >> so explain to me, elizabeth, how the mastectomy process works. is it a sure way to get rid of all the risk? >> you know, it's interesting. because angelina jolie says she now has a 5% chance of getting breast cancer. it's not zero. it's 5. and so, there's still a chance. they don't take absolutely everything. so you still could get breast cancer. but still 5% is really, really low, compared to, for her, it was 87% chance. so that's a drastic difference. >> and one other thing we wanted to discuss, elizabeth, is this 50% risk that she has of getting ovarian cancer, a lot of times a lot of women have chosen when they do have this brca gene they get the double mastectomy and remove their oaf veries, as well. do you think that that will be

another option for her, what other treatments are available? >> well, it could be. when you read her piece in the "times" she sort of leaves that open. she said she wanted to do this first, since the risk was higher for breast cancer. but she leaves it open whether she's going to get her ovaries removed, as well. in some ways getting your ovaries removed is a bigger deal because it puts you into menopause. and so you've got this whole hormonal situation to deal with, as well. so it may be that she just, you know, you're not going to do both right at the same time. it may be something that she's putting off for another time. but that is the cancer her mother died of, ovarian cancer, so i imagine that it's really weigh -- >> weighing on her. >> absolutely. >> she loves a big family so you've got to feel for her making that major decision. that incredible team has helped me deal with my stuff, as well. so thank you, elizabeth cohen. they've been really great with me. it's like all this research right in your own home. >> well, we love you and we want you to -- you're going to do so well. >> i'm going to be great. >> you're going to be great.

>> thank you so much, elizabeth. i just want to stress once again that talking about this is not easy for a lot of people. i think probably men more so than women in some cases. but talking about it is crucial and could save so many lives. >> yeah, it can. it can. thank you. all right we're getting a disturbing new look into the backyard of cleveland kidnapping suspect ariel castro. photographs snapped by a neighbor last weekend and now obtained by cnn revealing horrifying evidence of torture, and abuse. along with a pink barbie bicycle back there, as well. pam brown is live from cleveland this morning. kind of surprising that all these things were in his backyard? >> that's right, zoraida. you see the front of his house, is a crime scene. it's boarded up. and then the backyard is full of dingy items. full of debris and junk and in it, there are items like chains and barbed wires, and these items are giving us clues into possibly what went on inside the house of horrors, and how ariel

castro kept an eye out for unexpected visitors. chilling new photos give us a glimpse of ariel castro's backyard, taken over the weekend by a neighbor. the backyard resembling a junk yard, spools of barbed wire, and probably the most unnerving, chains. the neighbor said he saw hundreds of thick, heavy chains in the yard. and then this mirror, hanging on castro's back door that may have allowed him to see if someone was coming up his driveway. possibly using it to prevent any surprise visitors. and finally, a pink barbie bicycle, fit for a little girl. a bicycle that may have belonged to amanda berry's daughter, fathered by ariel castro. and moments after this cell phone video was shot of amanda berry's rescue -- >> we've got own l castro and ariel castro in custody down here at mcdonald's. >> reporter: just released police dispatch reporting that revealed the arrest of ariel castro. and we're now learning more

about him. from six different police reports filed about castro since 1989. he had an argument with his wife in which she allegedly, quote, slapped her across the face several times, grabbed her and slammed her against the walls. 1994 a neighbor claimed castro attempted to hit him with a shovel, and threatened that he was going to take care of him. when arguing over a chain link fence. castro remains jailed on suicide precaution, being monitored every ten minutes by guards. locked up in solitude, receiving no visitors, no friends, no family, no mail. life in those respects not unlike what dejesus, knight berry and her daughter endured for years. as we have learned from the sheriff's office, that castro has only received professional visits from his attorneys. he remains on restriction, which is reserved only for high profile inmates. that means he cannot interact with other inmates in jail. evidence is still being collected in this investigation. the medical examiner's office

was at his house yesterday taking panoramicde all of the rooms, as the evidence is being collected a grand jury will decide what other charges he should face. >> and all sorts of bizarre behavior from him as he's behind bars. we understand that he's walking around naked, that he's using remnants from a carpet to floss his teeth. just totally bizarre. pamela brown we appreciate your live report today from cleveland. 12 minutes after the hour. new information this morning about the 12-year-old brother of leila fowler, who is now under arrest for the stabbing death of his sister. a fellow student and a school administration source say the boy was suspended for five days earlier this year after he brought a small pocket knife to school. the boy is not being named because he's a minor. he's now being held at a juvenile detention center and legal experts say because of his age, he cannot be tried as an adult in california. police in new orleans targeting a suspect in the mother's day parade shooting that wounded 19 people. they're telling 19-year-old

new this morning, is the government, our government, trying to intimidate reporters? infringing on freedom of the press. the associated press is threatening legal action for what it calls a massive and unprecedented intrusion by the justice department. the claim that the government was snooping on the news organization. our brian todd is following this story. >> reporter: the associated press said the justice department secretly obtained two months of telephone records, of reporters and editors for the ap, records listed incoming and outgoing calls, the duration of each call and the work and personal phone numbers of ap employees, according to that news agency. ap says the seizure covered numbers for its employees in the new york, washington, and hartford, connecticut, offices and the main number for ap

reporters in the house of representatives press gallery. ap says the justice department notified them of the seizure on friday, the 10th. now there is nothing to suggest actual phone conversations were monitored. the ceo of ap is furious and he let the justice department know it. gary pruitt in a letter to eric holder says these records potentially reveal communications with confidential sources across all of the news gathering activities undertaken by the ap during a to-month period, provide a road map to ap's news gathering operations, and disclose information about ap's activities and operations that the government has no conceivable right to know. now pruitt wants justice to return all of those records and destroy the copies. on monday afternoon we got this response from the u.s. attorney's office, "regulations require us to make every reasonable effort to obtain information through alternative means before even considering a subpoena for the phone records of a member of the media. the american civil liberties

union iediately criticized the move, as did congressman darrell issa, chairman of the house oversight and government reform committee. >> they had an obligation to look for every other way to get it before they, in fact, intruded on the freedom of press. >> reporter: so what is this specifically about and why would the justice department have sought those phone records? ap says government officials have said in public testimony that the u.s. attorneys office is conducting a criminal investigation into who may have leaked information obtained in an ap story from a year ago this month about a foiled terror plot. that story disclosed details of a cia operation in yemen that stopped an al qaeda plot to detonate a bomb on an airplane. brian todd, cnn, washington. >> and our thanks to brian todd for that report. a lot of serious questions raised right there. >> and coming up, massive product placement in the blockbuster movie "the great gatsby." will it have you buying up luxury brands? >> or just dancing? and much more to come on angelina jolie's revelation that she's had both her breasts

she's removed both her breasts after discovering a cancer gene. disturbing and revealing new images from kidnap and rape suspect ariel castro's backyard. barbed wire, chains, and a mirror installed in the backyard. and o.j.'s testimony. why his legal team says his own words will get him out of prison this time. >> welcome back to "early start," everyone. i'm john berman. >> and i'm zoraida sambolin. 29 minutes past the hour. and new for you this morning, actress angelina jolie, one of the most well-known women in the world, makes a very bold medical move, having both breasts removed in order to drastically cut down her cancer risk. she says genetic tests showed she had a cancer gene. but what is that exactly? senior medical correspondent elizabeth cohen joins us live from atlanta. elizabeth, can you tell us more about this test that angelina had this brca gene and what do the results actually mean? >> you know, the results can be very complicated, and i'm sure she had a great genetic

counselor and doctor to walk her through it. this is a test that looks for a variety of breast cancer genes. and different genes mean different things. you may carry a faulty gene and it doesn't matter, you're totally fine. you may carry a faulty gene and have a much higher risk of getting breast cancer. i'm going to read her words from her "new york times" piece about what happened to her. she said, i carry a faulty gene, brca1 which sharply increases my risk of developing breast cancer and ovarian cancer. my doctors estimated that i had a 1 in -- that i had an 87% risk of breast cancer, and a 50% risk of ovarian cancer, although the risk is different in each case in the case of each woman. sorry. so in other words an 87% increased risk of breast cancer. so she made a decision that a lot of women make, which is i'm just taking these things off. i am removing my breasts so that i can get that risk down. and she also wrote about getting that risk down. so let's look at that part of

her editorial, as well. she wrote, i wanted to write this to tell other women that the decision to have a mastectomy was not easy. but it is one i'm very happy that i made. my chances of developing breast cancer have dropped from 80% to under 5%. so you can see, for her, this was a very clear decision. john, zoraida? >> she talked about her children, and how at the end of the day that made this decision a lot easier for her. i'm thinking the same thing. i'm having a double mastectomy. i do have breast cancer. but that was really -- that's really what you do, right? every woman is different. but that's what you think about is i want to be here long-term for my kids. one of the things she talked about, which i thought was fantastic, is that this test is very expensive, it's a $3,000 test, and insurance companies don't always pay for it. so how accessible is this test for other women? >> you know, zoraida, the timing of this, you know, is so interesting. because this is before the supreme court. only one company makes this test, it's called miriad.

they have a patent, no one else is allowed to make it. you don't have to be an economist to know when one company makes something, that price is very high because there's no competition. things may be very different if the supreme courtdy significance comes out a certain way later this spring. if you don't have insurance or if your insurance won't pay the full cost, a lot of women are really in a pickle. i mean, imagine, let's say if your mother and sister and aunt had breast cancer, you really need to know if you have that gene, but you can't afford it, it's a real problem. >> i'm hoping at the end of the day that because of the fact that she has brought all of this attention to it that maybe it will be help for women who cannot afford to have that test. another thing i wanted to talk about, she talks about this high percentage, at least in my opini opinion, 50% ovarian cancer. what are her options there? did she hint at what she will do next there? >> she said that she has started the process. she used the term started. i'm starting with my breasts. so it made it sound like perhaps

she will get her ovaries removed at a later date. getting your ovaries removed can be a little bit trickier, that's because it throws you into menopause. that's not a small thing. and so, my guess is, that she might remove those ovaries later. that's what her mother died of, right? her mother died of ovarian cancer not of breast cancer. so i imagine that's weighing heavily on her mind. a lot of women in this situation, they do both. they don't do it at the same time but they do do both. >> elizabeth, i know that there's a website that's a treasure trove of information for anybody who is going through this. so could you share that with us as well? it's our own cnn site. i've been using it quite a bit. >> right cnn.com/health has all sorts of resources for various diseases, including breast cancer, and it's really important that women be empowered in this situation. and here's why. first of all i'm just going to be honest here. a lot of doctors don't know a lot about breast cancer genetics. you may go to a doctor who will do this test for you but you really want to see a genetic

counselor if you can to get a full discussion of what your genes mean. >> and i will also add to that that at the end of the day, we're really in a good position when we do get diagnosed with breast cancer that we really do participate in the decision. we make the decision as to what we want to do with our health. i mean i think that's really important, as well. >> that is so true. >> elizabeth cohen, thank you. i appreciate all the information this morning. >> talk about empower. let me just say this, you are one incredibly strong, tough -- >> listen this is a process as angelina said. and i was not in the beginning. because all you do is think about your children and think about what is a decision that i can make so that it could be the best outcome for them. and i want to see them grow up, and you know, at the end of the day, that was the toughest decision. >> we know -- >> i've come full circle and i'm ready. >> we're all incredibly proud of you. >> thank you. >> i got to add when i told berman that i had breast cancer i thought i was going to have to pick up the pieces, because, yeah -- >> well you make it easier on all of us. your strength makes it easier

for all of us. so thank you. >> yeah. >> we do have other news at 34 minutes after the hour. a first look this morning into the backyard of cleveland kidnapping suspect ariel castro. these photos were taken by a neighbor last week and they show piles of debris behind the home, including barbed wire, chains and this, a pink barbie bicycle. also there's a mirror installed on the back porch. apparently to detect any visitors from coming down the driveway. right now ariel castro is on suicide watch, jail logs reveal that he likes to walk around his cell naked. he frequently makes himself kool-aid, and get this, he's using strings from a floor mat to floss his teeth. we're told he's being checked by guards at this point about every ten minutes. 35 minutes past the hour. new information about the brother of leila fowler, who is under arrest in the stabbing death of his 8-year-old sister. a fellow student and a school administration source says the 12-year-old boy was suspended for five days earlier this year after bringing a pocket knife to

school. cnn's dan simon is live in valley springs, california, with the latest on this. what can you tell us, dan? >> good morning, zoraida. the fact that the suspect was suspended for bringing a knife to school is a noteworthy development given that he's accused of using a knife to stab his sister. we're also getting a better sense of what the suspect may face in the months ahead. chris piper knows the 12-year-old suspect from gym class. you say he made threats to you and others? >> yeah. >> reporter: can you tell me about the threats? >> he'd say like i'll stab you if you don't -- he'd just say he would stab us, messing around. >> reporter: he called the threats lighthearted but told us of an incident earlier in the academic year when the 12-year-old brought a knife to school. did you see the knife? >> yeah. >> reporter: did he show it to friends and classmates? >> he showed it to kids. >> reporter: was it a swiss army knife? like a little pocket knife? >> yeah. >> reporter: what happened?

>> he was showing it to people and so then he gave it to -- someone told on him and he went to the office. >> reporter: it landed him a five-day suspension. the boy seen here at a candlelight vigil days after the killing had some people suspicious at the outset. >> we kept kind of behind closed doors as saying, you know, we thought it was him. >> reporter: the young boy told investigators an intruder stabbed his 8-year-old sister leila while his parents were at a little league baseball game. pen penny's daughter also knows the suspect from school. she thought it seemed strange the killer would only target leila and spare the brother's life. >> you don't kill a person and then leave a witness, you know? and that's why we kept saying that, you know, they're not going to leave him alive if there was somebody else that did it. he witnessed this guy. so in my heart, i thought it was him from get-go. >> reporter: the boy is currently being held at a juvenile detention center. >> because the child in this particular case is 12 years of age, he cannot be tried as an adult.

if he was 14 years of age or older, of course, and because of the allegations that i'm certain will be raised here, he could have been tried as an adult. >> reporter: attorney brian chafe es ochoa has represented minors in cases involving serious crimes. >> these proceedings are going to take place behind closed doors. this isn't going to be an open trial like it would be if he was an adult. in this case, the public is not going to be allowed into the proceedings. >> well, if the 12-year-old is charged and convicted of murder, he would remain in custody until the age of 25. that's the law here in california. and, zoraida, we should point out that the father told the associated press that he believes his son is innocent, and he'll continue to believe that until he sees some evidence that proves otherwise. zoraida? >> all right, dan simon live in california. thank you. in just a few hours o.j. simpson will be back in a las vegas courtroom.

simpson is appealing for a new trial on a 2008 conviction for robbery, assault, and kidnapping. we got our first look at o.j. simpson yesterday, this after a 4 1/2 years. look at that. noticeably older, gray hair, around well.y, not getting - at all. like i said, it's been four years since we've last seen him. he could testify at this trial as early as tomorrow. cnn's paul vercammen is live in las vegas. good morning, paul. >> reporter: good morning, john. in the courtroom yesterday, o.j. simpson sometimes slightly nodding in approval as his attorneys hammered away at witnesses. heavier and grayer, disgraced football legend o.j. simpson slowly stepped into a las vegas courtroom, after 4 1/2 years in prison, for kidnapping, assault and armed robbery. the new simpson legal team is presenting 19 claims they say showed he was so poorly represented in the 2008 kidnap trial by yale galanter that he should get a new trial.

new lead attorney patricia palm argues simpson was never told about an offered plea deal and should have taken the witness stand. gabe grasso assisted galanter in 2008, and emphatically told the court monday he wanted simpson to testify then. >> o.j. is a very eloquent person. and he can explain himself very well. and so i thought he would be a great witness. >> reporter: simpson's lawyers also tried to show the former heisman trophy winner had been drinking alcohol, which impaired him from seeing his cohorts carry guns into the confrontation. the new simpson team argues that galanter knew about simpson's plans to get back some of his memorabilia. simpson's daughter arnelle took the stand saying she was with her father and galanter at dinner the night before the incident. >> was your dad drinking alcohol that evening? >> yes. >> do you recall overhearing any conversation about your dad's plan to go look at his property

the next day? >> yeah. >> and who did you hear talking about that? >> my dad was talking to you. >> simpson is waiting to testify in this hearing. >> this will be his first time to be able to tell what happened and, you know, instead of hearing it in bits and pieces and, you have to remember the evidence in this case was extremely conflicting from all the witnesses. >> reporter: simpson may take the stand as soon as wednesday. and he could be on the stand for a very long time. they say they expect that simpson's testimony could spread out over two days, john. >> and where is simpson staying while this whole trial or court case happens? >> well, according to his attorneys he took a long bus trip from northern nevada down here to the clark county courthouse. and the reason you don't see him on the street for example is because they have tunnels that lead from that jail to the courthouse. that's why he came in through that side door yesterday. >> paul vercammen. starting to get our first look
